Teacher Registration (General) Regulations 2012

The Regulations operationalise a set of recurring regulatory concepts from the Teacher Registration Act 2012 by prescribing precise thresholds, timeframes and forms. Key concepts turned into regulatory mechanics include actionable offence, criminal history check, educational program, categories of registration (full, provisional, limited), English competence, limited registration conditions, renewal criteria, register content, employer cooperation, and the Board’s administrative powers.

Actionable offence and criminal history checks

• Regulation 4 prescribes actionable offences for the Act’s definition by reference to Class 1 and Class 2 offences under the Working with Children (Screening) Act 2004 (r 4(2)(a)-(b)). That links teacher registration fitness processes to the statutory screening categories used elsewhere in child‑safety regimes.
• Regulation 5 prescribes the Australian Crime Commission as a body whose records may be used in criminal history checks for registration (r 5). The Regulations therefore tie the teacher registration regime to Commonwealth criminal intelligence mechanisms.

Educational program and non‑teacher exclusions

• Regulation 6 lists prescribed curricula that satisfy the Act’s educational program definition, including the Early Years Learning Framework and courses and accreditation by the School Curriculum and Standards Authority and the International Baccalaureate (r 6). This governs what counts as curricular teaching for registration purposes.
• Regulations 7 and 8 specify when unpaid volunteers "teach" for registration purposes and who is excluded from the Act’s teaching definition (for example, some early childhood educators unless they are early childhood teachers, and VET assessors/trainers for approved courses) (rr 7-8). These carve‑outs affect whether persons must be registered.

English language competence

• Regulations 10 and 11 translate statutory English‑language requirements into measurable tests (IELTS Academic) with numerical cutoffs: an average of 7.5 across four components, no component below 7, and at least an 8 in speaking and listening for full or provisional registration, subject to Board discretion for exceptional circumstances (r 10(2)-(4)).
• Regulation 11 extends similar and alternative pathways for limited registration, includes an express provision for positions teaching in languages other than English (r 11(4)), and an special rule for teaching in indigenous languages where local Aboriginal or Torres Strait Islander status and employer satisfaction substitute for formal English testing (r 11(6)).

Registration categories, renewal and conditions

• Regulation 12 sets the board’s opinion‑based pathways (teaching qualification, relevant higher education award, subject expertise, current enrolment in an accredited program, or completion of course requirements) to meet the limited registration eligibility test in the Act (r 12(2)).
• Regulation 13 prescribes renewal thresholds measured by teaching days and professional learning hours (100 days/100 hours for full registration; 60 days/60 hours for three‑year provisional/limited renewals; pro rata rules for shorter periods) and preserves Board discretion to waive requirements if sufficient reasons exist (r 13(2)-(5)).
• Regulation 17 makes a limited registration subject to a condition restricting the teacher to duties required by the position (r 17).

Administrative mechanics and data

• Regulation 21A prescribes additional register fields , date of birth, gender, expiry, last "fit and proper" determination, conditions, current employing institutions (as known), date annual fee is next payable, and whether the teacher has automatic deemed registration under mutual recognition rules (r 21A(2)(a)-(f), (h)). That choice of fields signals a focus on public accountability, fee administration and mutual recognition status.
• Regulation 24 prescribes retention of criminal history checks obtained from the Australian Crime Commission for 7 years measured from the last communication with the person (r 24).
• Regulation 20 allows, but does not mandate, a registration card system and specifies mandatory card fields if implemented (r 20).

Enforcement‑adjacent instruments

• Schedule 2 prescribes forms for notices from the Commissioner of Police and Director of Public Prosecutions to the Board under s 41/41A/41B of the Act (Forms 1-3), including a confidentiality flag in Form 3 referencing the Evidence Act 1996 s 36C.
• Regulation 26 sets strict content requirements for employer notices to the Board when a teacher ceases for reasons of serious incompetence or misconduct, and enumerates public authorities that should be notified (r 26(1)(a)-(j); r 26(2)).

Fees and economic levers

• Schedule 1 fixes application, renewal, criminal check and annual fees, plus late‑payment and replacement card fees. It also prescribes a non‑refundable fee for advisory services and a fee credit mechanism reducing application fees where prior advice was obtained within two years (Schedule 1; rr 19(3)(b), 28(3)).

Across these concepts the Board is the decision maker for many discretionary determinations , equivalence, fitness, exceptional circumstances, suitability for a particular post. The Regulations both constrain and empower the Board: they set precise quantitative thresholds where desirable (IELTS, days, hours, fees) and leave subjective areas (recognition of overseas qualifications, "fit and proper") to Board judgement. That allocation of tasks shapes incentives for applicants, employers and the Board itself and concentrates compliance costs in applicant testing, employer reporting, and record‑keeping.

