Termination of Pregnancy Act 2021

Definitions and scope: The Act defines key terms that determine the scope of lawful practice. “Termination” is defined broadly to capture any intentional termination by drugs, instruments or other means, and to include prescribing or administering (s 3). “Registered health practitioner” is defined by reference to the national registration scheme and includes medical practitioners and other registered health professionals, other than students (s 3). “Assist in a termination” is defined to include obtaining or supplying a drug on behalf of another person and any act that directly and materially aids a termination, but regulations may carve out specific acts (s 3).

Gestational threshold and clinical exceptions: A bright line applies to medical practitioners performing terminations in ordinary practice up to 22 weeks and 6 days (s 5(1)(a)). Beyond that threshold, performance by a medical practitioner is limited to clinically specified circumstances: to save the life of the pregnant person or another foetus, to address significant risk of injury to physical or mental health, or where there is or is likely to be serious foetal anomalies (s 6(1)(a)). The Act requires consultation with a second medical practitioner who must independently consider the same clinical criteria (s 6(1)(b)), and requires that the termination be performed at a prescribed hospital (s 6(1)(c)). An emergency exception permits a practitioner to act without the second opinion and hospital requirement if immediate action is required (s 6(3)).

Non‑medical practitioners and medical abortion: The Act permits registered health practitioners other than medical practitioners to perform terminations only by administering or prescribing a prescription drug, and only if authorised to prescribe that drug under s 18 of the Controlled Substances Act 1984 (s 5(1)(b)). The interplay with the Controlled Substances Act is explicit: this Act is in addition to and does not limit other legislation (s 4). That means the ability of other practitioners to prescribe will depend on their legal prescribing authority under the controlled substances regime.

Conscientious objection: A registered health practitioner with a conscientious objection must disclose that to a person requesting services, and if the person requests the practitioner’s direct services or advice the practitioner must, without delay, either provide information on how to contact a practitioner who, to the practitioner’s reasonable belief, does not have a conscientious objection, or transfer care to another practitioner or health service provider who can provide the service (s 11(2)-(4)). The Act provides that the practitioner will be taken to have complied if they provide Minister‑approved information consisting of contact details for a state service listing practitioners without objections (s 11(4) and Note). The section does not limit emergency duties (s 11(5)).

Protections and liabilities: Registered health practitioners who act in accordance with the Act incur no criminal liability and no civil liability for acts done in good faith and without negligence (s 13(1)). Practitioners who refuse to participate on conscientious grounds incur no civil liability for refusing to perform, assist or advise (s 13(2)). The definition of “assist” in s 3 and the conduct provisions in s 17 expand the regulatory perimeter to include acts such as obtaining or supplying drugs on behalf of another, or otherwise taking steps to organise or facilitate a termination (s 17(2)).

Reporting, confidentiality and publication limits: The Minister must arrange an annual report covering services provided in connection with terminations, including age of the pregnant person and the gestational age of the foetus at termination, and other prescribed data (s 20(1)-(2)). Regulations can require providers to collect and provide data and statistics to the Minister or Department (s 21(2)(a)). The Act imposes a separate offence with monetary penalties for publishing identifying information about people who sought or received a termination (s 18). Confidentiality obligations for persons engaged in the operation of the Act are set out at s 19, with specified exceptions for disclosures authorised by law, with consent, or for approved research, and with maximum monetary penalties.

Enforcement architecture and prosecutorial filter: The criminal offences for unqualified persons carrying out or assisting in terminations attract significant maximum penalties, but prosecutions for those offences cannot commence without the written consent of the Director of Public Prosecutions (s 14-15). Professional conduct and disciplinary bodies may take into account compliance with the Act when assessing practitioner conduct (s 17), linking statutory obligations to the professional regulatory framework.

Regulatory discretion: The Governor in Council may make regulations for any purpose necessary under the Act and may require data collection and reporting by practitioners and facilities, make differential provision, and delegate matters to ministerial or prescribed authority discretion (s 21(1)-(3)). The regulations therefore are a significant implementation mechanism.

