TNORALA LOCAL MANAGEMENT COMMITTEE REGULATIONS 1993

The Regulations directly affect several groups. Members of the Tnorala Local Management Committee are the primary duty-holders: they must attend meetings, participate in decisions, keep information confidential, and exercise their functions subject to the Act and plan. The Tnorala Aboriginal Corporation is the nominating body for four of the six members; if it fails to nominate, the Committee cannot be fully constituted, though vacancies do not invalidate proceedings (regulation 4(7)). The Corporation also likely bears the practical burden of ensuring its nominees are available and qualified. The Parks and Wildlife Commission nominates two members, provides staff and resources for the Committee’s work, and is the recipient of the Committee’s determinations and recommendations on management, works, concessions, charges, and other operational matters. The Commission must also receive minutes of meetings (regulation 8(5)). The Minister for Parks and Wildlife appoints and terminates members, publishes appointment notices in the Gazette, and may direct the Chairman to call a meeting (regulation 8(2)(a)). The Minister also has the power to appoint acting members on the recommendation of the relevant nominating body when a member becomes unable to perform duties (regulation 4(5)). The Central Land Council is a passive beneficiary: it must be given copies of minutes after each meeting (regulation 8(5)). Relevant Aboriginal persons are the intended beneficiaries of several functions: the Committee must protect their rights to use the Reserve, nominate them for employment selection, encourage Aboriginal business initiatives, and make recommendations on their employment terms and conditions. However, these persons have no direct enforcement mechanism under these Regulations if the Committee fails in those duties. Tour operators, film makers, concessionaires, and other commercial users of the Reserve are indirectly affected because the Committee makes recommendations on concessions, licences, filming, access, and charges. Their interests may be advanced or constrained depending on the Committee’s views. General visitors to the Reserve are affected by recommendations on entry charges, camping grounds, and access restrictions to certain areas. Commission staff, especially those employed in the Reserve, may be affected by the Committee’s recommendations on staff training programs (including Aboriginal content) and on employment terms for relevant Aboriginal persons. The Committee does not directly employ anyone, so its influence is mediated through the Commission.

Duty of confidentiality (regulation 10): A member must not disclose information obtained in the course of duties unless the disclosure is made in the course of those duties. This is an absolute prohibition with no express exceptions for whistleblowing, legal compulsion, or public interest. Breach triggers the Minister’s obligation to terminate the member’s appointment (regulation 6(1)(c)). There is no criminal penalty prescribed within these Regulations, but the duty is enforceable through termination. The breadth of “information obtained in the course of duties” could cover any document, discussion, or fact learned while being a member, which may chill open discussion outside the Committee if members are uncertain about what constitutes disclosure “in the course of those duties.”

Functions of the Committee (regulation 9(2)): The Committee has both advisory and determinative duties. It must assist the Commission in preparing and assessing the plan of management. It must “determine ... matters relating to the day to day management of the Reserve” for the purpose of providing guidance to the Commission. It must “determine, in consultation with the Commission, the location of works and facilities.” It must assist in protecting significant sites, protect the rights of relevant Aboriginal persons, and make recommendations on a wide list of subjects. The Committee has the power to do all things necessary or convenient for performing its functions (regulation 9(3)). These duties are not judicially enforceable by third parties unless the Act or plan provides a mechanism; the Regulations do not create a private right of action.

Rights of members: A member has the right to require the Committee to admit persons to a meeting to advise the member on matters being considered, and to allow those persons to address the meeting on the member’s behalf (regulation 8(6)). The Committee must comply. Members also have the right to give a proxy vote (regulation 8(4)), though limited to one absent member with the same qualification. Members can resign by writing to the Minister (regulation 5). A member whose appointment is terminated for breach of duty has no appeal or review mechanism stated in these Regulations, though general administrative law may apply.

Rights of the Chairman: The Chairman holds office for three years and is eligible for re-election, but can be removed at any time by a resolution of the Committee (regulation 7(5)-(6)). The Chairman calls meetings, presides, and has a casting vote as well as a deliberative vote (regulation 8(3)(c)). The Minister appoints one of the TAC-nominated members to preside at the initial election until a Chairman is elected.

Rights of the Minister and Commission: The Minister may direct a meeting to be called (regulation 8(2)(a)). The Commission is entitled to receive minutes and any recommendations or determinations the Committee makes. The Commission is not bound by the Committee’s determinations or recommendations; they are subject to the Act and plan.

