Telecommunications (Interception and Access) (Emergency Service Facilities — Tasmania) Instrument 2022

Emergency service facility is the core concept. The TIA Act treats communications intercepted at or in connection with an emergency service facility as falling within a permitted exception to the general prohibition on interception. The Act does not define the term in the instrument itself; rather, subsection 6(2D) empowers the Attorney‑General to make a legislative instrument declaring that certain premises are an emergency service facility and to specify the force or service operating them and their geographical region. The instrument therefore fills in the content of that power. The concept includes not just the building but the operational context - the premises where emergency calls are received, dispatched, or coordinated.

Premises is not defined in the instrument, but it is a standard legal term covering buildings, structures, and land. The instrument only identifies the geographical region (e.g., “Hobart”, “Launceston”, “Glenorchy”), which is a broad reference. This means that within those regions, there could be multiple premises operated by the same service. For example, Tasmania Police operates many stations in Hobart, but the instrument does not specify which particular station at which address. That imprecision creates interpretive risk: does the exception apply only to the primary communications centre, or to any police station in the Hobart region used for emergency service functions? The source does not answer this, so a court would likely look to the purpose of the provision and the practical operation of the service. This ambiguity is a design flaw that shifts compliance costs onto the organisations, which must exercise judgment or seek legal advice to determine coverage.

Force or service refers to the entity operating the facility. The listed entities are Tasmania Police (a state police force), Tasmania Fire Service (a state fire authority), Ambulance Tasmania (a state ambulance service), and Airservices Australia - Aviation Rescue and Firefighting Service (a Commonwealth‑owned corporation). The inclusion of a Commonwealth entity alongside state bodies reflects the cooperative nature of emergency service delivery in Tasmania, particularly at airports. The instrument does not distinguish between primary and secondary roles; all are treated as emergency services for the purpose of the TIA Act exception.

Geographical region is a descriptor, not a precise boundary. “Hobart” could mean the city of Hobart local government area or the broader Greater Hobart statistical division. “Launceston” similarly. This lack of definition is notable because the TIA Act’s exception likely relies on the premise that interception is occurring at a facility located in that region. If a mobile dispatch unit operates outside the named region, it may fall outside the instrument’s protection. The instrument creates a bright‑line rule by region but a fuzzy line within it.

The instrument also embodies the concept of delegation of legislative power. The TIA Act permits the executive to specify facilities by disallowable instrument, rather than by primary amendment. This reduces parliamentary oversight but enables rapid adjustments as emergency service operations change. The 2025 amendment adding Glenorchy illustrates this agility. However, it also means that the list is a creature of ministerial discretion, subject to political or bureaucratic influence. The instrument does not set criteria for what facilities should be listed; it simply lists them. This off‑ramp from the general prohibition thus depends entirely on executive choice, which may not align with operational needs or resource distribution.

The instrument directly affects the organisations listed in Schedule 1: Tasmania Police, Tasmania Fire Service, Ambulance Tasmania, and Airservices Australia - Aviation Rescue and Firefighting Service. For each of these entities, the instrument means that interception of communications occurring at or in connection with their designated premises is presumptively lawful under the TIA Act’s emergency‑service exception. This removes a significant legal hurdle for day‑to‑day operations, because these organisations routinely need to intercept calls to emergency numbers, coordinate dispatch, and monitor communications. Without the instrument, they would risk criminal liability for each interception.

Indirectly, the instrument affects all employees, contractors, and agents of those services who handle communications. For example, a Tasmania Police dispatcher in Hobart can lawfully intercept a phone call to triple‑zero and record it, because the facility is listed. A dispatcher at a police station in Devonport, however, cannot rely on the same instrument; their facility is not listed. That constrains operational flexibility and may force reliance on other legal bases (e.g., consent or warrant).

Telecommunications carriers and service providers are also affected. Under the TIA Act, carriers must not intercept communications except as permitted. When a listed emergency service requests assistance to intercept calls (e.g., to trace a caller in distress), the carrier can rely on the instrument to confirm that the request comes from a facility that is an emergency service facility. This reduces the carrier’s exposure to liability for cooperating. However, carriers must still satisfy themselves that the interception is for an emergency‑service purpose, not for other uses. The instrument thus creates a safe harbour but not a blanket immunity.

