What it does
This instrument creates a site-specific exemption under the Telecommunications Act 1997 for a named subdivision project in Lockhart River, Queensland. It specifies that the Lockhart River Aboriginal Shire Council Piiramo Street Subdivision Project, a 25‑lot subdivision owned by the Lockhart River Aboriginal Shire Council, is exempt from the requirements in sections 372E, 372F, 372G and 372H of the Act, subject to a single stated condition (s 5(1)-(2)). The instrument is made under paragraphs 372K(1)(a), (c), (d), (e) and (f) of the Act (s 3). It commences the day after registration (s 2, commencement table). The geographic extent of the project is defined precisely in Schedule 1 by a polygon of coordinates using the Geocentric Datum of Australia 1994; the Schedule also records the land reference as Lot 6 of WMT54 on Piiramo Street, Lockhart River (s 4 definition and Schedule 1).
Mechanically, the exemption removes the named project from whatever legal obligations are set out in ss 372E-372H of the Act. The instrument adds one mandatory condition where fixed-line telecommunications infrastructure is absent: the Lockhart River Aboriginal Shire Council must give written notice to all residents, including prospective residents, of a building unit situated on the land comprising the project, stating (i) that fixed-line infrastructure is absent and (ii) that telecommunications services will be delivered through wireless networks or satellite networks, as applicable (s 5(2)(a)(i)-(ii)). The instrument includes the legislated note that subsection 372K(2) allows an exemption to be conditional (note to s 5).
The instrument is narrow in scope: it applies to the single, named redevelopment project and only to the specified sections of the Act. It does not itself amend the Act or other statutes, nor does it specify enforcement penalties or further procedural detail. The Schedule supplies coordinates and the surveying datum used, which fixes the exemption to a precise parcel. The instrument contains an internal commencement table making the whole instrument operate from the day after registration (s 2).
