The plan revolves around a small set of operational and legal concepts that determine obligations and performance measurement. They are defined in the glossary and used throughout the plan: longline fishing; seabird; bycatch; interaction; observed caught; observed hooks set and hauled; dead seabird; independent monitoring; night and night setting; fishing areas, seasons and fishing operator. The meaning of these terms determines measurement, compliance and management responses.

Longline fishing is given a broad operational definition that includes pelagic or drifting longlines, demersal longlines, trotlines and droplines; it covers a wide range of gear configurations (Glossary: Longline fishing). Seabird includes all Class Aves caught by any part of the gear and observed to be dead or alive on interaction (Glossary: Seabird). Interaction is defined to capture the full spectrum of seabird-fishery events the plan cares about, including birds killed but not landed, birds landed dead, birds landed alive injured or released uninjured, and birds released alive and not on board injured or uninjured (Glossary: Interaction). The plan also contains a technical definition of "dead seabird" that includes birds released with a hook in situ and various pathologies that are considered likely to lead to death on release (Glossary: Dead seabird). Those definitional choices matter because they expand the counting of mortality beyond bodies retrieved on board and they affect data collection and reporting obligations.

Two measurement concepts are central to performance evaluation: bycatch rate and observed hooks set and hauled. Bycatch rate is the number of seabirds observed caught per 1000 hooks set. Calculation of bycatch relies on observed caught reported by AFMA scientific observers or approved independent observers and on logbook or audited electronic monitoring records of hooks set and hauled (Glossary: Bycatch rate; Observed caught; Observed hooks set and hauled). The plan explicitly links compliance and management responses to those observed bycatch rates and sets maximum permissible bycatch rates per fishery (Table 4).

Independent monitoring is a legal and practical lever in the plan. The plan requires AFMA to use AFMA scientific observers or other independent observers approved by AFMA and/or electronic monitoring systems approved by AFMA for independent monitoring and audit (Glossary: Independent monitoring; Data collection and analysis). Minimum coverage levels are specified for each fishery (Table 3), and a fall below those levels triggers a management response to promptly increase monitoring.

Adaptive management is embedded in the plan’s mechanics. AFMA must require specified mitigation measures in certain fisheries or areas (for example pelagic tuna fishers south of 25 degrees South), but it is also empowered and required to vary measures following consultation with the Department of the Environment and Energy if performance criteria are not met (Mitigation actions 1 and 3). Table 2 sets staged management responses tied to the occurrence of bycatch incidents, criterion exceedance in a season, repeat exceedance, and inadequate independent monitoring levels. The plan requires that management responses be implemented as soon as practical but no later than three months after identifying a problem (Mitigation actions 3).

The plan explicitly links domestic measures with international advocacy. It identifies international initiatives as a key action and assigns DAWR and the Department of the Environment and Energy to promote adoption of complementary measures in regional fisheries management organisations and conservation forums such as ACAP and CMS (Objective items 3, Mitigation actions 9 and 10). This reflects the biological reality that many threatened seabirds forage beyond Australian jurisdiction and that population recovery depends in part on measures adopted by other states.

Finally, the plan sets out the institutional framework for oversight and evaluation. The Department of the Environment and Energy will evaluate the plan in consultation with key stakeholders and seabird experts and report to the Minister through the Threatened Species Scientific Committee. A stakeholder group is to be established to discuss implementation; it must include government, fishing industry, NGOs and relevant experts (Glossary: Stakeholder group; Organisations and persons involved in evaluating the performance of threat abatement plan).

Each of these concepts has concrete operational consequences. Definitions determine what counts as a bird take. Monitoring coverage and audit requirements determine the informational environment for management decisions. Performance criteria convert conservation goals into numeric triggers. Adaptive management and AFMA’s powers determine who can impose operational constraints on fishers and on what timetable. International advocacy recognises limits to unilateral action. Those are the mechanisms the remainder of this note interrogates in relation to incentives, costs, and enforcement trade-offs.

The plan identifies, by name and by implication, the principal actors who will be affected by its prescriptions.

AFMA is the primary implementing agency. The plan repeatedly assigns AFMA operational responsibilities: requiring mitigation in specific fisheries and areas, setting approved line-weighting strategies and bird-scaring line standards, approving or rejecting electronic monitoring systems and other independent observers, granting scientific permits for trials, implementing management responses when criteria are exceeded, conducting compliance programs, collecting data and reporting to the stakeholder group (Mitigation actions 1-10; Research and development 11-13; Data collection 14-21; Table 2). AFMA therefore decides which measures are required, approves mitigation devices and monitoring systems and enforces the plan in practice.

