The standard turns on a set of defined concepts that determine who is covered and what obligations follow. Those definitions appear in Part 1 (s 5), and they are the operational keys for compliance and supervisory action.

• Consumer and customer: “Consumer” is defined broadly to include individuals acquiring telecoms products for personal/domestic use, not‑for‑profit organisations acquiring products not for resale, and small businesses that cannot reasonably negotiate contract terms and whose annual spend with the provider is, or is estimated to be, no greater than $40,000 (s 5, consumer). A “customer” is a consumer who has entered into a consumer contract with a provider, and includes current customers and former customers who owe money (s 5, customer). The distinction matters because the standard’s duties apply to customers (obligations when dealing with bills, arrears, credit action etc.), while “consumer” frames the structural scope (s 4(a)).

• Financial hardship and financial hardship customer: “Financial hardship” is a two‑part definition: inability to discharge obligations because of circumstances (enumerated examples are listed) and the customer’s belief that they will be able to discharge obligations if an agreed arrangement is implemented (s 5, financial hardship). A “financial hardship customer” is a customer who is, or may be, experiencing financial hardship (s 5).

• Payment assistance policy: Providers must establish, publish and comply with a “payment assistance policy” setting out processes for assisting financial hardship customers (s 7). The policy must meet accessibility and content requirements (ss 8-13) and be reviewed at least annually (s 7(3)).

• Financial hardship assistance: Assistance to help customers continue to access services or pay a debt; includes short term (≤3 billing cycles) and long term (>3 billing cycles) assistance (s 5). A non‑exhaustive list of “options for assistance” is defined (s 5) and must be made available in practice (s 18).

• Credit management action: Defined to cover any action including restriction, suspension or disconnection taken to manage credit risks or collect outstanding debts (s 5). The standard prescribes how and when such action can be taken (Part 4).

• Processes, training and records: Providers must implement written processes and procedures for personnel (s 26), deliver financial hardship training within set deadlines and annually (s 27), monitor interactions and review training (s 28), and keep specific records with minimum retention periods (ss 29-30).

• External oversight: The standard expressly confers on the TIO the functions to receive, investigate, resolve and determine complaints about matters in this industry standard (s 32). The ACMA can request records (s 30(1)(c)).

These main concepts are tightly linked: the definitions set the boundary for who is a protected customer; the payment assistance policy is the operational instrument each provider must publish; the options and restrictions on credit management action determine the pace and content of intervention; and training and records are the mechanisms to ensure the rules are implemented and can be reviewed or enforced. Many of the substantive obligations are procedural and timing‑based rather than outcome‑mandating, for example the required timeframes for assessment (s 17) and the obligation to offer minimum options (s 18(1)).

The primary legal objects are carriage service providers who “offer to supply telecommunications products to consumers under a consumer contract” as defined in the standard (s 4(a), s 7(1)). That includes providers of services and goods used in connection with telecommunications products (s 5, telecommunications product). The covered customer groups are residential consumers, not‑for‑profits acquiring products not for resale, and qualifying small businesses described in the consumer definition (s 5, consumer).

Specific groups and roles that the instrument affects in practical terms:

• Providers and senior executives: Providers must establish, maintain and comply with a payment assistance policy; the policy must be approved by the provider’s Chief Executive Officer (or equivalent) who is accountable for implementation and operation (s 7(2)). Providers are tasked with process design, training, publishing policies and summaries, recordkeeping, monitoring, and responding to enquiries and complaints.

• Personnel and contractors: Personnel who deal directly with consumers must be trained within specified timeframes and receive annual refreshers (s 27). Providers must implement written processes for personnel and monitor interactions (ss 26, 28). Contractors engaged by providers performing relevant functions fall within the definition of “personnel” (s 5).

• Consumers/customers: Financial hardship customers are given rights: a right to apply for assistance (s 9(d)), the right to free assistance (s 9(e), s 21), the right to have short term assistance applications processed without evidence in many cases (s 16(2)), and the right to receive written confirmation of arrangements and timelines (s 20). The policy must explain how to apply, monitors and complaints procedures including TIO referral (ss 10, 12).

• Telecommunications Industry Ombudsman (TIO): The standard confers complaints functions and powers on the TIO for matters within the standard (s 32). That expands the TIO’s operational jurisdiction in relation to financial hardship matters covered by this standard.

