Taxation (Staff Arrangements) Act 1969

Definitions and scope: The Act defines "Commonwealth employee" narrowly, as a person employed permanently or temporarily in the Commonwealth Service who is performing duties in the Commonwealth Taxation Office in a position located in Western Australia (s 2). The Act cross‑references the Commonwealth Employees’ Furlough Act, the Commonwealth Superannuation Act and the Public Sector Management Act 1994. For superannuation purposes the Act defines "Commonwealth contributor", "Commonwealth pension", and "Commonwealth pension contribution" within s 12(1). These defined terms control eligibility for the elective superannuation regimes in ss 12-13A.

Incorporation: The Act is not freestanding on personnel and employment matters; it is incorporated with the PSMA. Section 3 states that provisions of this Act relating to appointment or employment in the WA Public Service are to be read as one with the PSMA. That means appointment processes, conditions and definitions under the PSMA interact directly with how the Act operates. The Act frequently prescribes that the chief executive officer exercise powers "by force of this section" to appoint or engage staff (ss 5(1), 6(1)), while delegating many granular employment rules to the PSMA (s 6(2)).

Appointment and engagement mechanics: Section 4 creates the initiating administrative act, a written request by the chief executive officer asking a Commonwealth employee to elect to be appointed or engaged. The employee receives particular information about the proposed appointment or engagement with the request (s 4(2)). For non‑temporary employees who elect, s 5(1) authorises appointment under s 64 of the PSMA without examination and without probation (s 5(2)). For temporary employees, s 6(1) authorises engagement for temporary employment and the PSMA applies to that engagement (s 6(2)).

Remuneration standard and discretion: The Act sets a non‑deterioration floor on gross remuneration for transferred employees. Section 7(1) provides that gross remuneration shall be not less favourable than that to which, in the opinion of the chief executive officer, the person was entitled immediately before appointment or engagement. The Act defines "remuneration" for this purpose as salary or pay and includes, in the opinion of the chief executive officer, allowances that should be regarded as having formed part of the person's salary or pay immediately beforehand, together with increments that the person would have been entitled to if they had continued as a Commonwealth employee (s 7(2)-(3)). The operative test is therefore the chief executive officer's opinion, not an objective statutory formula.

Leave and service recognition: The Act preserves prior entitlements. Accrued recreation leave is preserved (s 8). Sick leave eligibility that existed immediately prior to the appointment is credited (s 9(1)), and the employee also receives sick leave prescribed by the PSMA on each anniversary date of prior eligibility (s 9(2)). Long service leave is complex. Section 10(1) credits a period of long service leave equal to the period of furlough for which the employee was eligible immediately prior to appointment, plus any pro rata furlough for which he was not yet eligible, and then allows an election within three months to continue accruing under the Commonwealth Employees’ Furlough Act or to accrue under the PSMA from the appointment date. Section 10(1) also explicitly excludes an entitlement to long service leave in respect of any furlough period for which the employee has received, or receives by reason of ceasing Commonwealth employment, payment or other benefit under the Commonwealth Employees’ Furlough Act.

Superannuation transfer elections: Sections 12-14 set an elective regime allowing prior Commonwealth contributors to become contributors to the State Fund or to the State Provident Account (s 13A), subject to precise timing and repayment rules. If a Commonwealth contributor elects, the Board must determine the Commonwealth pension equivalent and the number of State units required to match that pension at the same retiring age, and the employee may contribute for those units. The Act stipulates whether State contribution rates or continuing Commonwealth contribution rates apply, and requires the Consolidated Account to be charged where State contributions are less than Commonwealth contributions (s 12(7)-(8), (10)). Section 14(3) appropriates the Consolidated Account to meet amounts necessary for ss 12 and 13.

Non‑derogation and precedence: Section 14(4) states that ss 12, 13, 13A and 14 have effect notwithstanding anything to the contrary in the State Act. Section 14(1) disapplies s 35 of the State Act as it relates to a Commonwealth contributor who has elected under s 12. Section 14(2) prevents a Commonwealth employee from being regarded as a "former employee" for the purposes of s 32A of the State Act, irrespective of election under s 12 or 13.

Temporal and interpretive notes: The Act contains amendment annotations and a compilation table showing later legislative changes. The Act also refers to Commonwealth statutes that, per the embedded notes, have been repealed in later Commonwealth legislation and to a State Act that was repealed by the State Superannuation Act 2000, which adds interpretive complexity where the statutory text cross‑refers to repealed enactments.

