Telecommunications (Telemarketing and Research Calls) Industry Standard 2017

The instrument relies on a small number of defined legal concepts and cross‑references, which determine scope and obligations.

• Caller: a "participant in a section of the telemarketing industry" who makes, attempts to make, or proposes to make a call (s6). This is the actor directly responsible for compliance with the standard’s duties. The instrument also defines "cause" in extended terms so that third parties who contract for calls, and employers of call operators, can be treated as having caused a call (s6(2)-(3)). The statutory causation definitions therefore extend responsibilities up the contractual and employment chain.

• Call and telemarketing call: the instrument defines call to mean a telemarketing call, and adopts the Act’s definition of telemarketing call which is linked to the Do Not Call Register Act 2006. That definition comprises either a telemarketing call made to an Australian number, or a voice call to an Australian number where, judged by content and presentational aspects, the purpose includes opinion polling or standard questionnaire research (s6; note to s6 and the quoted text of s7 of the Act). The term research call is the subset of telemarketing calls that meet the Act’s paragraph (b) test for opinion polling or questionnaire research (s6). The instrument therefore separates duties for research calls and non‑research telemarketing calls in several provisions (for example s8 timing differences, s9 and s10 disclosure requirements).

• Relevant account‑holder and nominee: these terms come from the Do Not Call Register Act 2006 and are used to determine the "usual residential address" against which local time is measured for prohibited calling times (s6; s8(4)). The "usual residential address" is therefore a statutorily significant marker for time zone and prohibited time calculations.

• Calling line identification: defined in the instrument as a facility that indicates the telephone number from which the call was initiated or the number to which the call recipient may call back (s6). The instrument requires calling line identification to be enabled when calling, and imposes minimum functionality and longevity obligations on the transmitted number (s14).

• Information obligations: detailed in separate sections for non‑research calls (s9) and research calls (s10), covering what must be given as soon as the call starts, what may be deferred or omitted in narrow circumstances, what must be supplied immediately on request, and what contact details must include (s11).

• Recorded or synthetic voice calls: treated specially. Where a call involves recorded or synthetic voices, the caller must provide a mechanism during the call by which the call recipient can request the information required under the relevant disclosure regime (s12).

• Termination obligation: the caller must immediately terminate if the caller becomes aware that the recipient is not at the usual residential address of the relevant account‑holder and the time at the recipient’s location would be a prohibited time at the usual residential address, unless the recipient expressly wants the call to continue; and the caller must terminate if the recipient asks for termination or otherwise indicates they do not want the call to continue (s13).

• Interaction with other laws: references to other legislative instruments are to be read as references to those instruments as in force from time to time (s7). The standard expressly preserves concurrent State and Territory laws that are capable of operating alongside the standard (s15).

These concepts function together to create a compliance framework. The definition of "cause" broadens legal responsibility beyond the immediate caller, the "usual residential address" anchors temporal limits, and calling line identification and contact details anchor the recipient’s ability to follow up. The separation between research and non‑research calls produces differential timing and disclosure obligations, and the ACMA is explicitly given a role in requiring proof of express consent for exceptions (s8(5)(c)).

The instrument states it applies to "participants in each section of the telemarketing industry" in the context of subsection 125A(1) of the Act (s5). Reading the definitions and provisions together shows the scope extends beyond the person who physically places a telephone call.

• Direct callers: persons or organisations that make telemarketing or research calls to Australian numbers, whether live operators or automated services, are directly within scope because the duties are expressed as obligations on "callers" (s6; s8-s14). A call that involves recorded or synthetic voices remains subject to particular obligations (s12).

• Employers of call operators: a person who is the employer of another who makes a call as a call operator is taken to have "caused" the call for the purposes of the instrument, subject to the caveat that the call is not caused by another person under the contracting definition (s6(3)). This extends obligations and potential regulatory focus to employers that operate outbound calling operations, including in‑house contact centres.

• Contracting parties and principals who outsource: a person is taken to have "caused" a call if they enter a contract or arrangement, other than a contract of employment, under which another undertakes to make calls, and that other person or their employees or agents give effect to the arrangement by making a call (s6(2)). In effect, principals who contract third‑party call centres, agencies or telemarketing vendors can be treated as having caused calls, and therefore their arrangements are relevant to compliance.

