The instrument defines several key actors and concepts by cross reference and internal definition. “Fax” means a marketing fax - that is, a fax that falls within the definition of “marketing fax” in the Telecommunications Act 1997. The standard does not re-state that definition, so a reader must locate it in the Act. In practice, a marketing fax is one that markets, advertises, or promotes goods, services, land, business or investment opportunities, solicits donations, conducts opinion polling, or carries out standard questionnaire based research. Pure administrative, transactional, or personal faxes fall outside the scope.

“Fax advertiser” is defined independently: a participant in a section of the fax marketing industry that authorises the sending of a marketing fax for one of nine listed purposes. The list tracks the Act’s definitional categories for marketing faxes. Importantly, the advertiser is the party that decides to promote something and instructs the sending. The accompanying note clarifies that if an entity both authorises and sends the fax itself, it is both the sender and the fax advertiser.

“Sender” is defined more simply: a participant that sends or proposes to send a marketing fax. The note to the definitions indicates that the Act defines “send” by reference to the Do Not Call Register Act 2006, which includes causing a fax to be sent. A service bureau that physically transmits faxes on behalf of a client is therefore a sender and bears direct obligations under the standard.

“Consent” has the same meaning as in Schedule 2 to the Do Not Call Register Act 2006. That schedule sets out when consent is express, implied, or deemed. Because the definition is imported, the standard does not create its own consent rules. A fax advertiser relying on consent to send faxes during prohibited times must ensure the consent meets the Schedule 2 standard, and must be able to prove it if the ACMA asks.

“Relevant account holder” and “nominee” also come from the Do Not Call Register Act. The relevant account holder is the person who is the account holder for the fax number (as recorded by the carrier). A nominee is a person authorised by the account holder to give consent.

“Opt out address” is a composite: a fax number for opt out messages plus at least one of a local or toll free phone number, an email address, or a website address. Notably, the statute requires both a fax number and another channel, so a fax number alone is insufficient. The idea is that the recipient must be able to convey an opt out message without necessarily sending a fax in response albeit the primary opt out channel is a fax number.

“Australian number” is defined as having the meaning in s 4 of the Do Not Call Register Act, which essentially means a telephone number allocated under the Australian numbering plan. The standard does not apply to faxes sent to international numbers, but the definition of “number” in s 5 is limited to Australian numbers, so the fax limits, opt out rules, and time restrictions only protect Australian recipients.

The standard applies to participants in each section of the fax marketing industry. This is a broad category that captures any person or business involved in sending marketing faxes, whether as the advertiser who commissions the campaign, the sender who physically transmits the faxes, or entities that provide services such as list management, number acquisition, or fax broadcasting. The definitions of “sender” and “fax advertiser” apportion separate obligations; both are participants and both must comply with the relevant duties.

For a small business that conducts its own fax marketing - for example, a local real estate agent faxing property listings to clients - that business is both sender and fax advertiser. It must comply with all the rules: time restrictions, content requirements, opt out, volume caps. If it outsources transmission to a fax broadcast company, the broadcast company becomes the sender and must comply with the operational duties (e.g., ensuring opt outs are processed within seven days), while the real estate agent remains the fax advertiser and must ensure its name and ABN appear in the fax.

Charities and not for profit organisations are caught because soliciting donations and conducting opinion polling are within the definition of marketing fax. A charity that sends faxes asking for donations must include its ABN, observe time restrictions, and provide an opt out.

Businesses that use fax for standard questionnaire based research - for example, market research firms - are also covered. The definition of marketing fax in the Act includes standard questionnaire based research, so research firms that fax surveys must comply even if the survey is not overtly commercial.

Foreign companies that send faxes to Australian numbers face the same obligations, except they may use an equivalent business number instead of an ABN.

Fax recipients are not directly regulated, but they gain enforceable rights: the right not to receive faxes outside permitted hours (unless they consented), the right to clear identification of the advertiser, the right to an opt out mechanism, and the right to be removed from lists within seven days of opting out. Any recipient can enforce these rights by complaining to the ACMA.

Industry participants will need to invest in compliance systems: time zone aware scheduling, template management to ensure all required fields appear, reliable opt out channels (often a dedicated fax number, a phone line, or a web form), and list management to cap volumes and process opt outs. For low volume users, the cost per fax may rise significantly.

