8CC Provision to attract the corporations power and the communications power

This Part does not apply in relation to a Telstra successor company unless the Telstra successor company: (a) is a corporation to which paragraph 51(xx) of the Constitution applies; or (aa) is a holding company (within the meaning of the Corporations Act 2001) of a body corporate that is a corporation to which paragraph 51(xx) of the Constitution applies; or (b) carries on a business that consists of or includes the supply of a carriage service (within the meaning of the Telecommunications Act 1997); or (c) carries on a business that consists of or includes the supply of a service that facilitates the supply of a carriage service (within the meaning of the Telecommunications Act 1997); or (d) carries on a business that consists of or includes installing, maintaining, operating or providing access to: (i) a telecommunications network (within the meaning of the Telecommunications Act 1997); or (ii) a facility (within the meaning of the Telecommunications Act 1997); used to supply a carriage service (within the meaning of the Telecommunications Act 1997); or (e) is a holding company (within the meaning of the Corporations Act 2001) of a body corporate that carries on a business covered by paragraph (b), (c) or (d).
