Terrorism (Police Powers) Act 2005

The Act is organised around a small set of recurring concepts that determine when and how enhanced police powers are available.

• Special powers authorisation (s 3; defined in s 2). This is the core trigger for enhanced powers. There are two subtypes:

  • Preventative authorisation (s 3(1)): issued when there are reasonable grounds to believe a terrorist act is imminent and the powers will substantially assist prevention.
  • Investigative authorisation (s 3(2)): issued when there are reasonable grounds to believe a terrorist act is being or has been committed and the powers will substantially assist investigation.

• Relevant authority and confirmation (s 3(3)-(6)). The relevant authority hierarchy is Commissioner, Deputy Commissioner, Assistant Commissioner, or senior officer above superintendent. The Act requires confirmation of grounds by both the Police Minister and a relevant judicial officer before issuing an authorisation (s 3(5)), but allows urgent oral authorisations without prior confirmation (s 3(4)-(6)). If issued urgently without confirmation, the authorisation must be submitted for confirmation as soon as possible and will cease to operate if confirmation is refused (s 3(6)(a)-(b)).

• Duration and scope (s 4-5). Authorisations commence on issue (s 4(1)), must specify cessation time and cannot exceed statutory maxima (s 4(3)-(4)). The authorisation must state whether it has been confirmed by the Police Minister and a relevant judicial officer and describe the general nature of the terrorist act and target(s) , areas, persons, vehicles (s 5(1)(c),(f),(g)). An area targeted must be no larger than reasonably necessary (s 5(3)).

• Target of an authorisation (s 5(2)). The Act operates by reference to a target , person, vehicle or area , and many powers hinge on reasonable suspicion that the person, vehicle or area is the target (ss 8-11).

• Powers arising from authorisation (Division 2). These are practical operational powers: require identity (s 8); stop and search persons (s 9) subject to Schedule 1 search conduct rules; search vehicles (s 10); search premises (s 11); cordon and control access to target areas (s 12). Special area declarations extend stop-and-search powers to passengers and their baggage at specified public transport sites or special events (ss 13-14).

• Incidental and force powers (ss 15-16). Seizure and detention of things suspected to be evidence of a terrorist act or certain serious indictable offences is permitted (s 15). Use of "such force as is reasonably necessary" to exercise the powers (including breaking in) is expressly authorised (s 16).

• Constraints and conduct rules (s 17; Schedule 1). The Act requires powers be exercised with care to avoid unnecessary harm, humiliation, cultural or religious offence, or damage to property (s 17). Schedule 1 imposes detailed rules on searches, including limits on strip searches, gender of searcher, privacy, videotaping, and medical practitioner involvement.

• Non-justiciability and evidentiary presumptions (ss 24-27; s 26(1)). The Act curtails judicial review of authorisations and declarations (s 26(1)), provides police protection against liability for irregularities or lack of power of the issuer (s 24), and creates certificates of the Commissioner as prima facie evidence of authorisations or appointments (s 27).

• Terrorist act declaration and use of force (Part 2A). A separate immediate-declaration power (s 27A) applies to incidents where coordinated police action is required; it conveys statutory criminal-law protection for reasonable use of force by officers as they subjectively perceive the circumstances (s 27B). Part 2A also restricts disclosure or publication of the identity of police involved in such actions (s 27C).

• Reporting, review and expiry (ss 28-31). The Commissioner must report to ministers after an authorisation ceases (s 28). The Attorney‑General must lay the report before Parliament within a specified period (s 28(3)), subject to redaction for privilege or public interest immunity (s 28(4)). The Minister must cause periodic reviews (s 30) and the Act is subject to a statutory expiry (s 31).

These concepts interlock: the nature of the authorisation determines which powers are available, for how long (s 4), and against whom (targets under s 5). Procedural safeguards (confirmation, reporting and Schedule 1) sit alongside provisions that limit external legal challenge (s 26) and give operational protection to police (ss 24, 27B). The definition of "terrorist act" is linked to the Commonwealth Criminal Code (s 2(1)), meaning Commonwealth terminology supplies the substantive threshold for the Act's exceptional powers, except for threats which are excluded by s 2(1).

The Act creates distinct classes of affected persons and entities and allocates rights, duties and burdens across them.

• Police and designated law enforcement. The primary decision‑makers are the Commissioner of Police and, in specified contingencies, the Deputy Commissioner, Assistant Commissioners and senior officers above superintendent (s 3(3)). The Commissioner may appoint members of the Australian Federal Police or interstate/territory police as "recognised law enforcement officers" for up to 14 days; they have the powers and immunities of a constable and remain subject to their parent force (s 20(1)-(6)). Police officers exercising powers must comply with identification and explanation duties (s 21) and the conduct rules in Schedule 1 when searching persons.