The Regulations do not create criminal offences or civil penalties. The principal enforcement mechanism is the Minister’s power to terminate a member’s appointment. Regulation 6(1) says the Minister shall terminate the appointment as soon as practicable after receiving a resignation, becoming aware of a member’s inability to continue (due to illness or otherwise), or proof of a breach of regulation 10 (confidentiality). “Proof of a breach” is not defined; it presumably requires some evidence, but there is no prescribed process. The Minister has no discretion once the condition is met: the termination is mandatory. There is no provision for suspension, warning, or lesser sanction. Termination does not disqualify the person from future reappointment (regulation 4(4)(a) allows reappointment), so a member could theoretically be terminated, reappointed later, and terminated again. There is no penalty for failure to call the required minimum four meetings per year (regulation 8(1)), though the Chairman could be removed by resolution if members are dissatisfied. There is no penalty for a member failing to attend meetings. The quorum requirement (4 members, including 3 TAC nominees) effectively means that if enough TAC-nominated members boycott meetings, the Committee cannot conduct business, but there is no legal consequence for that.

The confidentiality duty (regulation 10) is the only conduct rule subject to termination, but it is not a criminal provision. If a member discloses information outside duties, the remedy is termination of that member’s appointment, not prosecution. The Regulations also do not provide for any enforcement against the Committee itself, the Commission, or the Minister for failing to perform statutory duties (e.g., failure to appoint a new member promptly under regulation 6(2)). Recourse would lie in general administrative law (e.g., judicial review for failure to exercise a statutory power) but the Regulations are silent on that. The absence of penalties for non-compliance by bodies other than members means the main risk falls on individual appointees.

The Regulations are made under the Territory Parks and Wildlife Conservation Act 1976 (the Act), and regulation 9(1) expressly states that the Committee’s functions and powers are subject to the Act and the plan of management for the Reserve. This means the Act’s provisions on reserve management, the powers of the Commission, and any statutory duties or limitations override anything in the Regulations that might conflict. If the Committee purports to determine a matter beyond its authority under the Act, that determination would be ultra vires. The plan of management, once approved under the Act, binds the Committee just as it binds the Commission and other parties.

Regulation 9(2)(n) directs the Committee to seek reservations of land under Division 1 of Part 6 of the Mineral Titles Act 2010. That Act governs mineral exploration and mining titles in the Northern Territory. A reservation under that Division prevents the grant of mineral titles over the reserved land. This function gives the Committee a direct role in protecting the Reserve from mining activity, but only by making recommendations to the relevant authority under the Mineral Titles Act; the Committee does not itself reserve land.

Regulation 11(1) disapplies section 57 of the Interpretation Act 1978. Section 57 ordinarily requires that certain subordinate legislation be published in full in the Gazette or otherwise made publicly available. Instead, the Regulations require only that copies be available for inspection at the Commission’s offices during office hours (regulation 11(2)). This is a significant limitation on transparency for a body that determines guidance on management and makes recommendations on public access and fees. A member of the public who wishes to obtain a copy of the Regulations must physically attend the Commission’s office; there is no requirement for online publication, though the Commission may choose to do so.

The Regulations do not create any interaction with the Native Title Act 1993 (Cth) or the Aboriginal Land Rights (Northern Territory) Act 1976 (Cth). The definition of “relevant Aboriginal persons” is tailored to the Act and does not use concepts from those Commonwealth statutes. However, the Tnorala Aboriginal Corporation is likely a registered native title body corporate or a land council-style entity; the Regulations do not clarify its legal status. The Regulations also do not interact with the Work Health and Safety (National Uniform Legislation) Act, anti-discrimination laws, or employment laws, even though the Committee makes recommendations on employment terms and conditions.

The Tnorala Local Management Committee Regulations 1993 were notified on 26 February 1993 and commenced on the same day. They have been amended twice.

The first amendment was by the Mineral Titles (Consequential Amendments) Act 2010 (Act No. 37, 2010), assented to on 18 November 2010 and commenced on 7 November 2011. This amendment changed the reference in regulation 9(2)(n) from the earlier “Mining Act” (presumably the Mining Act 1980) to the “Mineral Titles Act 2010”, reflecting a restructure of mineral tenement law in the Northern Territory. The functional effect was to preserve the Committee’s ability to seek land reservations for the Reserve under the successor legislation.