Patients and pregnant persons: The Act directly affects persons seeking a termination in South Australia. It determines where and when a termination can be lawfully performed, whether by medical practitioners or other registered practitioners (s 5-6). Persons seeking later gestation terminations will be affected by the requirement for two physician assessments and for performance at a prescribed hospital unless an emergency applies (s 6). Everyone who has sought or received a termination is the subject of publication and confidentiality protections (ss 18-19), because publications identifying them are prohibited and public reporting must be handled under the confidentiality regime.

Registered health practitioners: The Act governs the behaviour of registered health practitioners generally. Medical practitioners may perform terminations within the gestational limits and under the specified later gestation criteria (ss 5-6). Other registered health practitioners can only perform terminations by prescribing or administering prescribed drugs and only if authorised to prescribe under the Controlled Substances Act (s 5(1)(b)). Practitioners with conscientious objections must disclose the objection and either provide Minister‑approved contact information or transfer care (s 11). Practitioners who perform or assist in terminations in accordance with the Act are protected against criminal liability and, subject to good faith and absence of negligence, civil liability (s 13). The Act also makes failures to comply with certain duties relevant to professional conduct and disciplinary consideration under other regulatory regimes (s 17).

Hospitals, health services and administrative bodies: The Act requires that later‑gestation terminations be performed at a prescribed hospital (s 6(1)(c)), a term the regulations will define. The regulations may also prescribe which hospitals or classes of hospital are “prescribed hospitals”. Incorporated hospitals, incorporated health services and SA Ambulance Service staff engaged in operation of the Act are bound by the confidentiality provisions (s 19(5)). The Department and the Minister are central decision makers for data collection, reporting, and publication of annual reports (ss 20-21). The Minister also approves information that can satisfy an objecting practitioner’s obligations under s 11(4).

Private clinics and private day procedure centres: The Act allows private facilities to be involved subject to definitions in the Health Care Act 2008 and any prescription by regulation. The power to require data and reporting from private providers resides in the regulations (s 21(2)(a)). Private providers may bear reporting costs, privacy compliance costs and potential reputational costs associated with statutory reporting and publication restrictions.

Researchers, journalists and publishers: The Act imposes a publication prohibition on persons engaged with the Act not to publish identifying information about persons who sought or received a termination, with significant penalties for breach (s 18). Researchers will be affected by confidentiality obligations and the permitted exception for research where an ethics committee has approved the methodology and there is no reason to believe disclosure would be contrary to the person’s best interests (s 19(2)(d)). The annual report provision (s 20) requires release of some data to Parliament within set timeframes.

Legal, compliance and enforcement actors: Prosecutors are affected by the DPP consent requirement for prosecutions under the Part dealing with unlawful terminations by unqualified persons (s 15). Professional regulators and tribunals are explicitly permitted to treat conduct under the Act as relevant to professional conduct and performance matters (s 17). The Governor in Council and Minister hold regulatory and administrative powers under s 21 and s 11(4) respectively, affecting implementation.

Third parties who facilitate access: The definition of “assist” includes obtaining or supplying a drug on behalf of another (s 3). That definition, together with the offences for unqualified persons who assist in terminations (s 14(2)), brings into scope non‑clinical intermediaries who procure or supply drugs or otherwise materially aid a termination. The Act distinguishes lawful assistance by registered health practitioners acting in the ordinary course of their professions (s 14(3)(b)) from conduct that may attract criminal penalties.

Duty to provide counselling information: Before performing a termination, a registered health practitioner must provide all necessary information about access to counselling, including publicly funded counselling (s 8(1)). This is an affirmative duty, and an emergency exception allows a practitioner to proceed without complying where necessary (s 8(2)). Failure to provide this information is later listed as a matter that may be considered in professional conduct proceedings (s 17(1)(c)).

Gestational duties: A medical practitioner is entitled to perform terminations up to 22 weeks and 6 days in ordinary practice (s 5(1)(a)). For later gestations, a practitioner must be satisfied of one of the listed clinical grounds, must consult a second medical practitioner who independently considers the same grounds, and must perform the termination at a prescribed hospital, unless an emergency dispenses with the consultation and hospital requirement (s 6(1)-(3)). Section 6(2) requires consideration of all relevant medical circumstances and applicable professional standards and guidelines when assessing whether a termination is medically appropriate.

