Telecommunications (Requirements for DSL Customer Equipment for Connection to a Switched Telephone Network – AS/CA S041) Technical Standard 2025

This instrument is a technical standard made by the Australian Communications and Media Authority (ACMA) under subsection 376(1) of the Telecommunications Act 1997 (see s 3). It is titled the Telecommunications (Requirements for DSL Customer Equipment for Connection to a Switched Telephone Network - AS/CA S041) Technical Standard 2025 and commences on 30 March 2025 (s 1(1), s 2). The instrument repeals the earlier 2015 standard named Telecommunications Technical Standard (Requirements for DSL Customer Equipment for connection to the Public Switched Telephone Network - AS/ACIF S041) 2015 (s 4). The stated objects are fourfold: protecting the integrity of telecommunications networks and facilities; protecting health and safety of those who operate, work on, use services supplied by, or are otherwise reasonably likely to be affected by the operation of, a telecommunications network or facility; ensuring customer equipment can be used to give access to emergency call services; and ensuring interoperability of customer equipment with a telecommunications network for supply of a standard telephone service (s 5).

Mechanically, the standard operates by declaring that customer equipment which connects with a DSL service that shares the metallic local loop with an analogue switched telephone network two‑wire service must meet the requirements of specific Communications Alliance standards (AS/CA S041.1, S041.2 and S041.3) described in the instrument (s 6, s 8, s 13). AS/CA S041.1 applies in all cases; AS/CA S041.2 applies where the item is a DSL item; and AS/CA S041.3 applies where the item is an ADSL item (s 8). The instrument sets out the compliance model and timing rules for items and modified items: non‑modified items must satisfy the criteria in s 15; modified items must satisfy s 16; transitional and overlapping transition period arrangements are set out in ss 9, 10, 15 and 16; and pre‑commencement items that complied with the 2015 standard are treated as complying (s 17).

Operationally, the technical standard makes ACMA’s technical requirement for covered customer equipment dependent on the content and timing of the Communications Alliance standards. The instrument defers to Communications Alliance-produced amendment instruments or replacement standards when determining transitional arrangements (ss 9-10). The standard itself does not set technical tests in the text; instead it incorporates the AS/CA documents by reference and sets rules for which version of those documents applies to a given item, including rules for classes of items and modified items (ss 6, 8, 11-12, 15-16). The instrument therefore links legal compliance to the existence, content and timing of industry standards published by Communications Alliance Ltd (s 6 notes and s 8).

This technical standard is limited in scope to customer equipment that connects to a DSL service sharing the metallic local loop with an analogue switched telephone network two‑wire service, and expressly excludes equipment used only for connection to an analogue switched telephone network two‑wire service or equipment intended to operate in an all‑digital mode (s 13(1)-(2)).

The instrument relies on a small set of core concepts that determine scope, applicable standards and timing.

• Customer equipment and items: The instrument applies to "customer equipment" (as that term is used in the Act) that connects with a DSL service sharing the metallic local loop with an analogue two‑wire switched telephone service (s 13(1); see s 6 definitions). The label "item" is used to denote a thing of customer equipment to which the standard applies and includes modified items (s 6,definition of item and modified item).

• DSL item and ADSL item: A "DSL item" is customer equipment that is a DSL modem or part of a DSL modem used for connection to any DSL service sharing the metallic local loop with an analogue two‑wire service; an "ADSL item" is an ADSL filter or part of an ADSL filter used for connection to an ADSL service that shares the metallic local loop with an analogue two‑wire service (s 6). The instrument provides notes explaining DSL and ADSL acronyms (s 6).

• Applicable AS/CA Standards: Compliance is judged against Communications Alliance standards. The instrument identifies three specific AS/CA documents as "applicable AS/CA Standards": AS/CA S041.1 (general), AS/CA S041.2 (modems for all DSL services) and AS/CA S041.3 (filters for xDSL services) (s 6 definitions; s 8). AS/CA S041.1 is applicable in all cases; S041.2 and S041.3 apply depending on whether the item is a DSL item or an ADSL item (s 8).

• Transition periods: Two related transition period concepts control which version of an AS/CA standard applies to items imported, manufactured or modified during a change to an AS/CA standard. An "AS/CA transition period" is a period specified by Communications Alliance in an amendment instrument or replacement standard that deals with transitional matters (s 10). The "ACMA transition period" is the period ACMA treats as the transition period for legal compliance; it equals the AS/CA transition period when one exists, otherwise it defaults to two years from the day the applicable AS/CA Standard is amended or replaced (s 9).

