Telecommunications (Requirements for Customer Cabling Products – AS/CA S008) Technical Standard 2025

Customer cabling product is defined in section 6 as a passive device (including any cable or connecting hardware) that is used, or is to be used, on the customer side of the boundary of a telecommunications network. It expressly excludes a cabling product used primarily for the distribution of AC mains supply, a product used for telecommunications earthing systems or telecommunications power distribution, and a surge suppression device. This definition is narrower than the general concepts of “customer equipment” and “customer cabling” used in the Telecommunications Act, so the instrument applies only to passive network-side products, not to active equipment such as phones or modems.

Item is defined broadly as a thing that is customer equipment or customer cabling to which the standard applies (section 6). It includes a modified item. The use of “item” allows the standard to apply uniformly to both manufactured and imported goods and to both original and modified units. Modified item means an item that has been modified by or on behalf of the manufacturer or importer after the item was manufactured or imported; the reference is to the item as modified. This is important because the compliance date for a modified item can shift to the date of modification rather than the date of original manufacture or import, unless a non-material modification exception applies.

Class of items (section 10) is a central concept that reduces retesting burdens. A class consists of items that are identical to each other (irrespective of when manufactured or imported) and that share the same manufacturer or importer. The original item is the first item of that class to be manufactured in Australia or imported. For modified items, a separate class can be formed if the modification is identical across items and the items are otherwise identical, with the original modified item being the first item so modified in Australia. If an item falls within a class, it can comply under section 14(2) by meeting the standard as in force on the date of the original item, even if the standard has since been updated. This is a practical concession: it avoids requiring retesting of every production run when the specification has not changed.

ACMA transition period and AS/CA transition period (sections 8 and 9) govern what happens when the underlying industry standard is amended or replaced. The AS/CA transition period is set by Communications Alliance in its amendment instrument or replacement standard, if that instrument makes transitional arrangements of a specified period allowing compliance with either the old or the new version. If no such period is set by Communications Alliance, the ACMA transition period defaults to two years commencing on the day the AS/CA Standard is amended or replaced. This default is a safeguard: it ensures industry always has at least two years to adapt, but the period can be shorter if Communications Alliance specifies one. Overlapping transition periods occur when one amendment is made while another transition period is still running; during the overlap, items can comply with any of the base versions in force at the commencement of any overlapping period (sections 14(4) and 15(6)). This can create complexity but also flexibility.

Compliance date is a critical concept because the standard is not a single fixed version but is dynamic. For a non-modified item, the compliance date is the date of manufacture in Australia or import (section 14(1)), or if using the class-of-items path, the date of the original item (section 14(2)). For a modified item, the compliance date is the date the modification is made (section 15(1) and see definition of “date a modified item is made” in section 11). When a transition period is in effect, the compliance date reference is shifted to the start of the transition period or the day before, depending on which version is chosen. These date-based rules mean that a manufacturer or importer must keep precise records of production and import dates to defend compliance.

The primary duty bearers are manufacturers and importers of customer cabling products. The instrument defines “manufacturer or importer” by reference to section 406A of the Telecommunications Act (note to section 6). This includes Australian entities that manufacture the products in Australia, as well as entities that import the products into Australia. Importers are particularly affected because many cabling products are manufactured overseas; the importer bears the compliance obligation for each imported unit. The class-of-items provisions apply equally to imported goods: the original item in a class can be an imported item, and subsequent identical imported items can rely on its compliance date. However, if the original item was imported on a different date than later imports, the importer must document that each item is identical and shares the same importer.

Carriers and carriage service providers are indirectly affected. They operate the telecommunications networks to which customer cabling products are connected. If a non-compliant product damages network integrity or causes a safety hazard, the carrier or provider may suffer operational disruption, but the compliance obligation does not fall on them directly unless they manufacture or import cabling products. Nevertheless, they may require suppliers to provide evidence of compliance as a condition of procurement.