Mandatory considerations for later terminations: Section 9 prescribes a non‑exhaustive set of matters a medical practitioner must have regard to in assessing section 6(1). These include risks in multiple pregnancies, previously undiagnosed serious foetal abnormalities, access to specialist services and socio‑economic or geographical barriers, denial of agency due to abuse or coercion, mental or physical conditions that may worsen during pregnancy, deteriorating maternal conditions, or late diagnoses incompatible with pregnancy. These are statutory prompts for clinical and contextual assessment.

Conscientious objection procedures: Practitioners with a conscientious objection must promptly disclose that objection when requested to perform, assist, decide on, or advise about a termination (s 11(2)). Where the request is for services or advice directly to the person, the practitioner must, without delay, give information on how to locate a practitioner believed not to object, or transfer care to an appropriate practitioner or health service provider (s 11(3)). The practitioner may instead provide Minister‑approved contact information, which satisfies the duty (s 11(4)). Emergency duties override conscientious objection obligations (s 11(5)). The Act protects conscientious objectors from civil liability arising from refusal to participate (s 13(2)), and they remain subject to professional and emergency duties.

Prohibitions and limits: Registered health practitioners are prohibited from performing terminations for sex selection, with a narrow exception where there is a substantial risk of a sex‑linked medical condition causing serious disability (s 12). The Act also prohibits unqualified persons from performing or assisting in terminations, criminalising such conduct with specified maximum penalties (s 14).

Protection from criminal and civil liability: Section 13(1) exempts registered health practitioners who act in accordance with the Act from criminal liability, and from civil liability where acts were in good faith and without negligence. The subsection expressly includes protection from disciplinary liability by incorporating “civil liability” to include liability under disciplinary or similar proceedings (s 13(3)). Practitioners refusing to participate on conscientious grounds are similarly shielded from civil liability for that refusal (s 13(2)).

Reporting, publication and confidentiality duties: The Minister must have an annual report prepared on termination services and table it in Parliament, with the report required to include age and gestational age for each termination and other prescribed data (s 20(1)-(3)). Regulations may require registered health practitioners and institutions to collect and provide data to the Minister or Department (s 21(2)(a)). Persons engaged in the operation of the Act must not publish identifying information about persons who sought or received a termination, with penalties specified (s 18). Persons engaged in connection with operation of the Act must not disclose personal information obtained in that role except in enumerated circumstances, and breaches attract monetary penalties (s 19).

Professional conduct considerations: The Act makes contraventions of key duties relevant to professional conduct and performance matters, and lists specific contraventions such as terminating otherwise than as authorised, assisting improperly, failing to provide counselling information, failing to follow conscientious objection procedures, or performing a termination for sex selection as matters that may be considered by the relevant professional conduct bodies (s 17(1)). The matters to which s 17 applies explicitly include notifications and complaints under the national registration framework and the Health and Community Services Complaints Act 2004 (s 17(3)).

Regulatory delegation and discretion: Regulations may delegate consequential matters to the Minister or other prescribed authority, including allowing matters to be determined according to the discretion of the Minister (s 21(3)(c)). The Governor in Council has general regulation‑making power for necessary and expedient regulation (s 21(1)).

Criminal offences and custodial penalties: The Act creates criminal offences for unqualified persons who perform or assist in terminations. An “unqualified person” performing a termination who is not a registered health practitioner authorised under the Act commits an offence punishable by up to seven years imprisonment (s 14(1)). An unqualified person who assists in the performance of a termination commits an offence punishable by up to five years imprisonment (s 14(2)). The definition of “unqualified person” for assisting excludes registered health practitioners acting in the ordinary course of their profession (s 14(3)(b)). The Act does not specify other criminal offences for practitioners who breach procedural provisions such as failing to give counselling information or not complying with conscientious objection procedures; instead non‑compliance is treated as relevant to professional conduct (s 17).

Prosecutorial threshold: A prosecutorial filter applies. Section 15 requires the written consent of the Director of Public Prosecutions before a prosecution for an offence under the Part that contains the unqualified person offences can commence. The textual structure indicates this operates to prevent private or direct commencement of prosecution without DPP authorisation, concentrating charging discretion with the DPP (s 15).

