Telecommunications (Interception and Access) Western Australia Act 1996

Eligible authority: The Act defines "eligible authority" as the Corruption and Crime Commission or the Police Force of this State (s 3(1)). The long title indicates those bodies were the intended applicants to be declared agencies under the Commonwealth Act. The Act defines associated office-holders: "chief officer" for each eligible authority, "certifying officer", and "officer" (s 3(1)). Those definitions control who must carry out particular duties (for example, the chief officer must cause records to be kept , s 4).

Part 2‑5 warrant / warrant: The Act repeatedly uses the terms "Part 2‑5 warrant" and "warrant", referring to warrants issued under Part 2‑5 of the Commonwealth Act (s 3(1) definitions). The WA Act does not create new interception authorisations; it regulates how state agencies record and report on warrants and interceptions which they hold under the Commonwealth Act.

Record-keeping obligations: Sections 4 and 5 require the chief officer to ensure that an eligible authority's records contain: each warrant issued to the authority, revocations, certificates issued under s 61(4) of the Commonwealth Act, authorisations by chief officer under s 66(2) of the Commonwealth Act (s 4); and detailed particulars of telephone applications for Part 2‑5 warrants, whether applications were withdrawn/refused or issued, particulars of each interception including start time, duration, person who carried out the interception, and, for named person warrants, services intercepted (s 5(1) and (1a)). Section 5(2) requires those records to be kept in the authority's records.

Restricted records: The Act requires restricted records to be kept in secure places where access is limited to entitled persons (s 8(1)). It requires prompt destruction "forthwith" where the chief officer is satisfied the restricted record is not likely to be required for a permitted purpose other than inspection or related reporting (s 8(2)). The Act ties the definition and handling of restricted records to the Commonwealth Act (see s 5(1)(c) and s 8(1)).

Reporting and ministerial circulation: The chief officer must give copies of warrants and instruments revoking warrants to the responsible Minister as soon as practicable, and must provide reports about use and communications of information obtained by interceptions within specified timelines (s 6(1)(a)-(b), s 6(1)(c), s 6(2)). The responsible Minister is then required to pass those reports to the Commonwealth Minister as soon as practicable (s 7, s 21).

Inspection regime and principal inspector: The principal inspector is an inspecting officer prescribed by regulation (s 3(1)) with three general functions: inspect eligible authority records for compliance with Part 2, report to the responsible Minister, and do anything incidental or conducive to those functions (s 9). The principal inspector must inspect each eligible authority at least twice per financial year (s 10(2)), and may inspect at other times (s 10(3)). The principal inspector may report on contraventions of the Commonwealth Act or the recording/reporting requirements (s 12).

Inspection powers and compulsion: For inspections the principal inspector may enter premises (after notifying the chief officer), obtain full access to records, make copies and extracts "despite any other law", and require officers to give information (s 13). Further compulsion is provided by s 14, which allows the principal inspector to require in writing that an officer give information in writing, or attend to answer questions; if the person is unknown, the chief officer can be required to nominate someone (s 14(4)). Section 15 removes legal defences based on other laws, public interest, or self-incrimination for complying with inspection requests, but limits admissibility of compelled information in evidence except in prosecutions under s 23.

Inspecting officer protections and delegation: Inspecting officers have statutory immunity from suit for acts done in good faith in performance of their functions (s 17). The principal inspector may delegate functions to other inspecting officers, except the power to delegate and the power to report to the responsible Minister (s 18).

Interplay with Parliamentary Commissioner: Where the inspecting officer is the Parliamentary Commissioner or an officer of the Commissioner, the Act modifies application of provisions of the Parliamentary Commissioner Act 1971 in particular ways, excluding inspection conduct from reports under certain Parliamentary Commissioner Act sections and applying some sections with specific substitutions and omissions (s 19).

Information exchange with Commonwealth Ombudsman: The principal inspector may pass information that relates to a Commonwealth agency to the Commonwealth Ombudsman only if satisfied it is necessary for the Ombudsman to perform its functions in relation to that Commonwealth agency; reciprocal receipt of information is permitted (s 20).

Offences and disclosure controls: Officials administering the Act (other than inspecting officers) must not disclose information obtained in the administration of the Act except as permitted by the Commonwealth Act or for discharging functions under this Act (s 22), with a penalty of imprisonment for two years. Section 23 criminalises failure or refusal without reasonable excuse to comply with a requirement under s 14 to attend, give information or answer questions, and also criminalises wilful obstruction, hindrance or resistance and knowingly giving false or misleading information in inspection contexts; penalty for certain offences is imprisonment for two years.

Regulation-making: The Governor may make regulations necessary or convenient to carry out the Act (s 24).

Together these concepts create a compliance, record-keeping and inspection architecture for state agencies that operate with Commonwealth interception warrants and related powers, while integrating ministerial reporting flows to the Commonwealth and restricting dissemination of interception-related material.

