The Electoral Rules of 1908

The Rules rest on several recurring, concrete concepts that structure the petition process.

• Petition form and prayer. A petition must be titled as an Electoral Act 1907 petition to the Court of Disputed Returns and contain numbered paragraphs and a prayer stating the relief sought, for example, that a candidate be declared duly elected or that the election be declared absolutely void (r.2; Schedule 1 form). The Rules prescribe layout and content, so pleadings are structured and succinct.

• Filing and financial security. The petitioner must file at the Central Office of the Supreme Court, lodge a copy for publication and a form of notice, and deposit two monetary items: $100 security for costs and an amount to cover publication expenses (r.3). The Rules thus create an upfront monetary barrier and shift publication expense to the petitioner.

• Public notice. On filing, a Court officer must publish the petition in the Government Gazette and cause a newspaper notice to be published in either a statewide newspaper or a local district newspaper as appropriate, identifying the petitioner, relief sought, and concise grounds (r.4). Publication is immediate and public, not limited to court parties.

• Service and addresses for service. The petitioner must serve a sealed copy within 14 days on the person whose return is disputed, service being either personal or by prepaid registered post to the address on the nomination paper for someone returned as elected (r.5). Alternatively, a returned member may provide a written address for service to the Central Office and appoint a solicitor; service can then be made by leaving the sealed copy at that address (r.6).

• Strict particulars and lists. The Court may order particulars (r.7(a)). When a petition claims the seat for someone not returned, or challenges votes for qualification reasons, the parties must, within seven days after service (or such further time as a Judge allows), exchange lists of ballot papers or names and the grounds relied on for claiming or objecting to particular ballots or votes (r.7(b)-(c)), with the corollary that unspecified grounds will not be entertained except by leave of the Court and on such terms as to amendments, adjournments and costs as ordered.

• Counter‑charges. A respondent who seeks to assert alternative grounds for denying the claimed seat must file a statement of those grounds within seven days of service or within an extended time ordered by the Judge; the statement must be set out with the same factual specificity required in a petition (r.8).

• Interlocutory management and ex parte relief. All interlocutory matters are dealt with by a Judge at Chambers (r.9). If a respondent gives written notice that he does not intend to oppose the petition, the Court may make an order in the terms of the prayer on the ex parte application of the petitioner, and the respondent will generally not be liable for costs incurred after that notice unless the Court orders otherwise (r.10).

• Trial scheduling and advertisement. Trials are scheduled by order of a Judge, with 10 days notice of trial normally required and subject to public advertisement in an appropriate newspaper unless directed otherwise (r.11).

• Withdrawal and substitution. A petitioner may withdraw with leave of the Court, usually after ten days notice to the respondent and advertisement; the Court can substitute another person who is competent to present a petition on like grounds (r.12). If a sole petitioner dies before trial, a Judge may allow substitution (r.13). The Court may also substitute a party where collusion is suspected, continuing the proceedings as if the substituted person had been an original party while maintaining cost liability on the original party (r.14).

• Forms and fees; application of Supreme Court rules. Schedule 1 supplies standard forms; Schedule 2 prescribes modest filing and interlocutory fees. The General Rules of the Supreme Court and Orders relating to fees apply so far as consistent with these Rules (r.15-16).

These concepts create a short, publicly visible, judicially managed process for resolving electoral disputes. The Rules emphasise early exchange of precise particulars about contested votes and restrict ad hoc expansion of issues at trial unless the Court grants leave. The Rules also convert procedural failures (failure to list votes, failure to serve) into admissibility limits, time extensions or costs consequences governed by judicial discretion.

The Rules directly govern parties to an election petition under Part V of the Electoral Act 1907 and the Supreme Court staff and officers who manage filings and publications.

• Petitioners. Individuals who present petitions under Part V are the primary obligors under the Rules. They must prepare a petition in the prescribed form (or of like effect), pay prescribed fees, deposit $100 security for costs and sufficient funds to cover publication, lodge copies and notices for publication, serve the respondent within specified timeframes, and deliver particulars or lists of ballot papers or names in short statutory periods (rr.2-3, 4-5, 7). The petitioner therefore bears up‑front costs and early disclosure obligations.