• Australian Communications and Media Authority (ACMA): ACMA made the industry standard under s 125AA(1) of the Act (s 3) and may exercise oversight functions, evidenced by the requirement to produce records upon written request (s 30(1)(c)). The standard also preserves certain complaints originally made to the ACMA or under existing industry codes (s 33).

• Third parties: Financial counselling services and the TIO are explicitly referenced as contacts to be provided to customers (s 9(g), s 15(1)(d), s 24(5)(b)(vi)). Where providers are not subject to the Privacy Act 1988, the standard places bounds on disclosure of personal information collected under the standard (s 31).

Who is not directly affected: The instrument does not purport to bind suppliers that do not offer to supply to the consumer classes defined, nor does it apply (in the text) to providers of subscription broadcasting or narrowcasting services for the purpose of those definitions (subscriptions referenced only for definitional linkage to Broadcasting Services Act 1992). It is focused on the provider‑customer relationship as between carriage service providers and defined consumers.

This Part summarises core obligations placed on providers and corresponding rights of customers, grounded in the specific sections.

Establish and maintain a policy (s 7):

• Duty: A provider “must establish a payment assistance policy” that complies with Part 2 minimum requirements and must comply with it (s 7(1)). The CEO (or equivalent) must approve and be responsible for implementation (s 7(2)). The policy must be reviewed at least annually (s 7(3)).

Accessibility and publication (s 8):

• Duty: The policy must be written, plain language, accessible (including for customers with disability, diverse cultural backgrounds or special needs), clear font, and published on the provider’s website with a direct homepage hyperlink and concise summary in the same location (s 8(1)(a)-(g)). If the provider has an app, the policy must be available on the app (s 8(1)(g)(i)-(ii)). Application forms must be online if they exist (s 8(2)).

Policy content minimums (ss 9-13):

• Duty: The policy must set out processes for assisting financial hardship customers, include a statement of intention to prioritise keeping customers connected and only use disconnection as last resort (s 9(c)), state customers’ right to apply and that assistance is free (s 9(d)-(e)), identify contact times and points (s 9(f)), and include support service contact details (s 9(g)). It must permit applications via all contact methods ordinarily available, explain monitoring, include application forms, set out assessment steps and criteria (including that victims of domestic or family violence and short term applicants are not required to supply evidence), specify timeframes and list options for assistance (s 10, s 11). A summary must be no more than 500 words and include specified matters (s 13).

Identification and communication (ss 14-15):

• Duty: Providers must take “all reasonable steps necessary” to identify customers in financial hardship, including making reasonable efforts to write to customers who hit specified arrears markers (more than two consecutive overdue bills, three overdue bills in six months, or arrears > $200) (s 14). When a customer indicates financial hardship, the provider must advise on the policy, discuss options and timeframes, offer application forms and suitable formats, provide contact details for authorised personnel, and assist customers with accessibility needs to make an application (s 15(1)). Written bills and reminder notices must include advice about the policy, a hyperlink to it or app details, and contact details specified at s 15(4).

Assessment: eligibility and information limits (s 16):

• Duty and rights: Eligibility requires meeting the instrument’s definition of financial hardship and wishing to access options (s 16(1)). The provider must not request information or documents to show financial hardship for short term assistance or where the customer appears to be a victim of domestic or family violence (s 16(2)(a)). Providers may request information in limited circumstances where long term assistance appears necessary and certain criteria are met (s 16(3)); any such request must be strictly necessary, explained in writing and provide multiple contact points for submission (s 16(4)-(7)).

Timelines (s 17):

• Duty: Providers must advise estimated assessment time, complete an assessment within five business days of receiving a complete application, inform the customer of outcome within two business days after completing assessment, and advise immediately if the customer is ineligible (s 17(a)-(d)).

Options for assistance (s 18):

• Duty: Providers must make available options that are realistic, appropriate and tailored to customer circumstances, including a minimum of six options from the defined list; the list must include deferring/postponing payments (s 18(1)) and tailored payment plans (s 18(1)(e)). Providers must account for the customer’s individual capacity to pay, including the needs of victims of domestic or family violence (s 18(2)).

Commencement and communication of arrangements (ss 19-20):

• Right and duty: An arrangement for financial hardship assistance “must commence as soon as the customer indicates to a provider that they agree” (s 19). The provider must give written notice within two business days setting out arrangement details, rights and obligations, a requirement to advise changes within 14 days, circumstances in which credit management action may be taken, duration, and review options (s 20).