The second amendment was by the Statute Law Revision Act 2018 (Act No. 10, 2018), assented to 23 May 2018 and commenced 20 June 2018. This was a machinery amendment made to regulations 2, 9, and 11, described as formal in nature. The endnotes indicate that the Interpretation Legislation Amendment Act 2018 (Act No. 22, 2018) also made general formal amendments to regulations 1, 9, and 11, but the endnotes do not detail the changes. The 2018 amendment likely updated references to the Commission’s name or corrected numbering. The Regulations have not been amended otherwise in over 25 years, indicating that the structure and mechanisms have been considered adequate by successive governments. There is no evidence of sunsetting provisions; the Regulations have perpetual effect unless repealed.

The amendment history shows that the Regulations are low-amplitude secondary legislation, not a subject of ongoing policy adjustment. The fact that only consequential and formal amendments have been made suggests that the Committee’s role and composition have not been revisited in any substantive way since 1993. This stability may indicate a consensus among stakeholders, but it also means that any deficiencies in the Regulations (such as the absence of dispute resolution mechanisms or enforcement provisions) remain unaddressed.

The source text does not reference any litigation concerning these Regulations. No cases are cited in the endnotes or in the regulations themselves. This is unsurprising for a minor statutory instrument governing a single reserve’s management committee. The Regulations do not create private rights of action; the only enforcement mechanism is ministerial termination of a member. There is no merits review or appeal process provided within the instrument. Any legal challenge would likely arise under the broader Territory Parks and Wildlife Conservation Act or under administrative law principles. For example, a person aggrieved by a decision of the Commission that was influenced by the Committee’s recommendations might challenge the decision under the Act. Alternatively, a Committee member whose appointment was terminated might seek judicial review of the Minister’s decision on procedural fairness grounds. No such cases are reported in the text. The absence of litigation does not confirm legal robustness; it may simply reflect the small number of members and the low profile of the body. The confidentiality duty (regulation 10) could theoretically give rise to a dispute if a member discloses information and disputes the Minister’s finding of breach, but no such case is documented here. Anyone researching the practical operation of these Regulations should search NT Supreme Court and NCAT (or its NT equivalent) databases for any decisions concerning the Tnorala Local Management Committee or the 1993 Regulations specifically.

Several features of these Regulations could trip up members, the Minister, or the Commission.

Confidentiality duty is absolute and narrowly excepted: Regulation 10 forbids disclosure of information obtained in the course of duties unless the disclosure is made in the course of those duties. There is no exception for disclosures required by law, to a lawyer, to a regulator, or in the public interest. A member who reports wrongdoing to the Ombudsman, the police, or the media would risk termination even if the disclosure was justified under whistleblower protection legislation (which might override the regulation, but the member would have to rely on external law). The Minister must terminate upon proof of a breach; there is no discretion.

Proxy voting is limited and qualification-dependent: A member may give a general authority to another member to vote for them, but the authorised member can vote for only one absent member and can only be counted in place of one member “with the same qualification” (regulation 8(4)). That means a TAC-nominated proxy cannot replace a Commission-nominated absent member for quorum purposes, and vice versa. If two TAC-nominated members are absent, only one can be replaced by proxy, leaving the Committee without a quorum (needs three TAC nominees present or represented). This creates fragility: if two TAC members are ill and cannot appoint a proxy, the Committee cannot meet even though five of six members are available.

Chairman must be from TAC nominees and can be removed without cause: The Chairman is elected from among the four TAC-nominated members (regulation 7(3)). The Committee may at any time, by resolution, elect a new Chairman with that qualification; the former Chairman ceases to hold office (regulation 7(6)). There is no need for cause. This gives the majority a powerful tool to remove an inconvenient Chairman, but because a quorum requires three TAC nominees, a faction within the TAC group could potentially remove a Chairman from the same group if they have the numbers.

No provision for public participation or review: The Regulations do not require the Committee to hear from the public, publish its determinations, or give reasons for its decisions. The only transparency obligation is that copies of the Regulations be available at the Commission’s office (regulation 11(2)). Minutes are given to members, the Minister, and the Central Land Council, but not to the public. This limits accountability.

