#### 8BR Base of operations to be in Australia
(1) A Telstra successor company must ensure that it maintains a substantial business and operational presence in Australia.
(2) This section does not limit a Telstra successor company’s capacity to engage in activities outside Australia.
(3) A contravention of subsection (1) is not an offence. However, a contravention of subsection (1) is a ground for obtaining an injunction under Division 1 of Part 2B.
(4) A contravention of subsection (1) does not affect the validity of any transaction.
