#### 80 Actions under sections 95 and 186 of the Telecommunications Act 1991 (1) Despite the repeal of the Telecommunications Act 1991 by this Act, sections 95 and 186 of that Act continue to apply, on and after 1 July 1997, in relation to a contravention that occurred before that date, as if: (a) those sections of that Act had not been repealed; and (b) a person who was a carrier immediately before 1 July 1997 had remained a carrier on and after that date; and (c) in the case of section 95 of that Act—a reference in that section to AUSTEL included a reference to the ACA. (2) A reference in this section to section 95 of the Telecommunications Act 1991 includes a reference to section 395 of that Act, in so far as section 395 of that Act applies to section 95 of that Act. (3) A reference in this section to section 186 of the Telecommunications Act 1991 includes a reference to section 395 of that Act, in so far as section 395 of that Act applies to section 186 of that Act. (4) In this section: > ACA means the Australian Communications Authority. > AUSTEL means the Australian Telecommunications Authority.
