What it does
This instrument, the Therapeutic Goods (Clinical Trial Inspections) Specification (No. 2) 2020, prescribes the kinds of therapeutic goods information that the Secretary may release under subsection 61(5AA) of the Therapeutic Goods Act 1989 (the Act) and identifies who may receive that information and for what purpose. The instrument is made under subsection 61(5AB) of the Act (see s 3). It does not itself create inspection powers; instead it specifies permitted information releases that flow from authorised officers’ exercise of inspection powers under the Regulations or the Therapeutic Goods (Medical Devices) Regulations 2002 (MD Regulations). The operative provision is s 5, which refers to Schedule 1 as containing the table that sets out the information kinds, recipients and purpose.
Schedule 1 contains a single item. Item 1 permits release, in relation to a clinical trial of therapeutic goods (the relevant trial), of information about the conduct of the relevant trial that has been obtained by a “relevant authorised officer”, including information that relates to compliance of the trial with the National Statement on Ethical Conduct in Human Research (National Statement), the procedural protocol (trial protocol), and the Integrated Addendum to ICH E6(R1) (Practice Guideline). The instrument identifies two classes of recipients: the approving authority (defined in s 4) at the trial site and the responsible ethics committee (also defined in s 4). The stated purpose in the table (Schedule 1, column 4) is “to ensure that clinical trials are conducted in a safe and lawful manner, including in accordance with applicable ethics and good clinical practice considerations” (see s 5 and Schedule 1 item 1).
Mechanically, the instrument is permissive: the Secretary “may release” specified kinds of therapeutic goods information to the listed recipients for the listed purpose (s 5 and Schedule 1). The release is limited to information obtained by a “relevant authorised officer” (s 4 definitions; Schedule 1 item 1), which the instrument defines by reference to the exercise of powers under regulation 12AC of the Regulations or regulation 7.4 of the MD Regulations (s 4). The instrument therefore links the release power to the operational activity of authorised officers performing inspections or exercising investigatory powers under those regulations.