End users - such as households, businesses, and telecommunications installers - do not have duties under this standard. However, they are affected because non-compliant products could pose safety risks (e.g., fire or electric shock) or prevent access to emergency call services. The instrument’s objects mention protecting health and safety of persons who use services supplied by means of a telecommunications network. End users also rely on interoperability for standard telephone services, which the standard aims to ensure.

Communications Alliance Ltd is the private standards body that publishes the AS/CA Standard. Although not regulated by the instrument, its actions (publishing amendments or replacement standards) automatically trigger changes to legal obligations when the ACMA transition periods expire. The instrument gives Communications Alliance significant quasi-regulatory power: its transitional arrangement decisions set the AS/CA transition period, and if it chooses to set no period, the default two-year ACMA period applies. Industry participants therefore have an interest in Communications Alliance’s standards development process.

Third-party testing laboratories and compliance consultants are indirectly affected as service providers: demand for testing and advice on compliance with AS/CA S008 will continue, though the class-of-items provisions may reduce frequency of retesting for stable product lines.

Customs and border enforcement agencies may be involved because imported customer cabling products must comply. While the standard itself does not create customs clearance requirements, non-compliant products may be prohibited imports under the Telecommunications Act regulations.

Duty to ensure compliance: The core duty is set out in section 13: an item (other than a modified item) must meet one of the requirements in subsections 14(1), (2), (3) or (4), and a modified item must meet one of the requirements in subsections 15(1), (2), (3), (5) or (6). This is not a duty to “label” or “certify” compliance; it is a duty that the item actually meet the relevant version of the AS/CA Standard. The obligation applies at the moment of manufacture in Australia or import, and for modified items at the moment of modification. There is no ongoing duty after the product is placed on the market, but if a product is subsequently modified, the modification duty applies again.

Right to rely on class-of-items provisions: A manufacturer or importer whose subsequent items are identical to an earlier compliant original item can satisfy the standard without retesting each unit, as long as the original item complied and the subsequent items are identical (sections 14(2) and 15(2)). This reduces compliance costs. However, the right is conditional: if the product design changes even slightly, the class may be broken, and the new variant may need its own original item. The issue of when a modification is “not material” (section 15(4)) is critical: the right to rely on the original item’s compliance for modified items only exists if the modification does not affect compliance with the standard in force on the original item’s date.

Right to use transition periods: During an ACMA transition period (which may be up to two years by default, or a different period set by Communications Alliance), an item may comply with either the old version of the standard or the new version (sections 14(3) and 15(5)). Overlapping transition periods give a right to choose from multiple base versions (sections 14(4) and 15(6)). This provides flexibility to manage inventory and design changes. The right is time-limited: once the transition period ends, only the new version is valid for newly manufactured or imported items.

Savings right for pre-commencement items: Items manufactured, imported or modified before the commencement date (30 March 2025) that complied with the 2015 standard are taken to comply with this new standard (Part 4, section 16). This is not a duty but a protective right: products already in the supply chain do not need to be reworked or discarded. It applies automatically.

No explicit record-keeping duty: The instrument does not explicitly require manufacturers or importers to keep records of compliance evidence, dates of manufacture/import/modification, or class-of-items designations. However, in practice, to demonstrate compliance if challenged by ACMA or to defend against an allegation, a party would need such records. In enforcement proceedings under the Act, the burden may shift if a due diligence defence is raised.

No private right of action: The standard does not create a right for end users or competitors to sue for non-compliance. Only ACMA can enforce. This limits the legal exposure for non-compliance to administrative penalties and criminal sanctions under the Act, rather than civil liability to third parties for breach of the standard itself (though product liability under the Australian Consumer Law may still arise separately for defective cabling).