• Respondents (returned candidates). The person whose election or return is disputed is the respondent and must accept service in the ways permitted by the Rules (personal service, prepaid registered letter to nomination paper address, or by having provided an address for service with the Court) (r.5-6). Respondents may deliver counter‑charges within seven days where asserting alternative grounds (r.8), may give notice that they will not oppose the petition (r.10), and may be subject to Court orders, including ex parte orders where they decline to oppose.

• Other potential petitioners or intervenors. The Rules allow substitution where a petitioner withdraws or dies, and permit the Court to substitute parties where collusion is suspected (rr.12-14). The Court may allow other persons who were competent to present a petition on the same grounds to be substituted for a withdrawing petitioner (r.12), or permit substitution on death or for collusion. This affects politically interested third parties and suggests the Court can keep proceedings alive in the public interest.

• Supreme Court and judicial officers. The Court, Judges and Court officers hold specific operational responsibilities: receiving filings, publishing petitions and notices (r.3-4), administering sealed copies, scheduling trials and hearing interlocutory applications at Chambers (rr.9, 11), and making discretionary orders regarding time extensions, leave to amend, substitution and costs (throughout). The Rules embed the Court as the primary decision maker on procedural matters.

• The public and media. The Rules require publication in the Government Gazette and in a newspaper circulating generally in the State or in the relevant district (r.4). Trials are normally advertised (r.11). This makes electoral challenges publicly visible and brings reputational and political effects to parties beyond the immediate litigants.

• Legal practitioners. The Rules anticipate practitioners who will be appointed as solicitors by returned members when an address for service is lodged, and who will carry out filings, withdrawals and interlocutory applications (r.6, Schedule 1). The Rules also require use of forms and payment of fees at the Central Office of the Supreme Court, functions normally performed by solicitors.

Who pays and who bears risk. The petitioner pays initial deposits and publication costs (r.3), pays the filing fee (Schedule 2), and risks cost orders arising from adverse judicial decisions or costs consequences for late amendments or failures to particularise (r.7). Respondents who elect not to oppose can avoid liability for costs incurred after they give notice unless the Court orders otherwise (r.10). If substitution occurs for collusion, the original party, not the substituted party, remains liable for such costs as the Court orders (r.14). Thus the Rules allocate financial risk primarily to the petitioner but leave broad discretion for the Court to order costs against any party when appropriate.

The Rules impose specific duties on parties and vest discrete rights and procedural options. These duties and rights define the conduct of petition litigation and the Court’s case management powers.

Duties of the petitioner

• Draft and file the petition in the Central Office of the Supreme Court, using numbered paragraphs and concluding with a prayer for relief; use Schedule 1 forms as appropriate (r.2; Schedule 1).

• Lodge a copy of the petition and a form of notice for publication, and deposit $100 as security for costs plus an amount sufficient for publication (r.3). This duty to fund publication and security is non‑delegable in the filing step.

• Cause a sealed copy of the petition to be served on the person whose election is disputed within 14 days of filing, or such further time as a Judge allows (r.5).

• If claiming the seat for someone else or alleging invalid votes, deliver to the Court and opposing party, within seven days of service (or such further time as allowed), lists of ballot papers or names and grounds upon which ballots are claimed or objected to, with the effect that unspecified grounds are not ordinarily entertained (r.7(b)-(c)).

• Advertise notice of withdrawal, if seeking leave to withdraw, and comply with ten days’ notice to the respondent prior to applying for leave to withdraw unless the Court orders otherwise (r.12).

Duties of the respondent and other parties

• Accept service set out in the Rules; a respondent returned as elected may be served personally or by prepaid registered post to the address on the nomination paper (r.5), or may file an address for service with the Court to allow service by leaving a sealed copy at that address (r.6).

• If intending to rely on counter‑charges when a seat is claimed for a person not returned, deliver a statement of the grounds within seven days after service, set out in the same factual manner required of a petition (r.8).

• The respondent who serves a written notice that he does not intend to oppose need only serve that notice on the Court and the petitioner; upon doing so, the Court may make an order in terms of the prayer on an ex parte application (r.10). After such notice, the respondent will not generally be liable for costs incurred subsequent to the notice unless the Court orders otherwise (r.10).

Judicial powers and rights

• The Court/Judge may order any party to deliver particulars or further particulars of any matter alleged in the petition (r.7(a)). The Judge has wide discretion to order extensions of time, specify terms for amendment, and make cost orders when permiting late or expanded claims (r.7(b)-(c)).

