##### 237 Carrier may refuse to supply basic carriage service not included in its BCS tariff (1) A carrier may refuse or fail to supply to another person a basic carriage service that is not included in the carrier’s BCS tariff, even if the carrier supplies a basic carriage service of the same kind for use by the carrier for or in relation to its supply of a basic carriage service. (2) Without limiting subsection (1), a carrier may refuse or fail to supply a facility of a particular kind to another person, unless supply of a facility of that kind is a basic carriage service included in the carrier’s BCS tariff. (3) Without prejudice to their effect under section 238, subsections (1) and (2) of this section have effect subject to: (a) Part 8; and (b) a direction under section 181; and (c) section 234.