The instrument itself does not prescribe penalties. Contravention of a technical standard made under section 376 of the Telecommunications Act 1997 is an offence under the Act. The specific penalty provisions are in Part 21 of the Act. For a corporation, the maximum penalty for a contravention of a technical standard can be significant (up to $10 million or more for serious offences, depending on the provision and whether the breach is criminal or civil). The Act also provides for civil penalty provisions, infringement notices (on-the-spot fines), and enforceable undertakings. ACMA has the power to issue directions to comply, seek injunctions to stop supply, and accept remediation plans.

The standard is a legislative instrument, so strict liability may apply unless a defence is available. For criminal offences, the Act likely provides for a defence of reasonable mistake of fact or due diligence. For civil penalty provisions, the standard of proof is the balance of probabilities. ACMA’s enforcement policy typically focuses on serious risks to network integrity or safety rather than minor deviations, but the instrument’s objective nature means that even a non-complying product that never causes harm is technically in breach.

Enforcement actions may target importers who bring in large volumes of non-compliant cabling. ACMA can also request information or documents under the Act to verify compliance. If a supplier cannot produce records of compliance dates or testing, ACMA could treat that as evidence of non-compliance. The absence of an explicit record-keeping duty in the instrument does not prevent ACMA from using its general information-gathering powers.

The class-of-items provisions may reduce enforcement risk for suppliers who maintain stable product lines, but they also create a potential loophole: if an original item was compliant but a subsequent identical item actually deviated due to manufacturing variation, the class-of-item path would not be available if the item is no longer truly identical. ACMA could test samples and argue the class was broken. The burden would then shift to the supplier to prove identity.

For modified items, the materiality test (section 15(4)) could be litigated: a modification that the supplier considers immaterial might be deemed material by ACMA or a court, resulting in a finding of non-compliance. This creates legal uncertainty. Suppliers should treat any change with caution and obtain technical advice.

Penalties under the Act are not capped by the standard; they are set by the Act itself. The instrument’s repeal of the 2015 standard means that any enforcement action taken after 30 March 2025 must refer to this new standard, not the old one. However, the savings provision means items compliant with the old standard pre-commencement remain compliant and cannot be penalised.

The standard sits within a broader legal framework. It is made under the Telecommunications Act 1997, which also contains provisions on customer equipment and cabling registration, the ACMA labelling notice, and offences for causing interference or network damage. The standard does not replace those provisions; it supplements them. For example, even if a cabling product meets AS/CA S008, it may still need to comply with the ACMA Labelling Notice (e.g., the C-Tick or RCM mark) if it is also an electrical product subject to the Radiocommunications Act. But the instrument is focused on cabling products that are passive, so electromagnetic compatibility labelling may not apply.

Australian Consumer Law (ACL): If a customer cabling product fails to comply with the standard and causes property damage or personal injury, the supplier may face liability under the ACL for defective goods or for breach of a safety standard (if the product is prescribed as a safety standard under the ACL). The standard itself is not an ACL safety standard, but a failure to comply could be evidence of a “defect” or “unacceptable quality” under the consumer guarantees.

State and territory electrical safety laws: Many jurisdictions regulate low-voltage electrical wiring and cabling under their own electrical safety acts. The instrument’s definition of customer cabling product excludes products used primarily for AC mains distribution, but other cabling may still be considered electrical wiring and require compliance with Australian Standards such as AS/NZS 3000 (the Wiring Rules) in addition to AS/CA S008. The standard does not override state electrical safety regulations.

Work health and safety laws: Employers who install or use customer cabling products have duties under WHS Acts to ensure that plant and equipment are safe. Compliance with this technical standard would be a strong indicator of safety, but non-compliance could lead to enforcement by WHS regulators as well as ACMA.

Customs legislation: Imported customer cabling products must be declared as compliant with this standard. The Customs Act 1901 prohibits importation of goods that do not comply with certain Australian standards. However, the standard is not listed in the Customs (Prohibited Imports) Regulations, so enforcement relies on ACMA and border agencies cooperating. Non-compliant products could be seized or the importer prosecuted.

Contract law: Supply agreements between manufacturers/importers and carriers or installers often include contractual terms requiring compliance with ACMA technical standards. Breach of the standard could give rise to a breach of contract claim. The instrument itself does not create contractual rights, but it sets the benchmark.