• Interlocutory questions and matters may be heard and disposed of by a Judge at Chambers, who has the same control as in ordinary Supreme Court proceedings (r.9).

• A Judge may allow substitution of parties in several circumstances: where the sole petitioner dies before trial (r.13), where a petitioner wishes to withdraw and another competent person seeks to be substituted (r.12), and where the Court believes collusion exists and directs substitution, while keeping the original party liable for costs (r.14).

• The Court may make orders in the terms of the petition on ex parte application if the respondent gives notice of non‑opposition (r.10), and may otherwise direct trial scheduling and advertise the trial (r.11).

Procedural rights and evidentiary consequences

• The strict timetable for listing ballots and names gives parties the right to be heard on those specific grounds, and concomitantly restricts parties from advancing grounds not listed unless the Court grants leave on such terms as it orders (r.7(b)-(c)). That is an evidentiary gatekeeping mechanism.

• The application of the General Rules of the Supreme Court and Orders relating to fees extends ordinary civil process, subject to consistency with these Rules (r.16). Parties therefore have the procedural rights and obligations given by the Supreme Court rules unless inconsistent with these Rules.

Fees and cost allocation

• Schedule 2 sets out specified fees for filing the petition, interlocutory applications, sealing copies, witness summonses, and other matters. The Rules require the payment of the listed fees in proceedings in the Court of Disputed Returns (r.15; Schedule 2).

• The Court has discretion to order costs as it thinks fit, including preserving the original party’s liability when substitution is ordered because of collusion (r.14), and to exclude liability for costs for respondents who declare non‑opposition unless the Court orders otherwise (r.10).

These duties and rights allocate operational responsibility to petitioners for filing, publication and early disclosure, while equipping Judges with case management powers to control the scope of the dispute, permit substitution, and allocate costs. The Rules therefore trade in predictability of process for concentrated timelines that compress decision points and front‑load financial and disclosure obligations.

The Rules themselves do not create statutory criminal penalties; rather they provide procedural consequences, judicial remedies and cost mechanisms that enforce compliance and shape behaviour. Enforcement operates through the Court’s case management powers, admissibility rules, cost orders and the capacity to make substantive relief consistent with the petition.

Evidentiary and procedural sanctions

• Exclusion of unparticularised grounds. If a party fails to deliver the lists of ballot‑papers, classes of ballot‑papers or names with grounds within the seven‑day period (or the further time a Judge allows), then "no claim or objection shall be entertained in favour of or against the validity of any ballot‑paper upon any ground not specified in the lists so delivered", except by leave of the Court upon such terms as to amendment, adjournment and payment of costs as the Court may order (r.7(b)). The same rule applies to lists of names alleged to be unqualified voters (r.7(c)). This converts failure to particularise into an evidentiary bar unless the Court relaxes it with conditions, thereby enforcing early disclosure.

• Counter‑charges limited by time and form. Respondents who wish to set up alternative grounds must deliver a statement of those grounds within seven days and in the same manner as a petition sets out facts to invalidate an election or return (r.8). Failure to comply will reduce the respondent’s ability to press that ground absent the Court’s indulgence.

Cost orders and financial enforcement

• Security for costs and publication costs. The petitioner must deposit $100 as security for costs and an amount sufficient to defray publication costs at filing (r.3). The Court can call on that security to meet costs orders or other fee liabilities.

• Costs consequences for non‑opposition and withdrawals. A respondent giving a notice of non‑opposition is generally not liable for costs incurred subsequent to the notice unless the Court orders otherwise (r.10). Conversely, the Court may impose terms, including costs, for amendment of lists or for granting leave to call previously unparticularised matters (r.7(b)-(c)). If substitution is ordered for collusion, the original party remains liable to pay such costs as the Court may order (r.14). Thus costs can be used to penalise procedural abuse or collusive behaviour.

Substantive enforcement through orders

• The Court can make orders in the terms of the prayer on application when a respondent does not oppose the petition (r.10). The petition’s prayer may ask that a candidate who was not returned be declared duly elected or that the election be declared absolutely void (r.2). Thus the Court’s enforcement can include voiding an election or declaring a different outcome, subject to the substantive law in the Electoral Act 1907 that the Rules implement procedurally.

Operational enforcement by the Court

• Interlocutory control. All interlocutory questions and matters may be heard and disposed of by a Judge at Chambers; the Judge has the same control as in ordinary Supreme Court proceedings (r.9). This gives the Court continuous oversight to enforce timetables and compliance.

