Telecommunications (Requirements for Customer Equipment with Hierarchical Digital Interfaces – AS/ACIF S016) Technical Standard 2025

This instrument, the Telecommunications (Requirements for Customer Equipment with Hierarchical Digital Interfaces - AS/ACIF S016) Technical Standard 2025, is a legislative instrument made by the Australian Communications and Media Authority under subsection 376(1) of the Telecommunications Act 1997. It repeals and replaces the 2015 standard of the same name (F2015L00181). Mechanically, the standard prescribes mandatory technical requirements for certain customer equipment that possesses a hierarchical digital interface at one of four specified bit rates: 2,048 kbit/s, 8,448 kbit/s, 34,368 kbit/s or 139,264 kbit/s. These are the standard rates for digital transmission hierarchies used in older telecommunications network infrastructure such as E1 (2,048 kbit/s) and higher-order multiplexing levels. The equipment subject to the standard is that which is used or is to be used for connection to a telecommunications network operated by a carrier or carriage service provider in Australia.

The standard sets out compliance pathways for both new items and modified items. An item (defined as a thing of customer equipment to which the standard applies) may comply either by meeting the requirements of the AS/ACIF Standard (defined as AS/ACIF S016:2001, published by Communications Alliance Ltd in March 2002) as in force on the date it is manufactured or imported, or by relying on a class-of-items approach where an item that is identical to an earlier item and has the same manufacturer or importer can comply by reference to the original item’s compliance date. Alternatively, compliance can be achieved during an ACMA transition period, which is defined in two ways. If the AS/ACIF Standard is amended or replaced and Communications Alliance Ltd itself provides a transition period in the amendment or replacement instrument, then the ACMA transition period mirrors that period. If Communications Alliance Ltd does not provide such a period, the ACMA transition period is two years from the date of amendment or replacement. Overlapping transition periods are also contemplated: where one transition period overlaps with another, items manufactured or imported during the overlap may comply by reference to the earliest period’s standard or to any one of the overlapping periods’ standards.

The objects of the standard are stated in section 5: protecting the integrity of a telecommunications network or facility; protecting the health or safety of persons who operate, work on, use services supplied by means of, or are otherwise likely to be affected by the network or facility; ensuring customer equipment can be used to access emergency call services; and ensuring, for the supply of a standard telephone service, the interoperability of customer equipment with a telecommunications network. These objects mirror the standard statutory grounds for ACMA technical standards under the Telecommunications Act. The instrument does not itself impose labelling, certification, recording, or notification obligations; it merely sets the technical benchmarks that the equipment must meet. Compliance is assessed against the AS/ACIF S016:2001 standard as it may be amended or replaced from time to time by Communications Alliance Ltd, a private industry body. That means the mandatory requirements can change without a new legislative instrument being made, subject to the transition period mechanisms. This is a notable delegation of standard-setting to a non-government entity, albeit one that is widely recognised in Australian telecommunications industry self-regulation.

The instrument commences on 30 March 2025, ten days after it was signed on 20 March 2025. It contains savings provisions for items manufactured, imported or modified before commencement. Those items are taken to comply with the new standard if they complied with the repealed 2015 standard. Thus, there is no back‑dated non‑compliance for existing stock or installed equipment. The instrument is structured into four parts: Part 1 preliminary matters and objects; Part 2 interpretation, including important definitions for classes of items, transition periods, and modified items; Part 3 application and substantive requirements; Part 4 savings and transitional arrangements. The standard is essentially an updating instrument: it preserves the same technical requirements but updates the legislative framework to refer to the current industry standard document and provides new transition period rules that respond to how Communications Alliance Ltd itself handles transitional arrangements.

The central concept is the AS/ACIF Standard, defined as the Australian Standard AS/ACIF S016:2001 - Requirements for Customer Equipment for connection to hierarchical digital interfaces, published by the Australian Communications Industry Forum Ltd (now Communications Alliance Ltd) in March 2002. This is the benchmark technical specification. The instrument does not reproduce the technical content; it incorporates it by reference. Importantly, the definition permits the standard to be amended or replaced by Communications Alliance Ltd through an “amendment instrument” or “replacement standard”. These are in turn defined as instruments published by Communications Alliance Ltd, not by ACMA. This means the substantive technical rules can change at the initiative of a private industry body, and ACMA’s role is limited to providing transition periods and overlapping rules.

