What it does
This instrument, titled Telecommunications (International Conventions) Notification No. 1 of 1997, is a ministerial notification made under section 580 of the Telecommunications Act 1997. The operative text is a single sentence: the Minister for Communications and the Arts, Richard Alston, "under section 580 of the Telecommunications Act 1997, notify the Australian Communications Authority of each convention specified in the Schedule." The instrument is dated 18 June 1997 and is signed by the Minister.
Mechanically, the instrument performs one discrete administrative act: it sends a list of specified international conventions to the Australian Communications Authority (ACA). The list is set out in a Schedule attached to the notification and comprises 39 separate items. The Schedule identifies each item by number, gives the convention title, and records the place and date at which the convention was "done at" or adopted. Some entries carry parenthetical qualifications in the Schedule, for example the words "(as amended by the 1994 Amendment)" or "(as amended by the 1992 Amendments)" alongside particular treaties.
The notification does not itself purport to incorporate, give domestic legal force to, or implement any of the conventions listed. The only stated legal basis for the act is section 580 of the Telecommunications Act 1997. The instrument does not state any subsequent actions the Australian Communications Authority must take on receipt. It does not include regulations, conditions, or supplementary administrative directions. It does not record whether Australia has ratified, accepted, or otherwise become bound by the listed conventions, nor does it record entry-into-force or ratification dates. The Schedule records the conventions' adoption location and original adoption date, but the notification contains no statement about domestic legal effect.