• Classes and modified items: The instrument recognises "classes" of items. For non‑modified items, a later item can rely on the original item’s compliance if items are identical and share the same manufacturer or importer (s 11(1) and s 15(2)). For modified items, similar class rules apply (s 11(2) and s 16(2)). A "modified item" is an item modified after manufacture or import by or on behalf of the manufacturer or importer, and the "date a modified item is made" is the date the modification was made (s 6, s 12).

This instrument assigns obligations and produces compliance consequences primarily for manufacturers, importers and modifiers of customer equipment that connects to a DSL service sharing a metallic local loop with an analogue switched telephone two‑wire service (s 13(1); s 6 definitions). It also affects carriers and carriage service providers indirectly because the stated objects include protecting the integrity of telecommunications networks and ensuring interoperability for supply of a standard telephone service (s 5). The practical parties affected are:

• Manufacturers and importers of DSL modems and ADSL filters: These parties must ensure that items they manufacture in Australia or import meet the applicable AS/CA Standard as in force on the relevant manufacturing/import date, or qualify under the class or transitional rules (s 15). The instrument expressly deals with imported items, and the definitions and notes reference the Act’s definitions for "import" and "manufacturer or importer" (s 6 notes).

• Parties who modify customer equipment: If an item is modified by or on behalf of the manufacturer or importer after manufacture or import, that modified item is treated as a distinct regulated item. Modified items must meet the requirements in s 16, which depend on whether the modification is material, the timing of the modification and the applicable transition periods (s 6, s 16).

• Distributors and sellers: Although the instrument speaks in terms of manufacture, import and modification, distributors and sellers will be affected because they typically source and place products on the Australian market. They may be required to avoid offering non‑complying items and may need to insist on compliance evidence from suppliers to avoid downstream liability under the Act and other supply laws. The text does not address downstream commercial liability directly.

• Carriers and carriage service providers: The instrument’s objects expressly include protecting network integrity and interoperability (s 5), and the scope is limited to networks operated by carriers or carriage service providers in Australia (s 13 Note 2). Carriers’ operations may be affected if non‑compliant customer equipment causes network harm; the standards aim to reduce that risk by imposing technical requirements on equipment placed on the network.

• Consumers and installers: The consumer and installer experience is affected indirectly. The standard’s objects include ensuring equipment can access emergency call services and interoperate with standard telephone services (s 5). In practical terms, consumers might see product withdrawal or redesign costs passed on by manufacturers and importers, changes in product availability, or modified installation instructions.

The instrument imposes duties in two broad categories: duties to meet applicable AS/CA Standards for items and modified items, and duties to observe timing and transitional rules. It also creates limited legal rights by deeming prior compliance to satisfy current obligations in certain cases.

Primary duties

• Duty to comply with applicable AS/CA Standards: An item (other than a modified item) "must meet the requirements of subsection 15(1), (2), (3) or (4) in relation to each applicable AS/CA Standard" (s 14(1)). A modified item must meet the requirements of s 16(1), (2), (3), (5) or (6) (s 14(2)). Effectively, compliance is achieved when the item complies with the applicable AS/CA Standard as in force on the relevant date (ss 15(1), 16(1)).

• Duty to determine applicable standard(s): Manufacturers/importers must identify which AS/CA standards apply: S041.1 applies in all cases; S041.2 applies to DSL items; S041.3 applies to ADSL items (s 8). Multiple standards can apply together.

• Duty to establish timing of compliance: Compliance is judged against the version of the AS/CA Standard as in force on the date the item was manufactured/imported (non‑modified items) or the date the modification was made (modified items) (ss 15(1), 16(1), 12).

• Duty to document class membership for class reliance: To rely on class‑based compliance (where a later item can rely on the original item’s compliance), the items must be identical and have the same manufacturer/importer; for modified items similar class conditions apply (s 11(1)-(2), s 15(2), s 16(2)). This creates a duty to maintain records that confirm identity and provenance.

• Duty to assess modification materiality: For modified items, there is a specific test for materiality. A modification is material if it would or could reasonably be expected to affect whether the modified item complies with the AS/CA Standard as in force at the date of the original item (s 16(4)). The duty is to assess and potentially document that determination.