No fee and review (ss 21-22):

• Duty and right: Providers cannot charge to apply, be assessed for, access, or administer financial hardship assistance (s 21). Providers must review arrangements promptly if contacted by the customer about changed circumstances, and where it considers compliance issues arise, contact the customer promptly to discuss and offer review (s 22).

Restrictions on credit management action (ss 23-25):

• Duty: Providers must take all reasonable steps to determine financial hardship before taking credit management action, and if they determine hardship exists must offer suitable assistance and take steps to keep the service connected (s 23). Providers must not take credit management action while the customer is discussing options or has made an application, or if there is an arrangement on foot (s 24(1)), subject to limited exceptions (s 24(2)) including where the customer has not met obligations under the arrangement and the provider has taken steps to review; prescribed reasonable steps to contact (three separate attempts on separate business days over no more than 10 calendar days using at least two methods) apply (s 24(3)). Written notices and timing requirements are set: at least 10 business days’ written notice before taking action and statements of proposed action, timing, grounds, charges, impacts and contact details (s 24(5)(b)).

Processes, training and monitoring (ss 26-28):

• Duty: Written processes for personnel (s 26). Financial hardship training must be delivered to personnel who deal directly with consumers within three months of commencement (or before first dealing with consumers) and annually thereafter; training content and assessment requirements are specified (s 27). Providers must monitor interactions and review training annually (s 28).

Records and privacy (ss 29-31):

• Duty: Providers must keep specified records about arrangements, communication, applications, requests for information, and notices (s 29). Records must be kept for at least two years after the arrangement is completed or from creation (s 30). Providers must take reasonable steps to protect records and securely dispose of them when no longer needed (s 29(3), s 30). Providers not subject to the Privacy Act must restrict disclosure of personal information collected under the standard to the limited circumstances specified (s 31).

External dispute resolution and enforcement interfaces (s 32, ss 30, 33-35):

• Duty/Mechanism: The TIO is explicitly conferred functions and powers to handle complaints about matters in the standard (s 32). Providers must make records available to the ACMA on written request (s 30(1)(c)). Transitional provisions preserve existing complaints under relevant industry codes and require providers to transition or offer to replace pre‑existing arrangements within tightly prescribed timelines (ss 33-35).

These duties together create a structured operational framework providers must implement. Rights available to customers include a right to apply, free assistance, rapid commencement of agreed arrangements, written confirmation, review rights, TIO complaint channels, and limited privacy safeguards when providers are outside the Privacy Act.

The standard itself does not set out express financial penalties or criminal sanctions within its text. Its enforcement architecture, as specified in the instrument, operates through regulatory oversight and external dispute resolution channels.

Statutory source and supervisory bodies:

• The standard is made by the ACMA under subsection 125AA(1) of the Telecommunications Act 1997 (s 3). While the Act itself contains enforcement mechanisms and potential consequences for non‑compliance with industry standards, the instrument as provided does not reproduce those provisions. Readers must therefore locate relevant enforcement provisions in the Act to see sanctions tied to contraventions of industry standards under s 125AA and associated sections of the Act.

TIO functions and powers:

• The instrument confers functions and powers on the Telecommunications Industry Ombudsman (TIO) to receive, investigate, facilitate resolution of, make determinations in relation to, give directions in relation to, and report on complaints about matters in the industry standard (s 32). This conferral places the TIO as the principal external complaints mechanism for customers aggrieved about provider compliance with the standard.

ACMA information and oversight:

• Providers must make records available to the ACMA upon receiving a written request (s 30(1)(c)). The ACMA’s ability to request records is an enforcement lever; the instrument also requires record retention and protection measures (ss 29-30). The combination of recordkeeping obligations and ACMA access creates documentary evidence for compliance assessment.

Procedural controls that limit provider conduct:

• The standard imposes procedural gates (for example, restrictions on taking credit management action while an application is pending (s 24(1)) and mandatory notice periods before action (s 24(5)(b))). Failure to comply with these procedural safeguards may be the subject of TIO complaints and ACMA enforcement action.

Absence of express financial penalties in instrument:

• The industry standard text contains no explicit civil pecuniary penalties, infringement notices, or criminal penalties attached to particular breaches. Consequently, immediate enforcement will rely on the Act’s mechanisms (not reproduced here), TIO determinations and remediation orders, reputational consequences, dispute resolution outcomes, and any regulatory actions that the ACMA is empowered to take under the Act.