Determination powers may create false expectations: Regulation 9(2)(b) says the Committee determines day-to-day management matters “for the purpose of providing guidance to the Commission.” The Commission is not bound; it is guidance only. But regulation 9(2)(c) says the Committee determines the location of works and facilities “in consultation with the Commission”, which implies a stronger role. If the Commission proceeds with a works location against the Committee’s determination, the Committee has no legal remedy. The tension could cause friction if the Commission treats (c) as equally advisory.

Member continues in office until reappointed or successor appointed: Regulation 4(4)(b) says a member continues in office after the three-year term until reappointed or a successor is appointed. This indefinite holdover provision could result in members serving for many years beyond their term without fresh nomination, potentially weakening accountability.

Disapplication of publication requirement: Regulation 11(1) means the Regulations are not subject to the normal publication rule under section 57 of the Interpretation Act. A person who does not know the Regulations exist may have no easy way to find them, other than by visiting the Commission’s office. This is a transparency risk.

Compliance with these Regulations falls on different actors.

For Committee members:

• Attend meetings: The Chairman must call at least four meetings per calendar year (regulation 8(1)). Members should attend to maintain quorum. If unable to attend, a member may give a written proxy authority to another member, but only to one member and only to a member of the same qualification (regulation 8(4)). The proxy must be in writing and signed by or with the member’s authority. The authorised member must not vote for more than one absent member.
• Observe confidentiality: A member must not disclose information obtained as a member except in the course of duties. This means no sharing of Committee discussions, documents, or decisions with anyone outside the Committee unless it is part of the member’s official role (e.g., when the Committee makes a recommendation to the Commission, the member may discuss it in that context). A member who is uncertain whether a disclosure is “in the course of duties” should seek legal advice. Breach results in mandatory termination.
• Avoid conflicts of interest: Although not explicitly stated, a member who has a personal financial interest in a matter (e.g., a tour operation concession) should consider declaring that interest and not participating in related recommendations. The Regulations do not require this, but failing to do so could risk a breach of confidentiality if the member uses information for private gain, or could expose the Commission’s decision to challenge under the parent Act.
• Admit advisers: If a member wants to bring an adviser to a meeting, they must require the Committee to admit that person under regulation 8(6). The Committee must comply, but the adviser cannot vote. The request should be made in advance.

For the Tnorala Aboriginal Corporation:

• Nominate four qualified members: Nominations must be made to the Minister. Members must not be MPs (regulation 4(2)). The Corporation should ensure its nominees are willing and able to serve for up to three years (or longer via holdover). If a nominee becomes unable to serve, the Corporation should promptly recommend a replacement to the Minister.
• Recommend acting members: If a TAC-nominated member becomes ill or otherwise unable to perform duties, the Corporation may recommend an acting member to the Minister (regulation 4(5)(a)). The acting member has full powers.

For the Parks and Wildlife Commission:

• Nominate two members: As above, ensuring no MPs.
• Cooperate with Committee determinations: The Committee’s determinations under regulation 9(2)(b) and (c) are to be treated as guidance or as jointly determined. The Commission should document its consideration of the Committee’s views. If the Commission disagrees with a determination, it should provide reasons to the Committee to maintain a constructive relationship.
• Provide resources: The Commission likely provides administrative support. It should ensure minutes are taken, copied, and distributed to members, the Minister, and the Central Land Council as required by regulation 8(5).

For the Minister:

• Appoint members promptly: On receiving nominations, the Minister must appoint the member (regulation 4(1)). Appointments must be published in the Gazette (regulation 4(3)). If a member resigns, dies, or is terminated, the Minister must appoint a new member with the same qualification (regulation 6(2)).
• Terminate on proof of breach: If the Minister receives credible evidence of a confidentiality breach, the Minister must terminate that member (regulation 6(1)(c)). No discretion. The Minister should ensure a fair process before making a finding of breach, but the regulation does not require one.
• Hold Chairman election meeting: When the Chairman’s office is vacant, the Minister must convene a meeting to elect a Chairman (regulation 7(1)). The Minister appoints a TAC-nominated member to preside until a Chairman is elected.

General compliance tip: All parties should maintain written records of nominations, appointments, meeting notifications, minutes, and any decisions on confidentiality breaches. This will assist in demonstrating compliance if the Regulations are reviewed or challenged. The Reserve’s plan of management should also be consulted, as it may impose additional requirements on the Committee’s work.
