TERRITORY PARKS AND WILDLIFE CONSERVATION REGULATIONS 2001

The Regulations rest on a small number of recurring legal concepts: prescribed classifications, protected wildlife, prescribed statutory approvals, exclusions from prohibited entrant status, permit decision criteria for joint management areas, authorised action against snakes, advance payments credited against royalties, and an infringement notice regime.

Prescribed classifications: regulation 2(1) sets the conservation classification system to the IUCN Red List Categories as approved by the IUCN Council from time to time. This imports an external, internationally maintained taxonomy into Territory administrative decision‑making. Regulation 2(2) defines the acronym IUCN.

Protected wildlife: regulation 3 declares that "all species of threatened wildlife, whether identified by classification or species, are protected wildlife" under the Act. That statement is categorical and operates as an interpretive rule for the Act’s protections.

Prescribed statutory approvals: regulation 3A prescribes a list of external authorisations that meet the Act’s section 45A cross‑reference. The list includes authorisations to use and develop land under specified Act provisions, development permits under the Planning Act 1999, clearing permits under the Pastoral Land Act 1992, environmental approvals and environmental (mining) licences under the Environment Protection Act 2019, and approved environment management plans under the Petroleum (Environment) Regulations 2016. These items function as substitutes or evidentiary triggers for regulatory permissions under the Act.

Animals not prohibited entrants: regulation 4 and Schedule 1 specify mammals, birds, and other animals that are not "prohibited entrants". The Schedule lists, by scientific and common names, animals ranging from Bali cattle and domestic cats to particular parrots and finches. Listing an animal as not a prohibited entrant changes the biosecurity or entry status of that species in the Territory’s regulatory scheme.

Joint management permit decision factors: regulation 4A instructs the Director, when deciding whether to grant or refuse a permit relating to a joint management park or reserve, to consider listed instruments and objectives including the relevant agreements, any joint management plan, the objective and principles of joint management in sections 25AB and 25AC of the Act, and, where there is no joint management plan, any agreement under section 25AK(3). The regulation prescribes the materials that structure administrative discretion.

Authority to kill snakes: regulation 5 authorises a person to kill or injure a snake that is protected wildlife in only two circumstances: where the snake is within 100 metres of an occupied building, or where the person honestly believes killing or injuring is necessary to avoid an immediate danger of death or injury to a person or a domestic animal. The regulation identifies the factual thresholds guarding what would otherwise be unlawful harm to protected wildlife.

Advance payments for royalties: regulation 6 allows permit holders to prepay amounts listed in Schedule 2 at the time a permit is granted or before wildlife is taken under the permit, and credits such amounts against royalties subsequently payable for wildlife actually taken. Schedule 2 is a detailed pricing schedule covering eggs, hatchlings, adults of crocodiles, plant seeds in kilograms or 100 seeds units, whole plants, didgeridoos, leaves, fruits and firewood. Column 3 in Schedule 2 sets the unit amount expressed mostly in "revenue units" or specific dollar amounts.

Infringement notices: Part 3 (regulations 7 to 11 and Schedule 3) creates the framework by which a conservation officer may serve an infringement notice when they reasonably believe an infringement offence has been committed (regulation 7). Regulation 8 prescribes the particulars and statements that must appear on the notice, including the identity of the enforcement agency as defined in the Fines and Penalties (Recovery) Act 2001, an explanation of expiation, and a prescribed 28‑day period for payment to avoid court action. Regulation 9 deals with cheque clearance. Regulation 10 allows the Director to withdraw an infringement notice within 28 days and before payment. Regulation 11 clarifies that serving an infringement notice does not prevent court proceedings unless the offence is expiated, allows multiple notices for the same offence, and confirms that the Part does not mandate serving a notice. Schedule 3 lists the Act provisions that are infringement offences and specifies the number of penalty units for each.

These concepts allocate roles and thresholds between agency decision‑makers (the Director and conservation officers), regulated parties (permit applicants, park users, owners of certain species), and enforcement/collection agencies under the Fines and Penalties (Recovery) Act 2001. The Regulations convert statutory references in the Act into actionable administrative rules, and they do so by importing external instruments and listing specific amounts and species.