Practical enforcement dynamics:

• The TIO’s power to make determinations and give directions (s 32) means outcomes may include orders to provide or vary assistance, refund charges, or require other remedial steps depending on the TIO’s jurisdictional remit under its terms of reference (not contained in this instrument). Providers should expect the TIO to receive complaints alleging non‑compliance with timeframes, information requests contrary to s 16, improper credit action contrary to s 24, failure to provide written confirmation under s 20, or failure to maintain required policies and records. The ACMA’s record requests (s 30) support administrative enforcement and monitoring; however the instrument does not specify a graduated penalty regime in its own terms.

In short, enforcement as expressed in the instrument is implemented through the regulatory framework established by the Act, documentary oversight by the ACMA and dispute resolution and determinations performed by the TIO (ss 3, 30(1)(c), 32). The absence of explicit penalty clauses in the standard means legal consequences for breaches (beyond TIO determinations and ACMA actions) depend on the broader statutory powers in the Telecommunications Act and the authorities’ practices.

The industry standard expressly interacts with several legal instruments and regimes. Those interactions are stated in the instrument and shape compliance obligations and operational design.

Statutory basis and Direction:

• The standard is made under subsection 125AA(1) of the Telecommunications Act 1997 and in accordance with sections 5, 6 and 7 of the Telecommunications (Financial Hardship Industry Standard) Direction 2023 (s 3). The standard references the Act throughout (e.g. consumer contract defined to include standard form agreements formulated under s 479 of the Act, s 5). The standard’s obligations sit within the statutory framework of the Act; enforcement and further regulatory consequences must be sought in the Act.

Industry codes and transitional preservation:

• The standard recognises existing “relevant industry code[s]” registered under Part 6 of the Act that impose requirements relating to financial hardship (s 5, definition; s 33). Complaints already made under a relevant industry code before commencement are preserved and continue to be dealt with as complaints under that code on and after commencement, provided the code provision is in force (s 33). That implies the standard does not automatically supplant current code obligations for in‑flight complaints; continuity is provided in transition.

Privacy Act 1988 and privacy obligations:

• The instrument draws a distinction between providers that are subject to the Privacy Act 1988 and those that are not. Where a provider is not subject to the Privacy Act, it must still ensure personal information collected in connection with applications and arrangements is not disclosed except in very limited circumstances and is securely disposed of when no longer needed (s 31). Where a provider is subject to the Privacy Act, the instrument points to the Australian Privacy Principles (note to s 31) indicating those obligations will apply in addition to the industry standard’s record requirements.

Broadcasting Services Act cross‑reference:

• The definitions of subscription broadcasting service and subscription narrowcasting service are aligned with the Broadcasting Services Act 1992 (s 5). Those cross‑references are primarily definitional and delimit some content‑service exceptions.

TIO jurisdiction and external dispute resolution:

• The standard confers complaints functions and powers on the TIO (s 32). The TIO’s determinations and processes operate within its statutory and constitutional remit, which may be subject to judicial review or other statutory constraints not specified in the instrument.

Consumer contract and competition law context:

• The standard explicitly applies to “consumer contracts” as defined, including standard form agreements under the Act (s 5). While the instrument does not cross‑reference the Competition and Consumer Act 2010 or the Australian Consumer Law, providers must remain mindful that actions under the standard operate alongside consumer protection laws and unfair contract terms regimes, where applicable.

Record access and ACMA powers:

• Providers must make records available to the ACMA on written request (s 30(1)(c)). That access will interact with privacy obligations and other legal constraints on disclosure; the instrument clarifies obligations for providers not subject to Privacy Act rules (s 31).

Transitional interactions:

• The transitional provisions preserve complaints under relevant codes and convert pre‑existing applications and arrangements into matters to be dealt with under this standard subject to specified transition processes and timelines (ss 33-35). Providers should map their obligations under any industry code, the standard, privacy laws and the Act to ensure no inconsistent compliance.

In short, compliance under this industry standard operates in a layered legal environment: the Act provides the statutory base and enforcement mechanisms; industry codes and pre‑existing complaints may continue during transition; privacy laws apply in tandem; the TIO plays a primary external dispute resolution role; and record sharing with ACMA is expressly authorised. Providers must align their payment assistance policies and processes with all these intersecting legal requirements.

