The Act revolves around a small set of recurring legal and administrative concepts. The statute defines them precisely and then allocates duties, rights and penalties around them.

Eligible authority (s 3)

• The Act identifies the bodies subject to its record-keeping and inspection regime: the Australian Federal Police, the Australian Crime Commission, the NSW Police Force, the NSW Crime Commission, ICAC, the LECC, the Inspector of ICAC and any authority of another State or Territory for which a declaration under s 34 of the Commonwealth Act is in force (s 3(1), agency; eligible authority). The term "officer" and "chief officer" are defined in relation to each eligible authority (s 3).

Part 2-5 warrant and warrant (s 3)

• The text refers to "Part 2-5 warrant" or "warrant" meaning a warrant issued under the Commonwealth Act. The Act does not re-authorise interception; it requires eligible authorities to retain warrants, notifications, revocations, certificates and chief officer authorisations connected with warrants (s 4).

Restricted record and record (s 3)

• "Restricted record" is defined as a record obtained by an interception (whether or not in contravention of s 7(1) of the Commonwealth Act) of a communication passing over a telecommunications system. The broader "record" definition covers copies or extracts in relation to information, interceptions, and warrants (s 3).

Permitted purpose (s 3)

• The Act sets out what constitutes a "permitted purpose" for an eligible authority when dealing with material: general permitted purposes include investigations of prescribed offences under the Commonwealth Act, decisions about commencing relevant proceedings, relevant proceedings themselves, exercise of powers by chief officers under s 68 of the Commonwealth Act, inspections and reports under this Act, and keeping records under ss 4 and 5 (s 3(1), permitted purpose(a)(i)-(vii)). The definition then lists additional, authority‑specific permitted purposes for the Police Force, ICAC, the Inspector of ICAC and the LECC (s 3(1)(b)-(e)). Those tailored subparagraphs broaden permitted purposes to include internal disciplinary, appointment and Executive Council deliberations for the Police Force and investigative/reporting duties for oversight bodies.

Records obligations (ss 4-5)

• Chief officers must ensure the retention of warrants and related documentation in authority records (s 4). They must also ensure detailed logs of telephone applications for Part 2-5 warrants, results of applications (withdrawn/refused/issued), particulars for each intercept under a Part 2-5 warrant (including start time, duration, name of person conducting interception and, for named-person warrants, the services intercepted) (s 5(1)(a), (b1), (1A)). There are detailed tracking obligations for restricted records that come into and leave the authority's possession, including provenance and transfers to/from agencies and other persons (s 5(1)(c)). Uses of lawfully obtained information, communications to non-officers, and evidence uses in relevant proceedings must be logged (s 5(1)(d)-(f)).

Secure storage and destruction (s 8)

• Restricted records in possession must be kept in a secure place, inaccessible to unauthorised persons (s 8(1)). The chief officer must destroy restricted records forthwith where satisfied they are no longer likely to be required for a permitted purpose, except for inspection or inspection reporting (s 8(2)).

Inspecting officer functions and inspections (Part 3)

• Inspecting officers have the function of inspecting eligible authority records to ascertain compliance with Part 2, reporting results to the Minister, and anything incidental or conducive to those functions (s 9). Inspections are required at least twice per financial year (s 10(1)). Reports must be made to the Minister within three months after the end of each financial year and include summaries, deficiencies and remedial action (s 11). Inspecting officers may report breaches identified during inspections (s 12).

Inspection powers and compulsion (ss 13-16)

• Inspecting officers may enter an authority's premises (after notifying the chief officer), have full and free access to records, make copies despite any other law, and require officers to provide information or attend to answer questions, with requirements to the officer or to the chief officer where the inspector does not know the officer’s identity (s 13-14). Subpoena‑style compulsion is limited to written requests requiring provision of information or attendance at specified times and places, reasonable in the circumstances (s 14(2)-(5)). Despite other laws, persons are not excused from giving information or access; however, a statutory evidentiary protection limits admissibility of compelled information against the person, except for s 22 prosecutions (s 15).

Secrecy, confidentiality and disclosure limits (ss 15, 16, 19-21)

• The Act constrains how information obtained under the inspection regime may be used and disclosed. Inspecting officers may communicate, use and record information for inspection purposes despite other laws (s 16). Inspecting officers are required not to include anything they have done or omitted under this Part in LECC Division 2 Part 11 reports (s 19(1)). They face criminal penalties for unauthorised recording or disclosure of information acquired in the exercise of their functions, and are not compellable to give evidence or produce documents acquired in that capacity (s 19(2)-(3)). Persons administering the Act (other than inspecting officers) may not disclose information obtained while administering the Act except in certain enumerated circumstances, and face a penalty of 10 penalty units for unauthorised disclosure (s 21).

Information sharing with Commonwealth Ombudsman (s 19A)

• An inspecting officer may enter an information sharing arrangement with the Commonwealth Ombudsman to request, receive and disclose information reasonably necessary to assist exercising functions under this Act and the Commonwealth Act. The section permits such exchange despite other State laws but limits the subject-matter of information to matters concerning eligible authorities and information relevant to respective functions (s 19A(1)-(4)).

Offences and enforcement (ss 22-23)

• The Act criminalises refusal or failure to attend, furnish information or answer questions without reasonable excuse when required under s 14, obstruction, hindrance or resistance in relation to inspections, and provision of false or misleading information in connection with an inspection (s 22). Proceedings must be dealt with summarily in the Local Court (s 23).

