##### 345 Protection from civil actions (1) Civil proceedings do not lie against a person in respect of loss, damage or injury of any kind suffered by another person because of any of the following acts done in good faith: (a) the making of a complaint under section 334; (b) the making of a statement to, or the giving of a document or information to, AUSTEL in connection with an investigation under section 335; or (c) the making of a complaint to the Telecommunications Industry Ombudsman; or (d) subject to subsection (2), the making of a statement to, or the giving of a document or information to, the Telecommunications Industry Ombudsman in connection with the consideration by the Telecommunications Industry Ombudsman of a complaint. (2) Paragraph (1)(d) does not apply to the making of a statement, or the giving of a document or information, by: (a) a carrier; or (b) a person who supplies an eligible service and who is participating in the Ombudsman scheme under which the Telecommunications Industry Ombudsman has been appointed.