Items and classes of items are another key concept. An “item” is any piece of customer equipment that falls within the scope of the standard (hierarchical digital interfaces at the specified rates). Items are grouped into classes based on identity and manufacturer/importer. An item (other than a modified item) is in a class if it is identical to every other item in the class and has the same manufacturer or importer. The “original item” of a class is the first one manufactured or imported. This allows a manufacturer or importer to establish compliance for a class based on the original item’s compliance date, without having to re‑test or re‑certify each subsequent identical unit. This is a pragmatic concession that reduces compliance costs for high‑volume identical equipment.

Modified items are items that have been modified by or on behalf of the manufacturer or importer after manufacture or import. They are treated as separate items for compliance purposes. A modified item may also belong to a class if the modification is identical, the rest of the item is identical, and the manufacturer/importer is the same. The “original modified item” is the first one so modified in Australia. There is a special rule for non‑material modifications: if a modification would otherwise break class membership, but the modification is not material and the modified item still complies with the AS/ACIF Standard as in force on the original item’s date, then it is still deemed to meet the requirements. A modification is material if it would or could reasonably be expected to affect compliance. This introduces a degree of judgement for manufacturers: they must assess whether a change is material, and if it is, they cannot rely on the original item’s compliance date.

The standard primarily affects manufacturers and importers of customer equipment that has hierarchical digital interfaces at the specified bit rates and that is intended for connection to Australian telecommunications networks. The term “manufacturer or importer of customer equipment” is defined in section 406A of the Telecommunications Act and is imported into this instrument by the note to section 6. Any entity that manufactures such equipment in Australia, or imports it for supply in the Australian market, must ensure that the equipment complies with the standard. This includes both Australian businesses and foreign suppliers who export to Australia, though enforcement is likely to focus on the local manufacturer or the importer who brings the goods into the country.

Carriers and carriage service providers are indirectly affected because they may connect customer equipment to their networks. While the standard does not impose duties on them directly, they have an interest in ensuring that connected equipment complies, because non‑compliant equipment could affect network integrity, safety, or emergency service access. Carriers may also be exposed to enforcement action under the Telecommunications Act if they permit non-compliant equipment to be connected. However, the instrument itself does not impose obligations on network operators; it only specifies requirements for the equipment.

End users such as businesses, government agencies, and other organisations that use equipment with hierarchical digital interfaces are also affected, but indirectly. They must ensure that the equipment they acquire from suppliers is compliant. In practice, this is usually managed through supplier declarations, labelling, or ACMA’s compliance framework (e.g., the ACMA’s equipment compliance scheme under the Radiocommunications Act and Telecommunications Act). End users who modify their equipment may need to reassess compliance; a modified item must meet the standard unless it falls within the non‑material modification exception or a transition period.

Communications Alliance Ltd, a private industry self‑regulatory body, is a key actor because it publishes the AS/ACIF Standard and can amend or replace it. Its decisions on transition periods directly affect the ACMA transition period and thus the compliance timelines for industry. The standard essentially delegates substantive standard‑setting to Communications Alliance, albeit with ACMA oversight through the transition period framework. Any amendment or replacement by Communications Alliance will automatically change the mandatory requirements, subject to the transition rules.

The central duty is that items of customer equipment to which the standard applies must meet the requirements set out in sections 13 to 15. For a new item (not a modified item), it must comply with one of the four pathways in section 14. The most straightforward pathway is compliance with the AS/ACIF Standard as in force on the date the item is manufactured in Australia or imported (section 14(1)). Alternatively, an item can rely on class compliance: if it is identical to an original item of the class, and the original item complied with the standard as in force on its own date of manufacture/import, then the new item is compliant without having to meet the standard as in force at its own date (section 14(2)). This is a significant right for manufacturers and importers: they can continue to supply identical stock even if the standard has been amended, so long as the original item complied with the earlier version. However, this right is not unlimited: it only applies while the item remains identical. Once a modification is made, the class may break.

During an ACMA transition period, items have the right to comply with either the old standard (immediately before the transition period) or the new standard (in force at the start of the transition period), per section 14(3). This gives industry a grace period to redesign or recertify products. Overlapping transition periods provide even more flexibility: during the overlap, the item may comply with the earliest old standard or any of the standards in force at the start of any overlapping period (section 14(4)). The same rights apply to modified items under section 15, with the additional concept of non‑material modifications. If a modification is not material, the modified item can retain its original compliance date. This is a right that reduces the compliance burden for minor changes, but the manufacturer must assess materiality carefully.

