What it does
This instrument is a ministerial declaration, made under subsection 366(2) of the Telecommunications Act 1997. The operative text states: "I, RICHARD KENNETH ROBERT ALSTON, Minister for Communications and the Arts, under subsection 366(2) of the Telecommunications Act 1997, declare that, for the purposes of section 366 of that Act, the conventions specified in the Schedule are binding in relation to persons that are carriers or carriage service providers within the meaning of that Act." Dated 18 June 1997, the declaration attaches a Schedule of thirty-nine international conventions, agreements and instruments to the statutory mechanism in section 366.
Mechanically, the declaration does two things and only two things in the four lines of operative text. First, it invokes the power in s 366(2) of the Telecommunications Act 1997 to make a declaration. Second, it specifies a list of international instruments which, by the declaration, become "binding in relation to persons that are carriers or carriage service providers" for the statutory purposes set out in s 366. The instrument therefore does not itself restate treaty obligations, create offences, or set penalties. It makes particular international instruments relevant and binding within the statutory construct identified by the Act.
The Schedule contains a variety of treaties: telecommunications-specific instruments (for example the ITU Constitution and Administrative Regulations, INTELSAT and INMARSAT agreements and operating agreements, the Distribution of Programme-Carrying Signals convention), maritime and environment treaties (Law of the Sea, London Convention on dumping, MARPOL-adjacent instruments), space treaties (Registration of Objects Launched into Outer Space, Liability for Damage caused by Space Objects), search-and-rescue instruments (COSPAS‑SARSAT), trade and tariff instruments (WTO Agreements including the Information Technology Agreement and Group on Basic Telecommunications), and several regional/environmental/migratory species agreements. The Schedule entries include the treaty title, place done and date, and, where appropriate, notes that the instrument is "as amended" to a particular year (for example, the ITU instruments "as amended by the 1994 Amendments", INTELSAT as amended by the 1994 Amendment).