The instrument itself states its making and commencement details; there are no internal amendment entries or historical versions contained within the text provided. The facts in the instrument are:

• Date and signature: The instrument is dated 1 February 2024 and signed by two ACMA members, with the commencement date specified as 29 March 2024 (front matter; s 2). The signatures indicate the administrative making by ACMA officials.

• Authority and Direction: The instrument is made under subsection 125AA(1) of the Telecommunications Act 1997 and in accordance with sections 5, 6 and 7 of the Telecommunications (Financial Hardship Industry Standard) Direction 2023 (s 3). The Direction is noted to have been given to ACMA by the Minister under subsection 125AA(4) of the Act (note to s 3). Changes to the industry standard going forward would be subject to the legislative amendment processes applicable to legislative instruments and the Direction framework; the instrument itself does not record any amendments or prior versions.

• Transitional provisions: The instrument includes transitional arrangements to preserve pre‑existing complaints and to transform pre‑commencement applications and arrangements to the new policy framework (ss 33-35). These transitional clauses are part of the original instrument and clarify how the instrument applies to matters in progress at commencement.

• No recorded repeals or modifications in text: There is no clause in the instrument repealing prior instruments. The instrument’s Note sections reference other Acts (Acts Interpretation Act 1901; Legislation Act 2003) for interpretive guidance (s 6 notes), but no modification or repeal history is recorded.

For practitioners tracking amendment history, the actionable facts from the instrument are its making date, commencement date and the express link to the Ministerial Direction 2023. To determine whether amendments have been made after commencement or to identify the formal legislative history, one must consult the Federal Register of Legislation or ACMA registers for subsequent amendment instruments, which are not contained within this text.

The industry standard text contains no litigation history, judicial interpretations or references to case law. The instrument does not list any court decisions or TIO determinations as interpretive authority. The only dispute mechanism it expressly engages is the TIO (conferral of functions and powers at s 32) and the ACMA’s supervisory record access (s 30).

Practical implications of the absence of litigation history in the text:

• There is no binding judicial construction of the standard within the instrument to guide interpretation of terms such as “reasonable steps”, “strictly necessary”, or the precise contours of “financial hardship”. Those terms are partly defined by the instrument, but inevitably their application will be clarified by future TIO determinations or judicial review of decisions where jurisdictional questions arise.

• The TIO, being vested with the power to make determinations and give directions (s 32), is likely to generate early interpretive material in the form of determinations and reporting. Those determinations are not reproduced here.

• Absence of precedent increases the importance of clear internal policy drafting and conservative compliance practices, because providers cannot rely on established case law to predict how ambiguous compliance choices will be treated by the TIO or courts.

If litigation or TIO determinations are sought in the future, practitioners should review TIO determinations and any ACMA enforcement actions for interpretive trends (for example, the meaning of “reasonable steps” under s 14 and s 24 or the circumstances in which a provider may request information under s 16(3)). Those materials will form the litigation history relevant to enforcement and compliance, but none are contained in this instrument.

This standard contains numerous detailed, time‑sensitive, and process‑oriented obligations; small operational oversights can create non‑compliance risk. Below are concrete pitfalls and tricky points drawn directly from the text.

Immediate commencement of arrangements:

• Under s 19, an arrangement for financial hardship assistance “must commence as soon as the customer indicates to a provider that they agree to the arrangement.” That means providers must operationally treat oral or informal customer agreement as triggering the arrangement and apply its terms immediately, even if written confirmation is provided within two business days under s 20. Failing to activate relief immediately risks contravening s 19.

Tight assessment and notification timeframes:

• The provider must complete an assessment “as soon as practicable, but in any event, within 5 business days of receiving a complete application” and inform the customer of the outcome within 2 business days after completing the assessment (s 17(b)-(c)). Systems that do not track application completeness, or that batch processes applications, risk missing these deadlines. “Complete application” is not exhaustively defined; establishing internal definitions aligned with s 16 and s 11 is necessary.

Limits on information requests:

• Providers must not request information to show financial hardship for short term assistance or where the customer appears to be a victim survivor of domestic and family violence (s 16(2)(a)). Requesting evidence in those cases may be inconsistent with the instrument. Conversely, providers may request information for long term assistance but only when strictly necessary and where certain criteria are met (s 16(3)-(6)). Misapplied evidence requests or poor documentation about why a request is strictly necessary create complaints exposure.