The Regulations allocate obligations and costs across several identifiable groups: individual teachers (registered and applicants), prospective nominees for limited registration, employers and educational institutions, the Teacher Registration Board, police and prosecuting authorities, and, less directly, students and the public through record disclosure.

Individual applicants and registered teachers

• Applicants for provisional, full or limited registration are the primary cost‑bearers of the regime. Schedule 1 lists fees payable by applicants for applications and renewal (Schedule 1 items 1-5B; r 28(2)). Applicants who studied outside Australia/New Zealand face higher processing fees for some categories (Schedule 1 items 1(c), 2(c)). Applicants seeking advisory opinions pay fees (Schedule 1 items 11-12; r 19(3)).
• Teachers holding registration pay annual fees (Schedule 1 item 6; r 28(4)). They must notify changes to name, postal or email address, or telephone number within 30 days or face a penalty (r 27A(1) and penalty). Registered teachers are also the subject of entries in the public register, which will record DOB, gender, expiry and conditions (r 21A(2)(a)-(d)).

Nominees for limited registration and exchange participants

• Persons offered limited registration or employed as nominees of employers are affected by eligibility tests in r 12 and the condition limiting scope at r 17. Exchange program participants may be exempt from fees for limited registration where the Board has approved the exchange (Schedule 1 item 3(a)-(b)).

Employers and educational institutions

• Employers are obligated to provide, on written request from the Board, lists of who is employed to teach at specified institutions and, optionally, terms of employment and position duties; they must comply within 14 days (r 25(1)-(3)). The penalty for non‑compliance is a fine of $1,000 (r 25(3) penalty). Employers must also give detailed notices when a teacher ceases for reasons of serious incompetence or misconduct; r 26 specifies mandatory contents of such notices (r 26(1)(a)-(j)).
• Employers also have a role in confirming suitability for indigenous language positions under r 11(6)(b), where the applicant informs the Board that the employer (or the applicant) is satisfied the nominee’s English skills are suitable.

Teacher Registration Board

• The Board makes many determinations: equivalence of qualifications (r 12(2)(a)), whether a person is "fit and proper" for registration (r 19(2)(b)), decisions on exceptional circumstances for English skills (rr 10(4), 11(5)), whether renewal requirements should be waived (r 13(5)), and whether limited registration conditions should be modified or cancelled (Schedule 1 item 5B). The Board also implements the register and may implement a registration card system (r 20). The Board can require statutory declarations for verification (r 27).

Police and prosecutorial authorities

• The Commissioner of Police and the Director of Public Prosecutions have prescribed notice formats (Schedule 2 Forms 1-3) to notify the Board of charges, convictions, identifying information, and related matters under ss 41, 41A and 41B of the Act (rr 27AA-27AB; Schedule 2). Form 3 carries an express Evidence Act 1996 s 36C confidentiality note.

Public and students

• The register fields in r 21A and the details employers must provide under r 25 mean that data about teacher status, registration conditions, expiry and institution will be administratively available in the Board’s systems. That impacts parents and students indirectly because employer and Board reporting determines when the Board becomes aware of serious incompetence or misconduct.

Other public bodies

• The Regulations reference other Commonwealth and State laws: Working with Children (Screening) Act 2004 (for Class 1/2), Mutual Recognition and Trans‑Tasman principles (r 3), School Curriculum and Standards Authority and Education and Care Services national law/regulations (r 6, r 8). Those bodies interact with the Board’s determinations and information flows.

Who decides and who pays

• The Board decides on equivalence, suitability and discretionary waivers; applicants and teachers pay application and annual fees; employers face compliance costs in furnishing lists and mandatory notices and may pay the $1,000 penalty for non‑compliance; police and the DPP must use prescribed forms to notify the Board. The Regulations therefore allocate decision authority to the Board and data/provision obligations to employers and applicants, with concrete monetary charges specified in Schedule 1.

This section sets out the principal duties the Regulations create, and the corresponding rights or discretions of the Board and other actors. Each duty is stated with its regulatory source and practical consequence.

Duties imposed on teachers and applicants

• Notification duty: Registered teachers must give written notice to the Board of any change to name, postal or email address, or telephone number within 30 days; failure attracts a fine of $1,000 (r 27A(1)-(2)). This creates an ongoing administrative obligation post‑registration.
• Renewal evidentiary duties: For renewal, teachers must meet teaching time and professional learning activity thresholds set out in r 13 (100 days/100 hours for full registration; 60 days/60 hours for three‑year provisional/limited renewals; pro rata for shorter periods). The teacher must hold evidence sufficient for the Board to be satisfied (the Board’s power to make determinations is implicit in r 13 and r 19).
• Criminal history consent and retention: Teachers and applicants consent to criminal history checks from prescribed bodies (r 5), and the Board retains such checks from the Australian Crime Commission for 7 years from last communication with the person (r 24).