The Department of the Environment and Energy (DEEE) is charged with scientific advice, species identification and analysis, international advocacy and evaluating the plan’s performance with stakeholders and seabird experts (Actions 6, 10, 12, 17, Organisations and persons involved). The Department will also analyse collected seabird specimens and tissue samples where feasible and costed by the Department (Data collection 17).

The Department of Agriculture and Water Resources (DAWR) is given responsibilities for international advocacy on seabird bycatch mitigation through fisheries forums and for reporting annually to the stakeholder group on progress (Mitigation action 9; Objectives). DAWR also sits in the operational nexus because fishing regulation and fisheries policy are split across agencies.

Fishing operators holding concessional rights under the Fisheries Management Act regime are directly affected. The glossary defines "fishing operator" as a legal or natural person who holds a fishing concession. The plan requires domestic and foreign vessels operating within Australian jurisdiction to adopt proven mitigation measures so that performance criteria are achieved (Mitigation action 2; Table 1). For a defined subset of operators , all pelagic longline tuna fishers operating within the Eastern Tuna and Billfish Fishery or the Western Tuna and Billfish Fishery south of 25 degrees South , the plan prescribes specific measures: an AFMA-approved line-weighting strategy, bird-scaring lines or night setting, no offal discharge during setting and other AFMA-stipulated measures under adaptive management (Mitigation action 1).

The fishing industry more broadly is implicated through training and extension obligations imposed on AFMA, and through the stakeholder group, which must include industry representatives (Mitigation actions 7; Glossary: Stakeholder group). Industry bears implementation costs for mitigation measures, monitoring and record-keeping. The plan recognises industry costs explicitly and states they are an unavoidable consequence of abatement (Duration and cost of threat abatement process).

Foreign vessels operating in the Australian Fishing Zone are captured to the extent AFMA requires the adoption of mitigation measures while operating under Australian jurisdiction (Mitigation action 2). The plan also contemplates advocacy targeted at foreign fleets through international organisations, but the plan’s direct binding force is limited to Australian jurisdictional control.

Researchers, NGOs and seabird experts are affected in their advisory, trial and review roles. The plan encourages innovation, supports trials via permits, and anticipates collaboration with stakeholders and experts on analyses (Research and development 11-13; Data collection 18; Organisations and persons involved).

Other agencies are affected indirectly. Government agencies generally are bound not to take actions that contravene the plan. Where state or territory waters are concerned, the Commonwealth must seek cooperation with those jurisdictions for implementation outside Commonwealth areas (Threat abatement plans). That means state fisheries agencies may be invited to coordinate measures where seabirds range across jurisdictions.

Seabird species themselves are the object of the plan. Annex A lists albatrosses, petrels, shearwaters and other species by conservation status, likely incidence in catch and breeding locations. The plan singles out threatened albatross and petrel species when requiring AFMA to consider conservation status in determining more rigorous management responses (Mitigation action 5).

Who pays and who bears risk. The plan states costs will be borne from core agency budgets for implementation, while acknowledging costs to industry arising from compliance. It also allocates opportunities and responsibilities for funding research and trials through fisheries research programs (Duration and cost; Research and development 11).

Finally, the plan imposes reporting and specimen handling obligations on fishing operators and AFMA. For example, all seabirds killed on longlines deployed by Commonwealth fishing vessels are to be brought aboard if feasible, reported to AFMA, reported to the Bird and Bat Banding Scheme if banded, and where feasible sampled and stored for analysis with departmental costs met by DEEE (Data collection 17). That creates record-keeping, handling and storage obligations that will have operational implications for vessel procedures.

In sum, AFMA and DEEE are the decision-makers and enforcers. Fishing operators , domestic and foreign in Commonwealth waters , are the regulated parties. Research bodies, NGOs and international organisations are engaged as partners. Costs fall on agencies and industry, with monitoring and reporting obligations creating recurring compliance burdens.

The plan specifies duties for AFMA, the Department of the Environment and Energy, the Department of Agriculture and Water Resources and fishing operators. It also creates monitoring and reporting rights for the Commonwealth and stakeholder oversight mechanisms. The plan does not create novel criminal offences; rather it prescribes administrative and management duties to be implemented by AFMA and other agencies pursuant to existing statutory frameworks. The following are the concrete duties and practical rights derived from the plan.

