Commonwealth legislation
This instrument exempts two named Kiangatha real‑estate development projects from the fibre‑readiness obligations in sections 372E–372H of the Telecommunications Act 1997. Made by the Minister under paragraph 372K(1), it takes effect the day after registration and applies only to the specified lots shown in the annexed maps and owned by Kiangatha as at 1 May 2016. Mechanically, the named developer is released from those statutory installation/standards requirements for the identified project areas.

1 Name of Instrument
This Instrument is the Telecommunications (Fibre-ready facilities- Exempt Kiangatha Real Estate Development Projects) Instrument No.1 of 2016.
2 Commencement
This Instrument commences on the day after it is registered on the Federal Register of Legislation.
3 Definitions
In this Instrument:
Act means the Telecommunications Act 1997.
Kiangatha means Kiangatha Holdings Pty Limited (ACN 136 533 741), a company incorporated in New South Wales.
Specified Kiangatha Project means each real estate development project:
Note: The following words and expressions used in this Instrument have the meaning given by section 7 of the Act (see subsection 13(1) of the Legislation Act 2003):
\- project area; and
- real estate development project.
4 Exempt real estate development projects
Pursuant to paragraph 372K(1)(a) of the Act, each Specified Kiangatha Project is exempt from the requirements in sections 372E, 372F, 372G and 372H of the Act.