Duties on employers

• Provision of lists and information: Employers must provide, on written request, either a list of all persons currently employed to teach at specified educational institutions or specified information about individual teachers (terms and conditions or duties) within 14 days. The employer’s list must show each person’s name, date of birth and either category and registration number or the reason for non‑registration (r 25(1)-(3)). Penalty: $1,000 (r 25(3)).
• Notice on ceasing to teach: When a teacher ceases teaching in circumstances of serious incompetence or misconduct, the employer must give the Board a detailed notice containing name, registration number, dates and locations of suspected conduct, employer investigation dates and outcomes, whether public authorities have been notified, and contact details for the employer (r 26(1)(a)-(j)). The Regs also specify relevant public authorities that should be identified (r 26(2)).

Duties on the Board

• Advisory duty and fee: The Board may provide written advice on whether a qualification meets registration requirements and whether a person, on the facts presented, would be a fit and proper person. The Board may do so on payment of fees and must charge the fees in Schedule 1 for that service; that fee is not refundable (r 19(2)-(4); Schedule 1 items 11-12). If the applicant applies for registration within two years of receiving advice, the application fee is reduced by the amount paid for advice (r 28(3)).
• Register maintenance and data recording: The Board must record the additional information set out in r 21A(2), including DOB, gender, expiry date, date last determined "fit and proper", conditions and employing institutions, among other items.
• Registration card implementation: If the Board implements a registration card system, it must ensure cards are issued at commencement and on each grant or renewal and include specific fields (r 20(1)-(4)).
• Discretionary powers: The Board has subjective decision rights: to recognise overseas qualifications as equivalent (r 12), to accept alternative evidence of English competence under exceptional circumstances (rr 10(4), 11(5)), to waive renewal requirements where sufficient reasons exist (r 13(5)), and to require statutory declarations verifying supplied information (r 27). These are rights the Board may exercise, not duties.

Rights and protections for applicants

• Fee credit and advice: Applicants who obtain prior advice about qualification requirements or fitness to be registered may have the application fee reduced if they apply within two years (r 28(3)).
• Confidentiality note for DPP notices: Form 3 (Schedule 2) expressly flags that information is subject to the Evidence Act 1996 s 36C and is not for publication, creating a prescribed confidentiality expectation in prosecutorial notifications.

Operational consequences (behaviour change)

• Applicants will either incur the costs of testing (IELTS within 2 years if required; rr 10-11) or rely on Board discretion and country‑of‑study routes; they must prepare documentary evidence to establish teaching days and professional learning for renewals (r 13).
• Employers must institute record‑keeping and prompt reporting processes to meet 14‑day response obligations and the detailed notice requirements when serious misconduct occurs (rr 25-26).
• The Board must maintain data, handle criminal history records for 7 years (r 24), and be prepared to provide and price advisory opinions, manage registration cards where implemented, and exercise discretion in equivalence and fitness determinations.

In sum, the Regulations create a compliance architecture that combines numeric thresholds (IELTS scores, days/hours, fees), documentary obligations (register fields, statutory declarations, notice contents), and Board discretion, which together determine the administrative burdens and procedural rights for teachers and employers.

The Regulations specify a limited set of civil penalties and create procedural enforcement levers through obligations on employers, teachers, and record‑keeping, with administrative remedies executed by the Board.

Monetary fines and penalties

• Employer non‑compliance: An employer who does not comply with a Board request for information under r 25 must face a penalty, explicitly a fine of $1,000 (r 25(3) penalty).
• Failure to notify: A registered teacher who does not give written notice of changes to registration details within 30 days is liable to a fine of $1,000 (r 27A(1) penalty).

Fees as economic enforcement

• The Fees schedule (Schedule 1) operates both as revenue and as behavioural levers: application fees, renewal fees, criminal history check fees, late payment processing fee and other fees are prescribed and payable by applicants and registered teachers (r 28; Schedule 1). Late payment is specifically channelled via a late payment processing fee that allows the Board to accept payment within a one‑month window (r 28(5); Schedule 1 item 9).
• Replacement card fees and fees for advisory services operate as costed deterrents or cost pass‑throughs to manage demand for Board services (Schedule 1 items 10, 11, 12).