The Regulations affect identifiable groups by changing compliance obligations, payment expectations, permitted conduct and enforcement exposure. Key affected parties are permit applicants and holders, land users within joint management parks or reserves, species owners and keepers, conservation officers and the Director, and persons who may commit the Act’s infringement offences.

Permit applicants and holders: regulation 4A requires the Director to consider specific documents and statutory objectives when deciding permit applications for joint management parks or reserves. Applicants must expect the Director to take into account the relevant agreements, any joint management plan, the Act’s joint management objective and principles, and, if no joint management plan exists, any agreement under section 25AK(3) (regulation 4A(a)-(e)). This imposes an evidentiary and planning requirement on applicants and may require applicants to supply, or be ready to align with, joint management instruments.

Persons taking wildlife: regulation 6 lets permit holders prepay specified amounts in Schedule 2 at or after permit grant, with payments credited against royalties payable for actually taken wildlife. Persons intending to harvest eggs, hatchlings, adult crocodiles, seeds, whole plants, firewood, fruits or cultural objects such as didgeridoos will be directly affected by the Schedule 2 pricing; those monetised units change the timing and size of cash flows and planning for extraction under permits.

Owners, keepers and importers of listed animals: Schedule 1 lists animals that are not prohibited entrants. That affects owners, breeders, importers, pet shops and private keepers of animals such as domestic fowl, cats, dogs, many parrots and finches, rabbits (domestic varieties) and laboratory strains of mice and rats. Listing reduces regulatory friction associated with entry status for those species under the Act and relevant by‑laws.

Residents and landholders near occupied buildings: regulation 5 authorises the killing or injuring of a protected snake in two situations. A person within 100 metres of an occupied building may kill or injure a protected snake (regulation 5(a)). Also, a person who honestly believes killing or injuring is necessary to avoid immediate danger to life or property is authorised (regulation 5(b)). This creates a clear rule for residents, occupiers and landholders about permissible defensive action against protected snakes.

Conservation officers and the Director: the Regulations grant operational roles. Conservation officers may serve infringement notices on persons they reasonably believe committed an infringement offence (regulation 7). The Director has power to withdraw an infringement notice within 28 days and before payment (regulation 10) and must consider certain materials when deciding permits for joint management areas (regulation 4A). These roles place operational discretion on agency staff, and those officers are the primary decision‑makers and enforcers under the Regulations.

Persons subject to fines and enforcement mechanisms: Schedule 3 maps specific Act sections to prescribed penalty units (for example section 49(2) and sections 67A-67B carry 10 penalty units each). Regulation 8 requires that an infringement notice must identify the enforcement agency as defined in the Fines and Penalties (Recovery) Act 2001 and must inform recipients of possible enforcement actions such as licence suspension, seizure of property, deductions from wages, registration of statutory charges and community work orders (regulation 8(2)(c)(i)-(vi)). That affects defendants and respondents by informing them of consequences beyond the immediate monetary penalty.

Other statutory actors and regulators: the Regulations reference other statutes and their permit or approval regimes, so decision‑makers and regulated parties in planning, pastoral, environmental protection, and petroleum domains will be affected when approvals under those statutes are used as prescribed approvals under regulation 3A. Those cross‑links mean that decisions under the Planning Act 1999, Pastoral Land Act 1992 and Environment Protection Act 2019 can operate as the relevant statutory approvals for certain activities under the Territory Parks and Wildlife Conservation Act.

In short, the Regulations allocate obligations and privileges across private parties, permit applicants and holders, agency officers and complementary statutory regulators. Who pays is principally permit holders and people who incur infringement notices. Who decides is principally the Director and conservation officers, subject to the Act and the procedural requirements in these Regulations.

The Regulations establish discrete duties for officials and rights or authorisations for regulated parties. They do so by naming required considerations, authorising specific conduct, prescribing payment mechanics and imposing information duties on enforcement notices.

Director’s duties and considerations: regulation 4A imposes a duty on the Director when deciding whether to grant or refuse a permit in relation to a joint management park or reserve to consider and take into account specified matters: the relevant agreements for the park or reserve, any joint management plan, the objective of joint management under s 25AB of the Act, the principles under s 25AC, and if there is no joint management plan, any agreement under s 25AK(3). The Director’s duty is one of consideration, not an absolute bar; the regulation prescribes the materials that must inform the exercise of discretion.