Other ACMA technical standards: The ACMA makes separate standards for other types of customer equipment (e.g., AS/CA S042 for modems, AS/CA S003 for phones). Customer cabling products are distinct; a combined product (e.g., a cable with built-in surge suppression) may fall under multiple standards. The definition here excludes surge suppression devices, but other standards may apply.

The instrument’s reference to “telecommunications network” in Australia (note 2 to section 12) means compliance is only required for products for connection to Australian networks. Products exported overseas are not subject to this instrument, but manufacturers may still choose to design to AS/CA S008 for efficiency.

This instrument is a new legislative instrument registered in 2025. It repeals and replaces the Telecommunications Technical Standard (Requirements for customer cabling products - AS/CA S008) 2015 (F2015L00182) (section 4). The 2015 instrument was itself a remake of earlier standards that had adopted previous versions of AS/CA S008 (e.g., the 2010 version). The 2015 instrument had similar structure but did not have the specific overlapping transition period provisions now in sections 14(4) and 15(6). The current instrument updates the incorporated industry standard to AS/CA S008:2020, published in August 2020, rather than the earlier version referenced in the 2015 instrument. The gap between the publication date of the industry standard (2020) and the commencement of the legislative instrument (2025) is notable. It means the instrument is adopting a standard that is already several years old. Newer versions of AS/CA S008 may have been published by Communications Alliance after 2020; the instrument allows those to be adopted via amendment instruments and transition periods. But as of commencement, the mandatory version is the 2020 edition.

The instrument itself has not been amended since its registration. Its amendment history consists only of its own creation and the repeal of the 2015 predecessor. Future amendments will occur automatically when Communications Alliance publishes a replacement standard or an amendment instrument. The ACMA transition period mechanism ensures that each future change will have a built-in grace period. The instrument also contains a note about references to other legislative instruments being to those instruments as in force from time to time (section 7), which means that any future variations to the Acts mentioned (e.g., the Telecommunications Act) will automatically affect this instrument’s interpretation without needing a formal amendment to the instrument itself.

Users of this instrument should monitor the Federal Register of Legislation for any amending instruments that the ACMA may make to directly amend the text (e.g., to change the specific edition of the AS/CA Standard referenced, or to adjust transition periods). However, the instrument’s design suggests that ACMA intends future changes to be handled mostly via changes to the underlying industry standard rather than by direct legislative amendment.

The source text contains no reference to any litigation concerning this standard, its predecessor, or the underlying AS/CA S008 standard. Technical standards of this kind are rarely challenged in court. Most disputes are resolved administratively through ACMA investigations and compliance actions. There is no published reported decision specifically on the interpretation of AS/CA S008 requirements or on the class-of-items provisions of the 2015 standard.

Theoretically, a judicial review proceeding could be brought against ACMA for making the standard if it were alleged to be beyond power, procedurally unfair, or unreasonable in a Wednesbury sense. But subsection 376(1) of the Act gives very broad power, and the instrument’s objects are standard. A challenge on the basis that the incorporated industry standard is not accessible or is too costly to obtain could be raised, but Communications Alliance provides free access on its website (as noted in the definition). The High Court in ASX Operations and other cases have upheld incorporation by reference of private standards in legislative instruments, provided they are reasonably accessible. So litigation risk is low.

In enforcement contexts, a court may need to interpret whether a particular product falls within the definition of “customer cabling product” (especially the exclusions for AC mains distribution, earthing systems, or surge suppression). That could be litigated in a criminal prosecution or civil penalty proceeding. The materiality test for modifications (section 15(4)) could also be contested. But no such cases are reported yet; any that exist would be unreported ACMA tribunal decisions or Federal Court proceedings likely not captured in this source.