Administrative enforcement mechanisms

• Register entries and conditions: The Board’s recording of additional register data, including conditions imposed on registration and the date of last "fit and proper" determination (r 21A(2)(c)-(d)), is an enforcement mechanism that can affect a teacher’s ability to obtain or retain employment. Conditions imposed under the Act, recorded under r 21A(2)(d), are enforceable through the Act’s disciplinary provisions.
• Notices from police and DPP: The Regulations prescribe forms (Schedule 2) for notices under ss 41, 41A and 41B of the Act (rr 27AA-27AB; Schedule 2). These notices trigger the Board’s investigative and disciplinary machinery under the Act. Form 3 expressly carries the confidentiality flag referencing the Evidence Act (Schedule 2 Form 3), which constrains publication but not necessarily internal disciplinary use.

Record‑retention and data controls

• Criminal history checks from the Australian Crime Commission must be retained for seven years from the day the Board last communicated with the person (r 24). That retention period creates a window during which past checks remain available to the Board as enforcement evidence for future disciplinary or fitness assessments.

Board discretion and procedural enforcement

• The Board can require statutory declarations to verify applicant information (r 27), which is an enforcement tool to counter false or misleading statements.
• The Board has discretion to waive renewal requirements where "sufficient reasons" exist (r 13(5)). The exercise of this discretion is an administrative enforcement choice that affects whether a teacher loses registration for non‑compliance with renewal metrics.

Cross‑reference to other enforcement regimes

• By prescribing actionable offences as Class 1 and Class 2 under the Working with Children (Screening) Act 2004 (r 4(2)), the Regulations link teacher registration enforcement to the working‑with‑children screening framework. Notifications to the Working with Children Screening Unit are prompted in Form 1 (Schedule 2 Form 1 asks whether the matter has been reported).
• Regulation 26 requires employers to identify relevant public authorities that have been notified of suspected misconduct, for example the Commissioner of Police and the Corruption and Crime Commission (r 26(2)(a)-(b)), creating a cross‑agency reporting interface.

Limits on enforcement actions in the Regulations themselves

• The Regulations do not create criminal offences beyond the fines stated; most disciplinary enforcement, suspensions and cancellations are governed by the Act’s Part 5 machinery and notifications provided for in the Regulations. The Regulations provide forms, content requirements and timelines that channel how enforcement evidence is produced and shared with the Board and other authorities.

Practical enforcement risks

• Timeliness constraints (14 days for employer responses; 30 days for teacher notifications) mean failure to comply quickly can attract monetary penalties or be used as evidence in disciplinary contexts. The Board’s broad discretionary powers (equivalence, fitness, exceptional circumstances) also mean enforcement outcomes may be highly fact‑specific and dependent on the Board’s administrative processes.

These Regulations do not operate in isolation. They explicitly reference and integrate multiple Commonwealth and State statutes, align certain definitions with other regulatory frameworks, and create data and reporting flows to other public bodies.

Direct statutory cross‑references

• Working with Children (Screening) Act 2004: Regulation 4 imports the Class 1 and Class 2 offence definitions used in that Act when prescribing actionable offences for the Teacher Registration Act (r 4(1)-(2)). That aligns teacher registration actionable‑offence standards with the State’s child‑safety screening framework.
• Australian Crime Commission/Commonwealth bodies: Regulation 5 prescribes the Australian Crime Commission as a prescribed body for criminal history checks; a note indicates the Commission is now known as the Australian Criminal Intelligence Commission under Commonwealth regulations (r 3 note; r 5). The Board therefore relies on Commonwealth criminal intelligence infrastructure for vetting.
• Mutual Recognition Acts and Trans‑Tasman principle: Regulation 3 defines "mutual recognition principle" and "Trans‑Tasman mutual recognition principle" by reference to the Commonwealth Acts and their WA adoptions, and r 21A(2)(h) records whether a teacher has automatic deemed registration under mutual recognition (r 3; r 21A(2)(h)). This links registration treatment to inter‑jurisdictional occupational mobility regimes.
• School Education Act 1999 and School Curriculum and Standards Authority: Regulation 3 defines "school" by reference to s 4 of the School Education Act 1999; r 6 prescribes curricula and references courses and accreditation decisions made under the School Curriculum and Standards Authority Act 1997 (r 3; r 6). This ensures curricular matters are co‑ordinated with the State curriculum authority.
• Education and Care Services National Law and Regulations: Regulation 6 and r 8 cross‑refer to the national early childhood learning framework and the definition of an educator in the Education and Care Services National Law (rr 6, 8). That determines whether certain early‑childhood staff are within the teacher registration remit.
• Vocational education laws and Standards for RTOs: Regulation 8 excludes assessors and trainers delivering approved VET programs from the Act’s "teach" definition (r 8). The exclusion uses definitions from the National Vocational Education and Training Regulator Act 2011 and the Vocational Education and Training Act 1996, aligning teacher registration boundaries with VET regulation.
• Tertiary Education Quality and Standards Agency Act 2011: Regulation 12 borrows the terms "higher education award" and "overseas higher education award" from the TEQSA Act for limited registration pathways (r 12(1)).
• Corruption, Crime and Misconduct Act 2003, Parliamentary Commissioner Act 1971, Children and Community Services Act 2004: Regulation 26 lists these agencies as "relevant public authority" examples that employers should identify when reporting suspected misconduct (r 26(2)(a)-(f)).
• Evidence Act 1996: Schedule 2 Form 3 explicitly states information is subject to Evidence Act s 36C and is not for publication, indicating evidentiary and publication constraints on prosecutorial notifications to the Board (Schedule 2 Form 3).