The standard imposes duties primarily on the sender, but the fax advertiser’s identity and contact details must appear in every fax, and the advertiser’s volume is capped per number per day.

Sender’s duties:

• Not to send a marketing fax outside the permitted hours set out in s 8(1) and (2). This is a strict obligation, subject only to the consent exception under s 8(3). The sender must know the time zone of the recipient’s usual address and schedule transmissions accordingly.

• Not to send a fax that lacks the mandatory information under s 9(1): the fax advertiser’s name, ABN (or equivalent business number for foreign companies), contact details, the destination number, and a statement explaining how to opt out together with an opt out address. That information must be on the first page, at least 10 point font, clear, legible, and conspicuous.

• To have processes ensuring the opt out address is reasonably likely to be capable of receiving messages at all times (s 10(2)(a)). This means the sender must monitor the opt out channel and fix outages promptly.

• To remove the fax recipient’s number from any list used to arrange faxes on behalf of the relevant fax advertiser within seven days of the recipient opting out (s 10(2)(b)). The obligation runs to each advertiser whose faxes were sent to that number, so if the sender handles multiple advertisers, it must coordinate removal across all.

• To make reasonable efforts not to exceed ten faxes per advertiser per number per 24 hour period (s 11). “Reasonable efforts” is not defined, so compliance depends on what a prudent sender would do: automated volume controls, frequency caps, and regular audits.

The fax advertiser’s duties are less explicitly set out, but the advertiser must ensure its name and ABN appear, and its contact details (including a phone or fax number for normal business hours and at least one address). The advertiser also must not authorise faxes that would cause the sender to breach the standard.

Recipient rights:

• The right not to receive marketing faxes during prohibited times unless consent has been given in advance by the account holder or nominee.

• The right to have the sender’s identity and contact details visible.

• The right to opt out via the provided address, and to have that opt out honoured within seven days.

• The right not to receive more than ten faxes from the same advertiser in a day (though this is a “reasonable efforts” duty, not an absolute guarantee).

The Telecommunications (Fax Marketing) Industry Standard 2021 does not itself set out penalties for contravention. It is a legislative instrument made under s 125B(1) of the Telecommunications Act 1997, and the enforcement framework is found in the Act. Section 125B provides for the ACMA to determine industry standards that are enforceable. Under Part 27 of the Act, contravention of an industry standard can attract civil penalties. The maximum penalty per contravention is specified in the Act, typically by reference to penalty units. Additional remedies may include injunctions, directions to comply, or infringement notices issued by the ACMA.

Because the standard imports definitions from the Do Not Call Register Act 2006, there may be overlapping enforcement possibilities. For example, sending a fax to a number registered on the Do Not Call Register can itself be an offence under that Act, and the ACMA can investigate both breaches.

The standard places the burden of proving consent on the sender if the ACMA requests it (s 8(3)(c)). This effectively reverses the evidentiary onus: a sender who wishes to rely on the consent exception must be able to produce documentary evidence (e.g., a signed consent form, recorded oral consent, or a record of online consent) when asked. Failure to produce can mean the sender cannot rely on the exception, even if consent existed.

Non compliance with information requirements, opt out obligations, or volume limits may lead to ACMA investigations. The ACMA has power to issue formal warnings, accept enforceable undertakings, or seek civil penalties in the Federal Court. Directors and officers of corporations may also be exposed to accessory liability if they authorised or participated in contraventions.

Given that the standard only came into effect in late 2021, enforcement activity is still developing. However, the ACMA historically takes compliance with telemarketing and fax rules seriously, and has issued infringement notices under related rules. The volume cap and time restrictions are relatively easy for recipients to verify - a recipient can count faxes and note the time stamp - making complaints straightforward.

The standard explicitly addresses interaction with state and territory laws. Section 12 provides that the standard is not intended to exclude the operation of a state or territory law to the extent that the law is capable of operating concurrently. This means a fax marketer must comply with both the Commonwealth standard and any applicable state or territory law - for example, a state law that bans unsolicited faxes entirely on public holidays not listed in the standard, or that imposes additional disclosure requirements. The standard does not attempt to cover the field.

