#### 35 Vacation of office 35 Vacation of office > > (1) The office of a member of RICG becomes vacant if the member— > > > > > (a) dies, or > > > > > (b) resigns the office by instrument in writing addressed to Racing NSW and RICG, or > > > > > (c) is absent from 2 consecutive meetings of RICG of which reasonable notice has been given to the member personally or in the ordinary course of post, except on leave granted by RICG or unless, before the expiration of 4 weeks after the last of those meetings, the member is excused by RICG for having been absent from those meetings, or > > > > > (d) becomes a person who is not eligible to be a member, or > > > > > (e) is a member on the nomination of a body and that nomination is withdrawn by the body or the body ceases to exist, or > > > > > (f) is removed from office under subsection (2). > > > (2) The Minister may, on the recommendation of RICG, remove a member of RICG from office for incapacity, incompetence or misbehaviour. > > **s 35:** Am 1997 No 24, Sch 1 \[5\]; 1999 No 66, Sch 1 \[20\]; 2004 No 23, Sch 1 \[12\].