Functional interactions and data flows

• Criminal history checks and the Working with Children screening system interface: the Regulations create an expectation that actionable offences reported to the Board will overlap with matters reported to the Working with Children Screening Unit (Schedule 2 Form 1 asks whether the matter has been reported). This produces parallel data flows between police, screening units and the Board.
• Mutual recognition and automatic deemed registration: r 21A(2)(h) requires the register to record automatic deemed registration, which will affect a teacher’s lawful ability to teach in WA under mutual recognition regimes, tying the Board’s data to interstate registration statuses.
• Curriculum recognition and registration scope: r 6’s list of prescribed curricula ensures that teaching in recognised programs administered by the School Curriculum and Standards Authority or the International Baccalaureate is captured for registration purposes, linking teacher obligations with curriculum accreditation.

Regulatory boundary with VET and early childhood regimes

• By excluding many VET assessors/trainers and certain early childhood educators from the definition of "teach" (r 8), the Regulations carve out non‑teacher occupational groups and avoid double regulation. That boundary can generate interface issues for entities that straddle schooling, early childhood care and VET delivery.

Administrative law and confidentiality

• The Board’s discretion under multiple provisions (equivalence, fitness, exceptional circumstances) will be subject to administrative law review principles under general WA administrative law, but the Regulations themselves do not prescribe review bodies or appeal routes. Form 3’s Evidence Act reference creates an evidentiary limitation on publication but not necessarily on internal or administrative use.

Overall, the Regulations deliberately weave teacher registration into the State and Commonwealth legal fabric: screening and criminal history infrastructures, mutual recognition principles, curriculum authorities, VET and early childhood laws, and prosecutorial notification practices. Practitioners should note that many operational questions (evidence sufficiency for "fit and proper", equivalence judgments) will require consult with the Board and, where contentious, may engage other statutory regimes listed above.

The Regulations have been amended repeatedly since their initial 2012 publication. The compilation table provided in the Regulation text summarises the amendment chronology and commencement dates. Key elements of that history are set out below.

Original instrument and commencement

• The Teacher Registration (General) Regulations 2012 were published as a Statutory Instrument on 16 November 2012 and largely came into operation on 7 December 2012, with rr 1 and 2 commencing on publication day (r 2 and compilation table).

Subsequent amendments and notable change waves

• 2013 amendments: Two amendment instruments appeared in 2013: an amendment on 7 May 2013 and a second amendment on 13 August 2013 (compilation table). The 13 August 2013 amendments included insertion of definitions and changes later referenced in the r 3 defined terms footnotes.
• 2014 amendments: Amendments were made in January and July 2014 (Gazette 28 Jan 2014 and 1 Jul 2014). The 28 January 2014 instrument inserted the Division 1 heading in Part 3 and added r 21A (additional register fields) in the same Gazette entry (as indicated by the annotations at r 21A).
• 2015 amendments: Two amending instruments in 2015 updated the Regulations (13 March and 12 June 2015).
• Fee and administrative amendments (2016-2018): Several instruments in 2016, 2017 and 2018 adjusted fees and charges applicable to education and training regulations (compilation table entries for 2016-2018).
• 2022-2024 amendment series: A cluster of recent changes includes:
  • Teacher Registration (General) Amendment Regulations 2022 (SL 2022/125) , commencement 1 July 2022, which altered defined terms (see r 3 amendments) and added other operational provisions (e.g., register fields r 21A(2)(f) and r 27A amendments).
  • Education Regulations Amendment (Fees and Charges) Regulations 2023 (SL 2023/67) and Teacher Registration Regulations Amendment Regulations 2023 (SL 2023/194) , the SL 2023/194 instrument (Pt 3) has multiple insertions and deletions across the Regulations and introduced or amended several current provisions (notably rr 4, 5, 6, 7, 8, 10-13, 17-21A, 24-29 and Schedule 1 pricing updates). The 2023 amendments are significant: they inserted rr 4 (prescribed actionable offences) and rr 24 (retention of criminal history checks) and updated fees in Schedule 1 (SL 2023/194 r 32).
  • Teacher Registration (General) Amendment Regulations 2024 (SL 2024/188) , commencement 19 September 2024. Noted as making further defined‑term changes (r 3) and updating Schedule 2 (Forms) at r 32.