The instrument affects the broader public in two ways. First, callers to emergency services have their communications intercepted and recorded; the instrument provides the legal foundation for that interception, which may impact privacy. Second, individuals whose communications are intercepted incidentally (e.g., a bystander’s call) have no recourse if the interception occurred at a listed facility and was for an emergency purpose. Their privacy rights are limited by the exception.

The instrument’s geographical scope is confined to Tasmania. It does not affect emergency facilities in other states or territories, which have their own instruments or rely on other provisions. It also does not affect Commonwealth‑level emergency services outside Tasmania (e.g., Australian Federal Police in Canberra). This fragmented approach means that national emergency service interoperability may be undermined: a carrier handling calls for a Tasmanian facility knows the law; for a Victorian facility, it must check a different instrument.

Finally, the instrument affects state and federal regulators. The Australian Communications and Media Authority (ACMA) and the Office of the Australian Information Commissioner (OAIC) may take enforcement action if an interception occurs at an unlisted facility or for a non‑emergency purpose. The instrument defines the boundary of lawful behaviour, and regulators rely on it to determine whether an investigation is warranted.

The instrument imposes no duties and confers no rights directly; it is purely declaratory. However, by identifying specific facilities, it activates certain rights and duties that exist under the TIA Act.

Right to intercept communications. The principal right that flows from the instrument is the ability of the listed emergency service to intercept communications without committing an offence under the TIA Act. This right is not absolute: it is limited to interception occurring at or in connection with the facility, and likely only for the purpose of responding to an emergency or providing an emergency service. The instrument does not specify the permitted purposes; that is defined by the parent Act’s exception provisions. An organisation cannot use the instrument to justify interception for training, administration, or non‑emergency uses. The right is therefore conditional on the interception’s purpose, which imposes a duty on the organisation to ensure that its interception practices align with the TIA Act’s requirements.

Duty of telecommunications carriers to cooperate. While the instrument itself does not create a duty, the TIA Act and carrier licence conditions may require carriers to assist emergency services. The instrument provides a clear reference point: if a request to intercept comes from a listed facility (e.g., the Hobart Ambulance Tasmania centre), the carrier can confidently comply. Carriers have a duty to verify that the request is legitimate. The instrument reduces the verification burden but does not eliminate it. Carriers should still confirm that the person making the request is authorised by the emergency service.

Duty to maintain confidentiality and restrict use. The TIA Act imposes strict limitations on the use and disclosure of intercepted communications. The instrument does not alter those duties. Even if interception is lawful because it occurs at a listed facility, the emergency service must not use the intercepted material for purposes unrelated to the emergency service function. There is a duty to destroy or secure records after the emergency has concluded, subject to any retention obligations under state law. The instrument therefore cannot be used as a shield for data hoarding or secondary uses such as investigations unrelated to the emergency.

Right to rely on the instrument in litigation or investigation. If an organisation is accused of unlawful interception, it can point to the instrument as a defence, provided the interception occurred at a listed facility and for an emergency purpose. This right is procedural: it shifts the burden of proof onto the accuser to show that the interception fell outside the exception. The instrument thus confers an evidentiary advantage.

No right for third parties. The instrument does not give members of the public any right to require an emergency service to intercept or not intercept their communications. Privacy protections are enforced through the TIA Act’s general prohibition and the oversight mechanisms, not through the instrument.

Duty to update facilities. The instrument itself is static; the duty to ensure that it reflects current operational premises lies with the Attorney‑General, not with the listed organisations. However, organisations have an incentive to request amendments when they open new facilities or relocate. Failure to update the instrument could create a gap where a new facility is not listed and interception becomes unlawful. This is an administrative burden that the organisations must manage proactively.

The instrument itself contains no penalty provisions. It is a legislative instrument that does not create offences. Instead, it functions as a critical element in the enforcement framework of the TIA Act. The TIA Act makes it an offence to intercept a communication passing over a telecommunications system (section 105, maximum penalty: imprisonment for 2 years). It also creates civil penalty provisions for certain breaches. The instrument operates as a defence in that framework: if an interception occurs at a facility listed in the instrument and is for an emergency service purpose, it is not an offence.

