What it does
This instrument specifies the kinds of therapeutic goods information that the Secretary of the Department of Health (effectively the Therapeutic Goods Administration) may release to the public under subsection 61(5C) of the Therapeutic Goods Act 1989 (the Act). It is made under subsection 61(5D) of the Act, which empowers the making of a legislative instrument that sets out the categories of information that can be published. Mechanically, the instrument does not oblige the TGA to release any information; it merely removes a statutory bar on release that would otherwise apply under the Act’s confidentiality provisions. The instrument therefore expands the TGA’s discretion to publish data from the Database of Adverse Event Notifications (DAEN) for both medical devices and medicines.
The instrument splits the releaseable information into two parts in Schedule 1. Part 1 covers DAEN - Medical Devices, which holds reports about adverse events and defects relating to medical devices and other therapeutic goods (goods that are not medicines, biologicals or medical devices). For each report, the instrument specifies ten categories of information that may be released, including details of the device, manufacturer, sponsor, description of the adverse event, event outcome, event type, report source category, date received and a unique TGA report number. Part 2 covers DAEN - Medicines, which holds reports about adverse events relating to medicines and biologicals. For individual case reports, seven categories are specified: details of the medicine or biological, details of any other therapeutic good administered, the age and sex of the person who suffered the event, the adverse event description term (coded using MedDRA), the date recorded and a unique report number. An additional item in Part 2 allows release of collated, de-identified statistics: the number of relevant cases, the number with death as a reported outcome, the number where only the medicine or biological was suspected, and the system organ class and adverse event description term for each event.