Regulations and savings (ss 24-25; Sch 1)

• The Governor may make regulations for matters necessary for carrying out the Act; regulations can create offences up to 5 penalty units (s 24). Schedule 1 provides savings and transitional provisions related to amendment history (s 25; Sch 1).

These concepts are organised to support a compliance and oversight architecture that operates alongside and depends on the Commonwealth interception regime. Practically, the Act defines who must keep what records, who may inspect them, what information may be shared, and criminal consequences for non‑cooperation or unauthorised disclosure.

The Act directly and indirectly affects a bounded set of actors. The statutory text identifies them and allocates duties, powers and penalties accordingly.

Eligible authorities and their leadership (chief officers and certifying officers) (s 3; ss 4-6)

• The primary obligations fall on eligible authorities. The term "eligible authority" is defined to include the NSW Police Force, the NSW Crime Commission, ICAC, the LECC, and the Inspector of ICAC, plus certain other bodies where a Commonwealth declaration applies (s 3). The "chief officer" of each eligible authority (for the Police Force, the Commissioner of Police, and corresponding heads for other authorities) must cause the authority to keep documents and records specified by the Act (s 4-5) and give reports to the State Minister (s 6). The Act also defines "certifying officer" positions in relation to each eligible authority and connects those to authorisations under the Commonwealth Act (s 3).

Officers of eligible authorities and staff (s 3; ss 5, 13-16, 21)

• Individual officers within eligible authorities must carry out or facilitate operational steps, making intercepts, logging particulars, granting access to inspecting officers, and answering questions when required (s 5; s 13(1)(d); s 14(2)-(3)). The chief officer must ensure officers provide assistance reasonably required by an inspecting officer (s 13(2)). Persons engaged in the administration of the Act (other than inspecting officers) must keep information confidential except in specified circumstances (s 21).

Inspecting officers (Inspector and Assistant Inspectors of the LECC) (ss 9-19A)

• Inspecting officers have statutory powers to inspect records, require attendance and information, enter premises, make copies despite other laws, and report to the Minister (ss 9, 10, 11, 13-16). They hold secrecy obligations and limited privileges from compellability, and have immunity from suit for acts in good faith in the exercise of functions (s 17; s 19). Inspecting officers may share information with the Commonwealth Ombudsman under an information-sharing arrangement (s 19A).

Ministers (State and Commonwealth) (ss 6-7; s 20)

• The chief officer must provide reports to the State Minister (s 6). The State Minister must forward copies of inspection reports to the Commonwealth Minister (s 7; s 20). The Commonwealth Minister is therefore an addressee of the reporting chain for matters the Commonwealth Act also covers.

Commonwealth bodies and the Commonwealth Ombudsman (s 3; s 19A)

• The Act contemplates interaction with Commonwealth bodies: the Australian Federal Police and the Australian Crime Commission are listed as agencies (s 3), and an inspecting officer may enter into information sharing arrangements with the Commonwealth Ombudsman for the purposes described (s 19A). The Act also expressly borrows terms and definitions from the Commonwealth Act (s 3(2)), so Commonwealth definitions and frameworks shape the application of this Act.

Other oversight and inquiry bodies (s 21)

• The Act permits disclosure in a limited set of circumstances to support proceedings under the Ombudsman Act 1974, the Royal Commissions Act 1923, the Special Commissions of Inquiry Act 1983, the Crime Commission Act 2012, the ICAC Act 1988 and the LECC Act 2016 (s 21(b)(i)-(vi)). That means Ombudsman, royal commission or inquiry processes and specified State oversight bodies are within the class of authorised recipients in defined contexts.

Persons whose communications are intercepted (s 3)

• Indirectly, members of the public whose communications are intercepted are affected because the Act prescribes how restricted records (records obtained by interception) must be stored, logged and destroyed, and limits who may access or be communicated with about those records (s 8; s 5(1)(c)-(f)). The Act's confidentiality provisions constrain dissemination of such material.

Persons administering the Act (s 21)

• The phrase "a person, other than an inspecting officer, engaged in the administration of this Act" captures agency staff with administrative responsibilities who will be criminally liable for unauthorised disclosure unless the disclosure fits an enumerated exception (s 21).

Legal practitioners and courts (ss 15, 19)

• The Act affects evidentiary practice. Compelled information given under the inspection regime is generally inadmissible against the person compelled except in prosecutions for s 22 offences (s 15(1)). Inspecting officers are not compellable to give evidence or produce documents they acquired under this Act (s 19(3)), which affects document production and testimony in legal proceedings.

Regulators and policy officials (ss 24-25; Sch 1)

• The Governor and executive can make regulations for the Act (s 24). Schedule 1 contains savings and transitional provisions that afect the operation of amendments.

In short, the Act affects senior agency officials who must supervise compliance (chief officers, certifying officers), operational officers who must make records and respond to inspection compulsion, inspecting officers who exercise oversight, Ministers who receive reports, specified oversight and Commonwealth bodies that may receive or exchange information, and, indirectly, members of the public whose intercepted communications are subject to these administrative controls.

This Act assigns discrete duties to chief officers and other agency personnel, while granting rights and powers to inspecting officers and setting protections and limited immunities. The following lists are anchored to the statute.