Transition duties and rights

• Transition periods: If an AS/CA Standard is amended or replaced, ACMA treats an AS/CA transition period as the ACMA transition period if Communications Alliance specified one; otherwise a two‑year default ACMA transition period applies from the day of amendment/replacement (s 9). During ACMA transition periods, items manufactured/imported or modified during the period can comply with either the old or the replacement standard as specified in ss 15(3)-(4) and 16(5)-(6).

The technical standard text provided does not itself prescribe penalties, specific enforcement mechanisms, or civil remedies. The instrument records its authority as subsection 376(1) of the Telecommunications Act 1997 (s 3) and includes notes that several expressions used in the instrument have the same meaning as in the Act (s 6 notes), but it does not reproduce the enforcement framework of the Act within its text. Practically, this means:

• No penalties in the instrument: The 2025 technical standard does not set out fines, infringement notices, criminal offences or administrative penalties. It is limited to setting compliance requirements for items and describing transitional arrangements (Parts 3-4).

• Enforcement will depend on the Act and other legal mechanisms outside this instrument: Because the instrument is made under the Telecommunications Act 1997 (s 3), any enforcement, compliance notices, or sanctions for contravention will be governed by the legal and regulatory framework of the Act and any relevant subordinate instruments. The instrument itself does not detail those provisions.

• Compliance evidence and remedies: The instrument requires compliance to be judged against versions of the AS/CA Standards at particular dates (ss 15-16). In any enforcement or dispute context an affected party (manufacturer, importer, carrier) will need to produce contemporaneous evidence that an item complied with the relevant AS/CA Standard at the applicable date (for example, test reports, certificates, and manufacturing/import documentation). The instrument’s class and transition rules turn on factual proof of identity, date of manufacture/import and date of modification (ss 11-12, 15-16).

• Role of Communications Alliance material: Because the instrument incorporates AS/CA documents by reference (s 8 and s 6 notes), enforcement will require reference to those external documents and their versions. Any ambiguity in those documents or their amendment instruments may become relevant in enforcement proceedings.

• Practical enforcement avenues not specified here: The instrument does not specify which regulator function or office will carry out monitoring and enforcement activities, nor does it provide administrative process details. Those matters are typically addressed in the Telecommunications Act 1997 or ACMA procedures rather than in the technical standard itself. The text includes a note directing readers to federal legislation registers and referencing Acts Interpretation Act 1901 and the Legislation Act 2003 for references to Acts (s 7 notes), which is procedural guidance rather than an enforcement regime.

This technical standard is a subordinate legislative instrument made under the Telecommunications Act 1997 (s 3). Interaction with other laws occurs in multiple, specific ways reflected in the instrument’s text and notes.

• Integration with the Telecommunications Act 1997: The instrument draws on definitions and regulatory categories in the Act, and the ACMA’s power to make technical standards originates in subsection 376(1) of that Act (s 3). The instrument’s notes explicitly state that a number of expressions used in the instrument have the same meaning as in the Act, including carrier; customer equipment; emergency call service; facility; import; manufacturer or importer; standard telephone service; and telecommunications network, and refer to the relevant sections of the Act (s 6 notes, with references to sections 7, 21, 374(1), 374(2), and 406A). As such, application and compliance must be read together with the Act’s definitions and any enforcement or licensing regime contained in the Act.

• References to other Commonwealth Acts and interpretation Acts: Section 7 provides that references to other legislative instruments are to those instruments as in force from time to time, and the notes refer specifically to the Acts Interpretation Act 1901 (see section 10 of that Act) and the Legislation Act 2003 (subsection 13(1) of the latter) for rules on references to Commonwealth Acts and legislative instruments (s 7 notes). This means that statutory interpretation rules and commencement/amendment processes in those Acts will apply when reading the technical standard in context.

• Incorporation by reference of Communications Alliance standards: The instrument relies on Communications Alliance Ltd’s AS/CA S041.1/2/3 documents for technical content (s 6 definitions; s 8). Those documents are industry standards rather than statutory provisions. The legal effect of the instrument is to bind regulated parties to the content of those external documents as the applicable technical standard. Any legal dispute over technical compliance will therefore entail interpretation of external standards incorporated by reference, and the Communications Alliance’s amendment instruments and replacement standards will affect how the instrument operates via the transition provisions (ss 9-10).

• Relationship with previously repealed standard: The instrument repeals the 2015 AS/ACIF S041 technical standard (s 4) and provides savings for items that complied with the old standard before commencement (s 17). Consequently, obligations transition from the 2015 instrument to the 2025 instrument per the savings provision, and parties with pre‑existing stock or modified items have continuity.