• Targets of authorisations. Those who are named or described in an authorisation (persons, vehicles or areas) are directly affected because many powers depend on a reasonable suspicion that a person or vehicle is the "target of an authorisation" or is in or near a target area (see ss 8-11). The Act authorises stops, searches and detentions of persons and vehicles, and entry to premises in target areas (ss 9-11).

• Persons in special areas or at special events. When the Commissioner declares a "special area" (for instance an airport, transport terminal or site of a special event) under s 13, all persons in that area are affected by extended baggage search powers (s 14). Event organisers, transport operators and proprietors of public spaces designated as special areas will face an increased risk of search activity and potential operational disruption.

• General public and businesses. The Act empowers cordons and movement restrictions in target areas (s 12). Substantial sections of the public attending public events, using transport hubs, or in cordoned areas may be required to leave, be prevented from entering, or have vehicles withheld from movement. Businesses located in target areas may experience interruption and will be identified in the Commissioner’s report obligations (s 28(1)(e)).

• Persons giving evidence or publishing information about police action. Part 2A limits the disclosure of identities of "relevant police officers" involved in declared terrorist acts; courts must exclude the public while such evidence is given and publication without consent is an offence, with penalties up to $10,000 for individuals and $120,000 for bodies corporate (s 27C(1), (4)). The Supreme Court may grant publication orders in exceptional circumstances (s 27C(5)-(9)).

• Owners of seized property. Property seized under s 15 may be returned under s 22, or dealt with by the court under s 23 , including forfeiture to the State if lawful owners cannot be ascertained (s 23(2)-(3)). Property owners and those asserting ownership will be the parties in s 23 proceedings.

• Judiciary and ministers with oversight roles. The Act requires confirmation by a "relevant judicial officer" (a Judge of the Supreme or District Court) and the Police Minister for the issuing of authorisations and special area declarations (s 3(5); s 13(3)). The Attorney‑General must lay after-action reports before Parliament (s 28(3)). These roles allocate oversight responsibilities to the executive and to the judiciary, although s 26(1) removes the ordinary avenues of judicial review for authorisations and declarations.

• Persons subject to criminal offence provisions. The Act makes it an offence, without reasonable excuse, to fail to comply with a requirement under the Act, to give false identity particulars, to enter or interfere with cordoned areas, or to obstruct police (s 18). Penalties are stated at maximums of $10,000 or two years imprisonment for natural persons (s 18).

In short, the Act primarily affects police operational decision‑makers and persons present in identified target areas or otherwise subject to reasonable suspicion tied to an authorisation. It imposes compliance obligations on the public (identity disclosure, submission to searches and cordon instructions) and creates reporting and evidentiary duties for police. Corporations are jointly affected by publication penalties under s 27C and potential seizures and disposals under s 23.

The Act sets out explicit duties for police, statutory limits and procedural obligations, and compliance duties for members of the public; rights are primarily statutory and procedural rather than cast as constitutional rights.

Key police duties:

• Eligibility and confirmation duty before issuing authorisations. A "relevant authority" must obtain confirmation from both the Police Minister and a relevant judicial officer that there are proper grounds for issuing an authorisation, except where urgency justifies immediate issue (s 3(5)-(6)). When issued orally in urgent circumstances the authorisation must be confirmed in writing as soon as practicable (s 3(4)).

• Content obligations for authorisations and declarations. An authorisation must state key particulars: type (preventative or investigative), whether it has been confirmed by Minister and judicial officer, issue and cessation times, description of the terrorist act, and name/describe target(s) (s 5(1)). A special area declaration must state it is issued under the Act, describe the site, define boundaries and give commencement and cessation times (s 13(2)).

• Identification and explanation duties to persons subject to powers. Police officers must, before or at the time of exercising a power or as soon as reasonably practicable thereafter, produce identification if asked or state rank, name and number; and if requested, inform the person that the power is exercised under a special powers authorisation or special area declaration (s 21(1)). The Commissioner must arrange for a written statement, on written request within 12 months, that a search was conducted under the Act (s 21(2)).

• Reporting and parliamentary duty. The Commissioner must report to the Attorney‑General and Police Minister as soon as practicable after an authorisation ceases (s 28(1)). The Attorney‑General must lay that report before both Houses within 14 sitting days or 3 months, whichever is shorter (s 28(3)), subject to redaction for privilege or public interest immunity (s 28(4)).