Monetary penalties for publication and confidentiality breaches: Publication of identifying information about persons who sought or received a termination by someone engaged or formerly engaged in the operation of the Act is an offence carrying monetary penalties. For natural persons the maximum penalty is $50,000 and for bodies corporate $120,000 (s 18). Separately, breach of the confidentiality prohibition in s 19(1) attracts a maximum penalty of $10,000. Section 19(3) imposes a further $10,000 maximum if disclosed information is used for a purpose other than the purpose for which it was disclosed. These monetary penalties apply to persons engaged in operation of the Act, which is broadly defined to include those engaged under the Health Care Act 2008 in certain roles (s 19(5)).

Civil and professional consequences: The Act provides that registered health practitioners who perform terminations in accordance with the Act incur no criminal liability and no civil liability for acts done in good faith and without negligence (s 13(1)). The inclusion of disciplinary proceedings within “civil liability” means the statutory protection extends to exposure in disciplinary type processes, subject to the good faith and non‑negligence threshold (s 13(3)). Conversely, failure to follow the Act’s requirements may be taken into account in professional conduct and performance proceedings. Section 17(1) expressly lists specific contraventions that may be considered in any Act concerning professional conduct or performance, and s 17(3) identifies notifications and complaints mechanisms to which such conduct can be reported.

Enforcement actors and reporting obligations: Enforcement and oversight will involve the DPP for criminal prosecutions of unqualified persons under s 14, professional regulatory bodies for conduct considered under s 17, and the Minister and Department for collection and publication of data under ss 20-21. Regulations may further define reporting obligations and the administrative process for compliance, including penalties or administrative remedies authorised by regulation (s 21).

Discretionary regulatory powers: Section 21(3)(c) permits regulations to provide that some matter is to be determined according to the discretion of the Minister or another prescribed authority. That creates administrative discretion in implementation and potential scope for regulatory instruments to shape enforcement practice and compliance responsibilities.

Non‑exclusive operation: The Act expressly states that it is in addition to and does not limit or derogate from the provisions of other Acts, including the Consent to Medical Treatment and Palliative Care Act 1995, the Controlled Substances Act 1984, or any other Act (s 4). This means practitioners must comply with the Act as well as their duties and limitations under those other statutes. Practitioners who rely on the authority to prescribe or administer abortifacient drugs under this Act must still ensure they are authorised under the Controlled Substances Act as required by s 5(1)(b)(ii).

Interaction with the national registration regime and professional standards: The Act defines “registered health practitioner” by reference to the Health Practitioner Regulation National Law (s 3). Section 17 links compliance with the Act to matters considered under professional conduct and performance frameworks, including notifications under the Health Practitioner Regulation National Law (South Australia) Act 2010 and complaints under the Health and Community Services Complaints Act 2004 (s 17(3)). That integrates the statutory framework with the existing national registration and disciplinary architecture.

Privacy, confidentiality and other disclosure laws: Sections 18 and 19 impose obligations and penalties specific to the operation of this Act. These provisions operate alongside general privacy and health records regimes. Section 19(2)(a) permits disclosure as required or authorised by law, creating an express cross‑reference to other legal disclosure obligations. The confidentiality exceptions include disclosures with consent, to guardians or substitute decision‑makers, and for certain treatment, management, administrative, or approved research purposes (s 19(2)(b)-(d)). The regulations may further provide for disclosure rules (s 19(4)). Providers will therefore need to reconcile the Act’s provisions with privacy obligations under state and federal law and the rules governing health records.

Criminal law and prosecutorial discretion: The Act removes criminal liability for registered health practitioners who perform terminations in accordance with the Act (s 13(1)), but it also leaves intact criminal liability for unqualified persons who perform or materially assist in terminations (s 14). The requirement for DPP consent to prosecute under s 15 centralises decision making in the prosecutorial office and interacts with prosecutorial policy and discretion under other criminal law statutes.