Primary persons affected

• Commonwealth employees as defined in s 2, namely persons employed in the Commonwealth Service and performing duties in the Commonwealth Taxation Office in positions located in Western Australia. The Act is therefore targeted to a specific occupational cohort, rather than all Commonwealth employees or all State employees (s 2).
• The chief executive officer, the State official who initiates the statutory election procedure by requesting an employee to elect and who exercises the appointment and engagement powers under ss 4-6 and s 5(1) in particular. The Act repeatedly vests discretion with the chief executive officer (for example, to allow a longer election period than 28 days, s 4(1), and to determine remuneration entitlements, s 7(1)-(2)).
• The Western Australian Public Service as the employing entity where appointments or engagements occur. The Act incorporates its provisions with the PSMA (s 3), so employing agencies must apply PSMA processes to the extent the Act defers to them.

Superannuation parties and financial actors

• The Board referenced in ss 12-13A, the State superannuation administrative body charged with receiving elections, determining equivalence between Commonwealth pensions and State units, and handling payments and remittances required by the Act. The Board must determine the Commonwealth pension applicable to an electing contributor and the number of State units to produce an approximately equal pension (s 12(7)).
• The Consolidated Account, which under s 14(3) is appropriated to meet amounts necessary for ss 12 and 13. The Act requires the Board to remit certain amounts it receives under ss 12(4)-(6) to the Treasury to be credited to the Consolidated Account (s 12(6)(a)).
• State taxpayers indirectly, since the Consolidated Account bears the cost of amounts credited to the Fund and charged back by the Board when State contribution rates are lower than the Commonwealth contribution rates, and for pensions payable under s 13(2) paid by the Board and charged to the Consolidated Account (ss 12(8), 13(3), 14(3)).
• Commonwealth Superannuation Board and related Commonwealth superannuation authorities in practice, because ss 12-13A interact with the prior contributions, refunds and pension determinations that those Commonwealth bodies made; the Act creates administrative steps where a previous Commonwealth refund triggers repayment obligations to the State Board on election (ss 12(4)-(5), 13(1)(c), 13A(2)-(3)).

Other affected categories and administrative bodies

• Employees who are Commonwealth pensioners under s 13(1) have a particular entitlement structure on cessation of State employment (s 13(2)-(3)).
• Agencies that will have to administer leave credits, remuneration comparisons and increments, and long service leave elections, since the Act requires crediting of prior entitlements and offering elections for certain accrual methods (ss 7-10).
• The State Act (the State superannuation statute referenced in s 12(1) as the "State Act") and agencies administering it, because ss 12-14 are incorporated with and read as one with the State Act (s 12(2)) and override parts of it (s 14(4)).

Who decides and who pays

• Decision makers include the chief executive officer who requests elections, sets remuneration by opinion and appoints or engages employees (ss 4-7); and the State superannuation Board which determines pension equivalence and handles payments and remittances (ss 12, 13A).
• Financial responsibility flows to the Consolidated Account where the State must make good differences or pay pensions under the Board’s determinations (ss 12(8), 12(10)(b), 13(3), 14(3)). The Act requires the Board to remit certain payments to Treasury and the Consolidated Account to be credited for the purposes described (s 12(6)(a)).

Behavioural impact on affected parties

• Commonwealth employees who receive a request must decide within specified time windows whether to elect State appointment or engagement. The statutory periods are relatively short: the chief executive officer’s 28 day request period (s 4(1)), one month to elect into the Fund (s 12(3)), and three months for a long service leave election (s 10(1)(a)).
• State agencies must evaluate prior Commonwealth remuneration and entitlements, exercise judgement under s 7(1) about what allowances and increments to include, and process superannuation elections and associated financial transactions. The Act thus moves administrative workload and budget exposure onto State payroll and superannuation administrators.

Geographic and functional limitation

• The Act explicitly applies only to staff performing duties in the Commonwealth Taxation Office in Western Australia, an explicit geographic and functional limitation in s 2 that narrows its operation and concentrates effects on tax administration staff within the State.