Practitioners should be aware that the interpretation of “identical” in the class-of-items provisions could be contentious. Minor manufacturing tolerances might raise questions of identity. The Act’s strict liability nature means a court could interpret “identical” strictly. However, the instrument does not require absolute physical identity; it likely means the same product design and specifications. Without litigation, the safe approach is to treat any component change as potentially breaking the class unless verified to be identical in all respects that affect compliance.

Commencement date is 30 March 2025 - the instrument was made on 20 March 2025 but commences ten days later. That short gap means that any customer cabling product manufactured or imported on or after 30 March 2025 must comply with this new standard (or the transition provisions). But the underlying industry standard (AS/CA S008:2020) was published in 2020, so most compliant products should already meet it. The trap is for products that were designed to the 2015 standard only: after commencement, new production must switch to the 2020 standard unless they are in inventory that was manufactured or imported before commencement and comply with the 2015 standard (savings provision). So the transition is effectively immediate for new supply.

Overlapping transition periods can cause confusion - sections 14(4) and 15(6) allow compliance with any of several base versions when transition periods overlap. That means at any given time, multiple versions of the AS/CA Standard could be legal for new production. Compliance officers must track which versions are currently “live”. A mistake could lead to a product being compliant under one version but not under another, and enforcement may depend on the product’s date. The instrument does not require a single current version; it provides a set of legally acceptable versions. The onus is on the manufacturer or importer to choose the correct date reference for their product.

The definition of “customer cabling product” excludes surge suppression devices - but a surge suppression device may be integrated into a cable or connecting hardware (e.g., a surge-protected RJ45 patch cable). The instrument only excludes a “surge suppression device” as such. If the device is combined with cabling, the cabling component might still be a customer cabling product, while the surge suppression component might not be subject to this standard. A product that is primarily a cabling product should still meet AS/CA S008 for the cabling part; the surge suppression feature may need to comply with separate standards (e.g., AS/NZS 1768). Similarly, products for telecommunications earthing or power distribution are excluded, so a combined cable with an earth conductor must be assessed to ensure it is not primarily for earthing.

Modified items: the materiality test is inherently uncertain - a manufacturer who makes a minor change to a product (e.g., a different colour sheath, a slightly different connector plating) must determine whether that change “could reasonably be expected to affect” compliance (section 15(4)). If they guess wrong and consider it non-material, but ACMA disagrees, the modified item is non-compliant. There is no de minimis exception; even a change that has no effect on electrical performance might be material if it affects mechanical fit or durability and thus could affect long-term compliance. The safest course is to treat any modification as creating a new class unless the manufacturer performs testing to prove it does not affect compliance.

Class-of-items requires identical manufacturer and importer - section 10 requires that all items in a class have “the same manufacturer or importer”. If an importer changes their supply source, items from different manufacturers cannot be grouped even if they are physically identical. Similarly, if a manufacturer subcontracts production to different factories, the items may not be considered identical if there are any process differences. The phrase “identical to each other item” is strict; the instrument does not allow for minor variations. This could trap importers who source from multiple OEMs under the same brand but different production lines.

No sunset clause on class-of-items reliance - a class-of-item compliance path never expires. An item manufactured in 2035 could rely on an original item manufactured in 2025, as long as the items are identical and the standard has not been updated to a version that the original item did not comply with. But if the AS/CA Standard is amended, the original item’s compliance date becomes less relevant because the new item must still comply with the standard “as in force on the date the original item of the class was manufactured” (section 14(2)(b)). That means if the standard is amended, the class-of-items path continues to reference the old version. That is fine if the product still meets the old version, but the old version may become obsolete even if it remains legally acceptable. However, if the product’s design is unchanged, it still complies. This creates a permanent grandfathering effect for unchanged product lines, but only if the product never undergoes a material modification. A small change could trigger a new obligation to comply with the current standard, forcing a costly redesign.

No explicit transition for compliance evidence - the savings provision (section 16) deems pre-commencement items compliant if they complied with the 2015 standard, but it does not say how that compliance must be evidenced. A manufacturer or importer who cannot prove that their pre-commencement items met the 2015 standard may struggle in an enforcement action. It is advisable to retain test reports or declarations from that period.