At the Commonwealth level, the standard operates alongside the Do Not Call Register Act 2006. Many definitions are borrowed from that Act, and the consent framework is identical. However, the standard goes beyond the Do Not Call Register Act. The Register Act prohibits sending marketing faxes to numbers registered on the Do Not Call Register (unless consent is given). The standard adds restrictions that apply regardless of registration: time limits, content requirements, opt out mechanism, and volume caps. A fax marketer could be compliant with the Do Not Call Register Act but still breach the standard if, say, it sends a fax to an unregistered number at 10pm on a Sunday.

The standard also interacts with the Telecommunications Act 1997, under which it is made. Part 27 of that Act contains the compliance and enforcement provisions, including civil penalties for contravening an industry standard. The Act also contains definitions of “fax marketing industry”, “marketing fax”, and “participants in a section of the fax marketing industry” that are incorporated by reference.

There is no reference in the standard to the Spam Act 2003, which deals with commercial electronic messages sent by email, SMS, or MMS. Fax transmissions are not email or SMS, so the Spam Act does not apply. The Privacy Act 1988 may be relevant if fax numbers constitute personal information and the sender collects or uses them for marketing. The standard does not address privacy directly, but the requirement to remove numbers from lists upon opt out aligns with privacy good practice.

For foreign fax advertisers, the standard requires an “equivalent business number identification”. This will typically be a company registration number, tax identification number, or similar. Foreign companies must also ensure compliance with Australian time zones and consent requirements, even if their home jurisdiction has different rules.

This instrument is the second iteration of the fax marketing industry standard. It repeals and replaces the Fax Marketing Industry Standard 2011 (F2011L00668). The replacement was made on 26 August 2021 and commenced the day after registration. There have been no subsequent amendments to the 2021 standard as at the time of this analysis. The 2011 standard contained similar but not identical provisions. The key changes are likely in the area of technical updates to definitions (e.g., referencing the current version of the Do Not Call Register Act definitions) and potentially the volume cap of ten per 24 hour period - that provision did not appear in the 2011 standard in the same form. Without access to the repealed standard, a detailed comparison is not possible from the source alone, but the change is significant: the 2011 standard did not include an express numeric limit. The 2021 standard also clarifies the opt out address requirement by specifying both a fax number and at least one other channel.

No litigation is noted in the instrument itself. Because the standard is relatively new (commenced late 2021), there are no reported cases on its specific provisions. However, the ACMA’s enforcement of the predecessor 2011 standard may have involved administrative actions or court proceedings under the Telecommunications Act, but those are not referenced. The potential for disputes lies in the interpretation of “reasonable efforts” in the volume cap and in the definition of “reasonably likely to be capable of receiving opt out messages at all times”. A sender could be challenged if its opt out phone line is frequently busy or its fax machine runs out of paper. The consent exception is also a likely subject of enforcement: a sender relying on implied consent under the Do Not Call Register Act must be prepared to argue that the consent was valid. The ACMA may take a strict view, and the reverse onus of proof imposed by s 8(3)(c) means senders must maintain robust consent records.

Several traps exist in the wording of the standard that could catch an unwary sender.

First, “fax” in the standard means only “marketing fax”. A sender must determine whether a particular fax falls within the Act’s definition of “marketing fax”. Sending an invoice, a confirmation, or a personal message is not covered. But if the fax includes any promotional content - even a footnote advertising a special offer - it may become a marketing fax subject to the rules. The line between administrative and marketing messages is not bright. Senders should err on the side of treating borderline faxes as marketing faxes.

Second, the time restrictions are anchored to the “usual address of the relevant account holder”. If the sender does not know where the recipient is located, it cannot reliably determine whether the fax is sent at a permitted time. A sender that sends to a mobile number that can receive faxes (e.g., via an app) may not know the time zone. Best practice is to identify the area code and map it to a location, or to restrict sending to business hours in the most common time zones.

Third, the opt out address must include a fax number plus at least one other channel (phone, email, or website). Providing only a fax number is non compliant. Similarly, the contact details of the fax advertiser must include a phone or fax number suitable for receiving calls during normal business hours “at the location of the fax advertiser”. For an advertiser in a different time zone, that may create practical difficulties for recipients.

Fourth, the volume cap of ten per advertiser per number per 24 hour period is qualified by “reasonable efforts”. This is not a strict liability cap. A sender that accidentally sends eleven due to a technical glitch may argue it made reasonable efforts. But repeated overruns will likely be seen as a failure to implement adequate systems. The cap is per advertiser, so if the sender broadcasts for two different clients, each can send up to ten - meaning the recipient could receive twenty faxes in 24 hours from two different advertisers, but each advertiser’s ten are separate.

