Telecommunications (Requirements for Customer Equipment for Connection to a Metallic Local Loop Interface of a Telecommunications Network – AS/CA S043) Technical Standard 2025

This instrument, the Telecommunications (Requirements for Customer Equipment for Connection to a Metallic Local Loop Interface of a Telecommunications Network - AS/CA S043) Technical Standard 2025 (AS/CA S043-2025), is an ACMA-made technical standard under subsection 376(1) of the Telecommunications Act 1997 (see section 3). Mechanically, it replaces the 2015 version of the same technical standard (section 4) and commences on 30 March 2025 (section 2). It does not itself contain technical test methods but instead makes compliance with specified Communications Alliance AS/CA standards the route by which customer equipment is treated as meeting the technical standard (section 8).

Key mechanical effects

• Repeal: the 2015 AS/CA S043 technical standard is repealed (section 4). Equipment compliant with the 2015 standard immediately before this instrument’s commencement is expressly taken to comply with the new instrument (savings) if manufactured or modified before commencement (section 17).
• Reference architecture: the instrument identifies specific AS/CA Standards as the applicable technical content. AS/CA S043.1:2015 applies in all cases; AS/CA S043.2:2016 applies if the item has broadband capability; AS/CA S043.3:2015 applies for items with the capabilities defined for an AS/CA S043.3 item (section 8).
• Temporal rules: it establishes ACMA transition periods tied to amendments or replacements of the AS/CA Standards, either mirroring transition periods set by Communications Alliance or adopting a default two-year transition (sections 9 and 10). It also sets rules for overlapping transition periods (sections 9, 15(4), 16(6)).
• Coverage and compliance triggers: the standard applies to customer equipment used, or to be used, to connect to a telecommunications network via a metallic local loop interface (section 13). Substantive compliance obligations are framed by whether the relevant item is an original item, included in a class, manufactured/imported during a transition period, or a modified item (sections 14-16).
• Definitions and boundaries: the instrument supplies definitions for key terms including metallic local loop, metallic local loop interface, broadband capability, voice frequency band, modified item, original item, and AS/CA S043.3 item (section 6, section 11). These definitions determine which AS/CA Standard(s) apply to particular pieces of equipment (section 8).

Official purpose claims

The instrument sets out its objects, which the ACMA records as the reasons for prescribing these technical requirements: to protect the integrity of telecommunications networks and facilities; to protect health and safety of persons who operate, work on, use services supplied by or are otherwise reasonably likely to be affected by the operation of a telecommunications network or facility; to ensure customer equipment can be used to access emergency call services; and to ensure interoperability of customer equipment with networks for standard telephone service purposes (section 5). Those are the stated policy aims. The instrument implements those aims by making compliance with specific AS/CA Standards the compliance metric, and by setting temporal and class rules that determine which version of those standards is the operative standard for a particular item (sections 8, 9, 10, 15, 16).

What it does not do, within the text

• The technical standard itself does not recite penalties or enforcement procedures. It is made under the Act (section 3) and refers to definitions and other provisions in the Act (notes to section 6 and section 7), but it does not itself prescribe sanctioning mechanisms within its clauses. Enforcement therefore depends on the broader statutory regime under the Telecommunications Act 1997 and related provisions not reproduced in this instrument.
• It does not publish the text of the AS/CA Standards. Instead, it references those standards by title and notes where they can be accessed (section 6 notes). Communications Alliance remains the publisher of the AS/CA Standards and any amendment or replacement standards.

In short, AS/CA S043-2025 is an ACMA technical standard that (i) replaces the 2015 instrument, (ii) prescribes which Communications Alliance AS/CA documents are the applicable technical benchmarks for different classes of metallic local loop connected customer equipment, and (iii) sets the temporal and class-based rules that determine which version of those benchmarks applies to a particular manufactured, imported or modified item (sections 2, 4, 8, 9, 10, 15, 16, 17).

The instrument’s regulatory architecture rests on a small set of legal and technical concepts that determine coverage, the applicable technical content, and the timing rules for compliance. These concepts appear in defined form and are the control points for obligations and transition rights.

Customer equipment and metallic local loop interface

• The substantive scope is customer equipment used, or to be used, for connection to a telecommunications network via a metallic local loop interface (section 13). The instrument clarifies that the reference to a telecommunications network is a network in Australia operated by a carrier or carriage service provider under the Act (note to section 13 referencing subsection 374(1) of the Act). Metallic local loop is defined as a metallic twisted pair communications wire in a carrier’s telecommunications network that provides connectivity between a customer’s premises and equipment in the telecommunications network (section 6).

