The Parks and Reserves Act 1895

Primary institutional concept: a Board. The Act repeatedly defines the Board as the unit to which Crown reserved land is assigned for control and management (s 3(1); s 4). A Board can be constituted merely as an appointed group or, by proclamation, as a body corporate with corporate capacities (s 3(4)-(6)). Where corporate, the Board can hold real and personal property, borrow with Governor approval, and continue legal personality (s 3(4)).

Authority and enforcement: the Act creates authorised persons (s 2). Those are police officers, Board members, and rangers appointed under s 7. Authorised persons have specified powers when they find or reasonably suspect offences against a Board’s by‑laws (s 7A(1)). Non‑police authorised persons must produce a certificate of authority on request (s 7B(2)), and rangers/Board members are declared public officers for the purposes of the Criminal Investigation (Identifying People) Act 2002 (s 7A(1a)). These provisions align administrative enforcement powers with existing criminal‑investigation identification powers.

Rule‑making and procedural checks: Boards may make by‑laws, but only with the Governor’s approval (s 8(1)). By‑laws are subject to publication and parliamentary oversight: they must be published in the Government Gazette and laid before both Houses within 14 days, and they are effective when published unless repealed or disallowed by both Houses (s 9). The by‑laws catalogue is comprehensive: management, fees, opening hours, fencing, traffic on roads, animal admission, games, prohibitions and fee collection mechanisms (s 8(1)(a)-(u)).

Revenue and fines: by‑laws may prescribe fees for admission and other services (s 8(1)(t)-(u)), grant licences for depasturing and resource removal (s 5(1)(e)-(f)), and impose pecuniary penalties , fines not exceeding $1,000 and set penalties up to $200 for certain acts related to infringement notices (s 8(2)). All pecuniary penalties go to the use of the Board (s 8(3)). Thus Boards have both regulatory and revenue roles.

Evidentiary presumption and enforcement mechanisms: the Act contains procedural devices to facilitate enforcement. If a vehicle is used in breach of a by‑law and the driver is unknown, the owner can receive an infringement notice by attaching it to the vehicle or within 30 days (s 14(3)). By‑laws may deem the owner to have been the driver (s 8(1)(o)). Speed measurements by authorised persons using equipment defined in the Road Traffic (Administration) Act are admissible and taken as proof of speed unless contrary evidence is provided (s 7C). For animals, habitual possession can create a presumption of ownership in proceedings brought by a Board (s 12B(1)-(2)).

Liability and protections: the Act limits personal liability for persons acting in good faith under the Act, other than Boards (s 13). Boards remain potentially liable and the Crown is not relieved of its liabilities (s 13(4)). The Act also creates parental liability in particular factual scenarios: a Board may recover loss from a parent or guardian for damage caused by a child unless the parent proves due care was taken (s 12A).

Institutional change and continuity: where corporate Boards are dissolved, the Act requires pre‑arranged staff employment arrangements or coverage under the Public Sector Management Act (s 15), gives the Governor (with Treasurer’s approval) regulation‑making power to deal with property, rights, liabilities and continuity (s 16), and exempts State tax on acts connected to dissolution (s 17).

Conceptually, the Act is both managerial and regulatory: it allocates administrative autonomy to local Boards over reserved land while retaining executive checks (Governor approval for by‑laws and corporate constitution), and embeds enforcement tools and evidentiary aids to make regulatory compliance tractable.

The Act affects a constellation of actors with differing incentives and legal positions.

Boards and their staff: persons appointed to Boards and rangers (s 2; s 7) are principal operational actors. Boards exercise management and regulatory functions (s 4-5, s 8). If constituted corporately, a Board gains property and borrowing capacities (s 3(4)), and its staff are subject to staff‑transfer protections and consultation rules prior to dissolution (s 15). Boards listed under Schedule 1 to the Financial Management Act will be subject to those financial and audit rules (s 12).

Visitors and users of reserved land: members of the public who use parks and reserves will be directly regulated by by‑laws that can set opening hours, admission fees, vehicle rules, animal admissions, sporting bounds and prohibitions (s 8(1)(e), (f), (h)-(k), (t)). Those by‑laws can impose pecuniary penalties (s 8(2)), and can create procedures for infringement enforcement (s 14). Vehicle owners face specific obligations: an “owner of a vehicle” is defined (s 2) and may be addressed by infringement notice where the driver is unknown (s 14(3)); by‑laws may deem owners to have been the driver in certain circumstances (s 8(1)(o)).

