What it does
This Specification, made under subsection 61(5D) of the Therapeutic Goods Act 1989, identifies the precise kinds of therapeutic goods information that may be released to the public under subsection 61(5C) of the Act. The instrument was made by a delegate of the Minister for Health, Larry Kelly, signed 4 May 2016, and commences 1 July 2016 (see the instrument heading, the signature block, s 1 and s 2). Section 4 of the Specification states that the kinds of therapeutic goods information set out in Schedule 1 are specified under subsection 61(5D) for the purposes of subsection 61(5C) of the Act. Schedule 1 then lists two distinct groups of specified information.
The first group is information relating to sponsors who were exempt from liability to pay annual registration, listing or inclusion charges under the Annual Charges Exemption Scheme for a particular financial year. For these sponsors the Specification identifies: sponsor name (item (a)); ARTG number (item (b)); the name of the therapeutic goods as recorded on the ARTG entry (item (c)); and a statement that the sponsor was, for that financial year, exempt under the Annual Charges Exemption Scheme from liability to pay the relevant annual charge (item (d)).
The second group is information relating to sponsors who declared low-value turnover under regulation 43AAC or 43AAD, did not pay the annual charge, but were later the subject of a Secretary's notice under subregulation 43AAG(2) or (4) stating that the sponsor was not exempt for that financial year. For those sponsors the Specification similarly identifies: sponsor name (item (a)); ARTG number (item (b)); the name of the therapeutic goods as on the ARTG entry (item (c)); and a statement that, despite the sponsor's declaration, the Secretary has given a notice under subregulation 43AAG(2) or (4) that the sponsor was not exempt from liability to pay the annual charge (item (d)). The Schedule carries an explicit note that these specified kinds of information may be released by the Secretary to the public under s 61(5C) of the Act.