AFMA duties

• Require mitigation in specified fisheries and areas. For pelagic longline tuna fishers operating within the Eastern or Western Tuna and Billfish Fisheries south of 25 degrees South, AFMA must require an AFMA-approved line-weighting strategy, use of at least one AFMA-approved bird-scaring line or night setting, a prohibition on offal discharge during line setting, and the ability to stipulate other mitigation measures under an adaptive management approach (Mitigation action 1).
• Require proven mitigation measures for domestic and foreign vessels in all longline fisheries so performance criteria are met in all areas and seasons (Mitigation action 2; Table 1).
• Implement management responses when problems occur and ensure responses are implemented within three months at the latest (Mitigation action 3; Table 2).
• Implement extension and training programs for longline fishers where appropriate (Mitigation action 7).
• Implement a risk-based compliance strategy to ensure plan requirements relevant to seabird bycatch mitigation are complied with; provide annual summary compliance reports to the stakeholder group (Mitigation action 8).
• Collect data, operate independent monitoring programs (observers and/or electronic monitoring), audit video where used and analyse seabird-fishery interaction data annually (Data collection 14-18; Table 3).
• Provide scientific permits to support trials of mitigation measures and support trials with department advice on experimental design (Research and development 12).

Department of the Environment and Energy duties

• Provide species analysis and advice for trials and for assessing mitigation measures (Research and development 12; Data collection 17).
• Analyse collected seabird specimens or tissue samples and lead the evaluation of plan performance with stakeholders and experts, reporting through the Threatened Species Scientific Committee (Data collection 17; Organisations and persons involved).
• Report annually to the stakeholder group on progress and international advocacy efforts (Mitigation actions 6 and 10).

Department of Agriculture and Water Resources duties

• Communicate implementation results internationally and promote mitigation measures to foreign fleets and forums; report annually to the stakeholder group on progress (Mitigation action 9).

Fishing operator obligations and constraints

• Comply with fishery-specific mitigation measures as required by AFMA, including line weighting, bird-scaring lines or night setting, offal management and other AFMA-stipulated measures (Mitigation action 1; Table 1).
• Maintain accurate logbook records of hooks set and hauled, seabird catches, mitigation measures used, time and place of events and environmental factors that may influence bycatch (Data collection 19).
• When seabirds are killed on longlines deployed by Commonwealth fishing vessels, operators must bring carcasses aboard if feasible, report to AFMA and the Bird and Bat Banding Scheme if banded, and where feasible permit sampling and storage consistent with food safety requirements (Data collection 17).

Independent monitoring and auditing

• AFMA must ensure minimum levels of independent monitoring by observers or electronic monitoring systems, specified per fishery, and that video footage be subject to independent auditing to ensure accurate reporting by operators (Data collection 14-16; Table 3).

Performance measurement and management rights

• AFMA may hold individual vessels responsible for meeting bycatch rate criteria and apply management responses to vessels that breach criteria (Criteria to measure performance).
• If a fishery exceeds a criterion in one season, AFMA will review mitigation measures, environmental factors and compliance, and may implement improvements in consultation with DEEE (Table 2). If the criterion is exceeded in the next corresponding season, AFMA may implement additional measures, consider suspension of affected vessels and may close the area or fishery to longline methods until satisfied measures will enable the criterion to be achieved (Table 2).
• AFMA will take conservation status into account when determining whether more rigorous management responses are required (Mitigation action 5).

Rights and legal status

• The plan binds the Commonwealth and its agencies; government agencies must not take actions that contravene the plan (Threat abatement plans). The plan does not itself create new criminal offences; it operates through AFMA’s management and compliance powers under existing fisheries legislation and through administrative measures described in the plan.

Reporting and stakeholder engagement rights

• AFMA and the departments must report annually to the stakeholder group on progress and compliance measures, giving industry, NGOs and experts regular information about implementation (Mitigation actions 6, 8, 9, 10).

In sum, the plan imposes administrative duties on AFMA and the departments to require, monitor, audit and enforce mitigation measures and requires fishing operators to deploy those measures and maintain data and samples. AFMA is given discretion to intervene, up to suspending vessels or closing fisheries where repeat criteria breaches occur, with DEEE involved in consultative and scientific review.

The plan describes enforcement mechanisms in administrative and operational terms rather than specifying criminal penalties. It instructs AFMA to adopt and implement a risk-based compliance strategy and lists specific management responses that AFMA must take when events or data indicate problems. The plan does not itself list sanctions such as fines or imprisonment. Instead, enforcement is to operate through AFMA’s administrative powers and through management measures enumerated in the plan. The following are the enforcement and sanctioning mechanisms set out in the plan, with the caveat that the plan operates within broader fisheries legislation and regulatory regimes under which AFMA exercises statutory compliance powers.

