Section 17 preserves delegations made under the 1989 Act as delegations under the corresponding 1991 provision "being a function or power that AUSTEL is authorised by that section to delegate". If the 1991 Act authorises different delegation structures or conditions, the carry‑over delegation may need formal reaffirmation or reissue to align with new governance thresholds. Similarly, s 19 continues members and associate members for their unexpired term "as if" appointed under the 1991 Act, but appointment processes and eligibility criteria might differ under the new Act.
• Numbering and numbering plan transition. Section 13 allows the provision of services using numbers allocated before the national numbering plan is prepared under s 241 of the 1991 Act. This preserves current numbering arrangements in the short term, but practitioners should be alert to the impending national numbering plan process and to transitional commercial disputes that can flow from numbering reallocation.
• Continuation of technical standards. Section 14 treats standards determined under the old s 106 as if determined under s 246 of the 1991 Act, including for Acts Interpretation Act purposes. That presumes those standards are compatible with the new regulatory philosophy. If the 1991 Act imposes new procedures for standard‑making, past standards may still operate but their compatibility with new procedural requirements could be contested.
• FOI and competitive commercial activities. Schedule 2 updates Freedom of Information Act references to reflect the new Australian and Overseas Telecommunications Corporation Limited in relation to documents "in respect of its competitive commercial activities." This potentially changes FOI treatment of corporate records and must be considered by compliance teams.

In practical terms, the common "gotcha" is assuming that because an instrument appears to have been continued automatically, it remains substantively identical in scope and enforceability. In every case where the Act maps an old instrument into a new provision, confirm: (a) the precise textual mapping in the transitional Act; (b) whether the new Act authorises the continued instrument in the same terms; and (c) whether any carve‑outs or conditional exclusions apply.

For affected entities , incumbents (AUSSAT, OTC, Telecom), holders of old licences, persons with permits, and regulatory advisers , compliance under the transitional regime requires several concrete steps grounded in the Act’s provisions:

1. Inventory and mapping exercise.

   • Identify all existing notifications, directions, advisory committee appointments, class licences, eligible service approvals, permits, cabling licences, delegations and regulations that were in force immediately before repeal of the 1989 Acts. The Act treats such instruments as continued under the 1991 Act (see ss 5-6, 11, 12, 15-17, 20-21).
   • Map each instrument to the corresponding provision of the Telecommunications Act 1991 as the Act prescribes (for example, notifications/directions under ss 28/29 of the 1989 Act are mapped to ss 49/50 of the 1991 Act by s 5(1)).

2. Check authorisation under the 1991 Acts.

   • For continued regulations and standards, confirm that the content would be authorised by the relevant provision in the 1991 Act. Section 20(3) and s 21(3) preserve regulations only to the extent they would be authorised under the 1991 Acts. If not authorised, plan for variation, revocation, or re‑issuing under the 1991 Act.

3. Confirm licence and carrier status.

   • If you are AUSSAT, OTC or Telecom, note that you may continue to operate until the Minister decides whether to grant a licence under s 57 or the Minister revokes the transitional application by Gazette notice (s 7(2)). Establish a timetable for licence applications and allocate resources to preparing s 57 licence documentation. Also identify which obligations in Divisions 2 and 3 of Part 5 and Parts 8 and 9 are excluded from the transitional "general carrier" treatment (s 7(3)), and plan compliance accordingly.

4. Preserve approvals‑based supply practices.

   • If supplying value added services or private network services that were approved by a carrier immediately before repeal, keep written records of the approval and ensure continued supply complies with the terms of the old approval, because s 12 preserves the eligible service only while the supply remains in accordance with that approval. If supply practices change, update approvals or transition to a class licence approach under s 209.

5. Maintain and complete investigations and reporting.

   • If AUSTEL has ongoing investigations under Part 6 of the 1989 Act, the regulator must complete and report on them under s 18. Entities under investigation should prepare to respond as if the old investigatory processes remain in force for that purpose.

6. Reissue or confirm delegations and governance instruments.

   • Review delegations that were made under s 140 of the 1989 Act and are continued under s 17 as delegations under s 279 of the 1991 Act. Confirm that delegated powers remain appropriate under the authorising text of the 1991 Act. Similarly, ensure that membership appointments continued under s 19 comply with any procedural or eligibility differences in the 1991 Act.

7. Track commencement dates and Gazette notices.

   • Keep track of commencement dates identified in s 2 and the day fixed under the Australian and Overseas Telecommunications Corporation Act 1991 for s 24 and Part 5. Monitor the Gazette for any Ministerial notice under s 7(2)(b) that determines the cessation of transitional application for a corporation. These commencement and notice events materially change legal status.

8. Update compliance manuals and cross‑statute obligations.

   • The Schedules amend many other Commonwealth statutes by substituting the "carrier" definition and by aligning year references. Update internal compliance manuals, forms and training to reflect that obligations formerly referring to named corporations or the 1989 Act now refer to "carriers" and the 1991 Act. This includes interception obligations (Telecommunications (Interception) Act 1979 amendments), criminal exposure (Crimes Act amendments), FOI treatment (Schedule 2), and broadcasting or radiocommunications cross‑obligations.

9. Numbering and equipment standards.

   • If services use numbers allocated prior to the national numbering plan, continue provision consistent with s 13. Confirm that any customer equipment connection permits and cabling licences that were in force immediately before commencement are treated as new permits and cabling licences under ss 15-16, preserving their conditions; ensure ongoing operations adhere to those preserved conditions.

10. Legal review and documentation.

    • For each preserved instrument, document the statutory basis for continuity (cite the specific transitional section). Where regulatory obligations have shifted in scope because of Schedule amendments (for example offences that now apply "or by a carrier"), perform a legal risk assessment to identify new exposure and adapt contracts, insurance and compliance controls accordingly.

For advisers and compliance teams, the central task is legal mapping plus proactive regulatory engagement. The transitional Act keeps many old instruments alive but simultaneously subjects them to the authorising terms and structures of the 1991 Acts. That duality means continued operational reliance on an instrument is only secure after (a) confirming the transitional mapping in this Act, and (b) confirming that the instrument conforms to the authorisation and procedural requirements of the new 1991 statutory provisions.