Conservation officer powers and duties: regulation 7 permits a conservation officer to serve an infringement notice where the officer reasonably believes an infringement offence has been committed. The officer must therefore form a reasonable belief as the factual basis for service. Regulation 8 sets information duties on the issuer of an infringement notice: the notice must state identity particulars if known, date, time and place of the offence, a description of the offence and the prescribed monetary amount, and the enforcement agency responsible for collection (regulation 8(1)(a)-(e)). The notice must also contain statutory statements about expiation and election to be dealt with by a court and must include the statement of election itself (regulation 8(2)-(3)).

Director’s withdrawal power: regulation 10 gives the Director an express right to withdraw an infringement notice by written notice served on the alleged offender, so long as the withdrawal occurs within 28 days after service of the infringement notice and before payment of the prescribed amount. That is a time‑limited executive corrective mechanism.

Rights to expiate or elect court proceedings: regulation 8(2)(a)-(b) creates the regulated person’s right to expiate the offence by paying the prescribed amount within 28 days, and the right to elect court prosecution by completing and serving a statement of election under section 21 of the Fines and Penalties (Recovery) Act 2001. Regulation 11(1) clarifies that the Part does not prevent court proceedings unless the offence is expiated.

Authorisation to kill protected snakes: regulation 5 creates a narrow right to kill or injure a snake that is otherwise protected wildlife. The right exists where the snake is within 100 metres of an occupied building, or where the person honestly believes such action is necessary to avoid immediate danger to life or injury to a person or domestic animal. The right is conditional and requires either an objective circumstance (distance from occupied building) or a subjective honest belief as to imminent danger.

Payment and royalty mechanics: regulation 6( a) and (b) grants permit holders the right to prepay specified amounts listed in Schedule 2 for units of wildlife. Payments made under that rule must be credited against royalties subsequently payable for wildlife actually taken. That creates a partial prepayment system and a right to have paid amounts credited.

Definitions and operational rights: regulation 1A defines "infringement offence" and "prescribed amount" by reference to Schedule 3 and the monetary value of the specified penalty units. That definition sets the rights of alleged offenders to know the monetary exposure and to pay the specified amount for expiation.

Infringement enforcement consequences: regulation 8(2)(c) lists potential enforcement actions under the Fines and Penalties (Recovery) Act 2001 if the alleged offender does not respond, including licence or vehicle registration suspension, seizure of property, wage deduction, registration of a statutory charge on land and community work orders which could lead to imprisonment on breach. This gives enforcement agencies a suite of coercive powers that operate once collection mechanisms under the Fines and Penalties Act are engaged.

In effect, duties fall principally on the Director to consider specified materials for joint management permit decisions and on conservation officers to have reasonable belief before serving infringement notices and to ensure statutory particulars are included. Rights accrue to permit holders (to prepay and receive credit), to persons confronted with snakes in the specified circumstances (to kill or injure the snake), and to alleged offenders (to expiate or elect court proceedings).

The Regulations set out an infringement-notice enforcement pathway, including the offences that are deemed infringement offences, the prescribed monetary amounts for expiation, the content and form of notices, and the linkage to the Territory’s fines and penalties recovery mechanisms.

Infringement offences and monetary values: regulation 1A defines "infringement offence" as an offence against an Act provision specified in Schedule 3. Schedule 3 lists specified Act sections and the prescribed penalty units for each. For example, section 49(2) is allocated 10 penalty units and section 40(3) is allocated 2 penalty units. The prescribed amount for each infringement offence is the monetary value of the number of penalty units specified in Schedule 3 column 2, as stated in regulation 1A.

Service and reasonable belief: regulation 7 permits a conservation officer to serve an infringement notice on a person if the officer reasonably believes that person has committed an infringement offence. The standard is reasonable belief, which sets a lower threshold than proof beyond reasonable doubt and is operational for administrative enforcement.