• Application of General Rules of the Supreme Court. The Rules incorporate the General Rules and Orders relating to fees "so far as ... applicable, and are not inconsistent with these rules" (r.16). This brings into play standard judicial enforcement mechanisms available in Supreme Court practice for contempt, enforcement of orders and compliance with process where applicable.

What is absent

• No criminal sanctions or specific statutory fines are prescribed within these Rules. The Rules rely on civil process tools: exclusion of evidence, costs, and the Court’s substantive powers under Part V of the Electoral Act 1907 to grant relief. The immediate enforcement levers are therefore procedural rather than penal.

In short, enforcement under these Rules is exercised by the Court through admissibility gating, cost consequences, judicial case management and the power to order relief in the terms of the petition, with initial financial enforcement through the deposit for publication and security for costs. The Court’s discretion, exercised under the Rules, is the primary enforcement mechanism.

The Rules are procedural directions made under the authority of the Electoral Act 1907 and expressly link to other legal instruments and court practice rules.

• Electoral Act 1907, Part V. The Rules are the procedural mechanism for petitions "under Part V of the Electoral Act 1907" (r.2). They therefore operate within the substantive framework provided by the Act; the Rules prescribe how the Court of Disputed Returns is to receive, publicise, manage and trial those petitions. The Rules do not restate substantive electoral law; they assume the Act supplies the legal standards for deciding petitions.

• Supreme Court structures and General Rules. The Rules bring ordinary Supreme Court process into play "so far as applicable, and are not inconsistent with these rules" (r.16). This means Civil Procedure Rules, fee orders, and the general supervisory powers of the Supreme Court apply alongside these specialised Rules. Interlocutory matters are to be managed by a Judge at Chambers with "the same control" as a Judge in ordinary proceedings (r.9). Consequently, practitioners must expect to conform to Supreme Court practice unless a specific Electoral Rule controls.

• Publication law and official Gazette. Rule 4 requires publication in the Government Gazette and in an appropriate newspaper. The Government Gazette is an official publication managed under other statutory and administrative regimes. The Rules therefore intersect with laws and administrative procedures governing Gazette publication and newspaper practice, including payment and timing logistics.

• Currency and fees legislation. The Compilation table shows the Decimal Currency Act 1965 affected the Rules' monetary amounts historically. The Schedule 2 fees are expressed in dollars, consistent with currency conversion performed in 1965, reflecting the interaction between currency conversion legislation and the fee schedule (Compilation table; Schedule 2).

• Supreme Court Orders relating to fees. Rule 16 refers to "Orders of the Supreme Court relating to fees", thereby incorporating any broader fee orders unless inconsistent. Thus fee levels and fee collection procedures may be influenced by Supreme Court Orders beyond Schedule 2, subject to inconsistency.

• Administrative practice (filing and service). The Rules require filings at the Central Office of the Supreme Court (r.3), service methods consistent with ordinary court practice (personal service, registered post), and the option for returned members to lodge addresses for service (r.6). These aspects interact with other legislative or court rules on service of documents and registry practice.

What the Rules do not do

• They do not amend or restate the substantive electoral offences, qualifications, or standards for trials; those remain in the Electoral Act 1907 and applicable law. The Rules provide procedural steps only.

• They do not specify criminal enforcement or external administrative penalties. Enforcement is judicial and procedural as noted.

Practical consequence for practitioners

• When preparing an electoral petition, counsel and solicitors must coordinate with Supreme Court registry practice and with the administrative processes for Gazette publication and newspaper notices. They must also be alert to Supreme Court General Rules that will apply by extension unless inconsistent with these Rules. When considering fees, be mindful that Schedule 2 is not the sole source of fee obligations; Supreme Court Orders relating to fees may also apply.

The Rules have a long history and the compilation table in the source lists key amendments and reprints.

Primary enactment and early history

• The Electoral Rules were originally made as The Electoral Rules of 1908 and published 9 October 1908 (Compilation table). The initial text provided the forms and procedural directions that have been maintained in substance.

Decimal currency and mid‑20th century change

• The Decimal Currency Act 1965 effected currency conversion measures that touched on the Rules' fees. The Compilation table records that some provisions came into operation in February 1966 and that the balance of the Decimal Currency Act was assented to in December 1965, indicating the fee schedule and monetary references were adapted to decimal currency, as reflected in Schedule 2.