Chief officer duties (ss 4-6, 8)

• Maintain warrants and related documents: The chief officer must cause each warrant issued to the authority, re-issued copies certified by certifying officers, notifications under s 59A(2) of the Commonwealth Act, revocation instruments, certificates issued under s 61(4) of the Commonwealth Act, and chief officer authorisations under s 66(2) of the Commonwealth Act to be kept in the authority’s records (s 4).
• Maintain interception and restricted-record logs: Chief officers must cause particulars of telephone applications for Part 2-5 warrants, statements about application outcomes (withdrawn, refused, warrant issued), particulars for each Part 2-5 warrant exercised by the authority (warrant particulars, interception start times, durations, names of persons carrying out interceptions, and, for named person warrants, services intercepted), particulars of restricted records that were at any time in possession of the authority (warrant provenance, occasions when the record came into and ceased to be in possession, and transfers to/from agencies or persons), particulars of each use of lawfully obtained information, particulars of communications of that information to persons or bodies other than officers, and particulars of occasions when such information was given in evidence (s 5(1)(a)-(f); s 5(1A); s 5(2)).
• Ensure secure custody and destruction: Restricted records must be kept in a secure place not accessible to unauthorised persons (s 8(1)); they must be destroyed forthwith when the chief officer is satisfied the record is not likely to be required for a permitted purpose, other than inspection or inspection reporting under this Act (s 8(2)).
• Reporting duties: The chief officer must give the State Minister a written report within three months after a warrant ceases to be in force about the use and communication of information obtained under that warrant (s 6(b)). They must also supply, within three months after each 30 June, a written report containing the information required under Division 2 of Part 2-8 of the Commonwealth Act insofar as it can be derived from the authority’s records (s 6(c)).

Officer duties (ss 5, 13-15)

• Operational logging: Officers involved in interception or handling of restricted records will be the sources of the particulars that must be recorded (s 5).
• Assistance to inspecting officer: The chief officer must ensure officers provide assistance reasonably required by an inspecting officer in connection with inspection functions (s 13(2)).
• Compliance with requirements to provide information or attend: An inspecting officer may require an officer to give written information or to attend to answer questions relevant to an inspection (s 14(2)-(3)). The requirement must specify place, time and be reasonable (s 14(5)).

Inspecting officer powers and duties (ss 9-16, 19A)

• Inspecting officers must inspect records at least twice per financial year to ascertain compliance with Part 2 (s 10(1)); they may also inspect at any time to ascertain compliance for any period (s 10(2)).
• They may enter premises occupied by the authority (after notifying the chief officer), have full and free access to all records at reasonable times, make copies despite any other law, and require officers to provide information or attend (s 13).
• Inspecting officers must report to the Minister within three months after the end of each financial year about the inspections and must include summaries, particulars of deficiencies impacting the integrity of the Commonwealth interception regime, and remedial actions (s 11(1)-(2)). They may report at any time and must give copies to the chief officer (s 11(3)-(4)).
• Inspecting officers may enter information sharing arrangements with the Commonwealth Ombudsman to request, receive and disclose information reasonably necessary to assist respective functions (s 19A(1)-(3)).

Rights, immunities and evidentiary protections (ss 15, 17, 19)

• Persons are not excused from giving information, answering questions or giving access under Part 3 on grounds of contravening another law, being contrary to public interest, or self‑incrimination; but the information given, answers and access, and any direct or indirect consequence are not admissible in evidence against the person except in prosecution for an offence under s 22 (s 15(1)). This establishes a limited form of testimonial immunity with a narrow exception.
• Inspecting officers are not liable to suit for acts or omissions done in good faith in the exercise or purported exercise of their functions (s 17).
• Inspecting officers must not record or disclose information acquired by reason of their functions except for purposes of this Act; unauthorised disclosure attracts a maximum penalty of 50 penalty units or 12 months imprisonment or both (s 19(2)). Inspecting officers are not compellable in any legal proceedings to give evidence or produce documents acquired under this Act (s 19(3)).

Disclosure exceptions (s 21)

• Persons administering the Act (other than inspecting officers) must not disclose information or records obtained in the administration of the Act, except in accordance with the Commonwealth Act, for the listed statutory proceedings (Ombudsman investigations, royal commissions, special commissions, Crime Commission Act Part 4 proceedings, Part 9 ICAC Act proceedings, LECC Act proceedings), or for discharging the person’s functions under this or any other Act (s 21(a)-(c)). Unauthorised disclosure is a 10 penalty unit offence.

Offences and enforcement (ss 22-23)

• Failure to comply with a lawful requirement to attend, furnish information or answer without reasonable excuse is an offence, as is obstruction, hindrance, resistance or giving false/misleading statements in connection with an inspection; penalty 10 penalty units or 6 months imprisonment (s 22). Proceedings for offences under the Act are to be dealt with summarily in the Local Court (s 23).

Regulation-making power (s 24)

• The Governor may make regulations for matters required or convenient to carry out the Act; regulations may create offences with penalties up to 5 penalty units (s 24).

These duties and rights allocate responsibility for record-keeping and internal compliance to agency leadership, create compulsory inspection powers for the inspecting officer, offer limited protections for persons compelled to provide information, and establish criminal penalties and summary enforcement mechanisms to secure compliance.

The Act sets out criminal penalties, enforcement routes, immunities and evidentiary rules to support the inspection and record-keeping regime. The statutory design mixes summary criminal sanctions with administrative oversight and reporting obligations.