Applicable AS/CA Standards

• The technical content that constitutes compliance is not embedded in the instrument; instead the instrument nominates specific Communications Alliance Standards as the applicable standards for different item types (section 8). The three referenced AS/CA Standards are:
  • AS/CA S043.1:2015 (Part 1: General) which applies in all cases (section 8(1));
  • AS/CA S043.2:2016 (Part 2: Broadband) which applies where the item has broadband capability (section 8(2), defined in section 6 as ability to transmit signal using frequency above 20 kHz);
  • AS/CA S043.3:2015 (Part 3: DC, low frequency AC and voiceband) which applies if the item is an AS/CA S043.3 item (section 8(3), definition in section 6).

AS/CA transition period and ACMA transition period

• Two related temporal constructs control transitional compliance.
  • AS/CA transition period is a period set out in an amendment instrument or replacement standard prepared by Communications Alliance that deals with transitional matters (section 10(1)). An AS/CA transition period applies to items manufactured or imported during that specified period (section 10(2)).
  • If Communications Alliance does not set an AS/CA transition period, ACMA provides an ACMA transition period, which is either the same as an AS/CA transition period if one exists, or a default two-year period beginning on the day the applicable AS/CA Standard is amended or replaced (section 9). ACMA transition periods may overlap and the instrument supplies rules for items manufactured or imported during overlapping periods (sections 9, 15(4), 16(6)).

The instrument identifies and allocates obligations, rights and transition entitlements among identifiable parties, although it does not itself set monetary penalties. The primary affected actors, the decisions that fall to them, and the locus of costs are set out in the text.

Manufacturers and importers of customer equipment

• The principal economic actors affected are manufacturers and importers of customer equipment that is used, or is to be used, for connection to a telecommunications network via a metallic local loop interface (section 13; section 6 notes referencing the Act for the terms “manufacturer” and “importer”). The instrument repeatedly frames compliance in terms of the date an item is manufactured or imported (sections 15(1) and 15(3)) and for modified items the date the modification is made in Australia (section 16(1) and section 12). Those actors therefore decide which version of the AS/CA Standards their product must meet and when.

Importers, especially, carry timing-sensitive compliance exposure

• Because the applicable AS/CA Standard is the version in force on the date of importation, importers must match supply timing to the operative standard or rely on transition provisions if an amendment or replacement standard has been published (section 15(1), section 9). The instrument treats items imported during an ACMA transition period as meeting requirements if they comply with either the applicable AS/CA Standard as in force immediately before the commencement of the transition period or the AS/CA Standard as in force at the commencement of the transition period (section 15(3)).

Manufacturers and modifier responsibilities for modified items

• The instrument treats modified items separately, and modifies the compliance date to the date of modification (section 16(1), section 12). The test of materiality for a modification, which determines whether an existing compliance route remains available, is whether the modification would or could reasonably be expected to affect compliance with the standard as in force on the date the original item of the class was made or imported (section 16(4)). This assigns to manufacturers and their agents the burden of assessing materiality.

Communications Alliance Ltd

• Communications Alliance remains the author of the AS/CA Standards and any amendment instruments or replacement standards. The instrument explicitly relies on amendment instruments and replacement standards prepared by Communications Alliance for transitional arrangements and for the content of the applicable standards (section 6 definitions; section 10). Consequently Communications Alliance’s decisions about the content of AS/CA S043.1, S043.2 and S043.3, and any amendments or replacement standards, determine the technical requirements that manufacturers and importers must follow.

The technical standard sets out mandatory compliance gates, inheritance rights for classes, transitional entitlements, and the tests that determine whether a particular item meets the standard. It frames duties and rights principally by reference to dates of manufacture, importation or modification and by reference to the applicable AS/CA Standard at those points in time.

Duty to meet applicable AS/CA Standards

• For an item that is not a modified item, the core duty is that the item must meet the requirements set out in subsection 15(1), (2), (3) or (4) in relation to each applicable AS/CA Standard (section 14(1)). Subsection 15(1) provides the baseline rule: an item complies if it complies with the applicable AS/CA Standard as in force on the date the item is manufactured in Australia or imported (section 15(1)). This is a strict date-of-manufacture/import rule unless one of the alternative inheritance or transition paths applies (section 15).