Vehicle owners, commercial operators and licence applicants: Boards may grant licences for depasturing animals and for removal of materials such as sand or gravel, and set fees for such licences (s 5(1)(e)-(f), s 8(1)(t)-(u)). Boards cannot grant such licences without Ministerial approval unless the land’s purpose when placed under the Board specifically contemplates the licence (s 5(1a)). Private commercial undertakings seeking access to reserve resources will therefore interact with both the Board and potentially the Minister.

Police and authorised persons: members of the Police Force are authorised persons under the Act and retain their usual powers; the Act’s provisions are in addition to other Acts relating to police (s 7A(4)). Non‑police authorised persons (Board members and rangers) gain limited enforcement powers but are subject to identity and procedural requirements (s 7A(1); s 7B(1)-(3); s 7A(1a)).

Parents and guardians: the Act gives Boards a cause of action against parents or guardians for loss resulting from intentional or negligent acts or omissions by a child, unless the parent shows they did not neglect due care and control (s 12A(1)). This shifts some risk of repair or replacement costs to parents in appropriate cases.

The Crown and Government actors: the Governor retains appointment and approval powers for Boards, by‑laws and corporate constitutions (s 3, s 8). The Treasurer has functions under the Act: regulations about dissolution require Treasurer approval (s 16(1)), and the Treasurer may certify that certain acts occurred because of a dissolution for the purpose of State tax exemption (s 17(3)). The Minister’s approval is required for licences under s 5(1a).

Courts and litigants: Boards can be plaintiffs or defendants and proceedings are to be taken in the name of the president (s 3(3)). The Act supplies evidentiary presumptions that affect civil and penal proceedings (s 7C, s 12B). Infringement notices under s 14 are an alternative to court process, and a person who pays a prescribed penalty pursuant to an infringement notice cannot later be prosecuted for the same alleged offence (s 14(4)). Where matters proceed to court, statutory presumptions and admissibility rules will shape litigation strategy.

Third parties affected indirectly: suppliers to Boards, contractors engaged for improvement works (s 5(1)(a)-(c)), and insurers (continuity of insurance policies addressed in s 16(2)(e)) are affected by the Board’s property and contracting capacity and the dissolution framework.

In distributional terms, the Act creates concentrated decision‑making authority in Boards (and Ministers/Governor where approval is required), a revenue stream to Boards via fees and fines (s 8(3)), direct compliance obligations on land users (by‑laws and penalties), and contingent liabilities on parents where children damage Board property (s 12A). The Governor and Minister are gatekeepers for corporate formation, by‑law approval and certain licences. The Treasurer has a role where dissolution involves tax or regulation‑making. These positions allocate decision rights and fiscal effects among public actors and private users.

Boards’ duties: the statutory duty of a Board is to control and manage all land placed under its control and to employ funds provided by Parliament and revenue from operations for those purposes (s 4). Boards have broad but enumerated specific powers to alter the land (fencing, clearing, drainage, walks), create water features, improve or ornament the land, maintain zoological gardens, and grant licences for depasturing and removal of materials (s 5(1)(a)-(f)). Those licences are limited by the Ministerial approval requirement in s 5(1a), unless the land’s placement expressly contemplated that use.

Rule‑making rights: Boards may make by‑laws with Governor approval for a wide set of subjects , meeting procedure, account keeping, conservation, appointment of staff, opening times, conduct of persons, regulation of sports, traffic and vehicle use on park roads, admission of animals and vehicles, prohibiting activities, fee setting and fee collection (s 8(1)(a)-(u)). That power to set binding rules is therefore substantial but operates within the executive check of Governor approval and parliamentary scrutiny (s 9).

Enforcement rights of authorised persons: authorised persons can remove vehicles, animals or other things, stop, detain and search vehicles, vessels and conveyances, and enter non‑permanent dwellings when finding or reasonably suspecting a by‑law offence, but must first take reasonable steps to communicate intention and grounds (s 7A(1)(a)-(c)). They can examine vehicles and require information about licences and owners (s 7A(2)), and demand information that may identify the driver or person in charge (s 7A(3)). Non‑police authorised persons are to produce a certificate of authority when asked (s 7B(2)), and their certificates are conclusive evidence of their appointment (s 7B(3)). Rangers and Board members are public officers for identification powers under the Criminal Investigation (Identifying People) Act (s 7A(1a)).

Revenue rights and fee collection: Boards may charge admission fees and other fees and prescribe collection methods; they may impose duties on persons to collect fees on behalf of the Board (s 8(1)(t)-(u)). By‑laws can impose pecuniary penalties up to $1,000 for breaches and prescribe sums up to $200 for removing certain notices as described in s 14(2)(d) (s 8(2)). The Act stipulates that all pecuniary penalties collected go to the Board (s 8(3)).

