What it does
This legislative instrument sets the monetary charge to be paid on an application for a carrier licence. It is titled the Telecommunications (Carrier Licence Charges) (Application) Determination 2022 (the Determination) and is made under subsection 9(1) of the Telecommunications (Carrier Licence Charges) Act 1997 (the parent Act) (s 1; s 3). The operative provision is short and direct: “The amount of charge imposed on an application for a carrier licence is $2,862” (s 4). The Determination therefore operates as a delegated-pricing instrument that fixes the application fee for a particular statutory permission, namely a carrier licence as defined by the parent Act and, by reference, the Telecommunications Act 1997 (note to s 4).
The compilation’s endnotes record how and when the Determination entered the Federal Register. The instrument was registered on 23 September 2022 and commenced on 1 October 2022 (Endnote 3). The endnotes also record an amending instrument, the Telecommunications (Carrier Licence Charges) (Application) Amendment Determination 2025 (No. 1), registered 8 August 2025 and commencing 9 August 2025 (Endnote 3). The amendment history table in the endnotes records that s 4 was amended by F2025L00910 (Endnote 4). The compilation also shows that s 2 of the Determination was repealed (labelled “s.2 … rep. LA 48D” in the amendment history table) (Endnote 4).
Mechanically, the Determination does three things and only three things in its operative text: (1) names the instrument (s 1), (2) states the statutory authority under which it is made (s 3), and (3) sets the dollar amount payable on a carrier licence application (s 4). The note to s 4 clarifies that “carrier licence” is to be understood by reference to the definitions in the Telecommunications (Carrier Licence Charges) Act 1997 and, by extension, the Telecommunications Act 1997. The instrument contains no procedural rules for payment, no schedules of exemptions, no provisions on refunds, and no enforcement or penalty clauses; those matters, if present, would be found in the parent Act or other instruments, not in this Determination (s 4; note to s 4).