Reprint and modern amendments

• A reprint of The Electoral Rules of 1908 as at 19 October 2001 is recorded in the Compilation table; such reprints consolidate amendments made up to that date.

• Electoral Amendment Rules 2009. The Rules were amended by the Electoral Amendment Rules 2009, published 3 July 2009. The Gazette entry lists which parts were effected on 3 and 4 July 2009. The marginal note in rule 1 records an amendment in Gazette 3 Jul 2009 p. 2681. Schedule 1 was also amended in 2009 (see note in Schedule 1), indicating updates to forms and perhaps minor textual modernisation.

• Electoral Amendment Rules 2022. The most recent amendments recorded are the Electoral Amendment Rules 2022 (SL 2022/201), which commenced 22 and 23 November 2022 depending on the provision (Compilation table). The marginal notes in several rules show targeted amendments in 2022: r.2 amended (r.4 of the Statutory Instrument), r.3 amended (r.5), r.4 (r.6), r.5 (r.7), r.6 (r.8), r.7 (r.9), r.8 (r.10), r.10 (r.11), r.11 (r.12), r.12 (r.13), r.14 (r.14), r.15 (r.14), and Schedule 1 amendments listed (r.15). These amendments appear to have modernised text and perhaps clarified service, filing and form procedures, as reflected by the cross references in each rule.

Notes section and citation

• The "Notes" following Schedule 2 explain the compilation and list the citations for published amendments and commencement dates, providing a legal history traceable through Gazette notifications and statutory instruments.

What is not provided

• The source does not supply the precise textual differences introduced by each amending instrument. It lists where amendments occurred and the dates of their commencement but does not reproduce prior versions for direct comparison. Practitioners requiring the detailed amendment text must consult the amending instruments SL 2022/201 and the 2009 Gazette entry, or the consolidated reprint for the current operative text.

In summary, the Rules are over a century old, have been brought up to modern practice by mid‑20th century currency reform and later amendment rounds in 2009 and 2022, and maintain continuity in structure while being updated for contemporary registry and procedural contexts. The Compilation table in the source documents these milestones and gives commencement dates for key amending instruments.

The source material provided is the Electoral Rules 1908 together with its Schedules and compilation table, and it does not record any cases, judicial decisions, or reported litigation applying the Rules. The Rules themselves refer to the Court of Disputed Returns and the Supreme Court but do not cite case law or judicial interpretations within the Rules text.

What is in the source

• The Rules prescribe procedural obligations and judicial discretions but contain no annotated references to authorities or examples of litigated matters. The Schedules supply forms and fees, and the Notes provide a compilation history of amendments, without any litigation references.

Implication for researchers and practitioners

• Because the Rules do not list litigation, researchers must consult other sources to determine how the Supreme Court and the Court of Disputed Returns have applied, interpreted or enforced these Rules in practice. Specifically, to understand judicial attitudes to time extensions, the application of r.7’s particulars restrictions, cost orders under r.10 and r.14, or substitution for collusion, a practitioner must search reported decisions of the Supreme Court and any Court of Disputed Returns judgments, and examine local court practice directions.

Limits of this section

• This section reports the content of the provided source only. It does not invent or assume any judicial history not shown in the Rules or the Compilation table. If you require a survey of cases or how the Rules have been interpreted, the next step is to perform a targeted case law search of Supreme Court decisions and Court of Disputed Returns judgments referencing the Electoral Act 1907 and these Rules.

The Rules contain several procedural traps and consequential requirements that are easy to overlook. These are practical, rule‑based risks that affect admissibility, costs and the viability of a petition:

1. Up‑front monetary obligations. At filing the petitioner must deposit $100 as security for costs and an amount sufficient to defray publication costs (r.3). If the petitioner does not lodge sufficient funds for publication the registry cannot carry out the mandated Gazette and newspaper publication (r.4). The Rules therefore require early budgeting and payment at filing.

2. Immediate public exposure. Upon filing, the Court officer must "forthwith" publish a copy in the Government Gazette and cause a newspaper notice to be published setting out the fact of the petition, the name of the petitioner, relief claimed and the grounds concisely (r.4). Filing a petition triggers public notice of a dispute; sensitive allegations will be made publicly available very quickly.