Automatic triggers to identify hardship:

• Providers must make reasonable efforts to communicate in writing with customers after becoming aware of the customer hitting arrears markers (s 14(b)(i)-(iii)). Systems must identify these arrears thresholds accurately; missing the trigger points may constitute failure to take all reasonable steps.

Minimum number and types of options:

• Providers must offer at least six options for assistance, including postponing/deferring payments and tailored payment plans (s 18(1)). Merely offering one or two options , even if generous , will not comply. Carefully map available options to the defined list in s 5 to ensure at least six are implemented.

Notice and contact requirements before credit management action:

• Where credit action can be taken, providers must give at least 10 business days’ written notice that includes prescribed content (s 24(5)(b)). The communication must state proposed action, timing, reasons, charges, impacts on other products, and TIO/financial counselling contact details. Failures to include any of those elements create procedural non‑compliance.

The “reasonable steps” defined contact test:

• For the purpose of taking credit action under s 24(2)(c)(i)/(iv), a provider is taken to have taken reasonable steps if it has made at least 3 separate contact attempts on separate business days over a total period of not more than 10 calendar days, using at least 2 methods, with at least one written method (s 24(3)). Failure to follow this exact contact pattern risks invalidating the provider’s lawful basis for action.

Training timing and content:

• Training for personnel who directly deal with consumers must be delivered within three months of commencement for current staff or before first dealing with consumers for new staff, and repeated annually; training must include assessment (s 27). Providers that apply informal onboarding or ad hoc shadowing without formal assessment risk non‑compliance.

Record retention and disposal:

• Many records must be kept for at least two years after arrangement completion or two years from creation, and must be made available to the ACMA on written request (ss 29-30). Additionally, where a provider requests information from a customer under s 16(3), it must only retain a copy of that information for the period required to complete the assessment and then securely dispose of it (s 30(2)). Providers with centralized retention schedules need discrete workflows to ensure compliant disposal.

Privacy divergence:

• Providers not covered by the Privacy Act must still restrict disclosure of personal information to narrow permitted purposes (s 31). That may catch some non‑Privacy Act entities that previously treated such information less carefully.

Transitional short windows:

• For arrangements that pre‑exist commencement, providers have a transition period of 20 business days to review and, if necessary, make and communicate offers to replace non‑compliant arrangements (s 35). The customer acceptance period is 10 business days (s 35). These are short windows requiring immediate operational attention for in‑flight arrangements at commencement.

Website and app presentation:

• The payment assistance policy must be accessible via a direct hyperlink from the home page and the concise summary must be on the same page or location where application information is kept (s 8(1)(g)(i)-(ii)). Firms with complex web architectures or multiple brands must ensure the link and summary appear on the primary customer contact page.

No fees allowed:

• Providers must not charge customers to apply for, be assessed for or access financial hardship assistance, or for administration of such arrangements (s 21). Charging activation or administration fees commonly used in commercial operations must be removed.

TIO interface:

• Since the TIO is conferred broad functions and powers (s 32), providers must be ready to engage with TIO investigations and determinations on the standard’s grounds. Lack of internal records or inconsistent implementation will present as weak defence in TIO proceedings.

In short, the gotchas are principally procedural: narrow timeframes, strict evidence limits, prescribed contact patterns, immediate commencement obligation, detailed notice content, mandatory minimum option sets, record disposal rules and training assessments. Providers must align operations and IT workflows precisely with the instrument’s prescribed processes.

Below is a practical, source‑grounded compliance roadmap shaped by the instrument. Each step cites the relevant sections for verification and identifies concrete deliverables.

1. Governance and policy adoption

• Draft and approve a written payment assistance policy that complies with Parts 2 and 3 (s 7(1)). Ensure the Chief Executive Officer (or equivalent) provides formal approval and that the CEO is documented as responsible for implementation and operation (s 7(2)). Schedule an annual policy review (s 7(3)).

2. Website, app and public disclosure

• Publish the full policy on the provider’s website and, if the provider uses an app, make the policy available on the app. Place a direct hyperlink on the home page to the policy and position a concise summary (≤500 words) on the same page as application information (s 8(1)(g), s 13). Ensure the summary includes the matters required by s 13(b)-(d) and s 13(d)(i)-(v).