Health Care Act and hospital definitions: Several definitions reference the Health Care Act 2008 to define hospitals, private hospitals, private day procedure centres and incorporated health services (s 3). The requirement that later terminations be performed at a “prescribed hospital” (s 6(1)(c)) depends on regulation and the definitions in the Health Care Act. That creates a point of intersection for hospital governance, accreditation and service provision regimes.

Controlled Substances Act and prescribing authority: The ability of non‑medical registered health practitioners to prescribe or administer abortifacient drugs is contingent on authorisation under s 18 of the Controlled Substances Act 1984 (s 5(1)(b)(ii)). Practitioners must therefore comply with controlled substances prescribing rules, scheduling and authority mechanisms. The Act’s non‑derogation clause reinforces that compliance is required in addition to the permissions granted here (s 4).

Data reporting and freedom of information: The Act mandates annual reporting to Parliament with specific data elements required in the report, such as age and gestational age for each termination (s 20). Regulations may require providers and facilities to collect and provide data to the Minister or Department (s 21(2)). The collection, retention and disclosure of such data will engage FOI and public records regimes and the overarching confidentiality and publication prohibitions of the Act; the Act’s confidentiality provisions contain built in exceptions for lawful disclosure, approved research, and certain administrative needs (s 19(2)(a), (d), (e)).

Amendments and subsequent statutes: The legislative history records that the Act amended and was later amended by the Statutes Amendment (Health and Wellbeing) Act 2025, which varied s 19 and s 21 effective 4 December 2025. Those recorded amendments indicate that provisions governing confidentiality and regulationmaking have been the subject of subsequent legislative change, and practitioners should consult the most recent consolidated text and subordinate instruments to understand the current interaction between statutes.

Principal Act and commencement: The Termination of Pregnancy Act 2021 received assent on 11 March 2021 and, per the legislative history, commenced on 7 July 2022 (Gazette 23.6.2022 p1919). The Act modified provisions of earlier legislation, including the Criminal Law Consolidation Act 1935 and the Intervention Orders (Prevention of Abuse) Act 2009, as recorded in the legislative history summary.

Recorded 2025 amendments: The legislative history lists the Statutes Amendment (Health and Wellbeing) Act 2025 (No 69 of 2025) as amending the Termination of Pregnancy Act 2021, with the schedule noting that parts of Pt 14 (ss 68 to 70) of the amending Act commenced on 4 December 2025. The history entry specifically records that “incorporated health service” was inserted into s 3 by s 68 of the 2025 Act, and that s 19(1) and s 19(2) were amended by ss 69(1), (2) and s 69(3) respectively, with s 21(2) amended by s 70. The legislative history also notes that other housekeeping updates, such as the long title amendment under the Legislation Revision and Publication Act 2002 and omissions under that Act, took effect on 4 December 2025.

What the source records and what it does not: The legislative history in the source sets out which provisions were amended and the commencement dates for those amendments. The source text presented appears to include the amended versions of the defined terms and confidentiality and regulation provisions, for example by including “incorporated health service” in s 3 and the present text of s 19 and s 21. The legislative history entry names the instrument effecting the amendments and the effective dates, but does not reproduce the amending Act’s explanatory material or its legislative debates. The source does not provide the full explanatory note or operation details of the 2025 amendments beyond the formal citation and effected sections.

Implications for practice: The recorded amendments show that confidentiality and regulationmaking provisions were targets for legislative revision in 2025, which suggests these parts of the Act were identified for refinement post‑enactment. Practitioners and compliance officers should ensure they consult the consolidated version of the Act and the Statutes Amendment (Health and Wellbeing) Act 2025 to read the amending text and understand the precise changes made to s 19 and s 21. The regulations referenced in s 21 are not set out in the source text and may have been made or varied following the 2025 amendments; those subordinate instruments will materially affect reporting obligations, data collection, prescribing authorities, and permissible disclosures.

Transitional and saving provisions: Section 21(3)(d) reserves power for the regulations to make saving or transitional provision consequent on the enactment of the Act or on the commencement of specified provisions or the making of regulations. The legislative history does not list any separate transitional instruments in the excerpt provided. Practitioners should check the regulations for any transitional arrangements and for the text of the Minister‑approved information referenced in s 11(4), which the Act contemplates will be made available.