3. Tight service timelines. The petitioner must serve a sealed copy within 14 days of filing (r.5), unless a Judge allows more time. Missing this deadline risks delay and possible procedural objections.

4. Service mechanics for returned candidates. Service on a returned member may be by prepaid registered post to the address on the nomination paper (r.5). If the nomination paper address is out of date, postal service risk increases. A returned member may instead lodge an address for service with the Central Office which permits service by leaving the sealed copy at that address (r.6). Practitioners should confirm addresses for service early.

5. Seven‑day disclosure rule and its consequences. Where the petition is not merely for a fresh count but claims a seat for someone not returned, parties must exchange lists of ballot papers/classes and specify grounds within seven days after service (r.7(b)). Likewise, petitions alleging votes by unqualified persons require a list of names within seven days (r.7(c)). The corollary is strict: failure to list a ground means it will not be entertained except by leave and on terms as to amendment, adjournment and payment of costs. Practitioners must prepare lists immediately after service, including careful consideration of legal grounds for objecting to ballots.

6. Respondent’s counter‑charges must be timely and particularised. If a respondent intends to assert grounds other than those set out by the petitioner, the respondent must deliver a detailed statement within seven days or such further time as allowed (r.8). Late counter‑charges risk being excluded or receiving adverse costs treatment.

7. Withdrawal requires notice and advertisement. A petitioner seeking to withdraw must give 10 days’ notice of the intention to apply for leave and must advertise that intention (r.12). The Court may substitute another competent person at the hearing. Failure to provide the notices risks denial of leave or procedural complications.

8. Costs risk on substitution for collusion. Where the Court believes parties are colluding to defeat the Act’s intent, it can direct substitution, but it keeps cost liability on the original party (r.14). Parties should not assume substitution removes cost exposure.

9. Small statutory fees may not reflect total costs. Schedule 2 lists minor fees such as $1.00 on filing and $0.05 for a witness summons, but these statutory fees are separate from the real costs of litigation, printing, publication, solicitor and counsel fees, and the publication deposit required at filing (Schedule 2; r.3). Do not rely on Schedule 2 to estimate total expense.

10. Reliance on judicial discretion. Many time extensions, admissions of unlisted grounds, and substitution events are subject to the Judge’s discretion and will be accompanied by terms as to amendment, adjournment and payment of costs (r.7(b)-(c); r.12-14). Parties should plan for uncertainty and potential conditional orders.

11. Interlocutory matters at Chambers. Interlocutory questions will be handled at Chambers (r.9), not necessarily in open court. Practitioners must be familiar with Chambers practice and ready to engage in that forum.

12. The Rules are procedural only. The Rules do not elaborate the substantive legal tests for declaring an election void or declaring a different candidate elected. Those tests are in the Electoral Act 1907 and substantive electoral law; the Rules govern how a petition proceeds procedurally (r.2).

Practically, these "gotchas" mean that petitioners must prepare for immediate public disclosure, substantive evidentiary particularisation on tight deadlines, and up‑front financial and administrative steps. Respondents must be ready to assert timely counter‑charges and consider whether to file an address for service to control service risk. Both parties should expect the Judge to exercise case management actively and to attach terms to admitted late matters, often involving costs.

This section provides stepwise, rules‑based actions, tied to the text, for a petitioner, a respondent and their solicitors to comply with the Rules. The steps assume the petition is under Part V of the Electoral Act 1907 and will be filed in the Central Office of the Supreme Court.

For petitioners: filing and initial steps

1. Prepare the petition in the prescribed form. Use the Schedule 1 petition form as a template, ensure facts are set out in numbered paragraphs and end with a clear prayer for relief (r.2; Schedule 1 petition form). Ensure factual specificity wherever possible to assist in particulars and for judicial assessment.

2. Calculate and prepare payment for required deposits. At filing you must deposit $100 as security for costs and an amount sufficient to defray publication costs (r.3). Consult the registry to determine the current estimate of publication costs for Government Gazette and newspaper notices. Also be ready to pay the filing fee specified in Schedule 2 (for filing petition $1.00 as listed) and any subsequent interlocutory fees.

3. Lodge with the Central Office: a copy of the petition, the form of notice for publication and the required deposit(s) (r.3). The Court officer then must publish the petition forthwith in the Government Gazette and arrange newspaper publication (r.4). Keep receipts and confirm publication timing.