There are also rights for items manufactured, imported or modified before commencement of the standard. Section 16 provides that such items are taken to comply with the new standard if they complied with the repealed 2015 standard. This is a grandfathering provision that prevents the new standard from creating retroactive non‑compliance. It effectively preserves the existing compliance status for equipment already in the supply chain or in use.

The duties of manufacturers and importers extend to ensuring that they can demonstrate compliance. Although the instrument does not specify record‑keeping or labelling requirements, the Telecommunications Act 1997 and associated ACMA compliance arrangements (such as the Telecommunications (Customer Equipment and Customer Cabling) Labelling Notice) typically require suppliers to keep compliance records and to label equipment with the ACMA logo if it complies with all applicable technical standards. Non‑compliance with this technical standard could therefore also result in breaches of those labelling requirements.

The instrument itself does not prescribe penalties. It is a technical standard made under subsection 376(1) of the Telecommunications Act 1997. The enforcement and penalty provisions are found in the Act, not in this instrument. Under the Telecommunications Act, supplying customer equipment that does not comply with an applicable technical standard may be an offence or may attract civil penalties. The exact penalty amounts and enforcement mechanisms are not specified in the provided source text, so this analysis cannot detail them. However, it is standard for such standards to be enforced under Part 21 of the Telecommunications Act (which deals with compliance and enforcement), which includes provisions for ACMA to issue infringement notices, apply to the Federal Court for injunctions, or seek civil penalties. The maximum civil penalty for a contravention of a technical standard is typically 2,000 penalty units for a body corporate (currently a penalty unit is $313, so $626,000 as of 2025), though this may vary.

ACMA is the primary enforcement authority. It can investigate suspected non‑compliance, issue directions to remedy, and pursue enforcement action. The instrument does not create any private right of action; an individual affected by non‑compliant equipment cannot sue for breach of the standard directly, though they may have recourse under contract or consumer law if the equipment causes harm.

Enforcement risks may be higher for manufacturers and importers who knowingly supply non‑compliant equipment or who fail to properly assess material modifications. The class‑of‑items approach could be abused if a manufacturer tries to treat a significantly changed item as identical. The materiality test in section 15(4) is subjective: a modification is material if it would or could reasonably be expected to affect compliance. This leaves room for ACMA to argue that a modification was material even if the manufacturer believed otherwise. In litigation, the court would assess whether a reasonable person in the industry would expect the modification to affect compliance. This creates uncertainty for manufacturers making incremental improvements or design changes.

The instrument does not provide for any certification or labelling scheme. It is the manufacturer’s or importer’s duty to self‑assess compliance. ACMA may audit compliance and can require suppliers to provide evidence of compliance. The transition period provisions also carry enforcement implications: if a manufacturer claims compliance under an earlier standard version, it must be able to demonstrate that the equipment falls within the transition period (by showing the date of manufacture/import, and that the equipment complies with that version). Overlapping transition periods add further complexity; errors in determining which standard version applies could result in non‑compliance.

This technical standard is made under the Telecommunications Act 1997 and forms part of a broader regulatory framework for customer equipment and customer cabling in Australia. It interacts with several other instruments and legislative schemes.

First, it repeals and replaces the Telecommunications Technical Standard (Requirements for Customer Equipment with hierarchical digital interfaces - AS/ACIF S016) 2015 (F2015L00181). That earlier standard is no longer in force. Items that complied with the 2015 standard and were manufactured, imported or modified before commencement of this standard are deemed to comply (section 16). After commencement, all new items must be assessed against the new standard.

Second, the standard interacts with the Telecommunications (Customer Equipment and Customer Cabling) Labelling Notice, which is made under the Telecommunications Act and requires that certain customer equipment be labelled with the ACMA compliance logo. The labelling notice cross‑references applicable technical standards. If this standard is listed in that notice (as it likely will be, given it is a replacement of the 2015 standard), then equipment within scope must also comply with the labelling requirements. Non‑compliance with the technical standard would also mean the equipment cannot lawfully be labelled.

