47 Appointments to positions generally
> > (1) The Secretary may, subject to section 47A, appoint to positions in the Teaching Service—
> >
> > > (a) persons who are accredited under the [Teacher Accreditation Act 2004](/view/html/inforce/current/act-2004-065), or
> >
> > > (b) persons who have, in the opinion of the Secretary, the appropriate qualifications to be employed in the Teaching Service.

> > (1A) Where—

> > > (a) an appointment to a position in the Teaching Service (other than a senior position) is to be made under subsection (1), and
> >
> > > (b) an Aboriginal and a person who is not an Aboriginal, each of whom is eligible to be appointed to the position, are offering themselves for appointment to the position,

> > the Secretary shall give preference to the Aboriginal or, if there are 2 or more such Aborigines, give preference to any one of them by appointment to that position.