Primary affected bodies are the Corruption and Crime Commission and the Police Force of Western Australia, by definition the eligible authorities (s 3(1), long title). The Act specifically imposes duties on the chief officer of each eligible authority: causing records to be kept (ss 4-5), providing copies of warrants and reports to the responsible Minister (s 6), ensuring secure storage and destruction of restricted records (s 8). The Commissioner of Police is the statutory office-holder named in the definitions (s 3(1)); for the Corruption and Crime Commission, the Commissioner and Deputy Commissioner as defined in the Corruption, Crime and Misconduct Act 2003 are referenced for roles such as certifying officer and chief officer (s 3(1)).

Inspecting officers and the principal inspector are persons prescribed by regulation (s 3(1)). The principal inspector exercises inspection functions and reports to the responsible Minister (ss 9-11). If the Parliamentary Commissioner acts as an inspecting officer, the Act modifies how the Parliamentary Commissioner Act 1971 applies in that context (s 19). Inspecting officers also have statutory protection against suit when acting in good faith (s 17).

Responsible Ministers are affected in their reporting role. The chief officer must give reports and copies of warrants to the responsible Minister (s 6), and the responsible Minister must forward certain reports to the Commonwealth Minister (s 7, s 21). For the Corruption and Crime Commission the responsible Minister is the Attorney General; for the Police Force it is the Minister (s 3(1) definition of "responsible Minister").

Officers of eligible authorities (defined to include members of the Police Force and officers of the Commission) are subject to compulsion to provide information and answers during inspections (ss 13-15). They are also affected by the Act’s confidentiality and anti-disclosure provisions: persons engaged in administration of the Act (other than inspecting officers) must not disclose information or records obtained in administration of the Act except as permitted (s 22). The Act provides criminal sanctions (s 22, s 23) for particular forms of non-compliance, which directly affect those officers’ behaviour.

Other actors affected indirectly include:

• The Commonwealth Minister and Commonwealth agencies that interact through reporting and information exchange. The responsible Minister must send copies of certain reports to the Commonwealth Minister (s 7, s 21), and the principal inspector may share information with the Commonwealth Ombudsman where it relates to a Commonwealth agency and is necessary for the Ombudsman’s functions (s 20).
• Members of the public whose communications are subject to interception under warrants: the Act requires eligible authorities to keep details of warrants and interceptions (s 4, s 5), but the Act itself does not alter substantive interception powers; it prescribes administrative controls around those interceptions under the Commonwealth Act.
• Inspecting officers and persons who might be required to attend or provide information under s 14, as those persons may be compelled to provide material despite other legal protections (s 15), though the compelled information is generally not admissible against the person except in prosecutions under s 23.

The Act also affects the executive decision-makers within eligible authorities who must determine when to destroy restricted records (s 8(2)) and who must certify or authorise certain matters in relation to Commonwealth Act provisions that are cross-referenced (s 4). Finally, the Governor and the responsible Ministers are affected by the regulation-making and reporting duties respectively (s 24; ss 6-7, 21).

Duties on chief officers and eligible authorities:

• Keep and maintain records: The chief officer must ensure the authority's records include every Part 2‑5 warrant issued to the authority, copies of specified written descriptions given under s 59A(2) of the Commonwealth Act, instruments revoking warrants, copies of certificates issued by certifying officers under s 61(4) of the Commonwealth Act, and each authorisation by the chief officer under s 66(2) of the Commonwealth Act (s 4).
• Maintain detailed particulars about warrant applications and interceptions: The chief officer must ensure particulars of telephone applications for Part 2‑5 warrants, the outcome (withdrawn/refused/issued), and for each Part 2‑5 warrant exercised by the authority a range of particulars including start date/time, duration, the person who carried out the interception, and for named person warrants, the services intercepted (s 5(1), (1a), (2)). The records must be made and kept "as soon as practicable" after the events to which they relate (s 5(1)).
• Secure storage and destruction of restricted records: The chief officer must secure restricted records so they are not accessible to unauthorised persons (s 8(1)). The chief officer must destroy a restricted record "forthwith" if satisfied it is not likely to be required for a permitted purpose other than for inspection/reporting (s 8(2)).
• Reporting to responsible Minister: The chief officer must give copies of warrants and instruments revoking them to the responsible Minister as soon as practicable after issue or revocation (s 6(1)(a)). Within three months after a warrant ceases to be in force, the chief officer must give a written report about use of intercepted information and communications of that information to persons other than officers of the authority (s 6(1)(b)). Annually, within three months after each 30 June, the chief officer must give a written report setting out information required by Division 2 of Part 2‑8 of the Commonwealth Act that can be derived from the authority's records, and must include a statement of total expenditure connected with execution of warrants during the year (s 6(1)(c), (2)). The responsible Minister must forward copies to the Commonwealth Minister (s 7, s 21).