Third, the instrument interacts with radiocommunications standards under the Radiocommunications Act 1992. Equipment with hierarchical digital interfaces may also emit radiofrequency energy or be subject to EMC requirements. The Standard AS/ACIF S016 is purely about electrical characteristics for connection to hierarchical digital interfaces; it does not cover radio or EMC. Therefore, equipment must also comply with the applicable ACMA technical standards for electromagnetic compatibility (e.g., AS/NZS CISPR 32) and any radiocommunications standards if the equipment contains a radio transmitter.

Fourth, the standard interacts with state and territory electrical safety laws. While the Telecommunication Act standards deal with network protection and interoperability, electrical safety is a separate area. Equipment must also comply with Australian electrical safety standards (e.g., AS/NZS 62368.1 for audio/video and ICT equipment). The technical standard does not replace those requirements.

Fifth, the standard must be read together with the Telecommunications Act 1997 itself, especially Part 21 (Compliance and enforcement), sections 376-379 regarding technical standards, and section 406A regarding definitions of manufacturer and importer. The Act provides the statutory backing for the standard and the penalties for non‑compliance.

This is a new instrument made on 20 March 2025, commencing on 30 March 2025. It repeals the Telecommunications Technical Standard (Requirements for Customer Equipment with hierarchical digital interfaces - AS/ACIF S016) 2015 (F2015L00181). That earlier standard was the immediate predecessor. The instrument does not contain any internal amendment provisions; it does not reference any earlier amendments to itself because it is new.

The primary driver of change is not amendments to this instrument itself, but amendments to the AS/ACIF Standard (AS/ACIF S016:2001) by Communications Alliance Ltd. The instrument explicitly provides for future amendments and replacements of that private standard. If Communications Alliance publishes an amendment instrument or replacement standard, the ACMA transition period provisions will apply. This means the technical requirements can change without a new legislative instrument. The instrument’s definition of “amendment instrument” and “replacement standard” allows those changes to be automatically incorporated into the mandatory framework, subject only to the transition periods.

The instrument also provides for its own repeal? No, it does not; it only repeals the 2015 standard. It could be repealed or varied by a later ACMA technical standard. There is no sunset clause mentioned.

The history of the hierarchy of digital interfaces standards in Australia dates back to the earlier Telecommunications Technical Standard (Requirements for Customer Equipment with hierarchical digital interfaces - AS/ACIF S016) 2015, and before that, earlier versions of the standard under the previous regulatory framework. The 2015 standard would have replaced an even older standard. The precise lineage is not in the source, so cannot be detailed.

One notable change from the 2015 standard is the explicit handling of AS/ACIF transition periods and overlapping periods. The 2015 standard may have had simpler transition rules. The new instrument also clarifies the concept of “material modification” for modified items, with a specific definition (section 15(4)), which may not have been present in the 2015 version. These are improvements that reduce uncertainty for industry, but also impose a duty to assess materiality.

The instrument also updates references to Communications Alliance Ltd (formerly Australian Communications Industry Forum Ltd). This is a naming change from the 2015 standard likely.

The instrument was made by ACMA members Adam Suckling and Michael Brealey, signed on 20 March 2025. There is no explanatory statement provided in the source, so the rationale is limited to the objects in section 5. One can infer that the 2025 update is intended to ensure the standard remains current with industry practice, incorporates updated transition period rules, and provides a clearer framework for modified items.

The source text does not refer to any litigation. This is a newly made instrument, so there is no litigation history specific to it. However, litigation may have arisen under its predecessor, the 2015 standard, or under the Telecommunications Act more broadly. Since the source does not mention any cases, this analysis cannot name any. It would be speculative to discuss potential litigation.

That said, it is possible that compliance disputes have occurred under the broader regime for hierarchical digital interface equipment. For example, there may have been cases about whether equipment with E1 interfaces complied with the standard, or about the validity of the class‑of‑items approach. But without citation in the source, we cannot assert that.

The instrument itself does not create a private cause of action. Any litigation would likely be by ACMA seeking civil penalties or injunctions against suppliers of non‑compliant equipment, or by a supplier challenging ACMA’s interpretation of the standard. The material modification test (section 15(4)) is a potential source of litigation if there is disagreement about whether a modification is material. The overlapping transition period rules could also lead to disputes about which standard version applied at a given time.