Contents and form of infringement notices: regulation 8(1) requires particular particulars to be specified on the infringement notice: name and address of the alleged offender if known, the date of the notice, the date time and place of the alleged offence, a description of the offence and prescribed amount, and the enforcement agency to whom payment is payable (regulation 8(1)(a)-(e)). Regulation 8(2) requires the notice to inform alleged offenders that they may expiate by paying the prescribed amount within 28 days, may elect prosecution by court under the Fines and Penalties (Recovery) Act 2001 by completing a statement of election, and that enforcement action under the Fines and Penalties Act may follow if the alleged offender does nothing. The regulation lists the enforcement actions the recovery Act permits, including licence and registration suspension, seizure, wage deduction, registration of statutory charges on land and community work orders (regulation 8(2)(c)(i)-(vi)).

Cheque payment and clearance: regulation 9 states that a tendered cheque is not taken to have been paid unless it clears on first presentation. This rule affects payment finality and the date payment is treated as effective for the purposes of expiation.

Director withdrawal power: regulation 10 allows the Director to withdraw an infringement notice by written notice served on the alleged offender within 28 days after service of the infringement notice but before payment. That provides an internal remedy to correct issued notices within a narrow window.

Multiple notices and court proceedings: regulation 11 clarifies three points: Part 3 does not prevent the start or continuation of court proceedings for an infringement offence for which an infringement notice has been served unless the offence is expiated (regulation 11(1)). More than one infringement notice for the same offence may be served and payment of the prescribed amount in accordance with any of the notices is sufficient to expiate the offence (regulation 11(2)). Finally, the Part does not require an infringement notice to be served and does not affect liability to be prosecuted for an infringement offence where no notice has been served (regulation 11(3)(a)-(b)).

Interconnected enforcement: regulation 8 ties collection and enforcement to the Fines and Penalties (Recovery) Act 2001 by requiring the notice to identify the enforcement agency as defined in that Act and by enumerating the recovery actions available. The practical effect is that collection is outsourced to the Territory’s general recovery machinery, which carries coercive tools over and above the immediate monetary penalty.

Specified offences: Schedule 3 lists the Act provisions that attract infringement notices and the number of penalty units. Examples include section 21H(1) and 21J(1) at 5 penalty units each, section 25AKI(1) and 25AKJ(1) at 5 penalty units, section 46(2) at 5 penalty units, and sections 67A and 67B at 10 penalty units. These allocations determine monetary exposure when an expiation option is available.

In sum, the Regulations create an administrative enforcement pathway that allows conservation officers to issue notices based on reasonable belief, gives alleged offenders a clear 28‑day window to pay or elect court proceedings, and links default to the Fines and Penalties recovery powers. The Director’s narrow withdrawal window and the capacity to issue multiple notices are specific procedural features that shape enforcement practice.

The Regulations explicitly cross‑refer to multiple other statutory instruments and to specific provisions of the Territory Parks and Wildlife Conservation Act 1976. Those cross‑references create direct legal interactions that affect approvals recognition, enforcement flow and transition rules.

Recognition of external approvals: regulation 3A prescribes a set of statutory approvals that constitute acceptable approvals for the purposes of section 45A of the Act. The prescribed approvals are: authorisations to use and develop land under section 21A or 25AKB of the Act (regulation 3A(a)); development permits under the Planning Act 1999 (regulation 3A(b)); clearing permits under section 91H of the Pastoral Land Act 1992 (regulation 3A(c)); environmental approvals granted under Part 5 of the Environment Protection Act 2019 (regulation 3A(d)); environmental (mining) licences under specified parts of the Environment Protection Act 2019 (regulation 3A(e)); and environment management plans approved under regulation 11 of the Petroleum (Environment) Regulations 2016 (regulation 3A(f)). This means that an approval or permit under those statutes may serve as the operative statutory approval recognised by the Act for certain activities affecting wildlife, creating coordination between permitting regimes.

Fines and Penalties (Recovery) Act 2001: regulation 8(1)(e) requires infringement notices to identify the enforcement agency as defined in the Fines and Penalties (Recovery) Act 2001, and regulation 8(2)(c) lists recovery actions available under that Act. The practical effect is that the Territory’s general debt‑recovery and enforcement machinery supports the collection of expiation amounts and any enforcement proceedings following default.