Administrative and management responses

• Investigation and corrective action. If more than one seabird is observed caught on a single trip by an individual longline vessel, AFMA must investigate whether the cause was inadequate or non-compliant mitigation or lack of effectiveness. In cases of non-compliance, AFMA will take appropriate corrective action, including monitoring of future compliance (Table 2, Problem 1).
• Review and adjustments. If a criterion is exceeded in a fishing area or fishery during one season, AFMA will review measures currently deployed, including compliance, environmental factors and fishing practices, and consult with DEEE on feasibility and desirability of improvements. AFMA will implement identified improvements (Table 2, Problem 2).
• Additional measures, suspension and closure. If the criterion is exceeded in the next corresponding season, AFMA will implement additional mitigation for vessels that exceeded the criterion and must consider suspension from longline fishing until AFMA and DEEE are satisfied with measures on affected vessels. AFMA may close the fishing area or fishery to longline methods until satisfied mitigation measures are available for deployment to enable the criterion to be achieved (Table 2, Problem 3).
• Monitoring coverage enforcement. If independent monitoring drops below specified coverage levels, AFMA will take actions necessary to increase independent monitoring promptly (Table 2, Problem 4).

Compliance strategy and reporting

• AFMA must develop and implement a risk-based compliance strategy to ensure requirements relevant to seabird bycatch mitigation are complied with. It must provide annual summary compliance reports to the stakeholder group describing implementation effectiveness and incidents of non-reporting in domestic and high seas Commonwealth longline fisheries (Mitigation action 8).

Monitoring and audit

• Minimum observer coverage levels are specified per fishery (Table 3). Video footage from electronic monitoring must be independently audited to ensure accurate reporting by operators of hooks set, seabird interactions and mitigation effectiveness (Data collection 15-16).
• AFMA will use independent monitoring to validate operator logbook data and to identify deficiencies in programs. Findings are to be disseminated among domestic fishers and in international forums as appropriate (Data collection 20).

Relationship to statutory enforcement powers

• The plan is made under the EPBC Act which requires the Commonwealth to implement plans to the extent they apply to areas under Commonwealth control and to seek cooperation with states and territories where the plan applies outside Commonwealth areas (Threat abatement plans). The plan itself does not state that it creates offences under the EPBC Act, nor does it set out monetary penalties. Instead, AFMA’s potential to suspend vessels and close areas, and its general compliance strategy, are enforcement tools. Those enforcement actions would be executed using AFMA’s statutory powers under fisheries legislation and management plans cited in the plan (Background and References to AFMA management plans). The plan requires AFMA to consider suspension and area closure as management responses, but leaves the exercise of legal sanction to the relevant fisheries regulatory instruments and AFMA’s powers.

Implementation timing and transparency

• The plan sets a deadline for management responses: actions should be implemented as soon as practical, but no later than three months after identification of the problem (Mitigation action 3). AFMA and the departments must report annually to the stakeholder group on progress and compliance, creating a transparency mechanism that can inform enforcement and political oversight (Mitigation actions 6 and 8).

In sum, enforcement under the plan operates by administrative controls, monitoring, audits, corrective action and, if necessary, suspension or closure of vessels or fisheries. The plan expressly delegates operational enforcement to AFMA and indicates that management responses should escalate with repeat failures and where conservation status suggests more rigorous action. The plan does not itself prescribe criminal penalties; any fines or prosecutions would arise under the fisheries laws and regulations AFMA administers rather than from the text of the threat abatement plan itself.

The plan situates itself within the architecture of Commonwealth environmental and fisheries law and within international instruments. The text repeatedly references the EPBC Act as the statutory basis for threat abatement plans and cites specific EPBC provisions governing content and process. It also connects to fisheries management instruments and international agreements. The interaction mechanisms are administrative, normative and operational.

EPBC Act

• Statutory basis and content requirements. The plan is made under the EPBC Act, specifically under s 270B as stated at the head of the instrument. The plan follows the content requirements the Act imposes on threat abatement plans, including stating objectives, actions, criteria for performance and persons involved in evaluation (the plan cites s 271 and its subsections at multiple points). The plan is therefore an EPBC Act instrument; the Act requires the Commonwealth to implement plans to the extent they apply in areas under Commonwealth control. It also requires that agencies must not take actions that contravene the plan (Threat abatement plans).
• Administrative binding effect on Commonwealth agencies. The plan states that it binds the Commonwealth and its agencies and that agencies must act consistently with it. That creates an internal legal constraint on Commonwealth administrative action under the EPBC Act regime.