• Search conduct obligations. Police conducting personal searches must comply, as far as reasonably practicable, with the rules in Schedule 1: seek cooperation, explain reasons, minimise intrusion, perform searches quickly, use same‑gender searchers (subject to medical practitioner exception), videotape strip searches, and other constraints (Sch 1, cl 3).

Key duties and compliance obligations for the public:

• Identity disclosure. A person must disclose identity when required by police under s 8. A person can be required to provide proof of identity under s 8(2). Failure to comply without reasonable excuse is an offence (s 18(1)).

• Submission to searches and detentions. A police officer may stop and search persons, vehicles and premises in target areas or those suspected to be targets (ss 9-11). Persons may be detained for as long as reasonably necessary to conduct those searches (ss 9(4), 10(2)-(3), 11(3)). Non-compliance or obstruction is an offence (s 18(4)).

• Restrictions on entering or interfering with cordoned areas. Once cordoned, officers may require persons not to enter, to leave, or to remain outside, and may control vehicle movement (s 12(3)(a)-(b)). Entering, damaging or tampering with a cordoned area without reasonable excuse is an offence (s 18(3)).

Rights and protections:

• Procedural constraints and search standards. The Act imposes conduct constraints to reduce unnecessary harm, humiliation and cultural offence (s 17). Schedule 1 gives detailed procedural safeguards for searches, with special rules for strip searches and searching minors or those with disability (Sch 1 cl 3(2), (4)).

• Right to obtain written confirmation that a search was conducted under this Act (s 21(2)). This facilitates later accountability and potential legal redress.

• Return and judicial disposition of property. Seized property must be returned as soon as reasonably practicable if retention as evidence is not required and possession is lawful (s 22). Courts can order delivery or other disposition (s 23).

• Limited oversight avenues. Although ordinary challenges to authorisations and special area declarations are barred (s 26(1)), internal police complaints mechanisms remain available for questioning authorisations or declarations under the Police (Complaints and Disciplinary Proceedings) Act 1985 (s 26(2)). Reports to the Attorney‑General and Parliamentary laying provide an executive and parliamentary oversight pathway (s 28).

• Criminal-law protection for police use of force in declared terrorist acts. Part 2A grants that a police officer "does not incur any criminal liability" for authorising or using force that is reasonably necessary as the officer perceives the circumstances to defend persons or prevent unlawful deprivation of liberty (s 27B(1)). That protection does not apply to conduct contrary to an order or not in good faith (s 27B(2)). The protection continues, in specified ways, after revocation or even where a declaration is later found invalid until the officer should reasonably have been aware (s 27B(3)-(4)).

Limitations and explicit non‑limitations:

• The Act expressly preserves other statutory and common law powers; it does not limit other Acts nor are its powers limited by other Acts (s 25(1)-(2)). It also bars judicial review of authorisations and declarations (s 26(1)), which is an important constraint on legal remedies.

Together these duties and rights map the operational responsibilities of police, the compliance obligations of the public, and the statutory checks (Ministerial/judicial confirmation, reporting, search conduct rules) that the Act requires as conditions or limits on the special powers.

The Act provides a combination of criminal offences, administrative processes and evidentiary mechanisms to enforce compliance and to protect police action taken under the Act.

Criminal offences and penalties:

• Refusal or failure to comply. It is an offence to, without reasonable excuse, fail or refuse to comply with a requirement made by a police officer under this Act (s 18(1)). Maximum penalty: $10,000 or imprisonment for two years.

• False identity particulars. On a requirement to disclose identity, it is an offence to give a materially false name or other than full and correct address without reasonable excuse (s 18(2)). Maximum penalty: $10,000 or imprisonment for two years.

• Interference with cordoned areas. Entering a cordoned area without authorisation, damaging or removing property in a cordoned area, or tampering with a cordon without reasonable excuse are offences (s 18(3)). Maximum penalty: $10,000 or imprisonment for two years.

• Obstruction or hindrance. Obstructing or hindering a police officer in the exercise of a power under this Act is an offence (s 18(4)). Maximum penalty: $10,000 or imprisonment for two years.

• Publication restrictions. Part 2A restricts publishing material that reveals or reasonably infers the identity of a "relevant police officer" involved in a declared terrorist act. The maximum penalty under s 27C(4) is $10,000 for natural persons and $120,000 for bodies corporate.

Enforcement mechanisms and operational powers:

• Seizure and detention of things. Under s 15 a police officer may seize and detain things (including vehicles) found during searches where the officer suspects on reasonable grounds they may provide evidence of a terrorist act or certain serious indictable offences (punishable by life or 5+ years). The power includes removal and guarding of the thing (s 15(2)(a)-(b)).