Criminal offences and penalties (ss 19(2), 21, 22)

• Inspecting officer secrecy breach: An inspecting officer who records or discloses information acquired in the course of exercising functions under the Act, except for the purposes of and in accordance with the Act, commits an offence carrying a maximum penalty of 50 penalty units or imprisonment for 12 months, or both (s 19(2)). The section thereby places a substantial criminal sanction on unauthorised disclosure by inspectors.
• Disclosure by persons administering the Act: A person engaged in administering the Act (other than an inspecting officer) who discloses information or records obtained in administration of the Act contrary to s 21 faces a penalty of 10 penalty units (s 21).
• Obstruction, refusal and false statements in inspections: A person who, without reasonable excuse, refuses or fails to attend, furnish information, or answer a question when required under s 14 commits an offence (s 22(1)). A person who without reasonable excuse wilfully obstructs, hinders or resists a person in connection with the exercise of an inspecting officer’s functions, or who provides false or misleading information in connection with an inspection, also commits an offence (s 22(2)). The penalty is 10 penalty units or imprisonment for 6 months (s 22).

Procedural enforcement (s 23)

• Proceedings for offences under the Act or the regulations are to be dealt with summarily before the Local Court (s 23). That means enforcement will typically be through summary prosecution in the Local Court jurisdiction rather than indictable proceedings.

Admissibility limits and prosecution exception (s 15)

• Section 15 creates a control on admissibility of compelled information: a person is not excused from giving information, answering a question, or giving access on grounds such as self-incrimination, but the information, the answer, or the fact of access, and any information obtained as a consequence, is not admissible in evidence against the person except in a prosecution for an offence against s 22. Practically, compelled information cannot be used to prosecute a person for unrelated offences, but it can be used to prosecute the person for refusing to comply with inspection powers or obstructing inspections (s 22). This creates an enforcement backstop for inspection powers while protecting persons from broader use of compelled material.

Inspecting officer immunity (s 17)

• Inspecting officers, and persons acting under their direction, are not liable to an action, suit or proceeding for or in relation to acts or omissions done in good faith in exercising, or purporting to exercise, functions under Part 3. This shields inspectors from civil suits for actions taken while performing statutory inspection functions, subject to the “good faith” qualifier (s 17).

Non-compellability and evidence protections for inspectors (s 19(3))

• Inspecting officers are not compellable, in any legal proceedings, to give evidence or produce documents acquired by reason of, or in the course of, exercising functions under the Act. That protects the confidentiality of information gained via inspection from disclosure in other legal processes.

Regulatory offences (s 24(2))

• The regulations (if made) may prescribe offences punishable by penalties not exceeding 5 penalty units. The Governor’s regulation-making power therefore enables creation of lower‑level regulatory offences to support the Act’s operation.

Administrative enforcement mechanisms (ss 11, 12)

• Inspecting officers must report deficiencies identified during inspections, including particulars of remedial action taken or proposed (s 11(2)(b)-(c)). Where the inspecting officer is of the opinion that an officer has contravened a provision of the Commonwealth Act or the reporting requirements of s 6(b)/(c), the inspecting officer may include a report on the contravention (s 12). The reporting and public accountability pathways create a non‑criminal enforcement channel: reports to Ministers and to the Commonwealth Minister (s 7; s 20) facilitate oversight and potential administrative or disciplinary outcomes.

Practical enforcement flow

• Operationally, the statutory architecture means failures to keep required records or failures to assist inspection are first addressed by inspection findings and ministerial reporting (s 11). Where criminal threshold conduct occurs (refusal, obstruction, disclosure contrary to s 21 or s 19), the Act permits summary prosecution in the Local Court (ss 21-23). Inspecting officers are insulated against civil suit for acts in good faith (s 17), but are criminally liable for their own unauthorised disclosures (s 19(2)).

Risk allocation and incentives

• The penalty structure targets unauthorised dissemination by inspecting officers with a substantial sanction (50 penalty units or 12 months) and unsanctioned disclosures by administrative staff with a lower monetary penalty (10 penalty units). Coercive inspection powers are backed by s 15’s admissibility protective rule, balanced by the s 22 carve‑out so compelled evidence can be used to prosecute non‑compliance with inspection powers. The statutory design thereby encourages cooperation with inspections, limits wider evidentiary uses of compelled information, and places criminal risk on unauthorised disclosures by both inspecting officers and administrative staff.

This Act is explicitly designed to operate in close conjunction with the Commonwealth Telecommunications (Interception and Access) Act 1979 and interacts with a number of State and Commonwealth oversight statutes. Interdependencies appear throughout the text.

Dependence on the Commonwealth Act (s 3; ss 4-6)

• The Act embeds and relies on the Commonwealth Act in several ways. It defines “the Commonwealth Act” and states that expressions not defined in this Act have the same meanings as in the Commonwealth Act (s 3(2)). It refers to Part 2-5 warrants under the Commonwealth Act and requires retention of documents, notifications, certificates and chief officer authorisations connected to warrants issued under the Commonwealth Act (s 4). The annual reporting duty imposed on chief officers requires inclusion of information that Division 2 of Part 2-8 of the Commonwealth Act requires in the Commonwealth Minister’s report (s 6(c)(i), (ii)). The certifying officer definitions cross‑reference authorisations under the Commonwealth Act (s 3). In short, much of the NSW Act’s effect is to create administrative and oversight structures that operate around and in parallel to the Commonwealth statute.