4. Serve the sealed copy on the returned candidate within 14 days of filing unless you apply for and obtain an extension from a Judge (r.5). If the returned candidate was returned as elected, service can be personal or by prepaid registered post to the address stated on the nomination paper (r.5). Obtain proof of service in the permitted form.

5. Prepare lists required by r.7. If your petition claims the seat for a person not returned or alleges votes by unqualified persons, prepare the lists of ballot papers or names and set out the grounds for each contest. These lists must be delivered to the Court and the respondent within seven days after service, or seek a prompt extension from a Judge to avoid exclusion (r.7(b)-(c)). Ensure lists are precise, with clear grounds for each ballot or voter challenged.

6. Anticipate interlocutory applications. Be ready to seek particulars, amendments or extensions early through chambers applications, which are within the Judge’s power to grant or deny (r.7(a); r.9). File interlocutory applications via the Central Office and pay the applicable interlocutory fee (Schedule 2).

For respondents: service, addresses and counter‑charges

1. If returned as a member, consider lodging an address for service at the Central Office and appoint a legal practitioner to act as solicitor in respect of any petition (r.6; Schedule 1 Address for Service form). Lodging an address for service allows service by leaving a sealed copy with some person at that address (r.6). This can reduce postal risk and create procedural certainty.

2. If served, lodge a timely response and, if intended, prepare counter‑charges. If you intend to set up that the person for whom the seat is claimed was not duly elected on different grounds, deliver to the Court and petitioner a statement of those grounds within seven days after service or apply for further time from the Judge (r.8). This statement must present facts with the same particularity as a petition.

3. If you do not intend to oppose the petition, serve written notice on the Court at the Central Office and on the petitioner or their solicitor (r.10). The Court may then make orders in the terms of the prayer on ex parte application by the petitioner; consider cost implications because you will not usually be liable for costs incurred after such notice unless the Court orders otherwise (r.10).

General case management and trial steps

1. Trial scheduling. Apply to a Judge to fix the time and place of trial if not scheduled by the Court; normally give 10 days’ notice or the notice period the Judge directs, and be prepared for the trial to be advertised in a newspaper circulating generally in the State or the relevant district unless the Judge orders otherwise (r.11).

2. Prepare witness summonses and attendance. Use the Schedule 1 summons form for witnesses and ensure payment of any fees per Schedule 2 where required. Ensure witnesses are notified of dates and documents they must bring (Schedule 1 Summons form).

3. Withdrawal and substitution. If the petitioner wishes to withdraw, give 10 days’ notice of the intention to apply for leave to withdraw to the respondent and advertise the intention in an appropriate newspaper as required (r.12). At the hearing of an application for leave to withdraw, the Court may allow substitution by another competent person; be ready for that possibility.

4. Collusion and substitution risk. Be aware that the Court can substitute parties where collusion is suspected (r.14). If involved in politically sensitive settlements, consider the risk that the Court may direct substitution and hold the original party liable for costs.

5. Fees and copies. Use the Schedule 1 forms to avoid procedural rejection for improper format and pay the fees listed in Schedule 2 where applicable (r.15; Schedule 2). Check with the Registry about any application of Supreme Court Orders relating to fees that may affect actual payments (r.16).

Practical checklist for compliance

• Before filing: confirm the estimated publication cost with Court registry, prepare $100 security and publication funds, complete appropriate Schedule 1 forms.

• On filing day: lodge petition, notice for publication, deposit, and obtain a stamped sealed copy for service.

• Within 14 days: serve sealed copy on returned candidate, obtain proof of service, prepare and deliver requisite lists within seven days of service where relevant.

• Throughout: seek extensions or particulars early if necessary via chambers application; expect the Judge to exercise case management actively; keep careful records of publications and service steps.

Final note on discipline and contingency

• Given the Rules’ tight deadlines (7 and 14 day timelines) and the public nature of publication, plan for contingency: budget for costs, prepare lists concurrently with drafting the petition, and secure legal representation early. Where a party anticipates issues with particularisation or counter‑charges, make immediate interlocutory applications for extensions to avoid exclusionary consequences under r.7 and r.8.

Compliance with these Rules therefore requires synchronising litigation preparation with registry and publication logistics, preparing particularised lists promptly after service, and engaging the Court early for any necessary extensions or interlocutory relief.