• Detention for search. The Act permits detention of persons as reasonably necessary to conduct searches of persons, vehicles or premises (ss 9(4), 10(2)-(3), 11(3)). The Act does not set a fixed maximum detention time but subjects detention to "reasonably necessary" for the search.

• Use of force. Police may use such force as is reasonably necessary to exercise the Act’s powers, including breaking in to premises or vehicles (s 16). Part 2A goes further to remove criminal liability for police who authorise or use force reasonably necessary as perceived by the officer when dealing with incidents under a terrorist act declaration (s 27B(1)).

• Court disposal and forfeiture. Courts can make orders for the return or other disposition of seized property on application (s 23). The court may forfeit property to the State if the lawful owner cannot be ascertained (s 23(2)(d)). For money forfeited, the Treasurer is to pay it into the Consolidated Account (s 23(3)(a)); other property may be auctioned with proceeds paid to the Consolidated Account (s 23(3)(b)).

Administrative and evidentiary provisions:

• Non‑justiciability of authorisations and declarations. Section 26(1) bars the challenge, review or quashing of a special powers authorisation or special area declaration "on any grounds whatsoever" before any court, tribunal, body or person, or by prohibition or mandamus. This is a strong statutory limitation of judicial supervision.

• Police protection for irregularities. Section 24 protects police from conviction or liability merely because there was an irregularity in issuing an authorisation or because the issuer lacked power. It is framed as protection against conviction or being "held liable merely because" of irregularity or lack of power. The precise scope of that protection will be defined by the courts where litigation occurs, but the text gives operational protection from liability attached to procedural defects in authorisation making.

• Evidentiary certificate. An apparently genuine Commissioner’s certificate purporting to certify that an authorisation or declaration was issued and in operation between specified times is proof, in the absence of proof to the contrary, of the matters stated (s 27). That mechanism assists prosecutors and police in proof of the existence and terms of authorisations.

• Reporting and parliamentary oversight. The Commissioner must report to the Attorney‑General and Police Minister after an authorisation ceases (s 28(1)). The Attorney‑General must lay a copy before Parliament, subject to redaction for privilege or public interest immunity (s 28(3)-(4)). This creates an administrative record that can feed parliamentary scrutiny.

Relation to other enforcement frameworks:

• The Act expressly states it does not limit powers under other Acts or at common law, and that nothing in other Acts limits powers under this Act (s 25(1)-(2)). That makes this Act part of a cumulative set of enforcement authorities available to police.

• Records and videotapes. Section 9(3) and Schedule 1 require searches and strip searches to be videotaped where reasonably practicable; s 9(3) engages s 81 of the Summary Offences Act 1953 and the regulations under that section, treating the videotape recording as if made under that section, which could have evidentiary and privacy law implications.

In practice enforcement is a mixture of criminal sanctions for non-compliance by the public, administrative seizure and forfeiture procedures, operational immunities and evidentiary devices favouring police, and reporting duties intended to produce accountability. The statutory bar on judicial challenges to authorisations and declarations (s 26(1)) and the protections for police acting during authorisation or declarations (ss 24; 27B(1)) are central features affecting enforcement risk and post‑action review.

The Act contains explicit cross‑references and non‑limitation clauses establishing how it sits within the broader legal landscape.

Definitional cross‑reference:

• Terrorist act. The Act adopts the meaning of "terrorist act" from Part 5.3 of the Commonwealth Criminal Code, except that it excludes terrorist acts consisting of threats (s 2(1)). This links the Act’s operational threshold to Commonwealth criminal law, aligning the test for whether an authorisation is available with the federal statutory scheme.

Non‑limitation clauses:

• Nothing in any other Act limits the powers under this Act and nothing in this Act limits powers under other Acts or at common law (s 25(1)-(2)). That creates an additive relationship: police retain their ordinary powers at common law and under statute, and may also use powers under this Act. It also means that police should consider obligations under other Acts (for example, the Police Act, occupational health and safety rules, privacy laws) remain relevant unless expressly displaced elsewhere.

Procedural and evidentiary linkages:

• Videotape recordings made under the Schedule 1 strip-search rules are to be treated as if made under s 81 of the Summary Offences Act 1953 and the regulations made under that section (s 9(3)). This imports evidentiary or procedural consequences from the Summary Offences Act for recordings made during searches under this Act.

• Certificates of the Commissioner as evidence (s 27) operate within legal proceedings to establish the terms and operation periods of authorisations or appointments of recognised law enforcement officers. That evidentiary provision will interact with rules of evidence in court.