Evidentiary linkages and limits (s 15; note in s 11)

• Section 15 expressly displaces other laws as a ground for refusing to give information or access during an inspection, but then places an evidentiary limitation on admissibility consistent with the Commonwealth Act’s general approach to interception material. The note in s 11 reminds that the inspecting officer remains bound by s 63 of the Commonwealth Act, which prohibits disclosure of intercepted information or designated warrant information. This demonstrates that the Act’s powers are intended to be exercised within constraints set by the Commonwealth Act.

State oversight bodies and reporting/exceptions (s 21)

• The Act permits disclosure by persons administering the Act in the context of proceedings under a defined set of NSW statutes: the Ombudsman Act 1974 (s 37), the Royal Commissions Act 1923, the Special Commissions of Inquiry Act 1983, the Crime Commission Act 2012 (ss 25, 27, 29), Part 9 of the ICAC Act 1988, and the LECC Act 2016 (s 21(b)(i)-(vi)). That links NSW investigatory and oversight mechanisms. Where those other statutory processes are engaged, conditional disclosure is authorised.

LECC Act constraints (s 19(1))

• Section 19(1) prohibits including anything that an inspecting officer has done or omitted to do under this Part in a report or special report under Division 2 of Part 11 of the LECC Act 2016. That is a specific cross-reference limiting disclosure of inspection conduct within LECC reporting frameworks.

Information sharing with Commonwealth Ombudsman (s 19A)

• The Act authorises information-sharing arrangements with the Commonwealth Ombudsman notwithstanding other State laws (s 19A(3)). The information that can be shared is circumscribed to matters concerning eligible authorities and information relevant to respective functions, and sharing is limited to what is reasonably necessary to assist in exercising those functions (s 19A(2)-(3)). This provision creates a statutory channel for interstate/Commonwealth oversight cooperation.

Regulations and transitional provisions (s 24; s 25; Sch 1)

• The Governor may make regulations to give effect to savings and transitional provisions resulting from amendments to the Act (Sch 1), including retrospective transitional application where permitted (Sch 1 Part 1). Schedule 1 contains transitional provisions consequential on the 2009 amending Act, with express treatment for s 3A and s 7 applications (Sch 1 Part 2).

Operational consequence: necessity to cross-reference

• Because the Act adopts Commonwealth definitions and requires reporting in formats tied to the Commonwealth Act, compliance requires agencies to cross-reference and apply the Commonwealth Act in parallel. For example, determining what constitutes a “prescribed offence,” a “relevant proceeding,” or the scope of a Part 2-5 warrant will require consulting the Commonwealth Act (s 3, permitted purpose; s 4). Similarly, obligations about notifications under s 59A(2), certificates under s 61(4), and chief officer authorisations under s 66(2) refer to named Commonwealth Act provisions (s 4). The Act therefore functions as a State-level administrative and oversight wrapper that presumes the Commonwealth statutory architecture remains the controlling substantive law on interception and access.

Limits on disclosure and other law: interplay with secrecy and compellability

• The Act places its own limits on disclosure (s 19, s 21) and on compellability of inspecting officers (s 19(3)), while also displacing other grounds for refusing to provide access or information in inspections (s 15). Those rules interact with State secrecy rules and privilege doctrines, but the Act itself declares the extent of admissibility and compellability for information obtained under its inspection regime. At the same time, the inspecting officer must adhere to the Commonwealth Act’s prohibitions on disclosing intercepted information (note to s 11 referencing s 63 of the Commonwealth Act).

Inter-agency and inter-jurisdictional cooperation

• The Act contemplates transfer of restricted records to agencies or other bodies and requires logging of such transfers (s 5(1)(c)(iv)). It permits information sharing with the Commonwealth Ombudsman (s 19A) and lists circumstances in which disclosures may be made to NSW oversight mechanisms (s 21). These provisions create statutory channels for controlled inter-agency cooperation while maintaining confidentiality obligations.

In practice, implementing the Act requires agencies to map records and processes to both the NSW Act’s prescriptive record-keeping rules and the Commonwealth Act’s substantive definitions and warrant framework. The Act is therefore not a stand-alone interception statute but an administratively focused instrument that operates in the shadow of Commonwealth interception law and within a network of State and Commonwealth oversight and inquiry regimes.

The text includes explicit amendment annotations for many sections that indicate legislative changes over time. The Act as presented carries several insertions, substitutions and repeals across different years, which the statutory notes identify. The following summarises what the Act’s own notes disclose about amendment milestones and their locus in the text.

General notes

• Several sections carry amendment or substitution notes referencing the Law Enforcement Conduct Commission Act 2016 (No 61) Sch 6.43, and the Telecommunications (Interception and Access) (New South Wales) Amendment Act 2009 (No 16) Sch 1. The amendment notes in the Act frequently mark the replacement or insertion of Part 3 and related inspection provisions in 2016 (see e.g. preface to Part 3: "pt 3: Subst 2016 No 61, Sch 6.43 [14]").

Notable section-level amendment annotations (as listed in the text)

• s 23: Amended 2007 No 94, Sch 4.
• s 24 and s 25: appear with no detailed amendment notes in the text extract beyond Sch references.
• Schedule 1: Inserted 2009 No 16, Sch 1 [17] and carries provisions about regulations and transitional matters.