Recordkeeping and locating amending instruments: The legislative history includes a practical note pointing to the Index of South Australian Statutes and the legislation.sa.gov.au website for further information about the Act and subordinate legislation. That indicates the official consolidated text and the regulations are the necessary sources to fully implement obligations created by the Act and to track subsequent amendments or delegated instruments.

No cases named in the source: The text provided does not cite any judicial decisions, and the legislative history included makes no reference to litigation about the Act. There are no appellate or trial court determinations recorded in the material provided. The Act itself does not include a schedule of decided cases or notes of judicial interpretations.

Potential litigation vectors: Although the source contains no recorded litigation, the statutory provisions indicate several factual and legal issues that could give rise to disputes that might reach courts or tribunals in future. These include disputes over whether a termination after 22 weeks and 6 days met the statutory clinical criteria in s 6, whether the second medical practitioner’s consultation satisfied the requirement in s 6(1)(b), the application of the emergency exception in s 6(3), the adequacy of counselling information provided under s 8, and whether a conscientious objector complied with the disclosure and referral obligations in s 11. Professional disciplinary proceedings may also arise under the national registration regime and state complaints avenues where s 17 identifies statutory breaches as relevant to professional conduct and performance matters.

Prosecutorial decisions and DPP consent: Given s 15 requires the Director of Public Prosecutions’ written consent for prosecutions under the Part dealing with unqualified persons, litigation about charging decisions or prosecutorial refusal might take the form of judicial review of DPP decisions. The source does not record such litigation. Challenges could also arise to the interpretation or application of s 18 and s 19, in particular balancing publication restrictions and confidentiality obligations against other legal rights, although the Act contains specific prohibitions and exceptions.

Data and reporting disputes: The annual report obligation (s 20) and potential regulationally required data collection (s 21(2)(a)) could give rise to disputes about the scope of required reporting, the privacy protections applicable, and the allowable uses of deidentified or aggregated data. Any litigation about the sufficiency of regulations or the Minister’s approval of information under s 11(4) would similarly require consultation of the regulations and the Ministerial instruments, none of which are reproduced in the source.

Absence of recorded caselaw: Because the source does not provide any litigation history, readers and practitioners must not infer there have been judicial determinations on the Act’s provisions. For current case law or disputes, practitioners should search court databases and legal reporting services for decisions postdating the source text.

Broad definition of “assist” and criminal exposure: The Act defines “assist in a termination” broadly to include obtaining or supplying a drug for use in a termination and any act that directly and materially aids performance of a termination, subject only to possible regulatory carve outs (s 3). The offence for assisting by an unqualified person in s 14(2) carries a maximum five year imprisonment term. The combination of a broad statutory definition and a severe penalty means non‑clinical third parties who procure or facilitate drugs or other means could face criminal exposure unless they are registered health practitioners acting in the ordinary course of their profession (s 14(3)(b)). Providers and intermediaries should therefore carefully map roles to the statutory definitions and ensure legal authority to act.

Publication prohibition extends to persons engaged in operation of the Act: Section 18 prohibits persons engaged or formerly engaged in connection with the operation of the Act from publishing information that identifies a person who has sought or received a termination. The definition of “person engaged in connection with the operation of this Act” includes those engaged under s 93(1) of the Health Care Act 2008 (s 19(5)), which captures a wide range of health service workers and administrators. The publication prohibition carries significant monetary penalties: $50,000 for individuals and $120,000 for bodies corporate (s 18). Journalists, researchers and staff should be cautious about handling identifiable information and confirm lawful authority before any disclosure.

Mismatch between annual report data and publication restrictions: The annual report must include information about each termination performed in the calendar year including the age of the pregnant person and gestational age (s 20(2)(a)). This level of granularity could, in small jurisdictions or for rare combinations of attributes, create a risk of re‑identification if combined with other public data. The Act’s confidentiality protections (s 19) attempt to manage this by prohibiting unauthorised disclosures and by requiring ethics approval for research disclosures (s 19(2)(d)). However, data custodians and compliance officers must carefully apply deidentification and disclosure controls when implementing s 20 reporting obligations.