Limits on judicial review and interaction with complaints processes:

• Section 26(1) bars challenge, review, quashing or questioning of an authorisation or declaration "on any grounds whatsoever" before any court, tribunal or body, and precludes remedies in the nature of prohibition or mandamus. That statutory bar constrains judicial review avenues ordinarily available under administrative law. However, s 26(2) preserves the possibility of calling authorisations or declarations into question under the Police (Complaints and Disciplinary Proceedings) Act 1985, indicating an internal disciplinary or complaints avenue remains available.

Interaction with Commonwealth and interstate agencies:

• The Commissioner may appoint AFP members or interstate police as "recognised law enforcement officers" (s 20). Those appointees have the powers and immunities of a constable under the Police Act 1998 and remain subject to the control of their parent force (s 20(1), (5)-(6)). This provision enables interstate and federal operatives to assist under the Act without extinguishing their supervisory ties, and aligns the Act with interjurisdictional operational practices.

Publication and court secrecy provisions:

• Part 2A’s publication restrictions (s 27C(4)-(11)) state they operate "despite any other Act or law" (s 27C(11)), which means these restrictions over-ride conflicting statutory provisions. The Supreme Court retains power to vary or remove restrictions by publication order in the public interest or to aid an investigation (s 27C(5)-(6)); that form of judicial intervention interacts directly with judicial case management and national security concerns.

Interaction with parliamentary oversight and privilege:

• The Act requires the Attorney‑General to lay the Commissioner’s report before both Houses (s 28(3)). The Attorney‑General may edit the report to exclude material subject to privilege or public interest immunity (s 28(4)), linking the Act to established doctrines of executive privilege and parliamentary processes.

Regulatory and subordinate law links:

• The Governor may make regulations necessary or expedient for the Act (s 29); Schedule 1 also contemplates regulations (Sch 1 cl 4). The regulatory framework will determine procedural details, forms and the specific process for seeking judicial confirmation (s 19).

Taken together, the Act deliberately interfaces with Commonwealth definitions (terrorist act), the Summary Offences Act (videotaping), the Police Act (constable powers and immunities), disciplinary regimes (Police Complaints Act), and parliamentary privileges (s 28(4)). It also expressly preserves other statutory and common law powers (s 25). Notably, the statutory bar on judicial challenge (s 26(1)) creates a tension with administrative law oversight, while Part 2A’s "despite any other Act or law" publication restriction (s 27C(11)) similarly asserts a priority over other statutory rules concerning disclosure.

The legislative history included in the text records the Act’s principal amendments and their effect on particular provisions.

Principal enactment:

• Terrorism (Police Powers) Act 2005, No 70 of 2005 , assented and commenced 8 December 2005 (Legislative history).

Amendments recorded in the provided legislative history and how they changed the Act:

• 2015 , Statutes Amendment (Terrorism) Act 2015, No 33 of 2015 (assent 5 November 2015; Pt 2 (ss 3 & 4) commenced 5 November 2015). This amendment modified s 30: s 30(1) was amended by s 3(1) of the 2015 Act, and a new subsection s 30(1a) was inserted by s 3(2) of the 2015 Act (entry in the Legislative history). S 31 was also amended by s 4 of the 2015 Act (Legislative history: "s 31 amended by 33/2015 s 4 5.11.2015"). The legislative history also notes that material was amended under the Legislation Revision and Publication Act 2002 (Long title amended).

• 2018 , Terrorism (Police Powers) (Use of Force) Amendment Act 2018, No 22 of 2018 (assent and commencement 1 November 2018). This amendment inserted the Deputy Commissioner of Police into s 2(1) (definition) (22/2018 s 3(1)) and inserted the definition "terrorist act declaration" and Part 2A (22/2018 s 3(2); Pt 2A inserted by 22/2018 s 4). The Legislative history entries indicate Pt 2A and related provisions were added on 1 November 2018.

• 2025 , Statutes Amendment (Attorney-General's Portfolio) Act 2025, No 55 of 2025 (assent 20 November 2025; Pt 8 (s 10) commenced 20 November 2025: s 2). The legislative history lists the 2025 amendment and cites "amended by 55/2025 s 10 20.11.2025." The summary under "Provisions amended" lists various provision entries as "amended by 55/2025 s 10 20.11.2025: s 2",the exact textual changes are not set out in full in the extract provided, but the legislative history notes the amendment's commencement.

Other editorial and statutory revision notes:

• The "Principal Act and amendments" table lists the entry years and titles of the amending Acts (2005, 2015, 2018, 2025). The "Provisions amended" list notes that certain entries were inserted, and that Schedule 2 was omitted under the Legislation Revision and Publication Act 2002 on 5 November 2015.

