18A Declared smoking products (1) The Minister may declare that food or a toy, or its package or packaging, is a declared smoking product. (2) The Minister must not make a declaration under subsection (1) unless satisfied that the food or toy, or its package or packaging— (a) resembles a smoking product; or (b) resembles a smoking product package; or (c) may publicise or otherwise promote— product; or name, of a smoking product; or (3) A declaration is a notifiable instrument.