Conscientious objection compliance may be minimal but still required: A practitioner who objects can comply with s 11(3)(a) by providing Minister‑approved contact information, which the Act notes will be contact details for a SA Government service listing practitioners who do not have a conscientious objection (s 11(4) and Note). That creates a low administrative burden. However, failure to disclose an objection or to timely provide the approved information or a transfer may be treated as a matter for professional conduct consideration under s 17, and so carries regulatory risk.

Regulatory discretion and delegation: The regulations may delegate decisions to the Minister or a prescribed authority and may be of general or limited application, including saving or transitional provisions (s 21(3)(c)-(d)). That delegation creates possible implementation risk because key operational details, such as which hospitals are “prescribed hospitals” for later terminations and what data must be collected, may be set out in subordinate instruments rather than in the Act itself. Practitioners and institutions must therefore monitor subordinate legislation and Ministerial determinations.

Interplay with Controlled Substances Act and prescribing authority: Section 5(1)(b) allows non‑medical registered health practitioners to perform terminations only by administering or prescribing a drug and only if authorised under s 18 of the Controlled Substances Act 1984. The Act does not itself confer prescribing authority; that authority depends on the controlled substances regime. Practitioners must ensure they are authorised under the Controlled Substances Act in addition to complying with this Act (s 4).

Professional liability conditioned on negligence and good faith: The civil protection in s 13(1)(b) is conditional. It removes civil liability only where the act was done in good faith and without negligence. Disciplinary proceedings are explicitly included within civil liability for the purposes of s 13(3). That means practitioners must continue to comply with professional standards and exercise appropriate clinical care to retain statutory protection. Failure of clinical standards could expose practitioners to civil and disciplinary liability despite the statutory protections.

DPP consent could limit private enforcement: Section 15 requires DPP consent for prosecution for the offences in the Part dealing with unqualified persons. That concentrates prosecutorial gatekeeping with the DPP and limits private avenues for commencing prosecutions. Entities or persons seeking criminal enforcement should be aware that the DPP’s written consent remains a statutory precondition.

Emergency exceptions are fact dependent: The emergency exceptions in ss 6(3), 8(2) and 11(5) permit action without complying with some procedural requirements, but they are fact specific. Applying the emergency exceptions carries evidential and potentially legal scrutiny. Practitioners should document the clinical rationale when relying on emergency exceptions to justify expedited or deviating action.

Penalties are monetary for confidentiality breaches, not necessarily criminal for all disclosures: Publication restrictions under s 18 attract monetary penalties rather than imprisonment. Confidentiality breaches under s 19(1) carry a maximum penalty of $10,000. Understanding whether a breach may attract civil, regulatory or criminal consequences requires detailed analysis of the context and the identity of the person making the disclosure.

Practical checklist for clinical practice

• Verify registration and prescribing authority. Ensure you are a registered health practitioner under the national scheme (s 3), and if you are a non‑medical registered practitioner who intends to prescribe or administer abortifacient drugs, ensure you are explicitly authorised under s 18 of the Controlled Substances Act 1984 (s 5(1)(b)(ii); s 4).

• Observe gestational thresholds and documentation. For medical practitioners performing terminations in ordinary practice, confirm gestational age on file and do not perform terminations beyond 22 weeks and 6 days unless the conditions in s 6 are satisfied. For later terminations, document the clinical basis under s 6(1)(a), the second practitioner consultation under s 6(1)(b) with that practitioner’s independent assessment, and the use of a prescribed hospital under s 6(1)(c). In emergencies, document the clinical reasoning and facts supporting reliance on s 6(3).

• Apply the mandatory considerations for later terminations. In decisions under s 6(1), expressly consider the statutory matters in s 9. Record how each relevant factor was considered, particularly when matters such as access barriers, late diagnoses, abuse or multiple pregnancy issues are present.

• Provide counselling information. Before performing a termination, provide the patient with all necessary information about access to counselling including publicly funded options, and record that the information was provided (s 8(1)). In emergencies, note reliance on s 8(2).

• Handle conscientious objections according to the statute. If you have a conscientious objection you must disclose it as soon as practicable when asked (s 11(2)). If the patient seeks your services or advice, promptly provide Minister‑approved contact information, or transfer care to another practitioner or health service provider believed not to object (s 11(3)-(4)). Keep records of the disclosure, the information or transfer provided, and the timing.