The instrument itself contains limited amendment history because it is new and repeals its 2015 predecessor. The explicit items in the instrument’s own history are:

• Repeal of the 2015 standard: Section 4 expressly repeals the Telecommunications Technical Standard (Requirements for DSL Customer Equipment for connection to the Public Switched Telephone Network - AS/ACIF S041) 2015 [F2015L00187]. That is the only express repeal recorded in the instrument.

• Dates: The instrument is dated 20 March 2025 (signature block) and commences on 30 March 2025 (s 1, s 2). The parties who signed are named: Adam Suckling (Member) and Michael Brealey (General Manager), Australian Communications and Media Authority, identifying the ACMA as the decision maker.

• References to Communications Alliance documents: The instrument identifies existing Communications Alliance standards by their publication dates: AS/CA S041.1, S041.2 and S041.3 were all published on 25 February 2015 (s 6 definitions and notes). The instrument does not itself amend or reproduce those documents; instead it designates them as applicable standards.

• Provisions for future amendments of the AS/CA standards: The instrument contains a structured mechanism to handle amendments or replacements of the applicable AS/CA Standards. If Communications Alliance publishes an amendment instrument or a replacement standard and that instrument determines arrangements to deal with transitional issues for a specified period starting on the day of amendment or replacement, ACMA will treat that specified period as an AS/CA transition period (s 10). If Communications Alliance does not specify transitional arrangements, ACMA’s default ACMA transition period is two years from the day the applicable AS/CA Standard is amended or replaced (s 9). The instrument therefore anticipates and provides the legal mechanics to accommodate future technical changes carried out by Communications Alliance (ss 9-10).

• Overlapping transition periods: The instrument also contemplates the possibility that an applicable AS/CA Standard may be amended or replaced during an ACMA transition period. In that case there is another ACMA transition period which overlaps with the first, and the instrument specifies how compliance will be judged when transitions overlap (ss 9 note 2; ss 15(4), 16(6)). This is an internal transitional rule rather than an historical amendment.

• Savings provision for pre‑commencement items: Section 17 preserves the compliance status of items manufactured/imported or modified before commencement that complied with the 2015 standard. That is an immediate transitional legal effect rather than an amendment history.

The instrument as provided contains no litigation history, no mention of cases, and does not record prior judicial or administrative determinations interpreting it or its predecessor standard. The text names no cases and includes no summaries of past disputes. Practically this means:

• No reported cases in the instrument: There are no references to judicial decisions or tribunal determinations in the technical standard text. The instrument therefore stands as a fresh legal instrument whose interpretation and enforcement have not been litigated within the document.

• Predecessor instrument litigation not recorded: Although the 2015 AS/ACIF S041 standard is expressly repealed (s 4), the 2025 instrument does not summarise any litigation that may have arisen under the 2015 standard. Any case law on the 2015 instrument would need to be researched separately in legal databases; the instrument contains no such references.

• Anticipated areas for legal contest: Based on the instrument’s content, likely areas where litigation or administrative disputes could arise (not stated in the instrument, but logical from its mechanics) include disputes about classification of items (whether an item is a DSL item, an ADSL item, or excluded because it operates in an all‑digital mode), the materiality of modifications (s 16(4)), the identity and provenance criteria for class reliance (s 11), the correct version of an applicable AS/CA Standard for a given item (ss 8, 10, 15-16), and the interpretation of overlapping transition periods (ss 9, 15(4), 16(6)). Any such disputes would involve interpreting the instrument together with the relevant AS/CA documents.

• Enforcement actions will likely reference the Act: Any enforcement or compliance action based on contravention of an ACMA technical standard will be brought using the powers and processes in the Telecommunications Act 1997; because the instrument is made under s 376(1) of that Act (s 3), legal proceedings or administrative sanctions would be part of the Act’s enforcement framework rather than the instrument itself.

Users requiring precedent or case law should search national legal databases and ACMA's published enforcement actions for cases addressing the 2015 standard or ACMA technical standards generally. The instrument itself offers no litigation guidance.

Several technical and legal pitfalls can catch practitioners or regulated parties because the instrument ties legal compliance to external industry standards and contains non‑obvious timing and classification rules. The key "gotchas" to watch are:

1. Multiple applicable standards may apply concurrently: AS/CA S041.1 applies in all cases; an item that is a DSL item may also be subject to AS/CA S041.2, and an ADSL item may be subject to AS/CA S041.3 (s 8). Compliance requires checking all applicable parts; relying on compliance with only one document may be insufficient.