Inspection and information-gathering duties:

• Provide access and assistance to the principal inspector: The chief officer must ensure officers provide the principal inspector with any assistance reasonably required (s 13(2)). The principal inspector may enter premises, access all records, make copies, and require officers to give information (s 13(1)(a)-(d)).
• Comply with requirements under s 14: Where the principal inspector has reason to believe an officer can give relevant information, the principal inspector may require in writing that the officer provide the information in writing signed by the officer within a specified period, and may require attendance to answer questions (s 14(2)-(3)). If the officer’s identity is unknown, the principal inspector may require the chief officer (or a nominee) to attend (s 14(4)).

Limits on legal defences and evidentiary protections:

• Persons are not excused from giving information, answering questions or giving access on grounds that doing so would contravene another law, be contrary to public interest, or might tend to incriminate them, but compelled answers and information and information derived from them are not admissible against the person except in prosecutions under s 23 (s 15(1)). That limits traditional use immunity to admissibility in evidence, while still requiring production.

Rights and protections:

• Inspecting officers and persons acting under their direction are protected from suits for actions done in good faith in performing functions conferred by Part 3 (s 17).
• Compelled responses are generally protected from being used in evidence against the person who provided them, except in prosecutions under s 23 (s 15(1)).
• Where the inspecting officer is the Parliamentary Commissioner, the Act modifies application of the Parliamentary Commissioner Act 1971 to inspection-related information (s 19). That section excludes inspection conduct from certain Parliamentary Commissioner Act reporting requirements and substitutes particular application of sections where appropriate.

Information-sharing rights:

• The principal inspector may communicate inspection information to other inspecting officers and make use of records for inspection/reporting purposes despite any other law (s 16). The principal inspector may also provide information relating to a Commonwealth agency to the Commonwealth Ombudsman only where necessary to enable the Ombudsman to perform its functions in relation to that agency (s 20(1)-(2)). The principal inspector may receive information from the Ombudsman relevant to its functions (s 20(3)).

Offences and duties to maintain confidentiality:

• Persons engaged in the administration of the Act (other than inspecting officers) must not disclose information or records obtained in administration of the Act except as allowed by the Commonwealth Act or in discharging functions under this Act; that carries a penalty of imprisonment for two years (s 22(1)).
• There are statutory offences for refusing or failing without reasonable excuse to comply with s 14 requirements to attend, give information or answer questions (s 23(1)), and for wilfully obstructing or hindering in the exercise of the principal inspector’s functions or giving false or misleading information in connection with inspections; certain offences carry imprisonment for two years (s 23(2)).

Reporting obligations and ministerial flows:

• The principal inspector must report to the responsible Minister in writing within three months after the end of each financial year on the results of inspections of the authority’s records carried out during that year (s 11(2)). The principal inspector must notify the Commonwealth Minister when a report has been given and provide a copy to the chief officer (s 11(4)). The responsible Minister must forward inspection reports to the Commonwealth Minister as soon as practicable (s 21).

Regulatory power:

• The Governor may make regulations prescribing matters necessary or convenient to carry out the Act (s 24).

These duties and rights form a compliance and oversight architecture intended to ensure eligible authorities maintain and account for interception-related activity performed under the Commonwealth Act, with inspection powers vested in a principal inspector and limited protections for compelled information.

Criminal offences and penalties are concentrated in Part 4. Two principal penal provisions appear:

1. Restricted disclosure offence (s 22)

• A person, other than an inspecting officer, engaged in administration of the Act "must not disclose any information or record obtained by the person in the administration of this Act" unless disclosure is in accordance with the Commonwealth Act or for the purpose of discharging functions under this Act (s 22(1)).
• Penalty: imprisonment for 2 years (s 22(1)).
• This places a state-level criminal sanction on unauthorised dissemination of interception-related material obtained through administration of the WA Act.

2. Offences relating to inspections (s 23)

• Section 23(1) creates an offence to refuse or fail, without reasonable excuse, to attend before a person, give information, or answer a question when required under s 14. The provision itself does not specify a penalty in the text reproduced; it sets out the duty. Practitioners should note the text distinguishes s 23(1) and s 23(2).
• Section 23(2) criminalises wilfully obstructing, hindering or resisting a person in connection with the principal inspector’s functions under Part 3, and making to an inspecting officer information or a statement known by the person to be false or misleading in a material particular. Penalty: imprisonment for 2 years.