Act cross‑references and joint management provisions: regulation 1B prescribes 1 July 2027 for the expiry of the application of the Territory Parks and Wildlife Conservation By‑laws 1984 to joint management parks and reserves under section 25APA(5)(b) of the Act (regulation 1B). The note to regulation 1B references section 25APA(5) and section 25AQ, indicating an intended legislative sequencing where by‑laws may cease to have effect earlier under s25AQ. Regulation 4A explicitly requires the Director to consider objectives and principles found in sections 25AB and 25AC when deciding permit applications for joint management areas. Those cross‑references anchor the Regulations within the Act’s joint management architecture and influence the interaction between legacy by‑laws and new joint management instruments.

Royalties and permit mechanics across statutes: regulation 6( a)-(b) permits advance payments against royalties and credits those payments against royalties subsequently payable. While self‑contained, this interacts operationally with permit conditions under the Act and the prescribed Schedule 2 amounts. It may also interact contractually with agreements under joint management and with any revenue reporting requirements imposed by other statutes or by administrative policy.

Planning, pastoral and environmental law coordination: the inclusion of approvals under the Planning Act 1999 and Pastoral Land Act 1992 in regulation 3A signals that development consents and clearing permits under those statutes operate within the Act’s environmental architecture. Practically, a developer or pastoralist who holds a permit under those Acts may be able to rely on that permit as the prescribed statutory approval for activity affecting wildlife, subject to the Act’s other requirements.

Petroleum environmental regulation interplay: regulation 3A(f) includes approved environment management plans under the Petroleum (Environment) Regulations 2016, which links petroleum sector environmental approvals to the Act. That creates a pathway for petroleum operators to have sectoral environment management plans recognised within the wildlife regulatory framework.

Interpretational standard: by importing the IUCN Red List Categories under regulation 2(1), the Regulations align the Territory’s conservation classification with an international standard. The IUCN Council’s periodic approvals therefore become operationally relevant to the Act’s classification of threatened wildlife.

In short, the Regulations are designed for compatibility with other statutory regimes. They coordinate approval recognition, enforcement collection and joint management decision‑making by explicitly citing those other Acts and instruments. The practical consequence is that compliance planning must consider the interplay between this regulatory schedule and the other named laws.

The Enactment and Endnotes in the provided text include a record of amendments and related instruments that have modified the Regulations since their initial notification. The Regulations were first made as the Territory Wildlife Regulations (SL No. 1, 2001), notified and commenced on 14 February 2001 (Endnote 2). Subsequent amendments and legislative instruments are recorded in the list and the table of amendments.

Key amendments and instruments recorded in the Endnotes and List of Amendments include:

• Amendment of Territory Wildlife Regulations (SL No. 2, 2004), notified 4 February 2004, which substituted regulation 3 (see Endnote 2 and List of Amendments r 3 sub No. 2, 2004).
• Territory Wildlife Amendment (Infringement Notices) Regulations 2007 (SL No. 1, 2007), notified and commenced 7 February 2007, which inserted Part 3 and regulations 7-11 as an infringement‑notice framework (List of Amendments: pt 3 hdg ins No. 1, 2007, r 7; r 7 sub No. 1, 2007, r 7; rr 8-11 ins No. 1, 2007, r 7; sch 3 sub No. 1, 2007, r 8).
• Fees and Charges Amendment Regulations 2009 (SL No. 34, 2009), notified 14 December 2009 and with effect from 1 January 2010 for certain rules, which substituted Schedule 2 (List of Amendments: sch 2 sub No. 34, 2009, r 11).
• Territory Parks and Wildlife Conservation Legislation Amendment Act 2010 (Act No. 34, 2010), assented to 18 November 2010 and commenced 6 December 2010; it amended the Regulations in part (List of Amendments: amd Act No. 34, 2010, s 6).
• Statute Law Amendment (Territory Economic Reconstruction) Act 2022 (Act No. 5, 2022), assented 14 April 2022, with part commencement on 25 May 2023; recorded as an amendment in Endnotes (List of Amendments: Act No. 5, 2022, s 131).
• Parks and Water Legislation Amendment Act 2024 (Act No. 13, 2024), assented 11 June 2024, which amended multiple regulations including insertion of regulation 1B prescribing the expiry date for by‑laws application to joint management parks and reserves and insertion of regulation 4A dealing with permit decisions for joint management parks (List of Amendments: r 1B ins Act No. 13, 2024, s 23; r 4A ins Act No. 13, 2024, s 24; amd Act No. 13, 2024, s 25). The Endnotes state that pt 3 of that amending Act commenced 2 July 2024.
• Lands, Planning and Environment Legislation Amendment Act 2025 (Act No. 25, 2025) is listed as assented 12 September 2025, with part 6 not commenced and removal of certain previous provisions as of 13 September 2025. Regulation 3A was inserted by Act No. 25, 2025, s 61 (List of Amendments: r 3A ins Act No. 25, 2025, s 61).