Fisheries law and AFMA instruments

• AFMA management powers and fisheries legislation. The plan assumes AFMA will use its fisheries management powers and existing fishery management plans (for example the Eastern Tuna and Billfish Fishery Management Plan 2010 and others cited in the references) to require mitigation measures, monitoring and compliance. The glossary and background reference the Fisheries Management Act 1991 and Fisheries Management Regulations 1992 in relation to regulated matters such as offal discharge (Glossary: Offal; Background). The plan therefore operates within the AFMA regulatory regime and is implemented through the fisheries management instruments AFMA administers.
• Permits, closures and suspensions. The plan contemplates AFMA granting scientific permits to support experimental trials of mitigation devices and contemplates AFMA suspending vessels or closing fisheries to longline methods when criteria are exceeded (Research and development 12; Table 2). Those actions would be exercised using AFMA’s statutory management powers under fisheries legislation rather than under the threat abatement plan alone.

State and territory interaction

• Where the plan applies outside Commonwealth areas, the Commonwealth must seek cooperation of the affected jurisdiction to jointly implement the plan. The plan therefore recognises the Australian federal split and anticipates intergovernmental cooperation where fisheries and seabird foraging overlap state waters (Threat abatement plans).

International law and agreements

• The plan draws on and references international instruments: the Agreement on the Conservation of Albatrosses and Petrels (ACAP) and the Convention on the Conservation of Migratory Species of Wild Animals (CMS) inform best practice guidance and mitigation advice (Background; References). The plan assigns DAWR and DEEE to advocate in regional fisheries management organisations such as the Commission for the Conservation of Antarctic Marine Living Resources, and in ACAP and CMS, for complementary measures in other jurisdictions (Objective item 3; Mitigation actions 9-10). The plan’s international advocacy obligations intend to influence foreign fleets that operate outside Commonwealth waters but impact the same seabird populations.

Policy instruments and other plans

• The plan explicitly links to other domestic policy instruments and strategies: Australia’s National Plan of Action for minimising incidental catch of seabirds in Australian capture fisheries, the Commonwealth Fisheries Bycatch Policy and the Threat Abatement Plan for impacts of marine debris on vertebrate marine life are referenced as complementary frameworks (Background; References). The plan is designed to align and coordinate with these instruments.

Data and banding schemes

• The plan uses the Australian Bird and Bat Banding Scheme for reporting banded birds and links specimen collection, tissue sampling and storage to DEEE analysis, subject to Department of Agriculture and Water Resources food safety requirements (Data collection 17). That requires coordination with other administrative regimes overseeing wildlife banding and biological sampling.

Consequential interactions and limits

• The plan does not amend fisheries legislation. Its force is administrative and policy-driven, applied via AFMA and within the EPBC Act framework. Where more robust legal sanctions are necessary, AFMA would rely on the fisheries statutory framework to impose penalties, suspensions or closures. The plan’s data, monitoring and audit requirements interact with existing logbook and reporting systems that operate under fisheries regulations and management plans referenced in the plan.

In effect, the plan operates as a statutory policy layer that directs AFMA and relevant departments to use existing fisheries powers, monitoring systems and intergovernmental relationships to achieve bycatch reduction objectives, while also embedding international advocacy and science-driven trial and adoption pathways for innovation.

The plan records its own placement in a lineage of threat abatement plans and sets a statutory review timetable. The 2018 plan explicitly replaces the earlier 2006 Threat Abatement Plan as varied in 2014 and reflects changes accumulated since those earlier texts.

Documented predecessors

• The plan replaces the Threat Abatement Plan 2006 for the incidental catch of seabirds during oceanic longline fishing operations, which itself was varied by the Threat Abatement Plan 2014 (Introduction). The document repeatedly references prior plans and background reviews, acknowledging that successive plans have implemented mitigation and monitoring measures that have reduced bycatch in Commonwealth fisheries (Summary; Background).

Review timetable

• The plan is to be reviewed within five years of coming into force (Summary; Duration and cost of threat abatement process). The plan’s text links this review requirement to the EPBC Act s 271(4) content requirements.

Mechanisms for future variation

• The plan does not prescribe a formal amendment procedure in the text beyond the EPBC Act process for making or varying threat abatement plans. Changes in the plan’s detailed measures will be implemented operationally by AFMA through management arrangements and consultations with DEEE as part of the adaptive management process. The plan contemplates AFMA and DEEE reviewing fishing effort trends annually and potentially adjusting maximum permissible bycatch rates if fishing effort changes by more than 20 per cent (Criteria to measure performance). That provides an explicit trigger and process for re-evaluating numeric criteria between formal five year plan reviews.