Enforcement architecture and powers:

• The principal inspector has statutory powers to enter premises of an eligible authority after notifying the chief officer and at reasonable times (s 13(1)(a)); to have full access to all records of the authority (s 13(1)(b)); to make copies and take extracts "despite any other law" (s 13(1)(c)); and to require officers to give information relevant to inspections (s 13(1)(d)). These are investigative enforcement tools which facilitate detection of non-compliance that could lead to criminal enforcement under ss 22 and 23.
• The principal inspector may require, by written notice, an officer to produce signed written information at a specified place and time or to attend before an inspecting officer to answer questions (s 14(2)-(3)). If the officer cannot be identified, the principal inspector may require the chief officer (or a nominee) to attend (s 14(4)). Failure to comply with these requirements without reasonable excuse falls under s 23(1).
• Section 15 removes defences that would excuse provision of information on grounds of other laws, public interest or self-incrimination, but protects the compelled information from admissibility in evidence against the person except in prosecutions under s 23. This means evidence obtained via compulsion may be available for prosecuting s 23 offences, undermining the usual privilege against self-incrimination in those circumstances for the purpose of enforcement.

Protections for inspecting officers:

• Inspecting officers and persons acting under their direction are shielded from civil actions for acts done in good faith in the performance (or purported performance) of statutory functions under Part 3 (s 17). This reduces the risk to inspectors of civil liability arising from intrusive compliance activity.

Administrative enforcement and reporting:

• The principal inspector must report inspection results to the responsible Minister and may include in those reports details of suspected contraventions of the Commonwealth Act or failures to comply with the reporting duties in s 6(1)(a)-(b) (s 12). There is a flow of inspections → reports to responsible Minister → notification to Commonwealth Minister (s 11(4), s 7, s 21), which is an administrative enforcement channel separate from criminal sanctions.

Limits on enforcement avenues:

• The Act does not itself create interception powers; it supports administration and oversight of Commonwealth-authorised interceptions by WA agencies. Enforcement therefore tends to be administrative and record‑focused, backed by criminal offences for obstruction, false statements and unauthorised disclosure. The Act allows use of compelled information in prosecutions for specified offences under the Act (s 15(1), s 23).

Practical enforcement implications:

• Inspecting officers have the investigatory tools to locate non-compliance (entry, copying, compulsion), and the Act creates criminal penalties likely intended to deter obstruction and leakage. The interplay between compulsion, admissibility, and prosecution under s 23 warrants close attention in enforcement planning: compelled answers are ordinarily protected from admissibility, but the Act carves out the s 23 prosecution exception (s 15(1)). Administrative action by responsible Ministers and onward reporting to Commonwealth bodies constitute parallel enforcement channels.

The Act is deliberately interactive with the Commonwealth Telecommunications (Interception and Access) Act 1979 (the Commonwealth Act). It imports definitions and relies on the Commonwealth Act as the source of warrant powers and certain concepts. Section 3(2) states that expressions not defined in the WA Act have the same meanings as in the Commonwealth Act, embedding the Commonwealth Act's terminology into the WA framework.

Cross‑references to the Commonwealth Act appear repeatedly:

• Record-keeping obligations reference specific Commonwealth Act sections: copies of descriptions under s 59A(2) of the Commonwealth Act, certificates issued under s 61(4), authorisations under s 66(2) (s 4).
• Section 5 addresses records relating to Part 2‑5 warrants, expressly referring to telephone applications for Part 2‑5 warrants and what particulars to keep, linking WA record-keeping duty directly to the Commonwealth Act's Part 2‑5 regime.
• Section 6(1)(c) requires the WA authority's annual report to include information Division 2 of Part 2‑8 of the Commonwealth Act requires in the Commonwealth Minister’s report for the same year, to the extent it can be derived from the authority’s records.

Priority and compulsion relative to other laws:

• Section 15 is a direct interactional provision: despite any other law, persons are not excused from giving information, answering questions or giving access when required by or under Part 3. That provision removes common legal defences (such as statutory secrecy obligations) for the narrow purpose of inspection compliance. However, s 15 also creates a corresponding protection: compelled information and derivative information are not admissible in evidence against the person except in prosecutions under s 23. Thus the Act overrides some interlocking secrecy regimes for inspection purposes while preserving limited evidentiary protection.

Interaction with the Parliamentary Commissioner Act 1971:

• Section 19 sets out special rules when an inspecting officer is the Parliamentary Commissioner (or an officer of the Commissioner). It excludes inspection actions from being included in certain Parliamentary Commissioner Act reports (ss 25 and 27 of the Parliamentary Commissioner Act) and applies sections 23 and 30(4) of that Act to inspection-obtained information with substitutions and omissions. It also expressly prevents s 29 of the Parliamentary Commissioner Act from applying to inspection functions under this Act. These provisions adjust accountability and information-handling obligations where the Parliamentary Commissioner acts as an inspecting officer.

Interaction with other State acts:

• The Act contains at least one reference to the Criminal Appeals Act 2004 in s 4A: the exercise of a power under the Commonwealth Act by a law enforcement officer (as defined in Criminal Appeals Act 2004 s 46C) is subject to that section. That means some investigative powers used by police officers will be constrained by the Criminal Appeals Act as it applies to law enforcement officers; practitioners must consult that Act for operational constraints.