Enforcement mechanisms. The primary enforcer of the TIA Act’s interception provisions is the Australian Federal Police (AFP), which investigates suspected unlawful interceptions. The Australian Communications and Media Authority (ACMA) also has a role in monitoring carrier compliance. An individual whose communications have been unlawfully intercepted can seek a civil remedy or complain to the Office of the Australian Information Commissioner (OAIC) under the Privacy Act, but the instrument may preclude such actions if the interception was at a listed facility for a permitted purpose.

Risk of misuse. The instrument does not create a compliance burden in itself, but it increases the consequences of misidentification. If an emergency service employee intercepts a communication while stationed at a facility that is not listed - or while the interception is not connected to an emergency - that employee may face criminal prosecution. The instrument therefore sharpens the line between lawful and unlawful conduct. Organisations must train staff to recognise that the legal protection is tied to the facility, not the organisation globally. A Tasmania Police officer on patrol in Hobart cannot rely on the instrument if the interception occurs via their personal phone; it must occur at or in connection with the listed premises.

Jurisdictional enforcement. The instrument covers only Tasmania. If a carrier in another state intercepts a communication for a Tasmanian emergency service, the location of the interception may determine which law applies. The instrument may not protect the carrier if the interception equipment is located outside Tasmania. This creates enforcement uncertainty.

No independent audit or reporting. The instrument does not require the listed organisations to report their use of the exception to any regulator. There is no oversight body checking that interception at these facilities is in fact for emergency purposes. This absence of transparency is a gotcha: the instrument provides a broad exemption without any built‑in accountability. If an organisation uses the exception for improper purposes, enforcement depends on whistleblowers or random complaints. The cost of detection is shifted onto regulators and the public.

Penalties for non‑compliance with other laws. While the instrument itself has no penalties, the organisations listed may still face sanctions under state laws or internal policies if they misuse the interception capability. For example, if Ambulance Tasmania records a non‑emergency conversation and uses it for disciplinary proceedings against an employee, that use might breach state privacy laws or industrial agreements. The instrument provides no immunity for such secondary uses.

Telecommunications (Interception and Access) Act 1979 (TIA Act). This is the parent Act, and the instrument sits squarely within it. The instrument’s entire legal effect stems from subsection 6(2D) of the TIA Act. The TIA Act’s other provisions - especially the prohibition on interception (Part 2‑2), the exceptions (Division 3 of Part 2‑2), and the record‑keeping and reporting requirements (Part 2‑6) - remain fully applicable. The instrument does not override any of those provisions; it merely identifies which facilities qualify for the emergency‑service exception. If the TIA Act is amended, the instrument may need to be reviewed for consistency.

Telecommunications Act 1997. Carriers licensed under this Act have obligations to assist emergency services. Section 313 of the Telecommunications Act requires carriers to give officers of emergency services such help as is reasonably necessary to prevent or reduce a serious threat to life or health. The instrument helps define who qualifies as an “officer of an emergency service” for that purpose, though the Telecommunications Act has its own definitions. There is likely to be substantial overlap, but the instrument is narrower (it lists specific facilities, not all police or ambulance officers generally). A carrier may need to satisfy both Acts: the instrument for interception lawfulness under the TIA Act, and section 313 of the Telecommunications Act for the duty to assist.

State emergency service legislation. Tasmania has its own laws governing police, fire, and ambulance services (e.g., Police Service Act 2003 (Tas), Fire Service Act 1979 (Tas), Ambulance Service Act 1982 (Tas)). These state laws regulate the operational conduct of the listed services and may impose additional privacy or record‑keeping obligations. The Commonwealth instrument does not displace state law; it operates alongside it. Where state law is more restrictive (e.g., requiring consent for recording calls), the organisation must comply with both. This can create a compliance burden where the TIA Act allows interception but state law restricts it. The instrument does not resolve such conflicts.

Privacy Act 1988 (Cth). Listed organisations that are “agency” (e.g., state police might be exempt under section 7, but Ambulance Tasmania may not be a Commonwealth agency) must handle intercepted communications in accordance with the Australian Privacy Principles (APPs). The instrument does not provide an exemption from the Privacy Act. An emergency service that collects, uses, or discloses personal information from intercepted calls must have a permitted purpose under the TIA Act and also comply with the APPs. If it uses intercepted data for a non‑emergency purpose, it could breach both laws.