Rights and duties of vehicle owners: vehicle owners may be compelled under s 7A(2)-(3) to provide information relating to licences and identify drivers. Where the driver is unknown in vehicle‑related offences, an infringement notice may be served on the owner by attachment or within 30 days (s 14(3)), and by‑laws may deem owners to have been the driver unless they satisfy the Board otherwise (s 8(1)(o)). Removal of notices attached pursuant to s 14 is prohibited except by the owner, driver or person in charge under s 8(1)(p).

Parental liability duty: parents or guardians may be liable to make good loss caused by intentional or negligent acts of a child on Board land or to Board property, unless they show they did not neglect to exercise due care and control (s 12A(1)). The Act provides definitions for “child” and “parent” for that purpose (s 12A(2)).

Procedural rights: persons issued with an infringement notice have the statutory option either to pay the prescribed penalty within a specified time (not less than 10 days) and avoid court proceedings, or to elect to have the matter determined in court (s 14(2)(d)-(e)). If they pay the prescribed penalty, the matter cannot subsequently be prosecuted (s 14(4)).

Corporate and staff rights and protections: if a Board is dissolved, staff members have protections: a Board cannot be dissolved unless the Minister (after consultation with the Public Sector Commissioner) has arranged for public sector employment of staff who agree, or staff are covered by Part 6 of the Public Sector Management Act (s 15(2)). Rights such as remuneration, accrued entitlements and continuity of service are preserved except where staff agree otherwise (s 15(3)).

Liability protections: individuals other than Boards who act in good faith in performance or purported performance of functions under the Act have protection from tort actions (s 13(2)-(3)), but this does not relieve the Board or Crown of liability (s 13(4)).

Evidentiary rights: authorised persons may rely on speed measuring equipment evidence in by‑law prosecutions where such equipment is defined by the Road Traffic (Administration) Act; the equipment’s readings are proof of speed in the absence of contrary evidence (s 7C(2)-(3)). Habitual possession of animals gives rise to a rebuttable presumption of ownership in proceedings by the Board (s 12B(1)-(2)).

Collectively, these duties and rights create a legal regime that grants Boards broad operational and rule‑making authority over reserved land while creating procedural safeguards for affected people (infringement notices, requirements to produce certificates, and evidentiary standards). The Act balances enforcement discretion with formal procedures (s 7A; s 14; s 7B).

Monetary penalties and fixed penalties: by‑laws made by Boards may impose pecuniary penalties not exceeding a fine of $1,000 for breach of any by‑law (s 8(2)). For persons who remove certain notices left on vehicles under the infringement scheme, Boards may prescribe sums not exceeding $200 as penalties (s 8(2)). All pecuniary penalties recovered under by‑laws go to the Board (s 8(3)), providing a direct revenue incentive for enforcement activity.

Infringement notice regime: the Act gives authorised persons the power to issue infringement notices where a by‑law offence is found or reasonably suspected and where the authorised person believes that proceedings under the infringement process are adequate (s 14(1)). The notice must be serially numbered, identify the recipient, describe the alleged offence in general terms, and inform the recipient that they may elect to pay a prescribed penalty within not less than 10 days to avoid court proceedings (s 14(2)(a)-(d)). The alternative of court proceedings must also be explained (s 14(2)(e)). If a recipient pays the prescribed penalty within the appointed time, prosecution for the alleged offence is precluded (s 14(4)). Special rules apply for vehicle‑related offences where the driver’s identity is unknown: a notice may be addressed to the owner within 30 days, or attached to the vehicle or left in/on the vehicle without naming the owner where parking is the alleged offence (s 14(3)(a)-(b)).

Powers of authorised persons and procedures: authorised persons who are not police have specific powers when they find or reasonably suspect a by‑law offence , they may remove vehicles, animals or other things; stop, detain and search vehicles, vessels or conveyances; and enter and search huts, tents, caravans or other non‑permanent dwellings (s 7A(1)(a)-(c)). These powers are subject to procedural preconditions: the authorised person must first take all reasonable steps to communicate their intention to exercise the power and their reasons for believing they are authorised to do so (s 7A(1)). For vehicle examinations, authorised persons may require the person in charge to state whether the vehicle is licensed and give the name and address of the owner (s 7A(2)). They can also require information to identify the driver or person in charge at the time of the alleged offence (s 7A(3)). For authorised persons who are police officers, the Act’s provisions are additional and not in derogation of other legislative powers (s 7A(4)).