Deletions and removals

• Several provisions have been explicitly deleted across amendment instruments (for example, r 9 was deleted by SL 2023/194 r 14; other provisions [14-16, 21B, 22, 29-34] are also noted deleted in the text). These deletions indicate re‑scoping of the regulatory content over time, including removal of obsolete or redundant mechanics.

Frequency and pattern

• The compilation table shows recurrent fee adjustments and operational clarifications timed with broader education regulations fee amendments (2016-2018, 2022-2024). Recent years, especially 2023-2024, show concentrated activity updating definitions, criminal‑history interaction, register fields and fee structures.

Implication for practice

• The amendment history demonstrates that many of the current procedural requirements (IELTS thresholds, retention periods, employer reporting obligations, register fields, prescribed actionable offences) are the result of discrete amending instruments rather than being present in the 2012 instrument. Practitioners should therefore check the current consolidated version of the Regulations and recent Government Gazettes to track potential further changes. The compilation table contained with the Regulations is the authoritative chronicle for commencement dates and amendment instruments and should be consulted when assessing which version applied at a given time.

The Regulations, as provided, contain no case law citations and the compiled text does not record judicial or tribunal decisions construing them. The Schedule of Forms and the Regulations themselves do not name or cite judicial authorities, nor do they summarise any litigation. Accordingly the following statements are strictly limited to what appears in the provided materials.

What the source shows

• The provided Regulations and compilation table include no litigation history entries and do not annotate amendments with references to court or tribunal decisions. They therefore do not record any judicial interpretations, challenges, or appeals arising from these Regulations.

Practical consequences for practitioners

• Absence of litigation references in the statutory compilation does not mean the Regulations have not been subject to judicial review or appeal; it only means the supplied instrument does not supply that history. Practitioners who advise on contentious issues , for example, Board decisions about "fit and proper" status, equivalence of overseas qualifications, or the exercise of discretion in waiving renewal requirements (rr 12, 13, 19) , should search case law databases, tribunal decisions and administrative law reports for relevant authorities since such matters are typically litigated by way of judicial review or merits review in administrative law contexts.
• Issues likely to generate litigation include:
  • Board determinations of equivalence or fitness to be registered (r 12; r 19(2)(b)).
  • Exercise of discretion in relation to English language exceptional circumstances (rr 10(4), 11(5)).
  • Enforcement or penalty disputes concerning employer non‑compliance with information requests (r 25) or teacher failure to notify changes (r 27A), though the monetary penalties specified are modest and may be resolved administratively.
  • Disputes about register entries and conditions recorded under r 21A and their implications for employment.

How to locate litigation

• Search points:
  • WA courts and tribunals: Supreme Court of Western Australia (judicial review), WA Civil and Administrative Tribunal (where applicable for merits review).
  • Administrative law reporters and case law databases for decisions involving the Teacher Registration Board of WA, particularly decisions addressing ss of the Teacher Registration Act 2012 that are operationalised by these Regulations.
  • Decisions regarding cross‑referenced regimes (Working with Children screening appeals, mutual recognition automatic deemed registration disputes) may also intersect with Board decisions under these Regulations.

Limitations of this section

• This "litigation history" section merely records that the supplied Regulations text does not include or cite litigation. It does not assert that there has been no litigation concerning these Regulations. It recommends that practitioners perform jurisdictional case law searches to locate any relevant decisions that interpret or apply these Regulations, especially around subjective Board powers and disciplinary outcomes.

This section flags pitfalls and counterintuitive mechanics set out in the Regulations that commonly generate compliance errors, disputes or unintended costs. Each point references the relevant regulation.

1. Board discretion is pervasive; numeric thresholds are not absolute

• Many important outcomes rest on the Board’s subjective assessments: equivalence of overseas teaching qualifications (r 12(2)(a)), whether an applicant is "fit and proper" (r 19(2)(b)), and whether exceptional circumstances justify accepting English language skills outside the IELTS thresholds (rr 10(4), 11(5)). Practitioners should not assume that meeting one criterion ensures Board approval; the Board’s opinion is decisive.