Evidence base for change

• The plan ties amendment and variation to research, monitoring and trial outcomes. It calls for AFMA and DEEE support of trials and innovation, and states that once a new mitigation measure has been demonstrated to consistently and effectively meet plan criteria it may be included in management arrangements for fisheries (Research and development 12). That sets a science‑based pathway for amending required measures administratively via AFMA, and for larger-scale plan variations via the statutory review process.

Record and citation

• The plan itself is an instrument registered under the EPBC Act and is reported as commencing the day after registration. The front material records the making by the Minister under s 270B and the date of 2 October 2018. It includes a last updated date for the document of 1 February 2018 in the publication metadata, reflecting drafting and public release timing.

Costs and expected change in costs

• The plan states that the cost of implementation will be covered under core agency budgets and that industry will incur costs to meet requirements. It states that overall costs should be similar to those under the previous plan, and are not expected to significantly increase and may decrease in some instances (Duration and cost). That is an anticipatory statement concerning the fiscal impact of amendments insofar as they are implemented.

In summary, the 2018 plan updates prior Commonwealth threat abatement plans for seabird bycatch, establishes a five year review requirement, and provides administrative mechanisms for AFMA and DEEE to incorporate new mitigation measures and adjust criteria between formal plan reviews based on monitoring, trials and changes in fishing effort.

The plan itself contains no record of litigation brought against it and does not cite any judicial decisions. The document is primarily a statutory policy instrument and not a judicial or adversarial text; it references scientific literature and international agreements rather than case law (References).

Practical implications concerning litigation risk and review

• Because the plan is made pursuant to the EPBC Act and binds Commonwealth agencies, it could be the subject of judicial review challenges in the administrative law context if an affected party were to allege that an agency acted unlawfully in implementing or failing to implement plan requirements. The text does not record any existing litigation or legal challenges to plan measures. The plan’s mechanisms for enforcement and its reliance on AFMA’s fisheries powers mean that legal disputes about specific measures would likely engage fisheries administrative law and the statutory procedures that govern AFMA decisions. The plan, however, does not itself enumerate fines, offences or criminal sanctions.

Absence of litigation references

• The only legal authorities cited in the document are statutory and treaty references, and the plan’s own predecessor instruments. No case law is cited in the plan. The references list scientific and policy documents but not judicial decisions.

For practitioners advising clients the absence of litigation history in the document means there is no in-plan precedent about interpretive disputes or implementation litigation. Issues that might give rise to legal challenge include: AFMA’s exercise of discretion to suspend a vessel or close a fishery, what counts as compliance with AFMA-approved mitigation standards, adequacy and legality of independent monitoring, and the procedural fairness of AFMA’s investigations under Table 2. Those are speculative legal issues not discussed in the plan itself. The plan’s text contains no adjudicated legal disputes to cite.

The plan contains several technical design choices and operational features that create implementation complexity, compliance costs, and interpretive risk. These are the concrete "gotchas" that practitioners and operators should note and plan around.

Counting rules that inflate apparent mortality

• The plan’s definitions broaden what counts as a seabird mortalitiy. The "dead seabird" definition includes birds landed with a hook in situ and birds with described pathologies likely to cause death on release (Glossary: Dead seabird). "Interaction" encompasses birds killed but not landed, and birds released injured or uninjured whether landed or not (Glossary: Interaction). As a result of these definitional choices, reported bycatch numbers may include birds not physically retrieved on board, and released birds with a hook will be counted as dead. That affects reported bycatch rates and can trigger management responses.

Observed data and audit dependency

• Bycatch rates rely on observed caught and observed hooks set and hauled, either by AFMA observers or by operator logbooks validated by audited electronic monitoring systems (Glossary: Observed caught; Observed hooks set and hauled). If independent monitoring coverage is insufficient, the plan requires AFMA to take action. However, where coverage is partial, statistical uncertainty and observer bias can complicate assessment of whether the performance criteria have been breached. AFMA must "take into account possible biases in independent monitoring" in annual analyses (Data collection 18). Practically, this creates uncertainty for operators about how partial monitoring may be extrapolated and used to trigger management actions.

Minimum independent monitoring levels and cost exposure

• Table 3 sets minimum observer coverage levels that may be substantial in some fisheries. For example the Antarctic Fishery requires 20% of hooks set and 40% of hooks hauled to be observed. Meeting those levels may require either AFMA observers or approved electronic monitoring with auditing. For operators this translates into direct costs for observer carriage or investment in audited electronic monitoring systems. The plan’s requirement that AFMA promptly raise monitoring if coverage drops below specified levels implies operators bear exposure to increased monitoring requirements if AFMA deems coverage insufficient.