• Avoid sex selection terminations. Do not perform terminations for the purposes of sex selection, except where there is a substantial risk of a sex‑linked medical condition that would result in serious disability (s 12). Document clinical bases when relying on the exception.

Privacy, reporting and publication compliance

• Understand reporting obligations and data collection under regulations. Be prepared to collect and submit data and statistics as required by regulation to the Minister, Department or attached office (s 21(2)(a)). Ensure secure handling of data and deidentification where appropriate to comply with s 19 and s 18. Confirm the Minister’s annual reporting requirements and internal timelines to enable delivery by 30 April each year and laying the report before Parliament within 12 sitting days after receipt (s 20(1), (3)).

• Implement confidentiality protocols. Train staff that the Act imposes a duty not to disclose personal information obtained in the operation of the Act except where authorised by law, with consent, for approved treatment or subject to the specified exceptions in s 19(2). Maintain logs of disclosures and privacy impact assessments, and seek legal advice before any disclosure outside of the statutory exceptions. Use ethics committee approvals where research disclosures are contemplated (s 19(2)(d)).

• Avoid prohibited publication. Staff who were engaged in the operation of the Act must not publish identifying information relating to persons who sought or received a termination. Publishable materials should be vetted by legal and privacy officers. The penalties in s 18 are significant, and organisations should adopt a conservative approach to avoid inadvertent breaches.

Professional standards and risk management

• Maintain professional standards and clinical governance. Since statutory protections are conditional on good faith and absence of negligence (s 13(1)(b)), continue to follow clinical guidelines, professional standards, and local hospital policies. Document decision making, informed consent, and clinical care to support assessments of good faith and non‑negligence.

• Prepare for professional scrutiny. Be aware that contraventions listed in s 17 may be referred to professional regulators and complaint bodies. Maintain auditable records that demonstrate compliance with s 8 (counselling information), s 11 (conscientious objection procedures), s 6 (later gestation criteria), and s 12 (sex selection prohibition).

Operational and administrative steps

• Map service provision to “prescribed hospital” definitions. Monitor the regulations to identify which hospitals have been prescribed for later terminations under s 6(1)(c), and ensure referral pathways are established for transfers when required.

• Implement transfer and referral pathways. For conscientious objectors, implement a directory or process to provide Minister‑approved contact information, or to effect swift transfers of care consistent with s 11(3). Verify the Minister’s approved information content and keep records showing the information provided.

• Secure data systems and retention policies. Align clinical records, data collection and reporting systems with the Act’s confidentiality framework. Ensure that any electronic records systems used for sharing information are compliant with s 19(2)(c)(ii) and regulations, and that any secondary uses of disclosed information are prohibited unless specifically authorised (s 19(3)).

• Liaise with compliance and legal advisors on DPP consent and criminal exposure. Organisations should be aware of the DPP’s role in prosecuting unqualified persons under s 14 and s 15. While most providers will not be subject to these offences when acting as registered practitioners, non‑clinical staff and third parties should be educated about the boundaries of lawful assistance to avoid inadvertently assisting unqualified activity.

• Monitor subordinate instruments. Because many operational details will be set out in regulations and Ministerial instruments referenced in s 21 and s 11(4), maintain a process to review and incorporate regulatory changes into clinical policies, including any prescriptions of hospitals, data elements required, and exceptions or permitted disclosures.

When to seek legal advice

• Complex clinical decisions beyond 22 weeks and 6 days, reliance on emergency exceptions, or cases involving marginal clinical evidence should prompt consultation with in‑house legal counsel or external medical‑legal advisers to document compliance with ss 6 and 9.

• Any contemplated disclosure of identifiable information for research, public health, or other purposes should be cleared with legal and ethics committees in light of s 19 and s 18.

• Organisations faced with a complaint, notification, or potential prosecution should obtain specialist advice early, noting the statutory interplay with professional regulators under s 17 and the DPP consent requirement under s 15.

By following these steps, practitioners and institutions can align operational practice with the statutory architecture of the Termination of Pregnancy Act 2021 as set out in the source text.