Interaction with Commonwealth oversight:

• Section 20 contemplates exchange of information between the principal inspector and the Commonwealth Ombudsman. The principal inspector may give information that relates to a Commonwealth agency to the Ombudsman only if it is necessary to enable the Ombudsman’s functions in relation to that Commonwealth agency. The principal inspector may also receive information from the Ombudsman relevant to its functions. This provides a channel for cross‑jurisdictional oversight where Commonwealth agencies are implicated.

Interplay of evidentiary rules:

• Section 15 removes some grounds for refusal to comply with inspection compulsion but creates a non-admissibility rule for compelled information and information derived from it, except for prosecutions under s 23. This creates a hybrid evidentiary position: compelled answers are protected from general use in evidence but not where prosecution for obstructive or false-evidence offences is pursued.

Regulatory overlay:

• The Governor’s regulation‑making power (s 24) allows the creation of subsidiary instruments to fill gaps on matters the Act requires or permits to be prescribed. The Act also relies on regulations to prescribe who qualifies as inspecting officers and the principal inspector (s 3(1)), meaning further operational detail may reside in regulations.

Ministerial reporting obligations tie the WA framework to Commonwealth reporting under the Commonwealth Act (s 6(1)(c) and s 7). Responsible Ministers must give the Commonwealth Minister copies of specified reports; this creates a vertical reporting interface between state and Commonwealth executive oversight.

In sum, the WA Act exists as an administrative and oversight complement to the Commonwealth Act. It expressly defers substantive interception powers to the Commonwealth Act while prescribing state duties, inspection powers, confidentiality obligations, and intergovernmental reporting. Where it overlaps other State and Commonwealth statutes, it both overrides (for inspection compulsion) and is shaped by those statutes (see s 4A and s 19). Practitioners need to consult the Commonwealth Act, the Parliamentary Commissioner Act 1971, and the Criminal Appeals Act 2004 to understand the complete legal framework governing interceptions, inspections and related procedural protections.

The Act as compiled includes multiple amendments dating from the original 1996 enactment through to 2024. The statutory text carries amendment annotations (for example in s 3) and the compilation table lists amending Acts and commencement dates. Key amendments and enactment milestones contained in the source are:

• Enactment: Telecommunications (Interception) Western Australia Act 1996, Act No. 44 of 1996. Sections 1 and 2 (short title and commencement) commenced on 16 October 1996; the remainder of the Act commenced on 25 December 1996 (compilation table).

• Telecommunications (Interception) Western Australia Amendment Act 2000 (No. 1 of 2000): Amended various provisions; commencement for non‑title provisions 10 May 2000 (compilation table). Sections throughout the Act reflect amendments labelled "No. 1 of 2000" in the source.

• Royal Commission (Police) Act 2002 (No. 10 of 2002): Certain provisions (s 3(3) and Pt 9) had commencement dates noted, and a relevant note indicates effect on 16 April 2004 for s 3(3) as per Gazette (other notes).

• Corruption and Crime Commission Amendment and Repeal Act 2003 (No. 78 of 2003): Amended definitions and references relating to the Corruption and Crime Commission. Section 74 of that amending Act came into operation on 1 January 2004 for s 74(1) and on 7 July 2004 for s 74(2) (compilation table).

• Australian Crime Commission (Western Australia) Act 2004 (No. 74 of 2004): Amendment recorded with commencement on 1 February 2005 (compilation table).

• Telecommunications (Interception) Western Australia Amendment Act 2011 (No. 2 of 2011): Amendments to update the Act’s text; Part 2 of that amending Act commenced on 2 July 2011 (compilation table).

• Criminal Appeals Amendment (Double Jeopardy) Act 2012 (No. 9 of 2012): Section 12 of that Act inserted s 4A into the WA Act. Section 4A (Authority required for some investigations) was inserted by No. 9 of 2012 s 12 and notes that the exercise of a power under the Commonwealth Act by a law enforcement officer, as defined in the Criminal Appeals Act 2004 s 46C, is subject to that section (see s 4A in the text). Commencement occurred on 26 September 2012 (compilation table).

• Corruption and Crime Commission Amendment (Misconduct) Act 2014 (No. 35 of 2014): Amended definitions and other provisions relating to the Corruption and Crime Commission; s 39 commenced 1 July 2015 (compilation table).

• Corruption, Crime and Misconduct Amendment Act 2024 (No. 5 of 2024): Part 3 Div. 4 noted and commenced 15 March 2024 (compilation table).

The section notes (after s 3) also record a sequence of amendments to s 3 by various Acts, including the 2000, 2003, 2004, 2011, 2014 and 2024 amending Acts (s 3 amended: No. 1 of 2000 s 5; No. 78 of 2003 s 74; No. 74 of 2004 s 74; No. 2 of 2011 s 6; No. 35 of 2014 s 39; No. 5 of 2024 s 34). Section 4A is explicitly described as inserted by No. 9 of 2012 s 12.