• Organisations using nominees: where express consent is relied upon from a relevant account‑holder or their nominee to make calls at otherwise prohibited times, the caller who relies on that consent must be prepared to demonstrate the consent to the satisfaction of the Australian Communications and Media Authority, if required (s8(5)(a)-(c)). Nominees are defined by the Do Not Call Register Act 2006, and therefore organisations that rely on nominated consent must factor in the statutory nominee concept (s6).

• Call recipients and relevant account‑holders: the instrument prescribes protections for individuals who receive an outbound telemarketing or research call to an Australian number, through restricted calling times, disclosure obligations and termination rights (s8; s9; s10; s13). The standard uses the "usual residential address" of the relevant account‑holder to determine time zone for calling restrictions (s8(4)), so account‑holders and those whose numbers are associated with an account are central to how obligations are applied.

• Agents and contractors: because the definition of cause reaches agents and broader contractual arrangements, intermediaries operating call campaigns, and suppliers of outbound calling services, fall within the instrument’s practical scope even if they are not the contracting principal (s6(2)).

• Entities making research calls: research calls are treated differently in timing (s8(2)) and disclosure (s10). Entities that conduct opinion polling or questionnaire‑based research by voice call to Australian numbers are therefore specifically in scope and must follow the separate set of obligations that apply to research calls (s6 note; s10).

The instrument does not limit its application by size of organisation, commercial model, or geographic location, provided the call is made to an Australian number and the person is a participant in the telemarketing industry. It also preserves the operation of State and Territory laws to the extent they are capable of operating concurrently, so a person who must comply with a State or Territory telemarketing or privacy regime may have to meet both sets of obligations (s15).

This section sets out the principal operational duties imposed by the standard, and the principal rights recognised for callers and call recipients.

Key duties on callers, with section references:

• Observe prohibited calling times. Non‑research telemarketing calls are prohibited on weekdays before 9 am or after 8 pm, on Saturdays before 9 am or after 5 pm, and on Sundays entirely, subject to certain exceptions and to State and Territory laws (s8(1); s8 note). Research calls have a slightly expanded window, prohibited on weekdays before 9 am or after 8.30 pm, Saturdays before 9 am or after 5 pm, Sundays before 9 am or after 5 pm, again subject to exceptions and other laws (s8(2)).

• Terminate prohibited calls immediately upon discovering the recipient is outside the relevant location or when requested. A caller must immediately terminate a call if the person making the call receives information that a reasonable person would conclude the call recipient is not at the usual residential address of the relevant account‑holder and the call is received at a time that would be a prohibited calling time at that usual residential address (s13(1)(a)). A caller must also terminate immediately if the call recipient asks for termination or otherwise indicates they do not want the call to continue (s13(1)(b)).

• Provide identifying information promptly at the start of a call. For non‑research calls, the caller must provide as soon as the call starts the given name of the individual making the call (unless the call uses solely recorded or synthetic voice), the employer’s company or registered business name or other readily identifiable name, the registered business name if the individual is self‑employed, the name of the person causing the call if not already mentioned, and the purpose of the call (s9(2)). For research calls, similar information is required, but the person causing the call need not be disclosed at the start if doing so would reveal that person, provided it is given on request and in any case before the end of the call (s10(2); s10(4)).

• Provide contact details on request. Immediately after being asked by the call recipient, the caller must provide contact details for the employer or self‑employed caller, and contact details for the person that caused the call, and the name and contact details of any person responsible for dealing with enquiries or complaints about the caller, employer or person who caused the call (s9(4); s10(5)).

• Ensure contact details meet minimum standards. Contact details must include a company name or registered business name or alternative readily identifiable name, an Australian number suitable for receiving voice calls during normal business hours at the location of the call recipient, and at least one of street address, postal address, email address, or a web address that provides a customer contact facility or other of those addresses (s11).

• Enable calling line identification and ensure returnability. A caller must ensure calling line identification is enabled when making or attempting a call and must ensure the number transmitted to the recipient’s calling number display is one that, if called by the recipient, will enable the recipient to obtain the required information within a reasonable timeframe (s14(1)-(2)). The transmitted number must be reasonably likely to be capable of receiving a return telephone call for at least 30 days from when the call was made (s14(3)).