Duty for modified items

• Modified items must meet subsection 16(1), (2), (3), (5) or (6) in relation to each applicable AS/CA Standard (section 14(2)). Subsection 16(1) provides the baseline rule for modified items: compliance is assessed against the applicable AS/CA Standard as in force on the date the modified item is made in Australia (section 16(1)). The instrument therefore shifts the operative compliance date for modified items from the manufacture/import date to the date of modification.

Rights of class inclusion and inheritance

• The instrument grants a right to items that are identical and share the same manufacturer or importer to inherit compliance from the class’s original item (section 11 and section 15(2)). In practice, if a producer can show an original item of an identical class complied with the applicable AS/CA Standard at the relevant date, later items of the class are treated as meeting the standard without being assessed independently (section 15(2)). The same right applies for modified-item classes, with the original modified item defined as the first modified item in Australia (section 11(2) and section 16(2)).

Transition rights during AS/CA or ACMA transition periods

• The instrument provides rights to rely on either the immediately previous version of the applicable AS/CA Standard or the version in force at the commencement of the transition period for items manufactured or imported during an ACMA transition period (sections 9, 15(3), 16(5)). The practical effect is to allow manufacturers and importers to use either the prior standard or the standard at commencement of the transition period as the operative standard for items brought into market during the transition period. If Communications Alliance specifies an AS/CA transition period in its amendment or replacement instrument, ACMA adopts that period for ACMA transition purposes (section 9(a)).

The technical standard itself does not set out penalty provisions or an enforcement schedule. It is a standards instrument made under subsection 376(1) of the Telecommunications Act 1997 and therefore sits inside the wider statutory enforcement framework governed by the Act. The instrument’s text identifies that relationship to the Act but does not reproduce the Act’s enforcement provisions. The following paragraphs set out what is in the instrument itself and the inferences users should draw from that text about enforcement mechanisms.

Absence of direct penalty clauses in the instrument

• The instrument contains no express civil or criminal penalty clauses, infringement notices, or administrative sanctioning rules (no sections in Parts 1 to 4 record fines, suspensions or compliance notice regimes within this instrument). The instrument’s regulatory effect is to prescribe technical standards and transitional rules; it therefore relies on the enforcement mechanisms provided in the Telecommunications Act 1997 (section 3; note references to the Act in section 6 and section 7).

Reference to the Act for enforcement and definitions

• Section 3 states the instrument is made under subsection 376(1) of the Telecommunications Act 1997. The instrument also includes notes directing readers to Act provisions for definitions and related matters (notes to section 6 referencing section 7 and various provisions such as subsection 374(1), subsection 374(2), and section 406A). Enforcement powers, notice regimes, penalties and statutory offences that may apply to failure to comply with a technical standard therefore depend upon the provisions of the Telecommunications Act and any regulations made under it, not on this instrument. The text signals this dependency but does not specify which provisions of the Act will be used in enforcement.

Practical enforcement expectations arising from the instrument

• Because the instrument makes compliance contingent on conformity with nominated AS/CA Standards at particular times (section 15, 16), enforcement in practice will turn on an ACMA determination or legal process that an item did not meet the applicable standard at the relevant date. That process will require factual determinations about dates of manufacture, importation or modification and whether a claimed class inheritance or transition entitlement is valid. The instrument itself does not preclude ACMA from using the Act’s enforcement powers to secure compliance, but any such action would be brought under the Act rather than by the technical standard’s text.

The instrument is situated within the statutory architecture of the Telecommunications Act 1997 and relies on Communications Alliance AS/CA Standards for its technical content. Its cross-references and notes identify the legal seams where interaction with other laws and instruments will occur. The instrument itself does not attempt to restate or displace provisions of the Act, and it explicitly depends on the Act for definitions and for the statutory power to make technical standards.

Primary statutory relationship: Telecommunications Act 1997

• The technical standard is made under subsection 376(1) of the Telecommunications Act 1997 (section 3). As a legislative instrument created under that Act, it must be read alongside the Act. The instrument’s notes draw attention to specific Act provisions that supply definitions used by the instrument, such as carrier, customer equipment, emergency call service, facility, import, manufacturer or importer, standard telephone service, and telecommunications network (note to section 6). Additionally, the instrument’s scope note in section 13 references subsection 374(1) of the Act when defining what constitutes a telecommunications network for the purposes of this standard. Consequently, definitions and legal duties in the Act, including obligations relating to access to emergency call services, network integrity protections, and obligations on carriers, will interact with this technical standard.