Reprints and compilations referenced:

• Reprint 1: The original Act as at 22 August 2003 (compilation table).
• Reprint 2: The Act as at 6 January 2012, which incorporates amendments up to that date (compilation table).

The compilation table and "Other notes" within the source provide commencement dates for each amending Act and identify specific sections altered. Practitioners must consult the current consolidated text (as provided) alongside the compilation table to track the legal provenance of each provision. The source lists the specific Acts and commencement dates numerically, enabling a line-by-line tracing of amendments and the dates on which they took effect. The amendments have been procedural and definitional in nature, reflecting changes to entities and to the intersection of interception procedure with other State legislation (for example by inserting s 4A in 2012 linking to the Criminal Appeals Act 2004).

The legislative text and compilation material provided do not cite or record any litigation or judicial decisions interpreting this Act. The document includes no case names, reported judgments, or references to judicial consideration. The only judicially-adjacent content concerns cross-references to other statutory instruments (not cases), and the Parliamentary Commissioner Act 1971 modifications where the Parliamentary Commissioner acts as an inspecting officer (s 19).

Practical implications of the absence of litigation references in the text:

• The Act’s provisions on inspections, compelled information, and confidentiality are presented as statutory rights and duties without any recorded judicial gloss in this source. Where contentious issues arise in practice (for example, the scope of s 15's override of other laws, or the limits of admissibility immunities), practitioners must expect those issues to be subject to future judicial interpretation rather than depending on settled state precedents recorded in the text.
• The Act modifies application of the Parliamentary Commissioner Act 1971 in specific ways (s 19). Any litigation involving the Parliamentary Commissioner and inspection powers under this Act would require careful reconciliation of the substituted and omitted provisions specified in s 19.
• Because the text contains important cross-jurisdictional interactions with the Commonwealth Act, the Parliamentary Commissioner Act 1971, and the Criminal Appeals Act 2004 (s 4A), litigation involving those interfaces would be informed by case law under each of those regimes. The absence of cited litigation here means the Act's practical contours may depend significantly on interlocking case law in those other statutes.

What to do in the absence of local case law in the source:

• Where legal risk exists, structured legal analysis should rely on the statutory text and on interpretative methods recognising the Commonwealth Act as the substantive foundation for interception powers. For contested factual or legal questions, anticipate reliance on judicial interpretation of evidence admissibility rules, statutory overrides of privilege and statutory obligations to cooperate with inspectors.
• Practitioners should also review subsequent judicial decisions and administrative determinations outside this source. The Act’s reporting and inspection mechanisms create opportunities for administrative decisions and possibly for judicial review on procedural grounds (for example, whether a principal inspector properly notified a chief officer prior to entry under s 13(1)(a)), but the source does not provide decisions or precedent addressing those points.

In sum, the provided text does not offer litigation history. Any assessment of enforcement risk, evidentiary admissibility, or constitutional challenge must therefore start from the statutory provisions themselves and treat potential judicial interpretations as a contingent variable external to the Act as printed here.

Several operational and legal traps are embedded in the Act’s mechanics and timeline requirements. The items below are grounded in the text and indicate specific points where non-compliance risk or ambiguity commonly arises.

1. Strict and detailed record-keeping requirements (ss 4-5)

• The chief officer must cause detailed particulars to be recorded "as soon as practicable" after the events to which the particulars relate (s 5(1)). The Act specifies particulars including the person who carried out each interception, the day and time each interception began and its duration, and for named person warrants the services intercepted (s 5(1)(ba), (1a)). Failure to capture these particulars promptly may lead to findings of non-compliance on inspection, and s 12 allows the principal inspector to report contraventions of the Commonwealth Act or the s 6(1)(a)-(b) requirements. Operationally, agencies must have systems that log exact start/stop times and identify operators for each interception; ad hoc or paper-based systems are high risk.

2. Time-critical reporting to responsible Minister and Commonwealth Minister (s 6; ss 7 and 21)

• The chief officer must provide a report within three months after a warrant ceases to be in force addressing the use and communication of intercepted information (s 6(1)(b)). Separate annual reporting is required within three months after each 30 June, and must include total expenditure on execution of warrants during the year (s 6(1)(c), (2)). After receipt, the responsible Minister must forward copies to the Commonwealth Minister as soon as practicable (s 7, s 21). Missed deadlines can create administrative non-compliance and political exposure; agencies must synchronise operational record systems with reporting calendars.

3. Destruction of restricted records is mandatory and immediate when satisfied no permitted purpose (s 8(2))

• The chief officer must cause destruction "forthwith" if satisfied the restricted record is not likely to be required for a permitted purpose other than inspection or a report on an inspection (s 8(2)). That leaves a high-stakes discretion for the chief officer: premature destruction risks losing potential evidence or material required for proceedings; delayed destruction risks unlawful retention or disclosure. The Act offers no detailed procedural checklist for satisfying the destruction test, so agencies should document the reasoning and approvals for destruction decisions to withstand inspection.