• Provide a mechanism in recorded or synthetic voice calls. When recorded or synthetic voices are used, the caller must provide a mechanism during the call by which the call recipient can request the information required under s9(4) or s10(5), as applicable (s12).

Rights, exceptions and discretion available under the instrument:

• Express consent exception. Subsections (1)-(3) of s8 (the various prohibited calling times) do not apply if the relevant account‑holder or a nominee has provided express consent in advance to receiving a particular call at the prohibited day or time, the caller only makes the call at the consented day or time, and, if required by the ACMA, the caller demonstrates the existence of the consent to the ACMA to its satisfaction (s8(5)(a)-(c)). This is a limited exemption that is conditioned on proof if the ACMA requires it.

• Limited omission at call start where the call is terminated quickly. The disclosure requirements at the start of a call do not apply if the call recipient terminates the call before the information can be provided, or if the caller terminates within 5 seconds without speaking to the recipient (s9(3); s10(3)). This recognises very short or aborted calls.

• Research calls may withhold causing person at outset. For research calls, if disclosing the employer or self‑employed identity at the start would reveal the person who caused the call, the caller may delay that disclosure but must provide it on request immediately and in any case before the end of the call, unless the recipient terminates early (s10(4)). This is a conditional relaxation of the immediate identification obligation.

• State and Territory law interplay. The standard preserves State and Territory laws that can operate concurrently; where those laws impose different or additional prohibitions on calling times, callers must comply with both regimes where they apply (s15). The instrument notes that callers may be prohibited by State or Territory law from making calls at times other than those set out in s8(1)-(3) and s8(2).

Operationally, the duties impose time‑based constraints, realtime disclosure and verification obligations, and technical network requirements (calling line identification functionality and durability). The causation provisions extend duties to employers and contracting principals, thereby affecting decisions about outsourcing, contracts, and supervision. The ACMA is explicitly empowered to require demonstration of express consent where an exception is relied upon (s8(5)(c)), giving it a role in evidentiary compliance.

The industry standard itself does not include explicit penalty or sanction provisions within its text. It is made under subsection 125A(1) of the Telecommunications Act 1997 (s3), and it provides a number of compliance‑focussed duties and ACMA‑facing evidentiary requirements, but the instrument does not set out fines, infringement notices or other specific sanctions in its provisions.

What the instrument does provide relevant to enforcement and regulatory oversight:

• ACMA engagement on proof of consent. Where a caller relies on express consent to make a call at a prohibited time, the caller must, if required by the Australian Communications and Media Authority, demonstrate to the satisfaction of the ACMA the existence of the consent and that the call was made only at the consented time (s8(5)(c)). That provision gives ACMA an explicit evidentiary enforcement role in relation to the express consent exception.

• Preservation of State and Territory laws. The standard expressly states it is not intended to exclude the operation of a law of a State or Territory capable of operating concurrently (s15). Many State or Territory regimes include their own enforcement and penalty mechanisms. The instrument therefore contemplates enforcement through other legal regimes where they apply.

• No internal penalty clauses. A careful reading shows no internal clause that awards monetary penalties, civil pecuniary penalties, administrative sanctions or direct injunctive remedies in the text of the standard itself. The standard instead specifies operational obligations that can be examined and tested by the ACMA, and leaves the precise enforcement toolbox to the parent Act and to other laws.

Practical consequences of this textual structure:

• Investigative and evidentiary focus. Because the instrument requires demonstrable evidence in specific cases, particularly for express consent, enforcement will be evidentiary in nature. The ACMA’s power to require demonstration implies investigatory or compliance activities where consent is contested.

• Multi‑jurisdictional enforcement pathways. State and Territory laws that operate concurrently may supply explicit penalties and enforcement regimes; callers may therefore face enforcement action under those laws for failing to comply with stricter or additional prohibitions (s15). The standard itself does not displace those regimes.

• Contractual and civil risk. The instrument’s expanded definitions of causation mean that contractual principals and employers may be treated as responsible for calls made by contractors or employees (s6(2)-(3)). Even in the absence of an express penalty provision in the standard, that extension can create risk of regulatory scrutiny and potential enforcement under the parent Act or other laws that apply to "causing" prohibited conduct.