The Endnotes also record general statutory housekeeping amendments made by the Interpretation Legislation Amendment Act 2018 to rr 1 and 8, indicating periodic formal amendments of a non‑substantive nature. The List of Amendments records formal changes such as the insertion of headings, definitions and the addition of Part 3.

Where the Regulations have introduced new operational elements, the record identifies the amending instrument and the year, for example the infringement notice framework added in 2007 (SL No. 1, 2007) and substantive additions made by Acts in 2010, 2022, 2024 and 2025. The Schedule content, particularly Schedule 2 monetary amounts and Schedule 1 species lists, have been updated by subordinate instruments, as indicated by substitution of Schedule 2 in 2009.

Practitioners should treat the Endnotes’ list as the canonical reprint history recorded in the provided text. For work that depends on the precise commencement timing of particular amendments, the Endnotes provide commencement dates (for example the Parks and Water Legislation Amendment Act 2024 commenced part 3 on 2 July 2024). The reprint indicates that some amending provisions are not yet commenced as at the reprint date; for example, some parts of the Lands, Planning and Environment Legislation Amendment Act 2025 are noted as not commenced within the Endnotes.

In practice, checking the operative text for a particular regulatory provision requires attention to the specific amending instrument and its commencement provision, as the Endnotes demonstrate that different parts of amending Acts commence at different times.

The provided text contains no case law, judicial decisions, appeal outcomes or recorded litigation history. The Regulations themselves do not list any judicial interpretations or court decisions. The instrument’s Endnotes and List of Amendments record statutory amendments and subordinate instruments but do not record litigation.

Because the source contains no cases or litigation references, the Regulations should be treated as a primary administrative instrument without attached judicial commentary in the reprint. When advice or litigation strategy is required, practitioners will need to search jurisdictional case law databases for judicial consideration of the Act and these Regulations, given that no litigation history is supplied in the provided text.

Notwithstanding the absence of recorded cases in the reprint, the Regulations cross‑refer to enforcement mechanisms (for example the Fines and Penalties (Recovery) Act 2001) that are commonly litigated in the recovery context. The Regulations permit alleged offenders to elect court proceedings under section 21 of the Fines and Penalties Act as noted in regulation 8(2)(b), so litigation may arise in relation to procedural or substantive defences to the underlying Act offences specified in Schedule 3. Similarly, decisions of the Director under regulation 4A or enforcement actions by conservation officers under regulation 7 could be judicially reviewed, but the reprint does not record any such decisions.

In summary, there is no litigation history contained in the instrument provided. Any analysis or argument about how courts have interpreted the Regulations must be grounded in external case law searches because the text contains no judicial pronouncements.

Several practical traps and non‑obvious implementation features are embedded in the Regulations. These are operational points likely to matter to lawyers, compliance officers, permit applicants and land managers.

1. Importation of IUCN standards binds change outside Territory control: regulation 2(1) prescribes the IUCN Red List Categories "as prepared by the IUCN Species Survival Commission and approved by the IUCN Council from time to time". That wording makes the Territory’s classification depend on an external international body’s approvals. An immediate implication is that classification changes made by the IUCN become operational in Territory decision‑making without further local legislative action.

2. Protected wildlife definition is categorical: regulation 3 states that "All species of threatened wildlife, whether identified by classification or species, are protected wildlife." That broad formulation covers species identified at a category level or named individually and can expand obligations quickly where classification changes. Practitioners must not assume protection is limited to a short list.