Communications Alliance AS/CA Standards and amendment instruments

• The instrument does not contain the detailed technical requirements. Instead it nominates particular AS/CA standards and any amendment instruments or replacement standards prepared by Communications Alliance as the operative technical content (sections 6, 8, 10). Those standards and amendment instruments are separate non-statutory documents produced by Communications Alliance and may themselves reference or be informed by other national or international standards. The instrument establishes a legal link between the statutory standard and the non-statutory AS/CA documents: compliance with the AS/CA documents, as they stood at prescribed times, is how an item is judged to comply with this statutory instrument.

Acts Interpretation and Legislation Act cross-references

• Section 7 states that references to any other legislative instrument are to the instrument as in force from time to time. The instrument also includes notes directing readers to section 10 of the Acts Interpretation Act 1901 and subsection 13(1) of the Legislation Act 2003 for interpretation matters and registration. Thus the instrument interacts with interpretative and legislative procedure law, including the treatment of references to Commonwealth Acts and legislative instruments as amended.

The instrument is short on internal amendment history because it is a replacement instrument that repeals the 2015 technical standard. The document itself records the key steps in its immediate genesis; beyond that, parties will need to consult Communications Alliance and ACMA notices for future amendments and transition arrangements.

Immediate change recorded in this instrument

• Repeal of the 2015 instrument: section 4 expressly repeals the Telecommunications Technical Standard (Requirements for Customer Equipment for connection to a metallic local loop interface of a Telecommunications Network - AS/CA S043) 2015 (F2015L00192). The repeal is absolute in textual form. The instrument therefore stands as the current statutory technical standard replacing the 2015 instrument as from its commencement.

Dates and formalities

• The formal record shows the instrument was dated 20 March 2025 with signatures of ACMA officials and that it commences on 30 March 2025 (front matter; section 2). Those are the primary chronological markers provided by the text.

Transitional mechanism for future amendments to AS/CA Standards

• The instrument contemplates amendment or replacement of the applicable AS/CA Standards and prescribes transition mechanisms for such events. If Communications Alliance prepares an amendment instrument or replacement standard that determines transitional arrangements for a specified period commencing on the day the AS/CA Standard is amended or replaced, that specified period becomes an AS/CA transition period (section 10(1)). ACMA then defines an ACMA transition period in relation to the applicable AS/CA Standard as being either the same as the AS/CA transition period or, in the absence of such an AS/CA transition period, a default two years commencing on the day the applicable AS/CA Standard is amended or replaced (section 9). Thus the instrument builds in an ongoing amendment pathway driven by Communications Alliance but administered or recognised by ACMA.

Replacement standards and amendment instruments

• The definitions in section 6 recognise the possibility of an amendment instrument, a replacement standard, and a replacement standard in relation to an applicable AS/CA Standard. The instrument therefore anticipates continuity through successive AS/CA Standards while providing default timing rules when Communications Alliance does not set transition periods (sections 6, 9, 10).

Savings for items compliant with the 2015 standard

This technical standard text contains no litigation history. There are no cases, determinations, judicial reviews, or administrative decisions mentioned in the instrument. The instrument does reference the Telecommunications Act 1997 and various sections of that Act in its notes and in its legal basis (section 3 and notes to section 6), but it does not cite any judicial authority or precedent.

What the instrument says about disputes and enforcement context

• The instrument’s silence on litigation mirrors its role as a technical standard: it prescribes technical compliance criteria but not enforcement procedures or adjudicatory processes. Enforcement and dispute resolution in relation to whether a particular item complies with the standard will therefore occur, if necessary, under the processes and powers provided by the Telecommunications Act 1997 and by general administrative and judicial review mechanisms available to parties affected by ACMA decisions. However, no litigation examples or case law are supplied in the instrument.

Implications for legal practitioners and compliance officers

• Because the instrument itself provides no litigation footing, parties should assume any disputes about compliance, transition entitlements, materiality of modifications, or class inclusion will be resolved under the Act and ordinary administrative law. To assess litigation risk or to prepare for enforcement or defence, practitioners must therefore consult the relevant provisions of the Telecommunications Act 1997 and track ACMA’s enforcement practices and any published decisions or administrative rulings that interpret how ACMA enforces compliance with technical standards. None of those materials are included in this instrument.