The instrument’s text confines its own content to operational and evidentiary duties, and leaves the precise forms of sanction or remedy to be located in the parent statute or in other Commonwealth, State or Territory laws. The instrument does not itself explain what specific enforcement powers or penalties the ACMA may exercise under the Telecommunications Act 1997 or other laws.

The instrument contains explicit cross‑references and statements that determine its legal interaction with other statutory regimes.

• Made under the Telecommunications Act 1997. The instrument states that it is made under subsection 125A(1) of the Telecommunications Act 1997 (s3). That identifies the parent statutory authority for its issuance. The instrument does not itself restate or reproduce the enforcement or administrative powers contained in the parent Act within its text.

• Definitions cross‑referenced to the Do Not Call Register Act 2006. Several key definitions are adopted by reference, including Australian number, relevant account‑holder, nominee and voice call, by referring to the Do Not Call Register Act 2006 (s6). The instrument also reproduces the Act’s definition of telemarketing call by quotation in the Notes to s6. Consequently, the border between telemarketing, research and other voice calls depends on the definitions developed in the Do Not Call Register Act 2006 and the Telecommunications Act 1997.

• Incorporation of interpretative approach to other instruments. The instrument states that a reference to another legislative instrument means that instrument as in force from time to time (s7). This makes the instrument dynamically linked to amendments in instruments it references, so changes in the Do Not Call Register Act or other legislative instruments will flow into the standard’s meaning without amendment of this instrument itself.

• Concurrent operation with State and Territory laws. Section 15 expressly provides that the industry standard is not intended to exclude the operation of State or Territory laws to the extent those laws are capable of operating concurrently. The examples in the instrument illustrate that State/Territory laws may prohibit calls at times outside the prohibited times in s8, and such laws will continue to apply (s15 and notes to s8). This means regulated entities must consider Commonwealth, State and Territory regimes and comply with the most restrictive applicable rule where they operate together.

• ACMA’s role. The instrument names the ACMA and specifically contemplates an ACMA role in determining evidentiary sufficiency for express consent when a caller invokes the exception in s8(5). That embeds a regulatory oversight function into the instrument and implies investigation, compliance checks and evidence demands may be an element of enforcement (s8(5)(c)).

• Interaction with privacy, consumer protection and telecommunications law. While the text of the industry standard does not directly reference privacy or consumer protection statutes, its requirements touch on matters subject to those regimes, such as caller identification, disclosure of sponsorship or causation and handling of complaints. The instrument does not assert primacy over those laws, and because it cross‑references other Commonwealth regimes, entities will need to map obligations under the Do Not Call Register Act, the Telecommunications Act and relevant State/Territory laws to ensure full compliance.

In sum, the industry standard is a Commonwealth instrument that operates within a network of existing legislation. It borrows definitions from and refers to the Do Not Call Register Act 2006, is made under the Telecommunications Act 1997 and preserves State/Territory concurrent laws. It also creates particular evidentiary relationships with the ACMA through the express consent provision (s8(5)(c)). Compliance therefore requires navigating multiple statutory sources as they currently stand, because the instrument reads those references as to be treated "as in force from time to time" (s7).

The instrument itself is short on amendment entries but records two immediate institutional events in its text.

• Repeal of the 2007 industry standard. Section 4 expressly repeals the Telemarketing and Research Industry Standard 2007 (Registration No. F2007L00815). This is a direct replacement mechanism, indicating that the present 2017 instrument takes the place of the 2007 standard, and the 2007 instrument is no longer in force once this instrument commences (s4).

• Commencement. Section 2 states the industry standard commences at the start of the day after it is registered. That sets a clear mechanical commencement date linked to registration rather than to a calendar date specified in the instrument (s2).

There are no further amendment clauses, transitional provisions or savings clauses set out in the text provided. The instrument also contains a general clause about references to other legislative instruments being references to those instruments "as in force from time to time" (s7). That clause has the practical effect that amendments to referenced statutes or instruments will inform the application of this industry standard without the need to amend the standard in lockstep, at least insofar as statutory definitions and referenced terms are affected.