Interpretation of amendment pattern based on notes

• The Act’s amendment history in the notes shows multiple iterative changes over decades, reflecting adjustments to definitions (s 3) and a material overhaul of the inspection regime associated with the Law Enforcement Conduct Commission Act 2016 (No 61), which substituted Part 3 and related sections (see repeated “Subst 2016 No 61, Sch 6.43 [14]” annotations).
• The Telecommunications (Interception and Access) (NSW) Amendment Act 2009 also made significant changes (noted via multiple Sch 1 citations), including the insertion of s 3A and s 19A and consequential transitional provisions in Schedule 1.

What the statutory notes do not provide

• The notes record only amendment instruments, sections and schedules; they do not provide legislative policy detail, parliamentary debates, or the exact content of the amendments beyond the labeling. To reconstruct the precise text replaced or inserted one must consult the amending Acts and their schedules cited (for example, 2009 No 16 Sch 1; 2016 No 61 Sch 6.43). The Act’s in-text notes point the reader to where to look for historical changes but do not themselves contain the deleted language.

In sum, the Act’s amendment annotations show sustained development over time, with a concentrated reworking around 2009 and another significant substitution of Part 3 in 2016 to align the inspection regime with the establishment and functions of the LECC.

The text of the Act provided contains no judicial decisions, case citations, or a litigation history. The statutory extract does not reference any cases, nor does it provide a schedule of judicial interpretations or reported decisions. The following observations are therefore based strictly on the Act’s content and the absence of case references in the supplied text.

• No cases named in the statute: The Act’s text, as supplied, does not name any judicial decisions or refer to appellate or trial rulings. Under the developer instruction to name only cases the source names, none can be cited.

• Potential areas where litigation commonly arises: While the Act itself contains no litigation history, the provisions create doctrinal touchpoints that are typically the subject of litigation in comparable statutory regimes. Those areas include:

  • Interpretation of "permitted purpose" and its application to specific handling or retention of restricted records (s 3).
  • What constitutes being "satisfied" that a restricted record is "not likely to be required for a permitted purpose" for the purposes of destruction (s 8(2)); that is a factual and legal judgment that could be litigated in the context of alleged premature destruction.
  • The limits of the inspecting officer’s powers to compel attendance and information, including the standard for "reason to believe" an officer can give relevant information and whether the requirement to attend or provide information was reasonable in time/place (s 14(1)-(5)).
  • The interface between s 15’s non‑admissibility protection and the s 22 exception (use of compelled information to prosecute inspection non‑compliance), which could raise contested questions about admissibility in prosecutions under s 22.
  • Secrecy and confidentiality obligations under s 19 and their exceptions, including disputes about whether a disclosure was "for the purposes of, and in accordance with, this Act" or whether unauthorised disclosure occurred.
  • Whether an inspecting officer's actions were in "good faith" for purposes of s 17 immunity from suit.

• Practical note on research: For authoritative guidance on how courts have interpreted comparable provisions or these exact provisions, one must consult case law databases, court reports and legal practice guidance. The supplied Act text does not supply any such decisions.

Because the supplied statutory text does not record litigation, practitioners or researchers interested in the judicial interpretation of any part of the Act should undertake targeted case law research, focusing on Local Court prosecutions under the Act’s summary offence provisions, and on any appellate rulings that interpret the intersection of State inspection powers and the Commonwealth interception framework.

Practitioners and compliance officers should note discrete traps and operational frictions embedded in the Act’s language and structure. The following are concrete procedural and legal "gotchas" grounded in the text that commonly create compliance risk.

1. Destruction timing and standard (s 8(2))

• The chief officer must destroy restricted records "forthwith" once satisfied they are not likely to be required for a permitted purpose, other than inspection or reporting. Forthwith suggests immediate action once the threshold is met, but the statutory standard,"satisfied that the restricted record is not likely to be required for a permitted purpose",is fact‑sensitive. Premature destruction could impede ongoing investigations or court proceedings; delayed destruction risks unlawful retention. There is no express requirement to log destruction in s 8, though s 5(1)(c) requires particulars of occasions when restricted records ceased to be in possession. Ensure administrative practice logs the factual basis for destruction decisions and records the date/time/authority.

2. Detailed logging requirements and operational strain (s 5)

• The Act demands granular particulars (start time, duration, name of person who carried out each interception, services intercepted for named-person warrants, transferral records for restricted records, uses of lawfully obtained information, communications to non-officers, evidence uses). Compliance needs operational workflows and IT systems capable of capturing and preserving this metadata in a secure, auditable form. Failure to capture particulars "as soon as practicable" risks non-compliance findings in inspection reports (s 5(1), (2)).

3. Compelled answers are protected but not absolutely (s 15 vs s 22)

• Section 15 provides that compelled information is not admissible against the person except in prosecutions for offences under s 22. That means an officer compelled to answer cannot be prosecuted for unrelated offences based on their compelled answer, but the compelled answer can be used against them in a prosecution for failing to comply with inspection requirements or related offences. Practically, an officer who refuses to answer to avoid incriminating themselves may nonetheless be prosecuted for the refusal. This creates a binary risk: answer and accept possibility of s 22 prosecution; refuse and risk s 22 prosecution for non-compliance. Operational guidance and legal advice should be clear on this tension.