The instrument does not specify testing or certification requirements - it only says the item must meet the AS/CA Standard. That standard itself likely contains specific tests and criteria. Manufacturers and importers must purchase and read AS/CA S008:2020 (free from Communications Alliance) to understand the technical requirements. Reliance on the instrument alone is insufficient for compliance.

1. Determine if your product is a customer cabling product - check the definition in section 6. It must be a passive device used on the customer side of the network boundary. Exclude products primarily for AC mains distribution, earthing systems or power distribution, and surge suppression devices. If you are unsure, obtain a technical opinion from a cabling standards expert. Products that fall outside the definition are not subject to this standard, though they may fall under other ACMA standards.

2. Identify the applicable compliance date - for each item, determine whether it is a new (unmodified) item, a modified item, or a pre-commencement item.

   • Pre-commencement items (manufactured or imported before 30 March 2025) that complied with the 2015 standard are deemed compliant. Keep records of that compliance.
   • New items manufactured or imported on or after 30 March 2025 must comply with one of the paths in section 14 or 15.
   • For unmodified items, the default path is to comply with AS/CA S008:2020 (or any later adopted version) as in force on the date of manufacture or import. That means you must test or certify the product to that version.
   • If you plan to use the class-of-items path, designate an original item for each class and verify that all subsequent items are identical and share the same manufacturer or importer. Document the original item’s compliance date and evidence of conformity.
   • For modified items, evaluate whether the modification is material (section 15(4)). If it is material, treat the modified item as a new item and comply with the standard in force on the modification date. If it is not material, the modified item can rely on the original class’s compliance, but document your reasoning and have technical evidence that the modification does not affect compliance.

3. Monitor changes to the AS/CA Standard - subscribe to Communications Alliance communications about amendments or replacement standards. When a new version is published, note the date and whether it comes with an AS/CA transition period (section 9). If it does, that period becomes the ACMA transition period. If it does not, the ACMA default of two years applies. During the transition period, you may choose to continue complying with the old version or switch to the new version. Keep track of overlapping periods to avoid accidentally relying on an expired version.

4. Maintain detailed records - for each product class, retain:

   • The date of manufacture or import of the original item.
   • Evidence that the original item met the AS/CA Standard in force on that date (e.g., test report from an accredited laboratory, supplier declaration).
   • For subsequent items, evidence that they are identical to the original item (e.g., design drawings, bills of materials, production quality records).
   • For modified items, the date and description of the modification, and the analysis of materiality.
   • For imported items, the date of import (e.g., shipping documents, customs entry).
   • Without these records, you cannot demonstrate compliance if ACMA investigates.

5. Consider independent testing - even though the instrument does not mandate third-party certification, having a test report from a laboratory accredited to test to AS/CA S008 strengthens your position. This is especially important for the original item of a class, because many subsequent items will rely on it. If the original item later turns out to be non-compliant, the entire class becomes non-compliant.

6. Implement change control - any proposed modification to a compliant product (whether by the manufacturer or by the importer at the factory) should trigger a compliance review under section 15. Do not assume that a minor change (e.g., different connector plating, new cable jacket material) is non-material without testing or analysis. A change that affects electrical characteristics, flame retardancy, or mechanical fit is likely material. Document the review and the outcome.

7. Train relevant staff - procurement officers, product managers, and quality assurance teams should understand the concept of compliance dates and class-of-items. They must know not to mix different production runs without verifying identity.

8. Review existing inventory post-commencement - any customer cabling products manufactured or imported before 30 March 2025 that complied with the 2015 standard can be sold without further action. Products manufactured or imported after that date must comply with the new standard. If you have stock that was manufactured before but imported after commencement, the import date determines compliance. To avoid a gap, arrange imports to occur on or before 30 March 2025 if you want to rely on the savings provision.