4. Compulsion despite other laws, coupled with limited admissibility protection (s 15)

• Section 15 prevents a person from refusing to provide information, answer questions, or provide access on grounds that doing so would contravene another law or tend to incriminate. However, the protection is limited: the compelled information and any information derived from it are not admissible in evidence against the person except in prosecutions under s 23 (s 15(1)). The "except" carve-out is significant: compelled answers can be used to prosecute obstruction or false-statement offences under s 23. Practitioners should be alert that s 15 removes some privilege defences for inspection purposes, and advise staff accordingly.

5. Criminal sanctions for disclosure and obstruction, with two-year maximum (ss 22-23)

• Unauthorised disclosure by persons administering the Act (other than inspecting officers) carries imprisonment for two years (s 22(1)). Wilful obstruction or knowingly making false or misleading statements relevant to inspections also attracts imprisonment for two years (s 23(2)). The existence of these criminal penalties raises workplace risk; training and clear protocols are necessary to manage behaviour during inspections and information handling.

6. Entry and copying "despite any other law" (s 13(1)(c))

• The principal inspector may make copies of and take extracts from records "despite any other law" (s 13(1)(c)). That is a strong claim to information access that can conflict with statutory secrecy regimes or document retention policies. Agencies must ensure records management systems account for the possibility of compelled copying and the need to protect sensitive non-disclosable material in ways consistent with the Act.

7. Delegation limits (s 18)

• The principal inspector may delegate functions to another inspecting officer, but may not delegate the power to delegate or the power to report to the responsible Minister (s 18). That means reporting functions remain personally the principal inspector’s responsibility and cannot be outsourced; agencies should be aware of who is the designated principal inspector in regulations.

8. Narrow channels for sharing with Commonwealth Ombudsman (s 20)

• The principal inspector may provide information to the Commonwealth Ombudsman only if the information relates to a Commonwealth agency and is necessary for the Ombudsman’s functions (s 20(1)-(2)). Information exchanged must therefore be carefully assessed before disclosure.

9. Interaction with other statutes, e.g. Criminal Appeals Act (s 4A)

• Section 4A makes the exercise of a power under the Commonwealth Act by a "law enforcement officer" subject to Criminal Appeals Act 2004 s 46C. Practitioners need to check the Criminal Appeals Act to understand the constraints on law enforcement officers' use of interception powers; the WA Act does not reproduce those constraints.

10. No penalty stated for s 23(1) in the text

• Section 23(1) criminalises refusal or failure without reasonable excuse to comply with s 14 requirements but the text reproduced here does not specify a penalty for s 23(1). Section 23(2) sets out explicit penalties for obstructing and making false statements. This separation may be a drafting feature to be aware of,practitioners should verify whether an omission was intended or whether a penalty exists elsewhere. It is a "gotcha" because some readers will assume uniform penalties across s 23; the text must be read carefully.

11. Reliance on regulations to fill operational detail (s 3(1), s 24)

• Inspecting officers and the principal inspector are "prescribed by regulations" (s 3(1)), and the Governor may make other regulations to carry out the Act (s 24). Operational detail, including precise designation of inspecting officers and processes, may not appear in the Act itself but in subordinate instruments. Practitioners must obtain and check current regulations.

Documentary discipline, tight timelines, compulsion with limited evidentiary protections, and mandatory destruction discretion are the main areas requiring operational caution. Agencies should document decision-making, create auditable logs, and prepare legal advice at the time of inspections or destruction decisions to manage risk.

To satisfy the statutory duties set out in the Act, eligible authorities should establish policies, systems and procedures aligned with the specific provisions. The following steps are grounded in the Act’s text and indicate practical measures and internal controls that an eligible authority should implement.

1. Roles, governance and responsibilities

• Identify and document who within the authority is the "chief officer" and who qualifies as "officer" and "certifying officer" under the definitions in s 3(1). Ensure job descriptions and delegations reflect responsibilities to maintain records, provide reports, and authorise or certify documents as required by the Commonwealth Act (s 4, s 5).
• Ensure the responsible Minister and the channels to forward reports to the Commonwealth Minister are known and that timetables for transmission to ministers are embedded in administrative calendars (s 6(1)(a)-(c); s 7; s 21).

2. Record-keeping systems and auditing

• Implement an auditable, time-stamped electronic records system capable of recording the particulars mandated by s 5(1): telephone applications for Part 2‑5 warrants, whether applications were withdrawn, refused or resulted in a warrant, and for each warrant particulars including start times, durations, and the person who carried out each interception (s 5(1)(ba)). For named person warrants, ensure the system indicates the service in respect of which each interception occurred (s 5(1a)).
• Ensure each Part 2‑5 warrant and any revocation instrument, certificates issued under s 61(4) of the Commonwealth Act, and authorisations under s 66(2) of the Commonwealth Act are stored in the records (s 4).