4. Inspecting officer powers override other laws for making copies (s 13(1)(c))

• Inspecting officers are entitled, "despite any other law", to make copies of and take extracts from records of the authority. That displaces secrecy or statutory confidentiality in many cases, but s 19 subsequently imposes strict confidentiality on inspectors. Agencies should not assume other confidentiality laws will stop an inspection's copying; instead, procedural safeguards should be relied upon to limit dissemination after the inspection.

5. Inspecting officer secrecy obligation and severe penalty (s 19(2))

• Inspecting officers face a maximum penalty of 50 penalty units or 12 months imprisonment, or both, for unauthorised disclosure. The severe sanction requires inspecting officers and their staff to have strict internal handling procedures. Where the inspecting officer is from the LECC, the substitution notes indicate the LECC framework governs; nonetheless, practical controls, access logs, and need-to-know rules are necessary.

6. Inspection frequency and scheduling constraints (s 10(1); s 14(5))

• Inspecting officers must inspect at least twice per financial year. They can also inspect at any time. When the inspector issues a requirement to attend under s 14, the time/place must be reasonable (s 14(5)). Agencies must maintain ready access to personnel and records to respond promptly. Failure to be able to produce records or persons at short notice invites s 22 prosecutions for non-attendance or obstruction unless a reasonable excuse exists.

7. Record scope extends to interceptions irrespective of Commonwealth Act contravention (s 3, restricted record)

• Restricted records include records obtained by interception "whether or not in contravention of section 7(1) of the Commonwealth Act". That means the Act’s obligations apply even to material that might have been obtained unlawfully under the Commonwealth Act. Agencies must be meticulous in tracing provenance and decisions about whether to retain or destroy such material in light of permitted purposes (s 5(1)(c); s 8).

8. Interplay with Commonwealth secrecy provisions (note to s 11)

• Inspecting officers remain bound by s 63 of the Commonwealth Act, which prohibits disclosure of intercepted or designated warrant information. The Act does not displace Commonwealth prohibitions. Agencies must reconcile state inspection copying powers with Commonwealth non-disclosure regimes when handling designated warrant information.

9. Narrow avenue for disclosure by State administrative staff (s 21)

• Staff administering the Act are prohibited from disclosing information except in specified contexts. The enumerated exceptions are narrow and procedural (s 21(b)(i)-(vi)). Unauthorised disclosure, even to support internal reviews, may attract a penalty of 10 penalty units. Agencies should have explicit policies describing when disclosure is authorised, and ensure staff are trained to follow the list of statutory routes.

10. Delegation constraints on inspecting officers (s 18)

• Inspecting officers may delegate functions to staff other than NSW Police Force members, but may not delegate the power to delegate nor the power to report to the Minister. That limits flexibility in some small-office contexts and requires attention to proper delegations and record-keeping.

11. Reporting timeframes (s 6(b), s 11(1))

• Chief officers must give a report within three months after a warrant ceases to be in force, and inspecting officers must report within three months after the end of each financial year. Missing these deadlines may attract ministerial scrutiny and adverse findings. Administrative calendars need to track warrant life-cycles and financial year reporting windows.

12. Information-sharing arrangements limited to what is “reasonably necessary” (s 19A(3))

• The Act authorises sharing with the Commonwealth Ombudsman only to the extent the sharing is "reasonably necessary" to assist functions. That is a fact-specific standard and could be the subject of dispute if information is shared where necessity is not obvious. Procedures should document the reasoning for sharing.

These are practical, statute-based pitfalls. Many can be addressed by robust internal policies, secure record architectures, train‑the‑trainer programs, and a compliance calendar that maps warrants, reporting windows, inspection schedules and retention/destruction triggers to responsible officers.

Compliance with this Act requires systems, roles and procedures mapped to the Act’s specific duties. The following is a compliance checklist with concrete steps tied to the statutory provisions.

1. Identify and document applicable personnel and roles (s 3)

• Record who in the organisation is the "chief officer" per s 3 (for the Police Force, Commissioner of Police; for other authorities their defined chief). Maintain a current roster of certifying officers, officers authorised under Commonwealth Act cross-references, and staff engaged in administration of the Act. Ensure the certifying officer list is consistent with any Commonwealth Act authorisations (s 3, certifying officer).

2. Implement secure record-keeping systems for warrants and associated documents (s 4)

• Ensure a secure physical and/or electronic filing system to store each Part 2-5 warrant, any certified true copies, notifications under s 59A(2) of the Commonwealth Act, revocations, certificates under s 61(4) of the Commonwealth Act, and any chief officer authorisations under s 66(2) (s 4).
• Maintain chain-of-custody logs for each restricted record reflecting provenance and movements (s 5(1)(c)(ii)-(iv)).

3. Build detailed interception and restricted-record logs (s 5)

• Configure systems to capture and retain:
  • particulars of each telephone application for a Part 2-5 warrant (s 5(1)(a));
  • outcome statements for each application (withdrawn, refused, issued) (s 5(1)(b));
  • for each Part 2-5 warrant exercised by the authority: the warrant particulars, date/time each interception began, duration, the name of the person conducting the interception, and, for named-person warrants, the service intercepted (s 5(1)(b1), (1A));
  • particulars of each restricted record that has at any time been in possession, including warrant provenance, occasions of possession and cessation, and transfers to/from agencies or other persons (s 5(1)(c));
  • particulars of each use of lawfully obtained information, communications to persons or bodies other than officers, and occasions when lawfully obtained information was given in evidence (s 5(1)(d)-(f));
  • record these particulars "as soon as practicable" after events occur (s 5(1)) and retain the records in authority records (s 5(2)). Electronic time-stamped logging is recommended.