3. Narrow but subjective snake‑kill authorisation: regulation 5 permits killing or injuring a protected snake if within 100 metres of an occupied building or where the person honestly believes immediate danger exists. Two points matter. First, the 100 metre rule is objective and could be measured; it effectively creates a spatial carve‑out. Second, the "honest belief" test is subjective and potentially contestable in court, including via cross‑examination of honesty. There is no explicit requirement for reasonableness; the authorised person's honest belief is the statutory touchstone.

4. Advance payment amounts are detailed and denominated inconsistently: Schedule 2 includes amounts stated as dollar figures for many items and as bare numbers that could be "revenue units" for others (Schedule 2 heading: "Amount per unit (revenue units unless otherwise stated)"). Practitioners must check precisely how "revenue unit" translates to dollars in current administrative practice and whether the plain numbers are dollar amounts or unit counts. Misreading the Schedule could cause underpayment or overpayment. Regulation 6 refers to amounts "specified in column 3", so reliance on the up‑to‑date schedule is essential.

5. Multiple infringement notices and withdrawal window: regulation 11(2) allows multiple notices for the same offence, and payment under any notice expiates the offence. This can be operationally awkward if overlapping notices are issued. Conversely, regulation 10 permits the Director to withdraw a notice only within 28 days and before payment. If an incorrect notice is served and payment is made, withdrawal is no longer possible and the only remedy is refund or court processes. The 28‑day window is short; agencies and recipients must act promptly.

6. Infringement notice must identify enforcement agency: regulation 8(1)(e) requires the enforcement agency as defined in the Fines and Penalties (Recovery) Act 2001 to be identified. Errors in naming the agency or failure to provide the statement of election (regulation 8(3)) could be procedural defects argued in litigation. The content obligations are prescriptive and may affect validity of notices if not met.

7. Expiation consequences tied to external debt recovery powers: regulation 8(2)(c) warns recipients of enforcement actions available under the Fines and Penalties (Recovery) Act 2001 including seizure, wage deduction and registration of statutory charges. Default consequences therefore extend into property and income rights beyond the immediate penalty.

8. Joint management timing and by‑laws expiry: regulation 1B prescribes 1 July 2027 as the expiry date for the application of the older by‑laws to joint management parks and reserves under section 25APA(5)(b). Parties operating under legacy by‑laws must prepare for transition and for any earlier ceasing under section 25AQ referenced in the note to regulation 1B.

9. The Director’s mandatory considerations are not a check list of outcomes: regulation 4A requires the Director to "consider and take into account" listed matters but does not mandate particular outcomes. Applicants may assume that presence of a joint management plan or an agreement guarantees approval. The requirement is one of evaluative consideration, not entitlement.

10. Schedule 1 uses taxonomic and common names: Schedule 1’s mixed use of scientific names and common names means small transcription or species identification errors could cause regulatory misclassification. Practitioners working with animal importation or holding should ensure accurate species identification.

11. No litigation history included: the absence of recorded case law in the provided reprint means there is no local interpretative authority in the text. Where contentious or ambiguous points arise, parties must perform fresh legal research; expectations about administrative discretion and procedural challenges cannot be assumed from the reprint alone.

12. Time value and prepayment allocation: advance payments under regulation 6 are credited to royalties "in respect of wildlife actually taken under the permit". If a permit holder prepays and then does not take the wildlife, the Regulations do not state the refund or forfeiture mechanics. That creates financial risk for permit holders who prepay.

Being alert to these operational details will materially affect compliance planning and litigation risk assessment.

Compliance under these Regulations depends on the role of the actor. Below are concrete steps and key check points for permit applicants and holders, landholders and occupiers, species keepers, conservation officers and enforcement agencies.

1. Permit applicants and holders (including for joint management parks or reserves)

• Before applying, assemble relevant joint management instruments: copies of the relevant agreements for the park or reserve, any joint management plan, and any agreement under section 25AK(3) if no joint management plan exists. Regulation 4A requires the Director to consider these materials when deciding on permits.
• When a permit grants rights to take wildlife, consider whether advance payments under regulation 6 are appropriate. Schedule 2 lists the amount per unit to be credited against future royalties. Document payments carefully and obtain receipts that identify the permit, the wildlife items, the unit quantities and the amounts paid.
• Track whether amounts in Schedule 2 are in "revenue units" or specified dollar amounts. Confirm administration practice with the issuing agency to ensure the payment amount is properly denominated and recorded.