• The schedule at the end records historical versions available at 5 November 2015 and 1 November 2018, consistent with the amendment dates.

Practical consequences of amendments as reflected in the text:

• The 2018 amendments are substantively consequential: they added Part 2A, which supplies the terrorist act declaration regime and the statutory protection for use of force under s 27B, and inserted the Deputy Commissioner into the chain of authority (s 2(1) and s 3(3)). Those insertions changed the operational framework for urgent incidents and added new protections and publication controls in s 27C.

• The 2015 amendments revised the review timetable and the expiry arrangements (s 30 and s 31 were amended by the 2015 Act), altering the statutory review architecture and expiry sequencing.

• The 2025 amendment is recorded but the extract does not detail the precise substantive textual changes other than the notation under "Provisions amended" listing "amended by 55/2025 s 10 20.11.2025", and that the Act was updated accordingly.

The Act as presented therefore reflects multiple legislative adjustments since 2005, with the most significant substantive change being the introduction of Part 2A in 2018, which added the terrorist act declaration power and use‑of‑force protection. The review and expiry framework was modified in 2015. The 2025 amendment is recorded but not fleshed out in the text excerpt beyond its citation.

The provided statutory text and legislative history contain no reported cases, judicial decisions, or litigation extracts. The Act itself contains several provisions that affect the scope for litigation:

• Statutory bar on challenge. Section 26(1) provides that a special powers authorisation or special area declaration "may not be challenged, reviewed, quashed or called into question on any grounds whatsoever" before any court, tribunal, body or person, nor restrained, removed or otherwise affected by proceedings in the nature of prohibition or mandamus. That clause is an express statutory removal of ordinary avenues of judicial review with respect to the validity or existence of authorisations and declarations.

• Complaints and disciplinary pathway preserved. Section 26(2) expressly preserves the possibility that an authorisation or a declaration may be called into question in proceedings under the Police (Complaints and Disciplinary Proceedings) Act 1985. That provides an administrative/disciplinary route for review, rather than a judicial one, although the content and practical efficacy of that route is a matter of administrative and disciplinary law practice rather than the Act’s text.

• Police protection from liability. Section 24 states that if proceedings are brought against a police officer for anything done under the Act, the police officer is not to be convicted or held liable merely because of an irregularity or defect in issuing an authorisation or because the issuer lacked the power. This provision is likely to be engaged in any proceedings that contest the validity of an authorisation, even though s 26(1) seeks to limit challenge.

Because the text contains no judicial decisions, there is no local litigation history recorded in the source to cite, and it would be improper to invent or attribute judicial treatment of these provisions. Practitioners should note the statutory scheme substantially limits opportunities for judicial review of authorisations and declarations (s 26(1)), while preserving disciplinary mechanisms (s 26(2)) and mandating reporting and parliamentary laying (s 28), which are the primary non-judicial accountability mechanisms contained in the Act.

The Act contains a number of features that produce operational or legal traps for both police and the public; these are practical points drawn directly from the text.

1. Urgent oral authorisations and conditional continuation (s 3(4)-(6)). A relevant authority may issue an authorisation orally in urgent circumstances, but must confirm it in writing as soon as practicable (s 3(4)). Crucially, if issued without prior confirmation the authority must seek confirmation from the Police Minister and a relevant judicial officer "as soon as possible", and the authorisation ceases to operate if the Police Minister or relevant judicial officer refuses to confirm it (s 3(6)(a)-(b)). Practitioners should note the operational benefit of rapid authorisation is counterbalanced by the risk that later non‑confirmation will retrospectively end the authorisation’s operation.

2. No requirement for police to carry a copy of authorisation (s 7(2)). Police officers may exercise powers conferred by the Division without being in possession of a copy of the authorisation and without any other warrant (s 7(2)). This increases the possibility of confrontation on the ground where a member of the public requests to see a copy while the officer can lawfully continue to act notwithstanding absence of a physical document.

3. Non‑reviewability of authorisations and declarations (s 26(1)). The express statutory bar on challenging authorisations and special area declarations "on any grounds whatsoever" removes ordinary judicial review and prerogative relief in relation to the validity or existence of authorisations. Lawyers should note this is a statutory exclusion of judicial oversight; the only specified route to call an authorisation into question is under the Police (Complaints and Disciplinary Proceedings) Act 1985 (s 26(2)).

4. Police protection despite irregularities (s 24). Section 24 protects police from conviction or being "held liable merely because" of irregularities or defects in the issuing of an authorisation or because the issuer lacked power. That phrasing can limit remedies in civil or criminal proceedings but does not necessarily remove all civil redress; the precise scope will depend on judicial interpretation if litigation occurs.