4. Secure storage and destruction protocols for restricted records (s 8)

• Establish secure storage with access controls for restricted records (s 8(1)): define who is entitled to access and ensure authentication, audit trails and physical security.
• Define destruction criteria based on permitted purposes: develop a documented decision process for when a chief officer is "satisfied" that a restricted record is "not likely to be required for a permitted purpose", with records of the decision, date of destruction and responsible officer (s 8(2)). Keep logs of destruction events (s 5(1)(c)(iii) suggests tracking occasions when a restricted record ceased to be in the authority's possession).

5. Reporting obligations to State and Commonwealth Ministers (ss 6-7; s 20)

• Create a reporting calendar for:
  • the “within 3 months after a warrant ceases to be in force” report about use and communication of information obtained under that warrant (s 6(b));
  • the annual report due within three months after each 30 June that sets out material required under Division 2 of Part 2-8 of the Commonwealth Act insofar as it can be derived from records (s 6(c));
  • ensure the State Minister forwards these reports to the Commonwealth Minister as soon as practicable (s 7; s 20).
• Adopt templates aligned to the Commonwealth Act’s Division 2 Part 2-8 reporting requirements so the required fields are consistently filled.

6. Prepare for inspections and ensure cooperation duties are met (ss 10, 11, 13)

• Maintain immediate access to required records so that inspecting officers can inspect at least twice per financial year and at other times as needed (s 10).
• Ensure officers are instructed to provide assistance reasonably required by an inspecting officer (s 13(2)), and establish liaison processes to handle notices under s 14 requiring written information or attendance.

7. Processes for responding to compulsion under s 14 and evidentiary implications (ss 14-15)

• When an inspecting officer issues a written requirement under s 14, ensure the specified place and time are reasonable and that the officer receiving the requirement is advised of s 15’s admissibility protections and s 22 potential for prosecution for non-compliance.
• Train officers on the limited protection under s 15: compelled information is not admissible against them except in prosecutions under s 22. Legal advice should be available where a request to answer may create complex legal exposure.

8. Confidentiality and information handling policies (ss 16, 19, 21)

• Implement clear internal policies distinguishing the confidentiality obligations of inspecting officers (s 19) and administrative staff (s 21). For staff administering the Act, train them on the narrow list of authorised disclosure contexts (s 21(b)(i)-(vi)) and the 10 penalty unit sanction for unauthorised disclosure.
• For inspecting officers and their staff, create stricter rules and audit logs because of the higher maximum penalty and the non-compellability protection (s 19(2)-(3)).

9. Information sharing with the Commonwealth Ombudsman (s 19A)

• If intending to enter an information-sharing arrangement with the Commonwealth Ombudsman, prepare an information-sharing agreement that clearly limits information to what is reasonably necessary for the functions described and document the necessity rationale for each exchange (s 19A(2)-(3)). Ensure the arrangement is consistent with other statutory obligations.

10. Delegation and resourcing (s 18)

• Document formal delegations from the inspecting officer to staff (excluding NSW Police Force members) and ensure those delegations exclude the power to report to the Minister and the power to delegate (s 18). Ensure adequate staff resourcing to carry out inspections.

11. Record audit trails and remedial action plans (s 11(2)(b)-(c))

• Since inspecting officers must report deficiencies that impact the integrity of the Commonwealth interception regime and remedial action, maintain internal audit trails of corrective actions taken after any deficiency is detected. Establish an internal remediation register capturing findings, actions, responsible officers and completion dates.

12. Prosecution preparedness and internal disciplinary processes (ss 11, 12, 22)

• Be ready to respond to inspection reports that identify contraventions. Ensure disciplinary processes and evidence preservation practices are robust to address potential s 22 prosecutions. Local Court readiness is required for summary proceedings (s 23).

13. Regulatory compliance and training

• Provide mandatory training for operational staff, legal officers and senior management on: required particulars for logs (s 5), secure storage and destruction (s 8), inspection response procedures (s 13-14), evidentiary protections and exceptions (s 15), confidentiality obligations (s 19, s 21), and penalty exposure (s 19(2), s 21, s 22).
• Establish an internal compliance officer responsible for monitoring adherence to timelines (warrant reporting within three months; annual inspections and reports), maintaining a register of warrants and restricted records, and serving as the liaison for inspecting officers.

14. Documentation and retention policy aligned to permitted purposes (s 3)

• Map retention periods and actions to the statutory list of permitted purposes (s 3). Ensure that decisions to retain or destroy are documented with reference to whether the material is reasonably likely to be required for a permitted purpose.

15. Legal review and cross-reference to Commonwealth Act

• Because the Act adopts definitions from and depends on the Commonwealth Act (s 3(2)), ensure legal review procedures include cross-references to the Commonwealth Act’s definitions, warrant types (Part 2-5), notification and certificate procedures (referenced s 4), and the Commonwealth Act’s Part 2-8 reporting requirements. Coordination with Commonwealth counterparts or legal counsel may be necessary.

Following this checklist will control many of the statutory compliance obligations and reduce exposure to inspection findings and possible prosecutions. The two persistent operational themes are (i) rigorous, auditable record-keeping, and (ii) clear, documented decision-making about retention and destruction tied to the statutory concept of "permitted purpose".