3. Policy content checklist

• Ensure the policy:
  • Sets out processes for assisting financial hardship customers and focuses on their needs (s 9(a)-(b)).
  • Contains a statement recognising the intent to keep customers connected and to use disconnection as last resort (s 9(c)).
  • States customers’ right to apply and that assistance is free (s 9(d)-(e), s 21).
  • Identifies contact times and at least two contact points where no telephone is provided (s 9(f)), and includes TIO and financial counselling contact details (s 9(g)).
  • Permits applications via all usual contact methods, includes application forms, and explains progress monitoring (s 10).
  • Sets out eligibility assessment steps and criteria, specifies evidence requirements and timeframes, and confirms short term applicants and victims of domestic violence are not required to provide evidence (s 11).

4. Operational processes and personnel

• Implement written processes and procedures for personnel to operationalise the policy (s 26).
• Develop staff training modules covering Parts 1-6, the provider’s payment assistance policy and compliance processes; include an assessment component; deliver training within three months for existing customer‑facing staff or before they first deal with customers, and annually thereafter (s 27(1)-(3)).
• Monitor personnel interactions with financial hardship customers regularly and schedule annual training effectiveness reviews (s 28).

5. Identification systems and triggers

• Configure billing and arrears systems to flag customers who meet trigger conditions in s 14(b): more than 2 consecutive overdue bills, a total of 3 overdue bills in the previous 6 months, or arrears greater than $200. Ensure automated or manual workflows generate written communications as required.

6. Application intake, assessment and evidence handling

• Design application intake forms and multi‑channel submission points (email, web/app, physical address/in store) per s 16(4)(b).
• Define what constitutes a “complete application” for internal operational purposes, aligned with the eligibility criteria at s 16(1) and the information types specified in s 11(c).
• For short term assistance and apparent victims of domestic or family violence, do not request evidence (s 16(2)(a)). For long term assistance, only request information when strictly necessary and one of the criteria in s 16(3) applies; document strict necessity and provide a named contact and clear instructions for presenting information and for secure sighting (s 16(4)-(7)). Implement secure temporary retention and disposal workflows for requested documents, complying with s 30(2).

7. Timeframes and customer updates

• Track and meet timeframes: provide an estimated assessment timeframe (s 17(a)); complete assessments within 5 business days of receiving a complete application (s 17(b)); advise outcome within 2 business days of completing the assessment (s 17(c)); immediately advise if the customer is ineligible (s 17(d)). Implement automated notifications to ensure compliance.

8. Assistance options catalogue and tailoring

• Ensure the provider offers at least six options for assistance including: temporary postponement/extension/deferral of bills and tailored payment plans (s 18(1), definition of options for assistance). Map each option to internal billing and provisioning systems so that selected options can be implemented immediately upon customer agreement (s 19). Document how options will be tailored to capacity to pay, and include specific provisions for victims of domestic or family violence (s 18(2)).

9. Commencement and written confirmation

• Activate arrangements immediately when the customer indicates agreement (s 19). Issue written notice within two business days that sets out arrangement details, rights and obligations, change notification obligations (14 days), circumstances allowing credit management action, duration and review rights (s 20). Create template notices covering all elements in s 20(a)-(f).

10. Credit management action protocols

• Before taking credit management action, run a hardship check per s 23(1) and offer assistance per s 23(2). Do not take action while the customer is discussing options or has an application/arrangement on foot except in the limited exceptions of s 24(2). Document and apply the “reasonable steps” contact test (3 attempts on separate business days within a 10‑day calendar window, at least 2 methods, one in writing) before action (s 24(3)). Where action is contemplated, send written notice at least 10 business days before the action and include the content required by s 24(5)(b)(i)-(vi).

11. Debt sale and staging

• Do not sell a debt if s 24(1) applies or while the provider is reviewing an arrangement under s 22 (s 25). Build processes to flag debts subject to protection.

12. Records, retention and ACMA access

• Maintain records specified in s 29(1)-(2), including unique identifiers, dates of oral communications, copies of correspondence, application copies, records of information requests, acceptance records and the s 20 notice. Retain records for at least two years after arrangement completion or from record creation (s 30(1)(a)-(b)). Implement secure storage, access logs and secure destruction policies aligned with s 29(3) and s 30(2). Ensure readiness to provide records to ACMA upon written request (s 30(1)(c)).