Evidentiary aids: the Act supplies statutory evidentiary presumptions to ease prosecutions. Readings from speed measuring equipment, as defined in the Road Traffic (Administration) Act, are admissible and are, in the absence of evidence to the contrary, proof of the vehicle’s speed when measured (s 7C(2)). A statement that apparatus used was speed measuring equipment is likewise proof in the absence of contrary evidence (s 7C(3)). For animal‑related proceedings instituted by a Board, habitual apparent ownership gives rise to a presumption that the person is the owner and is liable for the control of the animal, subject to rebuttal (s 12B(1)-(2)). These presumptions lower the prosecution burden of proof in the absence of contrary evidence.

Procedural constraints and safeguards: by‑laws require Governor approval before taking effect (s 8(1)). By‑laws must be published in the Government Gazette and tabled before both Houses of Parliament within 14 days, and they take effect on publication unless repealed or disallowed by both Houses (s 9). The requirement for gazettal and tabling is a legislative check on the exercise of by‑law powers.

Remedies and proceedings: Boards can sue and be sued, and proceedings must be taken in the name of the president (s 3(3)). If an authorised person issues an infringement notice and the recipient elects to proceed to court instead, the Act contemplates conventional prosecution in court; the infringement regime simply provides an alternative avenue for summary resolution (s 14(2)-(4)).

Protections and immunities: individuals other than Boards acting in good faith with respect to functions under the Act are protected from tort actions (s 13(2)), while the Board and Crown retain their own potential liabilities (s 13(4)). This immunisation shapes enforcement risk and may affect how aggressively individuals exercise enforcement powers.

Collectively, the enforcement structure mixes administrative fines, on‑the‑spot powers for authorised persons, presumptive evidence rules, and an administrative/summary resolution pathway via infringement notices. Boards retain discretion to use these tools but are constrained by Governor approval of by‑laws, requirements to communicate reasons prior to exercising certain powers (s 7A(1)), and the statutory right of recipients to elect court determination (s 14(2)(e)).

The Act embeds cross‑references and operational dependencies on several other Western Australian statutes, creating interaction points that affect powers, evidentiary rules, employee status and financial administration.

Land law and administration: the Governor may appoint Boards to control land reserved under Part 4 of the Land Administration Act 1997 (s 3(1)). Section 3(6) expressly ties the Board’s power to lease land to the Land Act 1933 or, as noted in the compilation table and notes, to the Land Administration Act 1997 where cross‑references have been modernised (s 3(6); compilation notes). Thus, leasing powers and related land tenure matters are governed by the Land Administration Act regime and relevant leasing provisions as applied to the Board.

Road traffic and vehicle law: definitions of “vehicle” and “owner of a vehicle” are linked to the Road Traffic (Administration) Act 2008 and the Road Traffic (Vehicles) Act 2012 respectively (s 2; defined terms). Speed measuring equipment is defined by the Road Traffic (Administration) Act and the Act’s evidentiary provisions for speed measurement rely on that definition (s 7C(1)-(3)). Authorised persons can question vehicle licensing status under s 7A(2), which interfaces with the vehicle licensing framework under road traffic legislation.

Criminal identification powers: rangers and Board members are prescribed public officers for the purposes of the Criminal Investigation (Identifying People) Act 2002 and may exercise identification powers under Part 3 of that Act (s 7A(1a)). This cross‑statutory designation expands the toolkit of non‑police authorised persons for identification during enforcement.

Financial and audit law: the Financial Management Act 2006 and the Auditor General Act 2006 apply to a Board and its operations if the Board is listed in Schedule 1 to those Acts (s 12). That means a Board may be subject to public sector financial controls, audit and reporting obligations that supersede general Board financial autonomy, depending on inclusion in Financial Management Act schedules.

Public sector employment law: section 7(3) specifies that where a ranger or other officer is also a Senior Executive Service (SES) member under the Public Sector Management Act 1994, that Act prevails in case of inconsistency (s 7(3)). Further, section 15 requires consultation with the Public Sector Commissioner and arrangements for employment or Part 6 coverage under the Public Sector Management Act for staff if a Board is to be dissolved (s 15(2)). These provisions integrate Board staff into broader public sector employment frameworks in the event of dissolution.

Children and guardianship law: the Act adopts the definition of “parent” from the Children and Community Services Act 2004 for the parental liability provision (s 12A(2)). The parental liability mechanism therefore sits at the intersection of the Parks and Reserves Act and child welfare definitions from the Children and Community Services Act.