3. Secure storage and destruction policies

• Create strict access controls for restricted records in accordance with s 8(1), with logging of who accessed records and why, to support compliance with the "secure place" requirement.
• Establish a documented destruction protocol for restricted records that identifies the criteria the chief officer will use to determine that a restricted record is "not likely to be required for a permitted purpose", and ensure each destruction decision is recorded with authorisation and rationale (s 8(2)). This provides evidence of compliance in inspections.

4. Reporting workflows and timelines

• Set up a calendar for the three‑month reporting deadlines: post-warrant report within 3 months after a warrant ceases to be in force (s 6(1)(b)), and annual report within 3 months after 30 June (s 6(1)(c)). Annual reports must include the information Division 2 of Part 2‑8 of the Commonwealth Act requires for the Commonwealth Minister’s report where the information can be derived from the authority’s records, and must include total expenditure connected with execution of warrants (s 6(1)(c), (2)).
• Ensure the chief officer’s reports are forwarded to the responsible Minister and that the responsible Minister forwards them to the Commonwealth Minister "as soon as practicable" (s 7, s 21). Establish read receipt and tracking processes to evidence timely transmission.

5. Inspection preparedness

• Prepare an inspection manual and train staff about the principal inspector’s powers under ss 13-14, including the ability to enter premises after notification, to access and copy records "despite any other law", and to compel written information and attendance (s 13(1)(a)-(c); s 14). Ensure staff understand obligations to provide assistance under s 13(2).
• Designate internal points of contact to receive written requirements under s 14 and to manage responses, ensuring that information provided in writing is signed where required and produced at the specified place and time (s 14(2)).

6. Legal advice protocols for compelled information

• Because s 15 removes the defence of self-incrimination for the purpose of inspection, but preserves a limited non‑admissibility protection (with exception for s 23 prosecutions), implement a protocol for staff to obtain immediate legal advice when presented with a s 14 requirement to attend or supply information. Document legal advice and any claimed reasonable excuse, recognizing that unreasonable refusals may attract criminal liability under s 23(1) and s 23(2).

7. Confidentiality and internal disclosure limits

• Reinforce through policy and training that officers engaged in the administration of the Act (other than inspecting officers) must not disclose any information or record obtained in administrating the Act except as permitted by the Commonwealth Act or for discharging functions under this Act (s 22). Highlight the two‑year imprisonment penalty (s 22(1)) and provide secure channels for authorised information sharing.

8. Data protection, chain of custody and audit trails

• Build chain-of-custody procedures for restricted records and interception-related materials so the authority can demonstrate handling compliance during and after inspections. Include encryption, restricted access, and documented logs to show who accessed what and why.

9. Communication with ministers and Commonwealth bodies

• Maintain templates and processes for reports required under s 6, including the expenditure statement (s 6(2)), and mechanisms to forward these to the responsible Minister for onward transmission. Maintain a record of when reports were given to the responsible Minister to evidence compliance with s 7 and s 21 obligations.

10. Review and subordinate instruments

• Check the current regulations to identify who is prescribed as inspecting officers and who is the principal inspector (s 3(1)), and any other operational requirements enacted under s 24. Keep the set of regulations and any ministerial directions under review for changes that affect inspection or reporting duties.

11. Records retention schedules

• Align records retention and destruction schedules with the Act’s specific duties: keep all required particulars and warrant-related documents until satisfied that restricted records are no longer required for permitted purposes or inspection/reporting, and appropriately document destruction decisions (s 8). Avoid destruction where litigation or criminal proceedings may require retention.

12. Training and auditing

• Provide mandatory training for all officers involved in interception or administration of interception records, covering statutory duties (ss 4-6), inspection obligations and privileges (ss 13-16), confidentiality and disclosure limits (ss 22-23), and the interplay with state and Commonwealth statutes (s 3(2), s 4A, s 19).
• Schedule periodic internal audits to ensure the authority can demonstrate compliance with the twice-yearly inspection cadence required of the principal inspector (s 10(2)) and with the record-keeping and reporting duties (ss 4-6).

13. Prepare for interaction with the Commonwealth Ombudsman

• If interception activity touches Commonwealth agencies, ensure documentation supports any necessary disclosures to the Commonwealth Ombudsman under s 20 and that any transfer of information is limited to what is necessary for the Ombudsman’s functions.

Implementing these practical steps aligned with the statutory text will reduce the risk of non-compliance, criminal exposure, and administrative criticism on inspection. Documentation of decisions, especially on restricted-record destruction and responses to s 14 notices, will be crucial evidence of procedural compliance.