Aviation Transport Security Act 2004. Airservices Australia is listed as an emergency service for aviation rescue and firefighting. Its activities at Hobart and Launceston airports are also regulated by aviation security laws. The instrument does not override those laws; it merely provides a TIA Act exception for interception. Aviation security regulations may impose separate recording or disclosure obligations.

Legislation Act 2003. As a legislative instrument, this instrument is subject to disallowance by either House of Parliament within 15 sitting days of registration. It is also subject to sunsetting under section 50 of the Legislation Act: legislative instruments generally repeal themselves after 10 years unless remade. The instrument was made in 2022, so it will sunset on 1 October 2032 unless re‑made or extended. This sunsetting risk means organisations should plan for a review well before that date.

Other states’ instruments. Australia has a patchwork of similar instruments for other states and territories. Interaction arises where an emergency service operates across state borders. For example, a call to triple‑zero from a mobile phone may be routed to a call centre in another state. If that centre is not listed in this instrument, the interception may not be protected. Organisations must be aware that the instrument is geographically limited.

The instrument was first made on 30 September 2022 (registration F2022L01288) and commenced on 1 October 2022. It originally contained two paragraphs: paragraph (a) (likely referring to the declaration of premises under subsection 6(2D)(a) of the TIA Act) and paragraph (b) specifying the force or service and geographical region. The original Schedule 1 had four items: Tasmania Police (Hobart), Tasmania Fire Service (Hobart), Ambulance Tasmania (Hobart), and Airservices Australia (Hobart and Launceston). The instrument’s commencement paragraph specified when it took effect.

On 19 August 2025, the Telecommunications (Interception and Access) Legislation Amendment (Emergency Service Facilities) Instrument (No. 2) 2025 (F2025L00927) was registered. Schedule 4 of that amending instrument inserted a new item 1A into the table: Tasmania Police, Glenorchy. The amendment had retrospective effect to 10 July 2025, as stated in section 2(1) item 1 of the amending instrument. This meant that for five weeks between 10 July and 19 August, the Glenorchy facility was in operation but not yet listed. The retrospective commencement was presumably intended to validate any interceptions that occurred during that gap, but it also raises rule of law concerns: persons who intercepted communications during that period could not have known on the day that the instrument would be backdated. This is a gotcha for legal compliance.

The compilation also shows that paragraph (a) and the commencement paragraph have been repealed by operations of sections 48C and 48D of the Legislation Act 2003. Those sections allow the Office of Parliamentary Counsel to remove spent or redundant provisions from compilations. Paragraph (a) was likely a recital that became unnecessary once the instrument was made; the commencement paragraph became redundant after the date passed. These repeals are editorial and do not affect the operative content. The amendment history table in endnote 4 confirms that paragraph (a) and the commencement paragraph were “rep LA s 48C” and “rep LA s 48D” respectively. Clause 1 of Schedule 1 was amended by F2025L00927.

The legislation history table shows only two instruments: the original and the 2025 amending instrument. There are no uncommenced amendments noted. The compilation date is 10 July 2025, which is the date the amendment took effect, not the date the compilation was prepared. The compilation itself was probably registered on 19 August 2025 but backdated to reflect the operative date.

The amendment history is sparse, but it demonstrates that the list is not static. Organisations should expect periodic additions as new facilities open or as political pressure mounts. The 2025 amendment added only one item, suggesting that the list is built incrementally. This piecemeal approach may leave gaps for years until operators lobby for inclusion.

The source does not mention any litigation involving this specific instrument. No cases are cited in the text, endnotes, or schedules. Given the instrument’s narrow and recent nature (first made in 2022, only one amendment), it is plausible that no court has yet considered its validity or interpretation. However, the absence of reported litigation does not mean the instrument is uncontroversial; it may simply indicate that organisations have complied without challenge, or that disputes have been resolved administratively.