Duties and taxation law: section 17 provides an exemption from State tax (including duties under the Duties Act 2008) for anything that occurs because of the dissolution of a Board or anything done under regulations made under s 16, and empowers the Treasurer to certify such occurrences (s 17(2)-(3)). This creates a tax interface that facilitates asset and rights transfers on dissolution without State tax consequences.

Interpretation and statutes revision: the Act’s compilation notes indicate that references to repealed or superseded statutes (for example the Land Act 1933 and the Public Service Act 1978) should be construed as references to successor statutes (Land Administration Act 1997; Public Sector Management Act 1994) as provided by those Acts’ interpretation clauses. Practitioners must read those cross‑references with contemporaneous statutory replacement rules in mind.

In practice, operationalising the Parks and Reserves Act requires simultaneous engagement with land administration regimes, road traffic laws, public sector employment and financial management statutes, criminal identification provisions, child welfare definitions and tax/duties law. For example, enforcement involving vehicles invokes both the Act’s by‑laws and the Road Traffic Acts’ definitional and administrative regimes (s 2; s 7C). Staffing choices and dissolution paths require compliance with public sector employment rules (s 15). By‑laws that affect fee‑collection and finance may trigger Financial Management Act rules if the Board is listed under that Act (s 12). These cross references create opportunities for legal coordination but also points of friction where differing statutory standards must be reconciled.

The compilation table and section notes in the Act provide a chronological record of amendments from 1895 through 2024. The Act has been amended repeatedly; the compilation table lists major amending Acts and reprints. Key modernisation and consequential amendments include:

• Early amendments and reprints: amendments in 1947 (s 1 amended by No. 60 of 1947) and mid‑20th century changes (1954, 1955, 1963) and a reprint in 1960 reflect early statutory maintenance.

• Substantive additions in the 1970s and 1980s: the Parks and Reserves Amendment Acts and related statutes (1972, 1978, 1982, 1983, 1985) expanded Board powers, appointment processes, and enforcement mechanisms. For example, section 7A (powers of authorised persons) was inserted by No. 50 of 1978 s 5 and amended later (see notes to s 7A).

• Modern cross‑statutory integrations: the Act was aligned with newer statutory schemes such as the Criminal Investigation (Identifying People) Act 2002 (s 7A(1a) inserted by No. 6 of 2002 Sch. 2 cl. 4), the Financial Management and Auditor General Acts (s 12 inserted by No. 98 of 1985 and updated 2006), and the Road Traffic Acts (s 2 and s 7C amendments linking to Road Traffic (Administration) Act 2008 and Road Traffic (Vehicles) Act 2012).

• Structural reforms and dissolution machinery: the Acts Amendment (Reserves and Reserve Boards) Act 2003 (No. 76 of 2003, Pt 3) introduced several provisions regarding corporate constitution of Boards, dissolution mechanics, staff arrangements, regulations consequential on dissolution, and tax exemptions related to dissolution (see s 3(4)-(8), s 15-17). These changes reshaped how Boards could be constituted as corporate entities and set out obligations if a corporate Board were dissolved.

• Recent technical updates: standardisation and formatting amendments in 2010 and other minor amendment Acts (2009, 2010, 2012) updated references, terminology and cross‑references. The compilation table records a 2012 Road Traffic Legislation Amendment and, significantly, an amendment in 2024 (Road Traffic Legislation Amendment (Infringement Management Reform) Act 2024 Pt 4 Div 2) which relates to the infringement management regime and appears in the compilation table affecting commencement dates.

The schedule of amendments shows the Act has been progressively modernised to integrate with contemporary administrative law (financial management and audit), public sector employment arrangements, road traffic enforcement regimes, and criminal identification powers. The 2003 amendments (No. 76 of 2003) are notable for adding structured dissolution provisions (s 15-17), clarifying that Boards could be constituted as bodies corporate with explicit powers to borrow and handle property (s 3(4)-(6)), and supplying staff protections in dissolution situations (s 15).

Practitioners must consult the compilation table for commencement dates and transitional provisions that might affect the operation of particular amendments. The notes attached to the Act direct users to statutory rules on interpretation where references to repealed statutes should be read as references to successor statutes (for example, Land Act 1933 references should be read as Land Administration Act 1997 where appropriate).

The Act’s amendment history demonstrates iterative policy choices: adding enforcement powers (authorised persons, infringement notices), harmonising with modern financial and road traffic frameworks, and providing machinery to reorganise Boards as corporate entities and to wind them up with staff protections and tax implications. All amendments cited above are recorded in the Act’s compilation table and the marginal notes to the relevant sections.