2. Compliance is version‑dependent and date‑sensitive: For non‑modified items, compliance is judged against the AS/CA Standard "as in force on the date the item is manufactured in Australia or imported" (s 15(1)). For modified items, the relevant date is the date the modified item is made (s 16(1) and s 12). Misdating manufacture/import or modification can defeat a compliance defence.

3. Class reliance requires strict identity and common manufacture/importer: To rely on the original item of a class, items must be identical to each other irrespective of manufacture/import dates and have the same manufacturer or importer (s 11(1)). For modified items the modification that produced them must be identical and other identity conditions must be satisfied (s 11(2)). Small differences between items (different batches, different subcontractors) could break class status.

4. Materiality test for modifications is prospective and fact sensitive: A modification is material if it "would or could reasonably be expected to affect whether the modified item complies with the AS/CA Standard as in force on the date the original item of the class was made in Australia or imported" (s 16(4)). That standard requires a forward‑looking technical assessment; superficial changes that interact with technical parameters in the AS/CA documents may be material even if they appear minor.

5. Overlapping transition periods complicate version choice: If ACMA transition periods overlap, compliance during the overlap can be satisfied by complying with the standard as in force immediately before the earliest transition, or the standard in force at the commencement of any one of those transition periods (s 15(4), s 16(6)). Determining which option is optimal requires tracking when each AS/CA change occurred and whether Communications Alliance specified an AS/CA transition period (s 10).

6. Default two‑year ACMA transition period if Communications Alliance is silent: If Communications Alliance does not specify transitional arrangements for an amendment or replacement standard, ACMA treats the transition period as two years from the date of amendment/replacement (s 9(b)). Parties should not assume automatic immediate effect; however they must be alert for Communications Alliance specifying a different AS/CA transition period, which ACMA will adopt (s 9(a), s 10).

Compliance under this technical standard is primarily an exercise in classification, version control and documentary proof. The following practical checklist maps the instrument’s legal rules (ss 6-17) into steps manufacturers, importers, modifiers and compliance advisers should take.

1. Determine scope: Establish whether each product is captured by s 13(1). The standard applies to customer equipment that connects with a DSL service which shares the metallic local loop with an analogue switched telephone network two‑wire service. Excluded are equipment used only for analogue two‑wire connections and equipment intended to operate in an all‑digital mode (s 13(1)-(2)). Document intended modes of operation and likely use cases.

2. Identify applicable AS/CA Standard(s): Apply s 8. AS/CA S041.1 is applicable in all cases. If the item is a DSL item (a DSL modem or part of a DSL modem), S041.2 also applies. If the item is an ADSL item (an ADSL filter or part of one), S041.3 also applies. Record the determinations and keep copies of the relevant AS/CA documents (s 6 notes and s 8).

3. Establish the relevant version and date: For non‑modified items compliance must be assessed against the AS/CA Standard "as in force on the date the item is manufactured in Australia or imported" (s 15(1)). For modified items use the date the modification was made (s 16(1), s 12). Maintain clear records of manufacture/import dates and dates of modification for every item or shipment.

4. If relying on class rules, document identity and provenance: If you intend to rely on s 15(2) or s 16(2) class provisions, ensure and document that items are identical to the original item of the class and that the manufacturer/importer is the same for all items (s 11(1)-(2)). Identify the "original item" (first manufactured/imported) and retain testing/certification showing its compliance at the relevant date.

5. For modified items, assess and document materiality: Apply s 16(3)-(4). If the modified item would have been included in a class but for the modification, determine whether the modification is material (i.e. whether it would or could reasonably be expected to affect compliance with the AS/CA Standard as in force on the original item date). Keep a technical assessment and test reports that substantiate a "non‑material" finding. If material, ensure the modified item complies with the AS/CA Standard as in force on the modification date (s 16(1); s 12).

6. Track Communications Alliance amendments and transition periods: Monitor Communications Alliance amendment instruments or replacement standards. If Communications Alliance specifies an AS/CA transition period for an amendment or replacement standard, ACMA treats that specified period as the ACMA transition period (s 10). If Communications Alliance does not provide transition arrangements, ACMA’s default ACMA transition period is two years from the date of amendment/replacement (s 9(b)). During transition periods items manufactured/imported or modified during the period may comply with either the old or the new standard as permitted in ss 15(3)-(4) and 16(5)-(6). Maintain a version control log with amendment dates and applicable ACMA transition periods.