Potential litigation could arise in several scenarios. A challenge to the instrument’s validity under the Legislation Act 2003 (e.g., whether it was properly registered or whether it exceeds the power under subsection 6(2D)) could be brought by a telecom carrier facing an interception request. A criminal defendant charged with unlawful interception might argue that the instrument is invalid and that their interception was not protected. A privacy advocate might challenge the retrospective application of the 2025 amendment on the ground that it violates the principle of non‑retroactivity in legislative instruments, though retrospective commencement is permitted by the Legislation Act if the instrument so provides.

No existing case law is cited because the instrument is not a primary Act and does not generate its own case register. Any litigation would be under the TIA Act, with the instrument as a factual element. For example, in a prosecution for unlawful interception, the prosecution would need to prove that the interception did not occur at a listed facility or was not for an emergency purpose. The defence would point to the instrument. The court would interpret the terms “premises”, “geographical region”, and “in connection with”. These interpretive issues have not yet been litigated, so there is no judicial guidance on how broad or narrow the exception is.

The absence of litigation history is a double‑edged sword. On one hand, it means the instrument has not been judicially narrowed; on the other, it means there is legal uncertainty. Organisations cannot rely on precedent to define the boundaries of the exception. They must proceed with caution. Compliance professionals should monitor any future decisions involving the TIA Act’s emergency service exceptions, as they may illuminate how this instrument is likely to be treated.

The instrument’s specific listing of Airservices Australia - Aviation Rescue and Firefighting Service might intersect with aviation safety litigation, but that would involve other laws. Overall, litigation history for this instrument is barren, but the instrument is still new (only 3 years old as at 2025). The 2025 amendment may trigger challenges if affected parties object to the retrospective operation.

Geographical region imprecision. The instrument uses broad region names like “Hobart” and “Launceston”. It does not specify a street address or building name. This creates ambiguity: if Tasmania Police operates more than one facility in Hobart, which ones are covered? A strict reading might include any police premises within the Greater Hobart area. A narrow reading might refer only to the primary communications centre. Organisations cannot be certain without obtaining an interpretive opinion. This ambiguity increases compliance risk for staff who may assume a facility is covered when it is not.

No transitional provision for facility relocation. If a listed service moves its operations to a new building within the same geographical region, is the new premises automatically covered? The instrument only declares premises based on the force and region, not the specific building. Arguably, if the service continues to operate under the same name in the same region, the new building is covered. But this is untested. A move outside the named region would clearly fall outside the instrument. Organisations that relocate should request an amendment immediately to avoid a gap.

Retrospective amendment. The 2025 amendment took effect from 10 July 2025, but the amending instrument was not registered until 19 August 2025. For the period 10 July to 19 August, anyone intercepting communications at the Glenorchy Tasmania Police facility would have relied on an instrument that did not yet legally exist on the register. The retrospective commencement purports to validate those interceptions, but it creates due process concerns. If a legal challenge were brought for an interception that occurred during that gap, the court might find the retrospective operation invalid if it interferes with vested rights or expectations. At a minimum, the backdating undermines the principle that law should be knowable before compliance is required.

Lack of sunset or review mechanism in the instrument. The instrument has no built‑in expiry or review date (other than the generic 10‑year sunset under the Legislation Act). There is no requirement to review whether the listed facilities are still operating or whether new ones should be added. Organisations must proactively monitor; if a facility closes, the instrument continues to list it, which could mislead third parties. Conversely, if a new facility opens, it falls outside the instrument until an amendment is made.

No distinction between emergency and non‑emergency functions. The instrument covers the facility, not the function. A Tasmania Police officer using the Hobart station for routine paperwork could theoretically intercept a communication and claim the facility exception. The TIA Act’s exception likely requires an emergency purpose, but the instrument itself does not limit it. An overzealous employee might misuse the exception, and the lack of explicit limits in the instrument could embolden them. The only safeguard is the parent Act’s purpose requirement, but that is not apparent from reading the instrument alone.

Interaction with state privacy laws. The instrument provides a Commonwealth‑law defence, but it does not override state laws that may impose additional restrictions on recording or monitoring communications. For example, Tasmania’s Personal Information Protection Act 2004 may apply to how Ambulance Tasmania handles intercepted call data. Organisations that assume the instrument gives them carte blanche to record everything may inadvertently breach state law. Compliance must be layered.