Because the instrument is very recent (commenced 30 March 2025), there has been no time for litigation. Any litigation under the 2015 standard may inform interpretation of equivalent provisions, but those cases are not in the source.

In summary, the litigation history is absent from the provided text. The best statement is that the source does not record any litigation, and given the instrument’s commencement date, no cases under it are yet possible. Practitioners should be aware that ACMA’s interpretation of transition periods and material modifications could be tested in future.

Several provisions in the instrument could trap the unwary.

The incorporation of the AS/ACIF Standard by reference means the mandatory technical requirements are not set out in the legislative instrument. They are in a document published by Communications Alliance Ltd, which may be updated at any time. If the AS/ACIF Standard is amended, the new requirements become mandatory at the end of the ACMA transition period (or immediately if no transition period is provided by Communications Alliance and the two‑year ACMA period expires). Industry must monitor the Communications Alliance website for changes. Failure to do so could result in continued supply of equipment that no longer complies.

The definition of “ACMA transition period” in section 8 is tied to the existence of an AS/ACIF transition period set by Communications Alliance Ltd. If Communications Alliance provides no transition arrangements, the ACMA period is two years. But if Communications Alliance provides a shorter period (e.g., six months), the ACMA period is only six months. This could shorten the grace period unexpectedly. Manufacturers should not assume they will always have two years. They must check the amendment instrument itself. Also, if Communications Alliance provides a transition period that is not a “specified period commencing on the day” the standard is amended or replaced, it may not qualify as an AS/ACIF transition period, and the default two‑year rule may not apply. This is a drafting ambiguity.

Overlapping ACMA transition periods can create confusion about which standard version is mandatory. An item manufactured during an overlap might comply with any of several versions. But the manufacturer must choose one and document it. Later, if there is a compliance dispute, the manufacturer must be able to demonstrate that the item complied with the chosen version. If the manufacturer picks a version that later proves incompatible with network operator requirements (e.g., interoperability with new carrier equipment), the item may still be legally compliant but commercially problematic.

The material modification test (s 15(4)) is deceptively simple. The modification is material if it “would or could reasonably be expected to affect whether the modified item complies” with the standard. This is not limited to changes that actually affect compliance; it includes changes that could reasonably be expected to affect compliance. That is a lower threshold. For example, a change to a circuit component that is not directly related to the hierarchical digital interface might still be material if it could reasonably be expected to affect the equipment’s electrical characteristics. Manufacturers should document their reasoning for any modification they deem non‑material, because ACMA or a court may later disagree.

Compliance requires a systematic approach by manufacturers and importers. The first step is to determine whether the customer equipment falls within the scope: does it have a hierarchical digital interface at 2,048, 8,448, 34,368 or 139,264 kbit/s? Is it used or to be used for connection to a telecommunications network in Australia operated by a carrier or carriage service provider? If yes, the standard applies. If the equipment has only Ethernet interfaces, for example, it is not covered.

Next, identify the relevant version of the AS/ACIF Standard. The current standard is AS/ACIF S016:2001 as it may have been amended or replaced by Communications Alliance Ltd. The manufacturer/importer should check the Communications Alliance website (http://www.commsalliance.com.au) for the latest version and any amendment instruments. If no amendments have been made, the 2001 version applies.

For a new item (not a modified item), there are four compliance options:

1. Direct compliance: Ensure the item meets the AS/ACIF Standard as in force on the exact date of manufacture or import. This is the safest path but may require testing or design updates if the standard has changed.
2. Class compliance: If the item is identical to an earlier item of the same manufacturer/importer (the “original item”), and that original item complied with the AS/ACIF Standard as in force on the original item’s date, then the new item can rely on that compliance. This avoids retesting but requires maintaining strict identity. Manufacturers should keep records of the original item’s compliance data and the BOM/drawings to prove identity.
3. Transition period compliance: If an amendment or replacement standard has occurred and the item is manufactured or imported during an ACMA transition period, the item may comply with either the old standard (immediately before the transition period) or the new standard (in force at the start of the transition period). The manufacturer must check whether Communications Alliance set its own transition period (AS/ACIF transition period) and then the ACMA period mirrors it. If not, the ACMA period is two years. The manufacturer must document which standard version is being applied.
4. Overlapping transition periods: If two transition periods overlap, the item may comply with the earliest old standard or any of the standards in force at the start of any overlapping period. This requires careful tracking of multiple amendment dates.