2. IELTS timing and score traps

• The Regulations require IELTS Academic scores within two years of the application, and very specific component thresholds (average 7.5, no component below 7, and speaking/listening 8 for full/provisional registration) (r 10(2)). Applicants who present older test results or different test formats will need to rely on alternative country‑of‑study pathways or Board discretion. For limited registration, the Board retains a route to accept language proficiency where the role requires another language, but the Board must still be satisfied in writing (r 11(4)-(5)).

3. Fee structure asymmetries and credits

• Application fees differ by source of qualification and by registration category, with higher fees for overseas qualifications from countries other than Australia or New Zealand (Schedule 1 items 1(c), 2(c)). Applicants who paid for Board advice may have part of their application fee credited only if they apply within two years (r 28(3)). The advice fee itself is non‑refundable (r 19(4)). Misunderstanding these interlocks can produce unexpected outlays.

4. Limited registration scope is constraining

• Limited registration is explicitly conditioned to allow teaching only the duties required for the offered position (r 17). A teacher who assumes limited registration permits general classroom duties may be out of compliance if their duties expand beyond the position description.

5. Employer obligations carry short timeframes and a fixed fine

• Employers must provide lists or specified information within 14 days of a written request (r 25(3)); failure attracts a $1,000 fine. The 14‑day window is short for employers with distributed workforces; record‑keeping systems should be prepared to produce name, DOB and registration status information quickly.

6. Mandatory content for notices on cessation for serious incompetence/misconduct

• When a teacher ceases for serious incompetence or misconduct, the employer’s notice must include detailed dates, locations, investigation dates, whether public authorities were notified, and contact details (r 26(1)(a)-(j)). Omitting any element could generate follow‑up inquiries and delay Board handling of the matter.

7. Criminal history retention timeline begins from "last communication"

• Regulation 24 requires the Board to retain ACC criminal history checks for 7 years from the day on which the Board last communicated with, or received communication from, the person (r 24). That phrasing means the retention clock resets on any subsequent communication. Practitioners relying on an assumed fixed retention window from the check date may be mistaken.

8. Registration card system is optional

• The Board need only implement a registration card system "if" it chooses to (r 20(1)). Therefore, registered teachers cannot assume there will be a physical card unless the Board notifies system commencement. Where cards are implemented, they must contain specific fields and replacement cards carry a fee (r 20(3)-(4); Schedule 1 item 10).

9. Mutual recognition implications recorded on the register

• The register records whether a teacher has "automatic deemed registration" to teach in the State pursuant to mutual recognition rules (r 21A(2)(h)). Practitioners should note that interstate practising rights are captured in the register and may affect enforcement or eligibility assessments.

10. Formality traps with police and DPP notices

• Notices from the Commissioner of Police and DPP must use prescribed forms (rr 27AA-27AB; Schedule 2). Form 3 explicitly signals evidence confidentiality under the Evidence Act (Schedule 2 Form 3). Where police or prosecutors deviate from prescribed formats, technical issues about whether the Board has been properly notified may arise.

11. Pro rata calculation nuances for provisional/limited renewals

• For provisional or limited registration last granted for less than 3 years, teaching and PL requirements are pro rated at 20 days and 20 hours per year (r 13(4)). Errors in calculating pro rata thresholds can lead to wrongly denied renewals.

12. Employer satisfaction vs Board satisfaction for indigenous language teaching

• For nominees teaching in an indigenous language, r 11(6)(b) permits the applicant to inform the Board that the employer is satisfied about a nominee’s English skills. The Regulation does not remove the Board’s overall discretion; evidence of employer satisfaction substitutes for formal testing only to the extent the Board accepts that representation.

These "gotchas" show where compliance is technically precise, time‑bound, or relies on discretionary assessments. Systems for document retention, communications logging, and pre‑application advisory checks materially reduce risk.

This section offers concrete steps for each affected party drawn from the Regulations. The goal is to turn requirements into checklists and system points that reduce operational and legal risk.