No obligation to notify carriers of changes. If a listed facility changes its contact details or ceases operations, there is no requirement in the instrument to notify carriers. Carriers might continue to treat the old facility as covered, leading to confusion. The onus is on the emergency service to communicate changes informally.

Airservices Australia’s dual role. Airservices Australia is listed for aviation rescue and firefighting. Its premises are at airports. The instrument does not clarify whether the exception covers interception of airport air‑traffic communications or only firefighting‑related calls. This ambiguity could lead to disputes about the scope of lawful interception for air‑traffic controllers.

Compliance does not involve filing returns or seeking approvals. The instrument is self‑executing: if your organisation is listed and operates at the specified region, you are entitled to rely on the exception. However, compliance with the law as a whole requires more active steps.

Step 1: Confirm listing. Organisations listed in Schedule 1 should verify that each facility they operate is covered. For Tasmania Police, this means ensuring that all stations in Hobart and now Glenorchy that handle emergency communications are within the instrument’s scope. For other stations (e.g., Launceston Police, unless it is also covered under a different instrument?), note that Tasmania Police is only listed for Hobart and Glenorchy. Launceston Police is not listed. Any interception at Launceston Police premises would require another legal basis. The organisation should map its facilities against the instrument and identify gaps.

Step 2: Document purpose. The instrument protects interception only for an emergency service purpose. Organisations should implement policies and training that require personnel to document the reason for each interception, especially when recording or monitoring calls. A simple log noting the emergency call number, time, and nature of the emergency will suffice. This documentation will be critical if an interception is later challenged.

Step 3: Limit use and disclosure. Intercepted material must not be used for non‑emergency purposes. Organisations should have internal rules that prohibit sharing recorded calls for training, performance evaluation, or disciplinary action unless an exception under the TIA Act applies (e.g., for law enforcement purposes with a warrant). Compliance with the Privacy Act should also be factored in; a breach of the Privacy Act could occur even if the interception is lawful under the TIA Act.

Step 4: Liaise with carriers. Telecommunications carriers serving the listed facilities should be informed that the premises are covered by this instrument. Carriers will want to see a copy of the instrument when an interception request is made. Organisations should keep the current compilation available and be prepared to provide it. They should also confirm that their own interception equipment (e.g., call recording systems) is configured to comply with the TIA Act.

Step 5: Monitor amendments. The instrument is subject to amendment. Organisations should subscribe to the Federal Register of Legislation for updates. When a new facility opens, the organisation should request that the Attorney‑General amend the instrument. Proactive lobbying may be necessary to avoid gaps. The 2025 amendment shows that the process works, but note the 5‑week gap caused by retrospective commencement; requesting an amendment before the facility becomes operational is ideal.

Step 6: Train staff. Staff who handle calls should be aware that the legal protection is facility‑specific. A dispatcher working remotely from home or from a vehicle may not be covered. Organisations should define which locations are “at or in connection with” the listed premises. For example, a Tasmania Fire Service dispatcher using a home workstation when the Hobart centre is closed may not be covered.

Step 7: Review other legal obligations. Even if the instrument allows interception, state laws may impose additional conditions. For example, Tasmania’s Police Powers Act may require recording of certain communications, but those recordings must still comply with federal law. Legal counsel should review the intersection.

Step 8: Prepare for sunset. The instrument will sunset on 1 October 2032 under the Legislation Act. Organisations should plan for a renewal submission well before that date. Without renewal, the exception will lapse, and interception at these facilities could become unlawful. The organisations should also consider seeking a longer term or permanent inclusion in the TIA Act itself to avoid periodic re‑listing.

Step 9: Keep records of reliance. For audit purposes, each organisation should maintain a register of interceptions that relied on the instrument. This will assist in defending any later investigation. Records should be retained for at least the TIA Act’s limitation period (possibly 6 years for civil breaches, longer for criminal).

Step 10: Educate carriers and partners. Organisations that subcontract emergency call‑handling should ensure that the subcontractor’s facilities are also listed. If a private call centre handles overflow calls for Ambulance Tasmania, and that centre is not in the instrument, the interception exception may not apply. The instrument only covers the premises operated by the named service itself.