Because the instrument is made under subsection 125A(1) of the Telecommunications Act 1997 (s3), any future amendments to the parent Act that alter the rulemaking power under s125A may affect the capacity to amend or the scope of instruments made under that power. The instrument itself contains no amendment history beyond the repeal of the 2007 standard and the mechanics of commencement. It does not set out staged implementation measures, transitional relief or grandfathering for conduct lawful under the 2007 standard.

Practitioners advising clients on historical obligations should therefore note that the 2007 standard was expressly repealed by s4; to establish what obligations applied in a prior period, one must consult the repealed 2007 instrument. The present instrument, once registered and commenced, is the operative industry standard for telemarketing and research calls per its commencement clause (s2) and repeal clause (s4).

The instrument’s text provides no litigation history, case references or judicial interpretations. It contains no citations to judicial decisions, and no reference to prior court or tribunal findings. The document is confined to statutory text, definitions, notes and examples illustrating the application of provisions.

What the instrument does offer that bears on the prospect of litigation and disputes:

• Evidentiary obligations that could generate dispute. The express consent exception requires a caller to be capable of demonstrating the existence of consent to the satisfaction of the Australian Communications and Media Authority if the ACMA requires it (s8(5)(c)). Disputes over whether adequate consent exists, and over the sufficiency of evidence provided to ACMA, are the kinds of factual and legal contentions that may lead to administrative review or litigation before appropriate courts or tribunals, although this instrument does not itself prescribe the enforcement pathways.

• Allocation of "causing" responsibility that can generate contractual disputes. The instrument treats persons who contract for calls, and employers of call operators, as having "caused" calls for the purposes of the standard if arrangements result in calls being made (s6(2)-(3)). That allocation may be the subject of contractual or regulatory disputes between principals and service providers about who bore compliance obligations and who holds evidence of consent or call logs. Those disputes could surface in litigation or in regulatory compliance proceedings, although again the instrument does not specify particular remedies.

• Interaction with other regimes as a source of litigation. Because the standard preserves concurrent State and Territory law (s15) and relies on definitions in the Do Not Call Register Act 2006 and the Telecommunications Act 1997 (s6; s3), litigation concerning applicability, primacy or enforcement could logically involve interpretation of multiple statutes together. The instrument itself does not supply litigation history, but its architecture presupposes multi‑instrument legal analysis in disputes.

In short, the instrument contains no documented litigation history. It establishes definitions and duties that are capable of producing disputes over evidence, causation and compliance, but the text offers no direct account of past cases or adjudications. For any litigation research, practitioners must examine ACMA enforcement decisions, the Telecommunications Act 1997, the Do Not Call Register Act 2006 and relevant State and Territory laws and any judicial or tribunal decisions interpreting them, since this instrument is a piece of that larger statutory and regulatory framework.

The instrument contains several provisions that may produce practical compliance pitfalls. These are matters that often catch callers, principals and advisers when they operationalise outbound calling campaigns.

• Time zone is anchored to the "usual residential address" of the relevant account‑holder. Prohibited calling times are calculated by reference to the time of day at the place that is the usual residential address of the relevant account‑holder (s8(4)). Therefore, a call received on a mobile phone in another time zone can be prohibited if the account‑holder’s usual residential address is in a different zone and the time at that usual address is a prohibited time. This creates risk for mobile and cross‑border calling where the caller cannot reliably determine the recipient’s location.

• Immediate termination obligation when recipient is not at the usual residential address. If the person making the call receives information that would lead a reasonable person to conclude the recipient is not at the usual residential address of the relevant account‑holder and the recipient is receiving the call at a prohibited time relative to the usual residential address, the caller must immediately terminate the call (s13(1)(a)). Practically, this requires real‑time awareness and training of operators to ask confirmatory questions or to respond quickly when recipients identify their location or time zone.

• Express consent exception requires demonstrable proof to ACMA. The exception to prohibited calling times for calls made with express consent is conditional on the caller being prepared to demonstrate the consent to the satisfaction of the ACMA if the ACMA requires it (s8(5)(c)). That imposes a documentary proof burden; reliance on informal or undocumented consent is therefore a compliance risk.