The Act text and compilation notes do not list judicial decisions or an authoritative litigation history. The statutory text, however, sets the institutional and procedural contours likely to generate litigation and provides pointers to where disputes are heard and what issues may be litigated.

Jurisdiction and parties: a Board may sue and be sued, and legal proceedings may be taken by or against a Board in the name of its president (s 3(3)). This provides standing and procedural form for litigants. Disputes may therefore be brought in courts of competent jurisdiction in the Board’s name, including matters relating to property, contract, tort, licence conditions, by‑law enforcement and challenges to by‑laws or their application.

Typical contentious issues likely to arise and their statutory hooks:

• By‑law validity and ultra vires challenges: by‑laws are made under s 8 with Governor approval and are subject to parliamentary disallowance (s 9). A person aggrieved by a by‑law might challenge its validity on grounds it exceeds the Board’s statutory power under s 5 or is inconsistent with an Act of Parliament. Courts will assess whether the by‑law falls within the ambit of powers granted by s 5 and s 8.

• Enforcement and procedural fairness: enforcement actions by authorised persons (s 7A) raising allegations of unlawful searches, detentions or improper exercise of powers may generate civil suits or criminal complaints. Section 7A requires authorised persons to take reasonable steps to communicate their intention and grounds before exercising certain powers, which may be a procedural element litigated in disputes.

• Infringement notices and penalties: recipients who elect to contest an offence after receiving an infringement notice may litigate the underlying alleged offence in court (s 14(2)(e)). Procedural compliance with s 14 (notification requirements and time limits) could be subject of litigation where the sufficiency or form of the notice is disputed.

• Evidence and presumptions: statutory evidentiary provisions for speed measuring equipment (s 7C) and presumptions about habitual animal ownership (s 12B) alter evidentiary burdens and may be a focus of litigation about admissibility, calibration, or rebuttal evidence. Challenging statutory presumptions or showing “evidence to the contrary” are likely litigation themes.

• Parental liability: recovery actions against parents under s 12A for damage caused by children may lead to contested claims about negligence, intentional conduct, and whether parents exercised “due care and control”. These cases raise civil liability issues.

• Employment and dissolution disputes: where a corporate Board is dissolved, section 15 requires certain staff arrangements; disputes over entitlements, continuity of service, or whether the dissolution complied with s 15 obligations may generate employment and administrative law litigation. Section 16(2)(i) contemplates regulations to continue a Board for the purpose of preparing final reports, which could be relevant in litigation over obligations at dissolution.

• Property and transfer disputes: s 16(2)(a)-(b) authorises regulations about disposition of property and transfer of rights and liabilities on dissolution; litigation could arise over interpretation or application of those regulations or over whether a transfer is lawful.

Remedies and courts: where matters proceed to court, the usual civil and criminal remedies apply. The Act itself does not specify exclusive jurisdictions or specialised tribunals for reviewing Board decisions; hence general courts would hear challenges. The Act’s protection from personal liability for persons acting in good faith (s 13) may be pleaded as a defence in tort claims.

Because the Act does not catalogue case law, practitioners should search contemporary databases for decisions citing the Parks and Reserves Act 1895 to identify judicial interpretation of by‑law scope, enforcement powers, evidentiary presumptions and staff/dissolution obligations. The Act’s statutory prescriptions , particularly for by‑laws (s 8-9), enforcement (s 7A, s 14), evidentiary devices (s 7C, s 12B), and dissolution/regulatory machinery (s 15-17) , define the legal arguments likely to be raised in litigation.

Several practical traps and legal friction points are embedded in the Act’s text and institutional design.

By‑law approval and parliamentary oversight: Boards can only make by‑laws with the Governor’s approval (s 8(1)), and by‑laws must be gazetted and tabled before both Houses within 14 days and are effective on publication unless disallowed by both Houses (s 9). Boards and users must therefore track the Governor’s approval status and the parliamentary tabling window; a by‑law applied without proper approval and gazettal may be vulnerable to challenge.

Licence limits and Ministerial approval: Boards may grant licences for depasturing animals and removal of materials (s 5(1)(e)-(f)) but cannot do so unless the Minister has first approved the licence or the original purpose of the land placement expressly contemplates it (s 5(1a)). Licence applicants may assume local Board discretion where Ministerial approval is required, causing delays or unexpected denial unless the Minister’s role is engaged early.

Authorised persons’ search and entry powers require communication: non‑police authorised persons may remove or search (s 7A(1)(a)-(c)) but must first have taken reasonable steps to communicate their intention and reasons. Failure to comply with the communication requirement can render an exercise of power procedurally defective and expose the Board to legal challenge.

