What it does
This instrument is a ministerial direction that requires the Australian Communications and Media Authority (ACMA) to make a binding standard governing how mobile network coverage is represented to the public. The direction is made under subsection 125AA(4) of the Telecommunications Act 1997 and instructs ACMA to determine a standard under subsection 125AA(1) of the Act (s 3; s 5(1)). The Minister directs ACMA to finalise the standard by 31 March 2026 and to have it commence in full at the earliest opportunity and no later than 30 June 2026 (s 5(2)(a)-(b)). The direction permits ACMA to vary the standard over time provided any variation continues to comply with the timing and application constraints in the direction (s 5(3)).
Mechanically, the instrument does four things. First, it sets the scope of what the standard must address: representations by carriers and carriage service providers of network coverage for Relevant Mobile Telecommunications Services (s 7(1)). Second, it prescribes mandatory objectives the standard must give effect to, including comparability, clarity, accessibility, methodology transparency and the ability to export coverage data for analysis (s 7(1)(a)-(g)). Third, it prescribes who is in scope , carriers and carriage service providers who supply services that meet the direction’s definition of a Relevant Mobile Telecommunications Service , but allows ACMA to treat different classes differently or exempt some classes (s 6(1)-(2)). Fourth, it requires ACMA to have regard to findings of the Australian Government’s National Audit of Mobile Coverage when developing the standard (s 7(2)).
The instrument itself does not set the detailed technical requirements, enforcement mechanisms, sanctions, or compliance processes. Instead it sets the policy objectives and deadlines that ACMA must translate into a regulatory standard under the Act (s 5(1)-(3); s 7). ACMA is expressly authorised to define additional terms required to operationalise the standard (s 5(4)). The direction therefore converts ministerial policy preferences into an administrative mandate for ACMA to produce the substantive regulatory instrument that will impose obligations on carriers and carriage service providers.