• Causation extends obligations up contractual and employment chains. A person who contracts for calls, other than by contract of employment, is taken to have caused the calls if the contractor implements the arrangement by making calls (s6(2)). Likewise employers of call operators are treated as causing calls made by their employees (s6(3)), unless the call is caused by another person under subsection (2). Clients frequently underestimate this extension when outsourcing telemarketing; principals may be exposed to regulatory scrutiny for actions of contractors.

• Differences between research and non‑research calls. Timing windows and disclosure duties differ between research and non‑research calls (s8(1) and (2); s9 and s10). Misclassifying a call as research to exploit a longer permitted time window exposes the caller to non‑compliance. The instrument’s definitions depend on the content and presentational aspects of the call per the Act’s definition of telemarketing call (s6; note to s6).

• Disclosure timing and the 5‑second carve out. The obligation to provide identifying information "as soon as the call starts" does not apply if the call recipient terminates before the information can be provided, or the caller terminates within 5 seconds without speaking to the recipient (s9(3); s10(3)). That narrow carve out is limited; failure to provide required information where the call is not quickly terminated is a compliance risk.

• Recorded or synthetic voice calls require a live or interactive mechanism to request details. Where calls involve recorded or synthetic voices, callers must ensure there is a mechanism during the call by which the call recipient can request the information required under s9(4) or s10(5) (s12). Automated systems that play recorded scripts but do not provide a prompt and effective mechanism for requesting human interaction or contact details can fall foul of this duty.

• Calling line identification obligations include number durability and functionality. Callers must enable calling line identification and ensure the number transmitted will allow the recipient to obtain required details within a reasonable timeframe, and that the number will be reasonably likely to receive a return call for at least 30 days after the call (s14(1)-(3)). Temporary numbers, number‑spoofing, or numbers that cannot accept return calls breach these obligations.

• Contact details must be local and functional. Contact details must include an Australian number suitable for receiving voice calls during normal business hours at the location of the call recipient, and one or more addresses or an email or web address that supports customer contact (s11). Using overseas contact numbers or non‑responsive addresses risks non‑compliance.

• Concurrent State/Territory rules may be stricter. The industry standard does not displace State and Territory laws to the extent they can operate concurrently; some States and Territories may impose stricter calling hours or other requirements (s15). Callers must therefore map and comply with the most restrictive applicable rules across jurisdictions.

• Research calls may defer disclosure of the person causing the call, but only with limits. If providing employer details at the start would reveal the causing person, those details can be withheld at the outset for research calls, but must be provided immediately on request and in any case before the end of the call (s10(4)). Research programs that obscure sponsorship must be ready to disclose on immediate request.

Each of these "gotchas" is grounded in a specific subsection of the instrument. Practitioners should ensure operational procedures, scripts, recordkeeping and technical arrangements address these specific requirements to avoid inadvertent non‑compliance.

Below is a practical, section‑referenced checklist for entities that make, cause or manage telemarketing and research calling activity to Australian numbers. The checklist aims to translate the instrument’s text into discrete compliance steps.

1. Determine whether each outbound voice contact is a "telemarketing call" or a "research call". Use the Act’s definition quoted in the instrument and the Do Not Call Register Act 2006 definitions referenced in s6. Classify campaigns accordingly because timing and disclosure duties differ (s6; s8; s9; s10).

2. Establish calling time rules in systems and scripts. Program dialling systems and operator schedules to block calls outside permitted windows:

   • For non‑research calls, block weekdays before 9 am and after 8 pm, Saturdays before 9 am and after 5 pm, and all day Sundays, subject to express consent exceptions (s8(1)).
   • For research calls, block weekdays before 9 am and after 8.30 pm, Saturdays before 9 am and after 5 pm, Sundays before 9 am and after 5 pm, and national public holidays as specified (s8(2)-(3)).
   • Implement logic to calculate prohibited times relative to the usual residential address of the relevant account‑holder (s8(4)).

3. Capture and retain express consent documentation where calls are to be made outside prohibited times. Where express consent is obtained from the relevant account‑holder or their nominee to receive a call at a prohibited time, record full details of the consent including date, time, identity of the consenting account‑holder or nominee, the specific days and times consented to, and any related call identification. Be prepared to demonstrate the consent to the ACMA if required (s8(5)(a)-(c)).

