67 Retail tobacconist must obtain smoking products from licensed wholesaler (1) The holder of a retail tobacconist’s licence commits an offence if the holder obtains a smoking product from someone who is not the holder of a wholesale tobacco merchant’s licence. (3) It is a defence to a prosecution for an offence against subsection (1) if the defendant proves that the defendant obtained the smoking product for a purpose other than retail sale. s (3) (see Criminal Code, s 59).