2. Landholders, occupiers and residents (especially near buildings)

• Note the limited authorisation in regulation 5 to kill or injure protected snakes. That authorisation applies where the snake is within 100 metres of an occupied building, or where the person honestly believes killing or injuring is necessary to avoid immediate danger to a person or domestic animal. Record the circumstances contemporaneously if relying on the honest belief ground, as post hoc evidence will matter in any challenge.
• Where possible call a conservation or wildlife officer for assistance rather than acting first, unless immediate danger exists. The regulation permits action but does not prescribe what post‑action reporting or evidence should be provided.

3. Species keepers, importers and breeders

• Review Schedule 1 to determine whether a species is listed as not a prohibited entrant. If so, confirm any additional regulatory regimes (quarantine, biosecurity) that still apply. The Schedule only addresses the Act’s prohibited entrant categorisation and does not remove other statutory or local obligations.
• Maintain species inventory records that align with the scientific names used in Schedule 1 to avoid misidentification.

4. Conservation officers and the Director

• Conservation officers should ensure a reasonable belief is recorded before serving an infringement notice, including the factual basis for that belief and any witnesses or documentary evidence (regulation 7). Use the form and content requirements in regulation 8 to prepare notices: include name and address where known, dates, place, description of the offence, the prescribed amount, and the enforcement agency for payment.
• Ensure the infringement notice contains the statements required by regulation 8(2), including the election statement form as required by regulation 8(3).
• If an infringement notice is incorrect, act swiftly. The Director can withdraw a notice only within 28 days after service and before payment (regulation 10). Put withdrawal procedures and timelines into internal standard operating procedures.

5. Parties served with infringement notices

• Note the 28 day expiation window under regulation 8(2)(a). If electing court proceedings, complete and serve the statement of election under section 21 of the Fines and Penalties (Recovery) Act 2001 as identified in regulation 8(2)(b) and keep proof of service.
• If paying by cheque, ensure cheque clears on first presentation because regulation 9 treats cheque payment as effective only after clearance.
• Be aware of enforcement consequences listed in regulation 8(2)(c). Non‑payment can lead to follow‑on actions under the Fines and Penalties (Recovery) Act 2001 with significant financial and practical consequences.

6. Developers and land users reliant on cross‑statutory approvals

• Where activities rely on external approvals listed in regulation 3A, ensure those approvals are current and documented at the time the Act’s decision point arises. For example, a development permit under the Planning Act 1999 or a clearing permit under the Pastoral Land Act 1992 must be validly granted and available for inspection.
• Retain copies of environmental approvals under the Environment Protection Act 2019 and any approved environment management plan under the Petroleum (Environment) Regulations 2016 if those instruments are intended to satisfy section 45A requirements.

7. Financial and accounting controls

• Permit holders intending to prepay under regulation 6 should record advance payments separately and reconcile them against royalty liabilities when wildlife is taken. The Regulations require that prepayments are credited to royalties payable for wildlife actually taken, but do not specify treatment when wildlife is not taken. Accountants should ensure treatment of such prepayments follows applicable public finance and permit conditions.

8. Records and species identification

• Maintain precise species identification records, using scientific names where possible, because Schedules use scientific and common names inconsistently.
• For actions involving snakes or other protected wildlife, keep contemporaneous incident reports, photos and witness statements to substantiate either the objective 100 metre rule or the honest belief condition.

9. Cross‑check amendments and version control

• Schedule 2 amounts and Schedule 1 species lists have been amended historically. Check the current reprint and any later amendments before advising clients or making payments. The Endnotes list the amending instruments and commencement dates; ensure you are working with the current operative version.

10. Seek early legal advice for contested enforcement

• If served with an infringement notice where the notice is defective in form or where the facts are contested, consider early advice about election to be prosecuted, or procedural challenges such as failure to include required particulars under regulation 8. The reprint provides specific content obligations that can form the basis of administrative or litigation arguments.

Following these steps reduces the risk of procedural non‑compliance, ensures documentation to support discretionary decisions, and mitigates financial exposure arising from royalty prepayments and infringement notices.