Performance criteria tied to fishing effort

• Maximum permissible bycatch rates are set on the basis of fishing effort at the time the plan was approved. The plan requires annual review of fishing effort trends and contemplates revising bycatch rates if fishing effort changes by more than 20% (Criteria to measure performance). For operators, this creates a contingent compliance risk: a significant increase in effort could lead to a recalibration of criteria which may be more stringent or could trigger different management constraints.

Spatially and temporally specific obligations

• Some obligations are triggered by latitude (the 25 degrees South parallel) and by fishing areas and seasons defined in the glossary (Night setting; Fishing areas; Fishing seasons). Operators must be aware of where and when measures apply. For instance night setting is an alternative mitigation option in some fisheries, but the plan includes nuanced treatment of night setting dependent on species vulnerability and fishery characteristics. Misinterpreting the geographic or seasonal boundaries could lead to non‑compliance findings.

Adaptive management and discretionary measures

• AFMA has discretion to stipulate other mitigation measures as part of adaptive management and to vary requirements after consultation with DEEE (Mitigation action 1 and 3). That is practical for addressing novel risks but creates regulatory uncertainty for operators because AFMA could require additional measures following review without a formal statutory amendment to the threat abatement plan.

Specimen handling and food safety interface

• The plan requires that seabird carcasses, where feasible, be brought aboard and sampled and stored in a manner that limits decay while meeting Department of Agriculture and Water Resources food safety requirements (Data collection 17). Vessels and operators must therefore reconcile specimen handling with onboard food safety obligations; practical logistics and storage space may be a constraint.

Trial and approval pipeline for new devices

• The plan supports trials and innovation, with AFMA authorised to grant scientific permits and DEEE advising on experimental design (Research and development 12). However, the plan insists measures be tested over sufficient effort, across seasons and between boats to give confidence. That sets a relatively high evidentiary bar before measures are included in management arrangements. Innovators and operators should expect a potentially lengthy trial and approval process before a new device becomes a mandated or approved alternative to existing measures.

Reporting and data completeness liability

• The plan requires detailed logbook and reporting items (Data collection 19). Operators who fail to report accurately or who are found to have non-reporting incidents will be the subject of AFMA compliance reports and corrective action. The plan contemplates publishing aggregated analyses to the stakeholder group and in international fora, which can have reputational and market consequences.

Costs and who pays

• The plan states core agencies will fund plan implementation, and the Department will meet certain specimen analysis costs, but it also states that industry will bear costs of meeting the plan’s requirements and that these are unavoidable. Operators should therefore expect a mixture of public and private costs, with monitoring, mitigation devices and training falling to industry.

Jurisdictional limits

• The plan applies in Commonwealth waters. Where seabirds forage outside Commonwealth jurisdiction, full conservation outcomes rely on other states adopting complementary measures. AFMA and DEEE are charged with international advocacy, but domestic compliance cannot control foreign-flagged fishing outside Australian waters. That means recovery of migratory populations may be constrained by actions in other jurisdictions (Background; Objective).

These gotchas create operational, compliance and strategic considerations for operators, regulators and advisers. They highlight where attention to definitions, monitoring arrangements, sampling logistics and AFMA’s discretionary powers is most crucial.

Compliance under the plan is a multi-element exercise combining equipment and operational measures, data and reporting, permitting for trials, and participation in monitoring and stakeholder processes. The following is a practical checklist mapped to the plan’s concrete requirements and thresholds.

1. Determine applicability

• Identify whether your vessel operates in a fishery listed in the plan. The plan applies to all longline fisheries under Commonwealth jurisdiction, with specific measures for particular fisheries identified in Table 1 and special provisions for pelagic longline tuna fishers operating in the Eastern and Western Tuna and Billfish Fisheries south of 25 degrees South (Mitigation action 1; Table 1).

2. Adopt required mitigation measures where specified

• If you are a pelagic longline tuna fisher south of 25 degrees South, you must, as required by AFMA: a. Employ a line-weighting strategy approved by AFMA to ensure bait sinks rapidly below the reach of seabirds. b. Employ either at least one AFMA‑approved bird‑scaring line constructed to AFMA standards or use another AFMA‑approved mitigation measure that replaces the tori line, or alternatively set longlines only at night where permitted. c. Not discharge offal during line setting. d. Be prepared to implement other AFMA‑stipulated measures as part of adaptive management (Mitigation action 1).
• If operating in other longline fisheries, consult AFMA’s management arrangements and Table 1 for fishery-specific requirements such as line-weighting, bird-scaring lines, offal management, night setting and hook-shields.

