What it does
This Instrument fixes a single numeric ceiling for the Telecommunications Universal Service Management Agency Act 2012 levy regime for one defined levy period. It is the Telecommunications (Overall Levy Cap Amount) Instrument 2013, made by the Minister for Broadband, Communications and the Digital Economy on 5 August 2013 under the statutory power conferred by subsection 99(4) of the Telecommunications Universal Service Management Agency Act 2012 (the Act) (Instrument s1; s4). The operative declaration is compact: for the purposes of subsection 99(4) of the Act, the overall levy cap amount for the relevant period is $254,900,000 (Instrument s4). The Instrument identifies the relevant period as the 2012-2013 eligible levy period (Instrument s3).
Mechanically, the Instrument performs three discrete tasks. First, it records the Ministerial exercise of a power in a prescribed form and names the Instrument (s1). Second, it specifies the time at which the Instrument has legal effect: the Instrument commences on the day after it is registered on the Federal Register of Legislative Instruments (Instrument s2). Third, it defines two internal terms for the Instrument’s own operation: Act (defined as the Telecommunications Universal Service Management Agency Act 2012) and relevant period (defined as the 2012-2013 eligible levy period) (Instrument s3). The substantive legal output is the single figure $254,900,000 stated as the overall levy cap amount for that relevant period (Instrument s4).
The Instrument does not itself create a levy, does not prescribe how any levy would be calculated between contributors, and contains no transitional or procedural detail. Its declared legal relationship to the Act is explicit: it operates for the purposes of subsection 99(4) of the Act (Instrument s4). Any further effects of the figure it sets, such as distribution of levy burdens among liable entities, timing of calls for funds, or enforcement mechanisms, are not addressed in the Instrument and therefore depend on the provisions of the Act and subordinate instruments made under the Act.