Duties of the chief executive officer and State agencies

• Issue of request: The chief executive officer may request a Commonwealth employee to elect to be appointed or engaged in the Public Service of Western Australia, and must include particulars of the proposed appointment or employment in the request (s 4(1)-(2)). The request confers a procedural duty to provide information and to set a valid election window.
• Appointment and engagement power: On a valid election by a Commonwealth employee, the chief executive officer is empowered to appoint permanent Commonwealth employees under s 64 of the PSMA without examination and without probation (s 5(1)-(2)); and to engage temporary Commonwealth employees for temporary employment, with PSMA provisions applying (s 6(1)-(2)). These are duties to exercise statutory powers consistent with the PSMA and the Act.
• Remuneration assessment: The chief executive officer must set gross remuneration at a rate not less favourable than that to which the employee was entitled immediately before transfer, as determined in the chief executive officer’s opinion, subject to PSMA Parts 5 and 6 and to any law reducing remuneration generally (s 7(1)). The chief executive officer also decides what allowances should be regarded as part of prior salary and whether increments should be included (s 7(2)-(3)).
• Leave and service credits: State employers must credit eligible recreation leave and sick leave entitlements that accrued under Commonwealth service (ss 8; 9(1)), and must ensure sick leave under the PSMA is credited on each anniversary date for continued benefit (s 9(2)). For long service leave, State agencies must credit prior furlough periods and implement the employee’s election under s 10(1).

Duties of the Board and Treasury

• Superannuation determinations and receipts: On receiving a valid election under s 12(3), the Board must determine the Commonwealth pension applicable and the number of State units needed to yield an equivalent pension, and enable the contributor to apply for and contribute those units (s 12(7)). The Board must also cause amounts paid under ss 12(4)-(5) to be remitted to Treasury and credited to the Consolidated Account (s 12(6)(a)), and to repay contributions where elections become invalid under s 12(6)(b).
• Charging and crediting the Fund and Consolidated Account: The Act requires credits to the Fund and charges to the Consolidated Account in particular scenarios, for example where the State contribution required is less than the employee’s prior Commonwealth contribution (s 12(8)), and where pensions are paid under s 13(2) (s 13(3)).

Rights of employees

• Right to be requested and to receive particulars: Employees have the right to receive particulars of the proposed appointment or employment with the request (s 4(2)). This is an informational right enabling a considered election.
• Right to elect: Commonwealth employees have the right to elect to be appointed or engaged in the WA Public Service within the specified periods (s 4(1); s 6(1); s 12(3); s 13A(1)). The election regimes are carefully time‑bound.
• Preservation or conversion of entitlements: Employees retain rights to accrued recreation leave (s 8), sick leave credits (s 9(1)), and to be credited with certain long service leave equivalent to their Commonwealth furlough eligibility (s 10(1)). Certain pensioner employees have a right to receive a State pension equal to or approximately equal to the pension they would have received under the Commonwealth regime if they had remained and resigned at the same time (s 13(2)).
• Superannuation election entitlements: Where an employee validly elects under s 12, they have the right to contribute for State units determined by the Board that will produce a comparable pension at the same selected retiring age (s 12(7)). They also have rights to refunds and repayments as prescribed (s 12(6), (10)).

Time limits and conditionalities that restrict rights

• Short statutory windows limit choices: Employees must make certain elections within 28 days (s 4(1)) or within one month of appointment for superannuation transfer (s 12(3)) or within three months for long service leave election (s 10(1)(a)). These deadlines are mandatory and affected employees must act promptly.
• Repayment conditions can void elections: If an employee has received a prior Commonwealth refund and does not pay that refund amount to the Board at the time of election, the election is invalid (s 12(4)). If an employee receives the refund after electing and does not repay within seven days, the election is deemed of no effect (s 12(5)). Similar repayment rules apply to provident account transfers under s 13A(2)-(3) and to Commonwealth pensioners under s 13(1)(c).
• Discretionary valuations: The protection for pay is tied to the chief executive officer’s opinion (s 7(1)-(2)), which injects an element of administrative discretion into what an employee’s non‑deterioration right actually means.

Absence of penalty provisions

• The Act does not create express criminal offences or detailed statutory penalties for non‑compliance in its text. Operational enforcement therefore relies on administrative mechanisms built into the PSMA, the Board’s roles under ss 12-13A, and ordinary public law remedies where applicable. The Act does create financial obligations and triggers appropriation of funds (s 14(3)), giving it fiscal force rather than penal sanctions.

