What it does
This Act creates a statutory imposition and sets the rate for a specific tax that is defined elsewhere in the income tax statute book. Section 3 states, in plain terms, that "Tax payable under paragraph 102UM(2)(a) of the Income Tax Assessment Act 1936 is imposed on the amount mentioned in that paragraph" (s 3). Section 4 fixes the rate of that tax at 47 per cent (s 4). Section 5 temporarily increases that rate by 2 percentage points for years defined as temporary budget repair levy years under the Income Tax (Transitional Provisions) Act 1997, meaning the applicable rate in such years is the 47 per cent base rate plus 2 percentage points (s 5(2)-(3)). The Act’s short title is set out in section 1 (s 1).
Mechanically, the Act does three things and only three things: it identifies an existing paragraph in the Income Tax Assessment Act 1936 (ITAA 1936) as the object of a statutory imposition (s 3), it prescribes the statutory rate for that imposition (s 4), and it provides for a temporary uplift to that rate in specified years (s 5). The Act does not re‑state paragraph 102UM(2)(a), does not alter that paragraph’s text, and does not itself define the triggering circumstances, the base on which the percentage is to be applied, the persons liable, the timing of assessments or payment, or any administrative or penalty rules; those aspects remain in the primary and ancillary taxation statutes referenced by the Act.
Commencement is addressed in section 2. Sections 1 and 2 and any matter not otherwise covered commence on the day of Royal Assent; the tabular commencement information supplied in the Act records 24 September 2007 as that date (s 2 and commencement table). Sections 3 and 4 commence "at the same time as Schedule 4 to the Tax Laws Amendment (2007 Measures No. 4) Act 2007 commences," for which the commencement table entry records 24 September 2007 (s 2 and commencement table). The table itself is accompanied by the statutory note that column 3 is not part of the Act (s 2(2)).