For applicants seeking registration (full, provisional, limited)

• Check the applicable category and fee: identify the correct Schedule 1 fee for your application type and qualification source before lodging (Schedule 1 items 1-3; r 28(2)). If you obtained Board advice about qualifications or fitness within the last two years, notify the Board to seek the fee reduction at application time (r 28(3)).
• English language readiness: if you do not qualify for an English‑language country pathway, complete IELTS Academic within two years of application and achieve the scores required for the category (r 10(2) for full/provisional; r 11(2) for limited). Retain certified test results and calculate validity periods against application date.
• Evidence of qualifications and equivalence: gather certified documentation for teaching qualifications or higher education awards. If relying on equivalence recognition, prepare course transcripts and descriptions to assist the Board’s assessment (r 12(2); r 19(2)(a)).
• Prepare renewal evidence: maintain records of teaching days/hours and professional learning activity hours. For full registration, evidence for at least 100 full working days and 100 PL hours is required since last renewal (r 13(2)). For provisional/limited, apply the 60 days/60 hours or pro rata rules as relevant (r 13(3)-(4)).
• Use Board advisory service if uncertain: consider paying for the Board’s written advice on qualification equivalence or fitness (r 19(2)-(4); Schedule 1 items 11-12). Remember this fee is non‑refundable but may reduce application fees if follow‑up occurs within two years (r 28(3)).

For registered teachers

• Update contact details promptly: adopt an internal reminder system to notify the Board in writing of any name, postal, email or telephone change within 30 days (r 27A(1)). Consider linking HR onboarding/offboarding processes to ensure compliance.
• Retain criminal history communications: when the Board requests or communicates criminal history checks, track the date of the last communication because the Board’s retention clock runs from that date (r 24). If you withdraw consent or lodge complaints, retain records of communications for your own defence.
• Maintain professional learning records: implement an evidentiary file for PL activity and teaching days to support future renewal claims (r 13). Use employer HR systems that timestamp work days and PL attendance.

For employers and educational institutions

• Prepare rapid response systems for Board requests: the Board’s written requests for lists or information must be complied with within 14 days (r 25(3)). Set internal service‑level agreements and maintain a centralised register capturing names, DOBs, registration categories, registration numbers and reasons for non‑registration to expedite responses (r 25(2)(a)-(b)).
• Draft standardised notice templates for serious incompetence/misconduct: r 26 specifies the mandatory content of notices (r 26(1)(a)-(j)). Create a template checklist that captures all required fields , alleged dates, locations, investigation start dates, dismissal/suspension dates, public authorities notified , and attach investigation reports and statements where available.
• Record employer satisfaction for indigenous language roles: where you employ Aboriginal or Torres Strait Islander persons to teach an indigenous language, prepare a formal statement that you (the employer) are satisfied as required by r 11(6)(b), and forward it with the application.
• Respond to police/DPP forms: if approached by police or prosecutors, ensure personnel use the prescribed Forms (Schedule 2) to notify the Board and retain copies as evidence of compliance (rr 27AA-27AB; Schedule 2).

For the Teacher Registration Board (administrative checklist)

• Decision records for discretion: when exercising discretion (equivalence, fit and proper, exceptional circumstances), document reasons in writing to provide an administrative record that supports decisions and assists with internal and external review (rr 10(4), 11(5), 12(2), 13(5), 19(2)(b)).
• Implement register fields and data quality controls: ensure register captures the fields listed in r 21A(2) , DOB, gender, expiry dates, dates of "fit and proper", conditions, employers, and mutual recognition status , and maintain data accuracy procedures for employer‑supplied information.
• Process for advisory services: if offering fee‑based advice under r 19, publish clear scoping guidance on what the advice covers, timelines for provision and the fee schedule (Schedule 1 items 11-12). Ensure advice letters expressly state whether they relieve applicants of any further Board inquiry, and note the two‑year fee credit mechanics (r 28(3)).
• Criminal history handling: set secure retention, access control and disposal policies for ACC criminal history checks retained for 7 years from last communication, consistent with r 24 and privacy obligations.

Records and evidentiary practices

• Keep originals or certified copies of all qualifications, IELTS results, PL activity records, statutory declarations (if requested) and employer contact details; maintain a chain of communications so that "last communication" dates for retention clocks are clear (r 24; r 27).
• Where statutory declarations are required by the Board for verification, advise applicants on timing and acceptable formats to avoid processing delays (r 27).

Practical stair‑step compliance for a new hire process

1. Before engagement, check the person’s registration status on the Board’s register (r 21A), and request documentary proof (registration number, category).
2. If the person lacks full/provisional registration, determine whether limited registration is required and whether the person meets r 12(2) eligibility pathways.
3. If hiring someone from outside Australia/NZ, budget for higher application fees per Schedule 1 and verify qualification equivalence.
4. Collect statutory declarations if the Board requests them for verification (r 27).
5. If a serious misconduct issue arises, prepare the r 26 notice promptly with all required details and notify relevant public authorities (r 26(2)).

This compliance map is derived directly from the Regulations. Parties should align internal HR, recruitment, and legal workflows to the exact wording of the relevant provisions (referenced above) and keep records of all communications with the Board to manage retention and evidentiary obligations.