Non‑police powers linked to Criminal Investigation Act: rangers and Board members are prescribed public officers under the Criminal Investigation (Identifying People) Act 2002 (s 7A(1a)), which gives them identification powers. However, different operational rules and safeguards apply to police and non‑police officers; practitioners must be careful about when, how, and under what statutory authority identification and search powers are exercised.

Vehicle owner as default liable party: where the identity of a driver is unknown, the Board’s by‑laws may deem the owner to have been the driver unless the owner satisfies the Board otherwise (s 8(1)(o)). Owners may be surprised to receive an infringement notice attached to a vehicle (s 14(3)(b)). Owners should be aware that they need to act promptly if they were not the driver, because the owner may be deemed liable under by‑laws.

Evidentiary presumptions are rebuttable but have practical force: readings from speed measuring equipment are proof in the absence of contrary evidence (s 7C(2)). Similarly, habitual possession of animals produces a presumption of ownership (s 12B(1)). These are not conclusive, but they shift evidentiary burdens in practical terms and create obstacles for defendants who may lack immediate access to contrary evidence.

Infringement notice technicalities: the notice must include certain information and offer an option to pay within not less than 10 days (s 14(2)(d)). Procedural errors in the notice’s form, timing or content may be a defence to prosecution or a basis to challenge enforcement. Conversely, recipients who pay the prescribed penalty cannot later be prosecuted for the same alleged offence (s 14(4)) , a tactical decision point.

Limits on Board leasing and borrowing: when a Board is constituted a body corporate, leasing powers operate subject to the Land Act / Land Administration Act provisions (s 3(6)), and borrowing requires Governor approval (s 3(4)). Boards and counterparties should confirm that any lease or borrowing transaction complies with the relevant land administration regime and required approvals.

Staff transition traps on dissolution: a Board cannot be dissolved unless the Minister has arranged employment for staff who agree, after consulting the Public Sector Commissioner, or staff fall under Part 6 of the Public Sector Management Act (s 15(2)). Failure to comply with s 15 procedural steps could render a dissolution legally precarious and provide grounds for staff action.

Tax exemption mechanism needs Treasurer certification: s 17 exempts State tax for things that occur because of dissolution or under s 16 regulations, but the Treasurer’s certificate is conclusive evidence of that fact unless the contrary is shown (s 17(3)). Practitioners handling asset transfers on dissolution should obtain appropriate Treasury certification to avoid disputed State taxes.

Personal liability protection limitations: s 13 protects individuals (other than Boards) acting in good faith from tort actions, but does not remove Board or Crown liability (s 13(4)). Individuals relying on s 13 as a shield need to ensure their conduct falls within “good faith” and that the Board/Crown will manage institutional liability.

Interaction with other statutes: cross‑references to the Road Traffic Acts, Land Administration Act and Public Sector Management Act mean that practitioners must check those statutes’ current provisions and definitions (s 2; s 3(6); s 7(3)). Outdated references in earlier versions may cause misreading if modern replacement statutes are not consulted (see compilation notes).

Collectively, these “gotchas” are implementation and procedural traps where administrative omissions, misunderstanding of approval requirements, or failure to respect procedural preconditions can produce legal challenge or liability. Diligent administrative practice and early legal review are necessary when drafting by‑laws, issuing notices, exercising search powers, handling licences that require Ministerial approval, or dissolving a corporate Board.

For Boards, staff and regulated parties the Act implies concrete compliance steps. Below is a practical checklist derived from the statutory provisions, with section references.