Concluding note

• The instrument provides the operative rules that will be central to any litigation over technical compliance, but it does not include litigation history or precedent. Any legal challenge will turn on the application of sections 11, 12, 15, 16 and 17 to the facts of manufacture, importation and modification, and on the enforcement and procedural provisions of the Telecommunications Act 1997. Readers should therefore treat the instrument as a substantive matrix that will feed into litigation steered by Act-based enforcement powers, rather than as a record of past litigation.

The instrument’s legal effect depends on precise definitions, timing rules and the interplay between Communications Alliance documents and ACMA transition decisions. There are several specific technical and legal corner cases that regulated parties should note because they create compliance risk or ambiguity.

1. Thresholds for AS/CA S043.2 and AS/CA S043.3

• AS/CA S043.2:2016 applies to items that have “broadband capability”, defined as the ability to transmit a signal that uses a frequency above 20 kHz (section 6). AS/CA S043.3:2015 applies to an AS/CA S043.3 item defined to include operation above the voice frequency band up to 20 kHz (section 6). The instruments therefore create a boundary at 20 kHz. Equipment that uses exactly 20 kHz sits within the AS/CA S043.3 range (up to 20 kHz), while equipment that uses frequencies above 20 kHz triggers AS/CA S043.2. This is a sharp boundary. Manufacturers must categorise their items precisely against these frequency thresholds because different parts of the AS/CA suite apply.

2. Identity and manufacturer/importer requirements for class inclusion

• To be included in a class for inheritance, items must be identical to each other item of the class and have the same manufacturer or importer as each other item (section 11(1)(a)(i) and (ii)). This means variations in firmware, subcontracted manufacturing, rebranding or supply chain changes could break class identity and thereby remove the right to inherit compliance from the original item. The instrument is strict on identity and shared manufacturer/importer.

3. Modified items and the materiality test

• The test of materiality is pivotal. Section 16(3) allows a modified item to be treated as compliant where the modification is not material and the modified item complies with the applicable AS/CA Standard as in force on the date the original item was made or imported. Section 16(4) specifies that a modification is material if it would or could reasonably be expected to affect whether the modified item complies with the AS/CA Standard. That presents a potentially fact-intensive and predictive inquiry. Manufacturers or modifiers who assert non-materiality must be able to justify that reasonably, potentially requiring technical analysis and supporting evidence to demonstrate no reasonable expectation of affecting compliance.

4. Overlapping ACMA transition periods

The instrument establishes a date- and definition-driven compliance regime. Compliance is therefore a process of identification, classification, version control, and documentation. The following steps map the actions that manufacturers, importers, modifiers and compliance officers should take, grounded in the instrument’s text.

1. Determine whether the product falls within scope

• Check whether the item is “customer equipment that is used, or is to be used, for connection to a telecommunications network via a metallic local loop interface” (section 13). Confirm the network type: the note to section 13 clarifies that this means an Australian telecommunications network operated by a carrier or carriage service provider as defined in the Act. If the product does not connect via a metallic local loop interface or is intended exclusively for non-Australian networks, this instrument’s obligations will not apply.

2. Identify applicable AS/CA Standards

• Use section 8 and section 6 definitions to determine which AS/CA parts apply:
  • AS/CA S043.1:2015 applies in all cases (section 8(1)).
  • AS/CA S043.2:2016 applies if the item has broadband capability, defined as the ability to transmit a signal that uses a frequency above 20 kHz (section 8(2), section 6).
  • AS/CA S043.3:2015 applies if the item is an AS/CA S043.3 item, which includes DC power feeding or signalling, low frequency AC below 300 Hz, voice frequency band operation, or operation above the voice band up to 20 kHz (section 6, section 8(3)).
• Be precise on frequency boundaries: an item using exactly 20 kHz is within S043.3’s “up to 20 kHz” scope rather than S043.2’s “above 20 kHz” trigger.

3. Establish the relevant compliance date

• For unmodified items, the operative standard is the version of the applicable AS/CA Standard in force on the date the item was manufactured in Australia or imported (section 15(1)).
• For modified items, the operative standard is the version in force on the date the modified item is made in Australia (section 16(1) and section 12).
• If the item is produced as part of an identical class, determine the original item and its date; later items of the class may inherit the original item’s compliance if they are identical and share the same manufacturer or importer (sections 11 and 15(2), 16(2)).