5. Broad definition tied to Commonwealth Criminal Code (s 2(1)). The Act’s trigger depends on the Commonwealth Criminal Code definition of "terrorist act" (Part 5.3), excluding mere threats. Practitioners must therefore cross-check federal definitions and elements when advising on availability of an authorisation.

6. Subjective standard for use of force in Part 2A (s 27B(1)). The protection from criminal liability for the use of force in relation to a terrorist act declaration is framed subjectively , force that is "reasonably necessary, in the circumstances as the police officer perceives them" (s 27B(1)). That wording privileges the officer’s perceived circumstances in assessing criminal liability, with exceptions for contravention of orders or lack of good faith (s 27B(2)). The protection continues in specified ways after revocation and even where the declaration is later found invalid until an officer should reasonably have been aware (s 27B(3)-(4)).

7. Publication restrictions and severe corporate penalties (s 27C). Part 2A forbids publication revealing the identity of relevant police officers without consent, with a maximum penalty of $10,000 for individuals and $120,000 for corporations (s 27C(4)). The Supreme Court can issue publication orders in limited circumstances (s 27C(5)). Media and lawyers must consider these limits when handling evidence identifying officers involved in declared incidents.

8. Videotaping obligations for strip searches (Sch 1 cl 3(2)(e)). Strip searches must be videotaped unless not reasonably practicable. Section 9(3) imports s 81 of the Summary Offences Act 1953 for videotapes "as if the recording had been made under that section", which may implicate further procedural requirements or restrictions.

9. No statutory compensation or redress process stated. The text requires return of seized items when retention is unnecessary (s 22) and provides for court orders and forfeiture (s 23), but does not set out an express compensation mechanism for harms, inconvenience or business interruption arising from searches or cordons. The Commissioner must report on inconveniences and adverse impacts (s 28(1)(e)), but the Act does not articulate a compensation procedure.

10. Interplay of reporting and privilege (s 28(4)). The Attorney‑General may edit a report before tabling it to exclude material subject to privilege or public interest immunity. This allows the executive to redact material before parliamentary scrutiny and may limit public visibility on operational details.

11. Potential mismatch between detention period and statutory maxima. The Act permits detention "for as long as is reasonably necessary" to conduct searches (ss 9(4), 10(2)-(3), 11(3)) but does not set bright-line time limits for detention tied to authorisation durations. Operationally, this raises questions about the maximum lawful detention period in practice.

These "gotchas" arise directly from the text and will affect operational decision‑making, public compliance, media coverage, and post‑action accountability. Advisers should pay attention to the subjective standards in Part 2A, the statutory bars on judicial review, and the procedural duties and evidentiary certificates that shape how these powers will be audited and litigated if contested.

This section sets out practical compliance steps for three audiences: police/operational command, event/venue operators and businesses in public areas, and members of the public who may be subject to powers under the Act. All steps are grounded in the statutory text.

For police and operational command:

1. Authorisation process checklist:

   • Ensure the relevant authority (Commissioner, Deputy Commissioner, Assistant Commissioner or senior officer per s 3(3)) is properly identified and that the factual basis meets the statutory standard: reasonable grounds that a terrorist act is imminent (preventative s 3(1)) or is being/has been committed (investigative s 3(2)).
   • Where practicable, obtain confirmation from both the Police Minister and a relevant judicial officer before issuing an authorisation (s 3(5)). If urgency requires an oral issue, record the oral authorisation contemporaneously and secure written confirmation as soon as practicable (s 3(4), (6)(a)).
   • Draft authorisations to comply with s 5: state Act clause, type (preventative/investigative), whether confirmed, date/time issued and date/time of cessation, general description of the terrorist act, and name/describe target(s) with maps or visual depictions if appropriate (s 5(1)(a)-(g)).

2. Time limits and extensions:

   • Track authorisation expiry strictly: preventative authorisations max 7 days (extensions up to a total of 14 days) and investigative authorisations max 24 hours (extensions up to a total of 48 hours) (s 4(3)-(4)). If issuing a series of authorisations, ensure cumulative duration does not exceed statutory maximums.

3. Operational execution:

   • Ensure officers exercising powers can fulfil identification and explanation duties: produce ID or state surname, rank and identification number if requested and inform persons the power is under a special powers authorisation or special area declaration (s 21(1)(a)-(b)).
   • Comply with Schedule 1 standards for searches: seek cooperation, explain reasons, minimise intrusion, conduct searches quickly, use same-gender searchers, offer replacements when necessary, and videotape strip searches when reasonably practicable (Sch 1 cl 3(1)-(2)).
   • Use seizure powers only when the item is suspected on reasonable grounds to be evidence of a terrorist act or serious indictable offence (s 15(1)). Maintain chain-of-custody and record seizure details for future s 22 return or s 23 court applications.