3. Meet monitoring and observer requirements

• Ensure coverage levels are met either by carrying AFMA scientific observers or by operating an AFMA‑approved electronic monitoring system with independent auditing. Minimum observer coverage levels per fishery are set out in Table 3. For example, the Eastern Tuna and Billfish Fishery requires 5% of all hooks set and hauled to be independently monitored in each fishing area (Data collection 15; Table 3).
• If using electronic monitoring, ensure the system and auditing meet AFMA’s approval and that video footage is retained and made available for independent auditing (Data collection 16).

4. Maintain precise logbook and reporting records

• Log and report accurately the items specified in Data collection 19: number of seabirds caught, species, life status, bait type, gear and mitigation measures and stage of operation when catch occurred, time of day/night, date and location, and external factors such as weather and moon phase.
• Report seabird mortalities to AFMA as required and to the Bird and Bat Banding Scheme if birds are banded (Data collection 17).

5. Carriage, sampling and storage of seabird specimens

• If feasible, bring aboard dead seabirds and store specimens or tissue samples in a manner that limits decay and complies with Department of Agriculture and Water Resources food safety requirements. Cooperate with AFMA and DEEE for transfer of specimens or tissue samples to designated facilities where requested (Data collection 17).

6. Familiarise yourself with performance criteria and risk of management responses

• Know the bycatch rate criteria in Table 4 for your fishery. Bycatch rates are monitored per fishing area and season. AFMA may hold individual vessels responsible for breaches and apply management responses ranging from vessel-level measures to suspension and area closures if repeat breaches occur (Criteria to measure performance; Table 2).
• Take account that "dead seabird" is broadly defined and that released birds with hooks in situ will be counted as mortalities for the purposes of criteria.

7. Prepare for AFMA investigations and compliance

• If an incident occurs where more than one seabird is observed caught on a single trip, AFMA will investigate and may impose corrective actions and monitoring. Keep maintenance, training and compliance records to demonstrate mitigation use, training of crew on tori line deployment, line weighting procedures and offal management (Table 2, Problem 1).

8. Participate in trials and innovation under permits

• If trialling new mitigation devices, apply for an AFMA scientific permit. Ensure trials are designed to be scientifically robust with sufficient effort, across seasons and boats as required by the plan, and coordinate with DEEE for experimental design advice (Research and development 12).

9. Engage with the stakeholder group and annual reporting

• AFMA, DEEE and DAWR will report annually to the stakeholder group. Participate in that stakeholder forum to stay informed about performance analyses, compliance summaries and emerging mitigation requirements (Mitigation actions 6, 8-10).

10. Budget for compliance costs and plan for contingencies

• Anticipate costs associated with mitigation devices (tori lines, line weighting materials, hook-shields), possibly retrofitting vessels for electronic monitoring, and increased observer coverage if AFMA raises monitoring levels. The plan recognises industry costs as unavoidable and anticipates these costs being similar to the previous plan (Duration and cost).

11. Remain aware of geographic and seasonal triggers

• Note the 25 degrees South parallel constraint and fishing areas divided into five degree latitudinal bands for some fisheries. Ensure your operational calendar aligns with the plan’s seasonal definitions (summer 1 September-30 April; winter 1 May-31 August) and local nautical definitions of nautical dusk and dawn used to determine "night" and "night setting" (Glossary: Night; Fishing seasons).

12. Monitor fishing effort and potential criteria revision triggers

• Annual reviews will consider changes in fishing effort. If fishing effort changes by more than 20 per cent, AFMA and DEEE may review and revise bycatch rates (Criteria to measure performance). Keep records on effort and be prepared for potential re-calibration of bycatch thresholds.

13. Coordinate with other jurisdictions where relevant

• If your operations cross state or territory boundaries or occur in areas where the plan extends beyond Commonwealth waters, expect AFMA to seek cooperation with other jurisdictions. Engage with state fisheries authorities where necessary to ensure consistent mitigation across jurisdictions (Threat abatement plans).

14. Seek legal or compliance advice on AFMA decisions

• AFMA retains discretion to require additional measures and to impose suspensions or closures. Operators should obtain legal advice where AFMA actions are proposed or implemented to understand rights of review, procedural fairness and statutory appeal pathways under fisheries legislation.

Following these steps aligns operational practice with the plan’s regulatory and administrative requirements. Operators should document mitigation deployment, monitoring interactions and training exercises because AFMA uses these records in investigating incidents, calculating bycatch rates and determining management responses.