For Boards and presidents

• Ensure authority is properly conferred: confirm Governor appointments and any corporate proclamation when constituting a Board as a body corporate (s 3(1), (4)). Keep copies of proclamations and appointment instruments.
• By‑law process compliance: draft by‑laws in the terms permitted by s 8(1); obtain Governor approval before promulgation; publish in the Government Gazette; arrange for tabling before both Houses within 14 days of gazettal (s 8(1); s 9).
• Fee and fine rules: when prescribing admission fees or collection mechanisms, follow s 8(1)(t)-(u) and ensure revenue accounting complies with public finance law; if the Board is listed under the Financial Management Act, follow that Act’s financial administration and audit obligations (s 12).
• Licence approvals: do not grant licences for depasturing or material removal without Ministerial approval unless the land’s placement specifically contemplates such licences (s 5(1a)). Document Ministerial approvals and any land purpose that may serve as an exception.
• Enforcement policy and training: authorise rangers and issue certificates of authority in the Schedule form (s 7; s 7B(1); Schedule). Train authorised persons on s 7A preconditions requiring reasonable steps to communicate intention before removing, searching or entering (s 7A(1)). Ensure rangers know they are public officers for identification purposes (s 7A(1a)).
• Infringement notice procedures: implement form controls to ensure notices meet s 14(2) content requirements and are serially numbered; maintain records of notices given and receipts of penalties (s 14(2)-(4)).
• Evidence and equipment: for speed enforcement, use equipment compliant with the Road Traffic (Administration) Act; keep calibration and maintenance records to rebut challenges to s 7C evidentiary presumptions (s 7C(1)-(3)).
• Staff transition planning for dissolution: if contemplating dissolution of a corporate Board, consult the Public Sector Commissioner and arrange staff employment transfers or ensure statutory coverage under the Public Sector Management Act; document staff agreements to preserve continuity of rights (s 15(2)-(3)).
• Insurance and property disposition on dissolution: if dissolution is possible, prepare regulatory or contractual mechanisms consistent with s 16 to transfer or preserve rights and liabilities and seek Treasurer certification if State tax consequences may arise (s 16; s 17).

For rangers and authorised persons

• Carry and produce certificate of authority: produce the certificate when requested (s 7B(2)); retain original authority documents (Schedule).
• Follow communication requirements before exercising powers: before removing or searching items or entering non‑permanent dwellings, take reasonable steps to communicate your intention and grounds (s 7A(1)).
• Use identification powers correctly: as public officers under the Criminal Investigation (Identifying People) Act, follow that Act’s procedures and safeguards when conducting identification (s 7A(1a)).
• Recordkeeping and evidence: document any use of speed measuring equipment and maintain calibration logs to support admissibility under s 7C; record the basis for reasonable suspicion where searches or detentions occur to support lawful exercise of powers (s 7C; s 7A).

For vehicle owners and park users

• Monitor by‑laws and gazettal: review the Government Gazette for new by‑laws affecting vehicle use, parking restrictions and admission fees (s 9; s 8(1)(h), (i), (t)).
• Respond promptly to infringement notices: if issued an infringement notice, note the minimum 10‑day payment window and weigh the decision to pay the prescribed penalty (which precludes later prosecution) versus electing a court hearing (s 14(2)(d)-(e); s 14(4)).
• Owner liability precautions: where parking or vehicle use is regulated, owners should be prepared to provide information identifying drivers to avoid being deemed the driver under a by‑law (s 8(1)(o); s 7A(3)).
• Contesting evidence: if speed or other equipment evidence is used, gather contrary evidence promptly (s 7C(2)).

For licence applicants and commercial operators

• Check Ministerial approval requirement: before expecting a Board to issue a licence for depasturing or resource removal, check whether Ministerial approval is required and seek it early (s 5(1a)).
• Contract and leasing due diligence: if dealing with a corporate Board’s capacity to lease or borrow, confirm statutory powers and any Governor approvals referenced in s 3(4)-(6); verify that leasing powers conform to the Land Administration Act and any applicable land tenure rules (s 3(6)).

For parents and guardians

• Supervise children on Board land: understand that a Board may recover loss from a parent or guardian where damage results from a child’s intentional or negligent act unless the parent proves due care and control (s 12A(1)). Maintain appropriate supervision and evidence of reasonable care where disputes may arise.

For accountants, auditors and compliance officers

• Financial reporting obligations: check whether the Board is listed under Schedule 1 of the Financial Management Act; if so, apply financial administration, audit and reporting provisions to Board accounts (s 12).
• Fee and penalty accounting: properly account for pecuniary penalties which go to the Board (s 8(3)), and ensure fee collection methods prescribed by by‑laws are followed (s 8(1)(u)).

For solicitors and legal counsel

• Validate by‑law forms and statutory compliance: ensure every by‑law follows s 8’s subject limitations, has Governor approval, and is gazetted and tabled per s 9 before enforcement.
• Challenge and defence strategies: for defendants, examine whether authorised persons complied with s 7A communication requirements and whether infringement notices complied with s 14; for claimants, preserve calibration evidence and records to rely on s 7C and s 12B presumptions.
• Dissolution planning: advise Boards on s 15-17 compliance, staff arrangements, regulatory steps under s 16, and Treasury certification options under s 17.

Overall, compliance is an administrative exercise: Boards must document authority and approvals, adhere to by‑law processes, equip and train authorised persons, maintain detailed records for enforcement and evidentiary purposes, and coordinate with Ministers, the Treasurer, and the Public Sector Commissioner where statutory approvals or dissolutions are contemplated.