4. Reporting and records:

   • Prepare the Commissioner’s report under s 28 promptly after authorisation ceases, covering terms of authorisation, matters relied on, powers exercised, results, and description of inconvenience or adverse impact (s 28(1)).
   • Preserve videotapes and contemporaneous records in compliance with s 9(3) and the Summary Offences Act 1953 reference.

5. Special incidents (Part 2A):

   • Where making a terrorist act declaration under s 27A, notify the police officer in charge of responding officers (s 27A(3)) and the Police Minister as soon as practicable (s 27A(4)).
   • Ensure clear command and control: s 27B(2)(a) excludes protection for actions contravening an order of the police officer in charge; therefore, orders must be clearly recorded and communicated.

For event, venue and transport operators and businesses in public areas:

1. Identify whether your site could be declared a special area. The Commissioner may declare airports, transport terminals, special event sites or public areas where crowds gather to be special areas for terrorism risk reasons (s 13(1)). The declaration must define boundaries and be notified in the Gazette (s 13(2), (6)).

2. Operational preparedness:

   • Establish procedures to respond to cordons and requests by police to prevent or control entry/exit and vehicle movement in target areas (s 12(1)-(3)).
   • Train staff on cooperating with police and on steps to protect patrons’ privacy and dignity during searches consistent with Schedule 1, including ensuring private spaces and offering replacements for clothing if needed (Sch 1 cl 3(1)(f)-(g)).

3. Documentation and assistance:

   • Keep accurate records of any interaction with police, including times, officer identification details (s 21(1)), and any property seized. This will assist with s 23 applications for return or disposition of property.
   • Anticipate business disruption and document impacts since the Commissioner must describe adverse impacts in the post‑authorisation report (s 28(1)(e)).

For members of the public:

1. Be aware of obligations and consequences:

   • If a police officer reasonably suspects you are the target of an authorisation, or in suspicious company with a target, you may be required to disclose your identity and to produce proof (s 8(1)-(2)). Failure to comply without reasonable excuse risks prosecution (s 18(1)-(2)).

2. Search and detention expectations:

   • A police officer may stop and search you and your possessions on reasonable suspicion you are a target or associated with a target, or if you are entering, in, or recently left a target area (s 9(1)). Detention is permitted for as long as reasonably necessary to conduct the search (s 9(4)). If a strip search is to be conducted, Schedule 1 requires specific conditions including same‑gender searcher (Sch 1 cl 3(2)(e)-(d)) and videotaping where reasonably practicable (Sch 1 cl 3(2)(e)). You may request to see officer identification (s 21(1)(a)).

3. Avoid obstruction and respect cordons:

   • Do not enter cordoned areas without authorisation or interfere with cordons or items in them (s 12(1)-(3); s 18(3)). Obstructing or hindering police is an offence (s 18(4)).

4. Record and seek confirmation:

   • If searched, consider requesting a written statement later confirming the search was conducted under this Act; the Commissioner must ensure the written statement is available on request within 12 months (s 21(2)). This assists with any later complaints or legal inquiries.

For legal advisers and compliance officers:

1. Prepare for limited judicial review. Note s 26(1)’s bar on judicial challenge to authorisations and declarations; advise clients that administrative remedies are constrained and that Police (Complaints and Disciplinary Proceedings) Act 1985 proceedings remain an internal avenue (s 26(2)).

2. Consider evidentiary and discovery implications. Preserve video recordings and seizure records, as s 9(3) and Sch 1 affect evidentiary treatment and s 27 allows a Commissioner’s certificate to operate as prima facie proof of an authorisation’s terms.

3. Media and publication counsel. If handling material that might identify relevant police officers involved in a declared terrorist act, assess the risk under s 27C and consider applying to the Supreme Court for a publication order where the public interest or investigative assistance might justify disclosure (s 27C(5)).

Regulatory and training steps:

• Ensure internal policy documents and training modules reflect the authorisation thresholds, documentation requirements, identification duties (s 21), search conduct (Schedule 1), reporting timetables (s 28) and the limits on judicial review (s 26). Maintain a chain‑of‑custody protocol for seized items to support s 23 proceedings.

Following these steps will align operational practice with the Act’s express requirements and provide documentary evidence needed for post‑action accountability, administrative reporting and any subsequent legal or disciplinary review.