No express criminal sanctions or pecuniary penalties are set out in the Taxation (Staff Arrangements) Act 1969. The Act relies on administrative implementation and fiscal mechanisms to give effect to its obligations rather than imposing offences. The enforcement architecture in the text is therefore administrative rather than punitive, consisting of the following mechanisms and implications:

Administrative powers and compliance levers

• Appointment and engagement powers: The chief executive officer’s statutory authority to appoint under s 5(1) and to engage temporary employees under s 6(1) are themselves implementation mechanisms. The chief executive officer’s ability to set remuneration by reference to their opinion (s 7(1)) creates an administrative lever to manage pay outcomes. Compliance for agencies therefore involves following the processes laid down in ss 4-7 and ensuring lawful exercise of those powers.
• Board obligations and remittances: For superannuation elections, the Board has duties to determine pension equivalence, receive contributions or repayments and remit certain amounts to Treasury to be credited to the Consolidated Account (s 12(6)(a)). The statutory requirement to remit received amounts creates a financial chain of compliance overseen by the Board and Treasury.
• Appropriation and charge: Section 14(3) appropriates the Consolidated Account to the extent necessary for ss 12 and 13. Section 12(8) requires sums to be credited to the Fund and charged to the Consolidated Account where State contributions are less than the Commonwealth contribution. Section 13(3) requires amounts paid by the Board under s 13(2) to be credited to the Fund and charged to the Consolidated Account. These fiscal provisions create enforceable obligations on public finance actors to meet liabilities arising under the Act.

Administrative consequences and remedies

• Invalidity and cessation of elections: The Act provides a remedial mechanism for non‑compliance with repayment conditions: an election that is invalid at the time of election because the electing person had received a refund is not valid unless the refund amount is paid (s 12(4)); and where a refund is received after election and the required repayment to the Board is not made within seven days, the election ceases to be valid and is deemed to have been of no effect (s 12(5)). The Board must repay contributions in such cases (s 12(6)(b)). These provisions effectively reverse the election and restore or adjust financial positions where statutory prerequisites are not met.
• Administrative law oversight: While the Act contains no criminal offences, appointments, engagements and determinations by the chief executive officer and the Board will be subject to public law principles such as legality, procedural fairness and reasonableness where those principles apply, and may be challengeable by judicial review if a decision is made unlawfully. The Act itself does not provide a special statutory appeal or penalty regime.

Absence of specific enforcement provisions

• No inspection, auditing or explicit penalty clauses: The Act does not prescribe specific audit powers, pecuniary penalties for misstatement, or criminal offences for failing to perform appointment, remittance or crediting duties. Enforcement therefore depends on normal public sector administrative controls, internal audit, and the PSMA’s enforcement mechanisms where the PSMA applies to matters of employment (s 3; s 6(2)).
• Fiscal enforcement via appropriation: The most direct enforcement mechanism is monetary. The Consolidated Account appropriation (s 14(3)) ensures that designated amounts must be paid by Treasury and funds can be credited or charged as the Act requires. Failure to provide the necessary funds would create a fiscal and administrative problem, but the Act does not specify intermediate sanctions for failing to make payments other than the statutory obligation itself.

Operational risks and compliance burdens

• The lack of express penalties increases reliance on careful administrative process. Agencies must maintain accurate records of prior Commonwealth entitlements, refunds and payments, and must administer time limits for elections and repayments precisely to avoid unintended invalidation of elections. The Board must perform equivalence calculations and remittance procedures properly to keep fund accounts aligned with the Act’s charging and crediting requirements.

In short, enforcement in the Act is administrative and financial rather than penal. Rights and obligations are enforced by appointment powers, Board determinations, refunds and remittance duties, and appropriation provisions, with public law remedies and PSMA obligations forming the legal background for resolving disputes about exercise of powers.

Direct incorporations and reading‑together

• Public Sector Management Act 1994 (PSMA): Section 3 explicitly incorporates the provisions of this Act that relate to appointment or employment in the WA Public Service and requires they be read as one with the PSMA. Section 5(1) expressly empowers appointment under s 64 of the PSMA. Section 6(2) makes the provisions of the PSMA applicable to temporary engagements effected under the Act. The PSMA therefore supplies definitions, procedural detail and employment rules which the Act either displaces in specific respects or defers to, creating a close operational dependency.
• State superannuation legislation (the State Act): Section 12(2) incorporates the provisions of ss 12-14 with and to be read as one with the State Act. Section 14(4) goes further and gives ss 12-14 effect notwithstanding anything to the contrary in the State Act. The Act therefore creates a special regime that overrides or modifies specific State superannuation rules for electing Commonwealth employees.

