What it does
This legislative instrument, made under subsection 360K(4) of the Telecommunications Act 1997, overrides the default assignment of statutory infrastructure providers for eight specific nominated service areas. The default rule under section 360J and subsection 360K(3) of the Act would otherwise treat a development area that was the subject of a carrier licence condition declaration as a nominated service area and the carrier that held that licence as the statutory infrastructure provider for that area. This declaration disapplies subsection 360K(3) to each listed area and instead names a different carrier as the statutory infrastructure provider for that area.
The table in section 5 is the operative component. Items 1, 2 and 3 designate LBN Co Pty Ltd as the statutory infrastructure provider for Elements Retirement Living (Springwood, QLD), Kelvin Grove Urban Village (QLD) and Little Bay Estate (NSW). Those three development areas were previously covered by the Carrier Licence Conditions (Pivit Pty Ltd) Declaration 2013, meaning Pivit Pty Ltd would have been the default statutory infrastructure provider under section 360K(3). The instrument removes that default and substitutes LBN Co Pty Ltd. Items 4 through 8 cover five residential apartment complexes in Docklands, Victoria (Forte, EXO, Serrata, Convesso and Concavo). Those areas were subject to the Carrier Licence Conditions (NT Technology Services Pty Ltd) Declaration 2014, which would have made NT Technology Services the default statutory infrastructure provider. The instrument instead designates OptiComm Ltd for all five.
From a mechanical standpoint, the instrument transfers the legal obligation to provide standard telephone and payphone services (or any other obligations the Act imposes on a statutory infrastructure provider) from one carrier to another for these small geographic areas. It does not create new duties, expand the definition of nominated service area, or alter the statutory regime for any other area. The instrument is highly specific and remedial in the sense that it corrects or updates the provider assignment for locations where the original carrier licence conditions have been superseded by later commercial arrangements. The practical effect is that residents and businesses in those eight areas now have a different carrier responsible for ensuring universal service infrastructure, and the previously designated carriers are relieved of that responsibility for those locations.