4. Train operators on immediate disclosure scripts. Prepare and require the use of short scripts that, as soon as the call starts, state the items required by s9(2) for non‑research calls and s10(2) for research calls:

   • Given name of the individual making the call, unless the call uses solely recorded or synthetic voice.
   • Employer company name or registered business name, or registered business name if self‑employed, or an alternate readily identifiable name.
   • For non‑research calls, the name of the person causing the call, if not already mentioned (s9(2)(d)).
   • Purpose of the call (s9(2)(e); s10(2)(d)).

Make clear the limited exceptions where these immediate disclosures are not required, namely where the recipient terminates before the information can be provided, or the call is terminated by the caller within 5 seconds without speaking (s9(3); s10(3)).

5. Prepare mechanisms to supply contact details immediately on request. Ensure staff and automated systems can supply the contact details described in s9(4) and s10(5) immediately upon request. These contact details must meet the minimum content requirements set out in s11: a company or registered business name or alternative, an Australian voice number suitable for the recipient’s location and hours, and at least one of street address, postal address, email or a web contact facility.

6. Configure technical systems for calling line identification. Ensure calling line identification is enabled on outbound calls and that the number displayed to recipients is one that enables the recipient to obtain the required information within a reasonable timeframe (s14(1)-(2)). Maintain that number so it is capable of receiving return calls for at least 30 days after the call (s14(3)). Avoid practices that block CLI or transmit numbers that will bounce or are not answered.

7. Design recorded and synthetic voice processes to include an interactive mechanism. If a call uses recorded or synthetic voices, implement a facility during the message that allows the recipient to request the caller’s identification and contact details, for example an option to press a key to speak to an operator or to be transferred to a live assist, or to receive a text or email with contact particulars (s12).

8. Institute termination protocols. Train staff and program systems so that calls are immediately terminated if the operator becomes aware the recipient is not at the usual residential address and the time at that address is a prohibited time, unless the recipient expressly wants to continue (s13(1)(a)-(2)). Ensure operators terminate calls immediately when requested by the recipient or when a recipient otherwise indicates they do not want the call to continue (s13(1)(b)).

9. Map contractual responsibility and evidence flows. Because a person who contracts to have calls made, or an employer of call operators, can be treated as having "caused" a call (s6(2)-(3)), ensure outsourcing contracts require the contractor to comply with the standard and to provide evidence of compliance, call recordings and consent records on request. Include warranties and indemnities in agreements, and ensure contractors maintain logs of CLI numbers used, contact details provided, and consent proofs.

10. Record retention for evidentiary purposes. Although the standard does not specify an explicit retention period for proof of consent, it does require durability of returnability of numbers for 30 days (s14(3)) and contemplates ACMA review of consent adequacy (s8(5)(c)). Maintain records of express consents, call logs, scripts used, and recordings for a period sufficient to respond to regulatory enquiries and to demonstrate compliance. The appropriate retention period should be determined with reference to the parent statute’s recordkeeping obligations and the practicalities of regulatory enquiries.

11. Check State and Territory requirements. Because State and Territory laws can apply concurrently and may impose stricter calling prohibitions, verify and incorporate applicable State/Territory rules into calling controls (s15). Implement the most restrictive applicable rule across jurisdictions where calls may reach recipients subject to different regional regimes.

12. Special rules for research calls. For research calls, where identifying the employer or registered business at the start would reveal the person who caused the call, callers may defer that information but must supply it immediately on request and in any case prior to call end (s10(4)-(5)). Include script variations and operator training for such circumstances.

13. Audit and compliance testing. Regularly audit outbound calling operations for CLI enablement, proper transmission of a working Australian telephone number, promptness and completeness of initial disclosures, capacity to supply contact details on request, and immediate termination behaviour. Test recorded message flows for interactive access to information as required by s12.

14. Plan responses to ACMA evidence requests. Given ACMA’s role in requiring demonstration of express consent, prepare processes to respond to evidence requests promptly and to provide the records that demonstrate adherence to the standard’s requirements, including consent records and call logs (s8(5)(c)).

Following these steps will align operational practices with the instrument’s specific obligations. The instrument itself does not set out penalties; therefore entities should adopt conservative compliance practices, maintain robust documentary evidence of consent and disclosures and ensure contractual arrangements with third parties allocate responsibility and data access to demonstrate compliance where required.
