What it does
The Therapeutic Goods (Medicines Watch List) Determination 2018 is a legislative instrument made under subsection 30EJ(1) of the Therapeutic Goods Act 1989. It performs a single mechanical function: it designates a specific set of medicines as being on the “Medicines Watch List” for the purposes of subsections 30EF(2) and 30EG(2) of the Act. Those subsections, which are not reproduced in the instrument, create reporting obligations that are triggered when a medicine appears on this list. The instrument does not itself impose any duty, penalty or reporting form; rather, it is the switch that activates pre existing statutory duties. By determining which medicines are “reportable medicines” within the meaning of the Act, the instrument expands the class of products for which certain adverse event reports, supply notifications, or other information must be lodged with the Therapeutic Goods Administration.
The list in Schedule 1 is exhaustive and highly specific. It groups medicines into eight categories: antimicrobial agents (item 1, with specified routes for several of them), antidotes and treatments for poisonings (item 2), emergency or critical care medicines (item 3), anticoagulants (item 4), vaccines (item 5, tied to the National Immunisation Program Schedule as at 1 March 2025), obstetric medicines (item 6), antivenoms (item 7), and a miscellaneous emergency category including adrenaline autoinjectors, glyceryl trinitrate sublingual, naloxone (injection and nasal spray), and salbutamol inhaler (item 8). The instrument thus identifies what the regulator considers high risk, high consequence, or frequently misused medicines requiring heightened surveillance. Although the instrument is titled “Medicines Watch List Determination 2018”, its effect is not static: it can be amended by the Minister or delegate by further determination under s 30EJ. The reference to the National Immunisation Program Schedule as at 1 March 2025 is anomalous for a 2018 instrument and may indicate a later variation or a drafting error; the instrument as provided does not show any amendment history.
