53Indicative performance standards to continue in force

#### 53 Indicative performance standards to continue in force (1) This section applies to an indicative performance standard that was in force under paragraph 38(2)(b) of the Telecommunications Act 1991 immediately before 1 July 1997. (2) Despite the repeal of the Telecommunications Act 1991 by this Act, paragraph 38(2)(c) of that Act continues to apply, in relation to the standard, as if: (a) a reference in section 38 of that Act to AUSTEL were a reference to the ACA; and (b) that repeal had not been made. (3) However, the rule in subsection (2) ceases to apply to the standard if: (a) a code is registered under Part 6 of the Telecommunications Act 1997 and that code is expressed to replace the standard; or (b) a standard is determined under Part 6 of the Telecommunications Act 1997 and that Part 6 standard is expressed to replace the first‑mentioned standard.
