##### 348 Enforcement of AUSTEL directions (1) This section applies where a carrier: (a) has engaged in conduct that involves; or (b) proposes to engage in conduct that would involve; a contravention of a direction. (2) The Minister or AUSTEL may apply to the Federal Court for: (a) if paragraph (1)(a) applies—an injunction, a declaration or both; or (b) if paragraph (1)(b) applies—an injunction. (3) Section 395 applies to an application under this section. (4) Where the Minister or AUSTEL applies under this section for an injunction, the Federal Court must not require the applicant or any other person, as a condition of granting an interim injunction, to give an undertaking as to damages.