Fifth, the consent exception under s 8(3) only applies to the time restrictions. It does not exempt the sender from the content, opt out, or volume rules. Consent to receive faxes at 2am does not excuse the sender from including the ABN or providing an opt out.

Sixth, the requirement to remove a number from “any list of Australian numbers used by the sender to arrange for the sending of faxes on behalf of the fax advertiser” within seven days is narrower than it appears. The sender must remove it only from lists used for that advertiser. If the sender broadcasts for multiple advertisers, the opt out from one advertiser does not trigger removal for others. The recipient must opt out separately from each advertiser.

Seventh, the standard does not contain a transitional period. It takes effect the day after registration. Businesses still using fax marketing should have reviewed their practices immediately upon commencement.

A participant in the fax marketing industry needs a systematic approach to meet the standard’s requirements. The following steps cover the core obligations.

1. Determine the relevant actor. If your business commissions fax campaigns, you are a fax advertiser. If you physically transmit faxes, you are a sender. Many businesses are both. Document your role and the role of any third party broadcasters.

2. For senders, implement a scheduling system that checks the time of sending against the recipient’s address time zone. Configure the system to block transmissions before 9am and after 8pm weekdays (recipient local time), before 9am and after 5pm Saturdays, and all day Sunday and the seven listed public holidays (including lieu days). Include logic for holidays that vary by state (e.g., Easter Monday is a public holiday nationwide, but some states have unique holidays; the standard lists only the named days, but state laws may add more - see s 12). The system should default to blocking these periods unless you have recorded consent from the relevant account holder or nominee.

3. If relying on the consent exception, obtain and record consent that complies with Schedule 2 to the Do Not Call Register Act. Consent must be express or implied, and you must be able to prove it if the ACMA asks. Keep a timestamped record of the consent, the identifier of the consent giver, and the scope (the specific times and days consented to). Do not assume consent from a general relationship or from an existing business customer unless it meets the implied consent test (e.g., the customer provided the fax number and did not object when the relationship was established).

4. For every marketing fax, include on the first page: the fax advertiser’s name, ABN (or foreign equivalent), contact details (phone or fax number capable of receiving calls during normal business hours at the advertiser’s location, plus street address, postal address, or email), the full destination number, an opt out instruction (e.g., “To opt out of future faxes from [advertiser], send a fax to [fax number] or email [email] or visit [website].”), and the opt out address. All text must be at least 10 point font and legible. Use a standard header block that is populated for every fax.

5. Set up the opt out address. You must have a fax number dedicated to receiving opt out messages (or a system that can process faxes to that number as opt outs) and at least one alternative channel: a local or toll free phone line with voicemail or operator, an email address, or a website form. Monitor all channels 24/7 or at least daily; the standard requires it to be “reasonably likely to be capable of receiving opt out messages at all times”. An automated response confirming receipt is good practice.

6. Process opt outs within seven calendar days. Remove the recipient’s number from all lists used to send faxes on behalf of the relevant fax advertiser. If the opt out relates to a specific advertiser, remove from only that advertiser’s lists. Maintain a suppression file and ensure it is applied before each send.

7. Implement a volume cap: no more than ten faxes per advertiser per Australian number per 24 hour period. This requires tracking the number of faxes sent by each advertiser to each number. Use a database or CRM that logs the count and prevents additional sends if the limit is reached. “Reasonable efforts” means you should have automated controls; manual checking is not sufficient for high volume operations.

8. Train staff on these obligations and audit compliance regularly. Maintain records of schedules, consent, opt out requests, and volume logs for at least the relevant limitation periods (typically 2-3 years for civil penalty matters).

9. For fax advertisers that outsource sending, contractually require the sender to comply with the standard. However, the advertiser remains responsible for its name and ABN being correct and for not authorising faxes that exceed the volume cap. The advertiser should also hold its own opt out records for each fax number it supplies to the sender.

10. Check state and territory laws for additional restrictions. For instance, some states regulate unsolicited faxes under fair trading legislation or specific telemarketing codes. Compliance with the Commonwealth standard does not guarantee compliance with state laws, and s 12 permits concurrent operation.