Interplay with Commonwealth legislation and legacy Acts

• Commonwealth Superannuation Act and Commonwealth Employees’ Furlough Act: The Act treats certain periods and benefits arising under Commonwealth Acts as convertible or creditable into State entitlements. Sections 10 and 12 explicitly reference the Commonwealth Employees’ Furlough Act and the Commonwealth Superannuation Act respectively. The operational interaction requires the State Board and agencies to assess prior Commonwealth entitlements and to deal with refunds, contributions and furlough calculations that were determined under Commonwealth law.
• Repeals and subsequent changes to referenced statutes: The Act’s Explanatory notes point out that some of the Commonwealth Acts referenced in the text have since been repealed (for example, the Commonwealth Employees’ Furlough Act was repealed by the Long Service Leave (Commonwealth Employees) Act 1976, and the Commonwealth Public Service Act was repealed in 1999). The State Act referenced in s 12(1) was also repealed by the State Superannuation Act 2000, per the notes. These later repeals mean that while the Act still reads and operates with the designated text as it was, administrators must map historical entitlement concepts from repealed Commonwealth Acts and the now‑repealed State Act to current statutory frameworks and administrative arrangements. The Act itself does not rewrite those later repeals; it retains its cross‑references and was amended at times to reflect statutory changes (see compilation table). The presence of repealed cross‑references is a practical interoperability risk and a point for administrative clarification.

Precedence and overriding effect

• Section 14(4) provides that ss 12, 13, 13A and 14 have effect notwithstanding anything to the contrary in the State Act. In practice that gives the Act a statutory precedence over conflicting State superannuation provisions, at least to the extent of the matters governed by ss 12-14. Section 14(1) and (2) further disapply particular State Act provisions, establishing a tailored statutory carve‑out for affected Commonwealth contributors.

Fiscal interactions

• Consolidated Account and Fund charging/crediting: The Act requires boards and administrators to remit amounts to the Consolidated Account and for the Consolidated Account to be appropriated and charged to meet State liabilities arising from the special superannuation arrangements (ss 12(6)(a), 12(8), 12(10)(b), 13(3), 14(3)). That poses direct interaction with public finance law and treasury procedures.

Operational interface points

• PSMA procedural requirements: Because appointment and engagement are read together with the PSMA, the procedural standards, probation and recruitment rules under the PSMA will be relevant unless the Act expressly displaces them (s 3; s 5(2) displaces examination and probation only).
• Board’s role as liaison: The Board acts as the conduit between Commonwealth refund processes, State Fund contribution processes, and Treasury remittances. Administrators must align actuarial equivalence calculations and contribution rates between Commonwealth and State regimes in accordance with s 12(7)-(8) and the Board’s determinations.
• Transitional and uncommenced provisions: The compilation table shows later Acts and an uncommenced provision in the State Superannuation (Transitional and Consequential Provisions) Act 2000 s 75, which may affect transitional arrangements for superannuation. Administrators must check the status of those transitional provisions and any proclamations affecting commencement.

Practical effect

• The Act creates a cross‑jurisdictional operational interface, requiring State agencies, the Board and Treasury to reconcile Commonwealth historical entitlements with State employment and superannuation regimes. That reconciliation operates under the Act’s express precedence where conflicts arise, but practical implementation depends on administratively mapping obsolete or repealed Commonwealth provisions to present frameworks, which may require policy and legal work beyond routine payroll tasks.

Primary legislative milestones recorded in the Act’s compilation table and annotations show multiple amendments and related enactments affecting the Taxation (Staff Arrangements) Act 1969. Key entries and annotated changes in the text are as follows:

• Taxation (Staff Arrangements) Act 1969 No. 108 of 1969, assented 25 November 1969, commenced 25 November 1969. The original Act established the statutory framework in the form examined above.
• Taxation (Staff Arrangements) Act Amendment Act 1970 No. 20 of 1970, assented 8 May 1970, commenced 8 May 1970. Section 12 was amended by this 1970 Act, and s 13A was inserted at that time (s 13A inserted: No. 20 of 1970 s. 3).
• Financial Administration Legislation Amendment Act 1993 No. 6 of 1993 s. 11, assented 27 August 1993, commenced 1 July 1993. This amendment is reflected in annotations to ss 12 and 13 (s 12 amended: No. 6 of 1993 s. 11; s 13 amended: No. 6 of 1993 s. 11).
• Acts Amendment (Public Sector Management) Act 1994 No. 32 of 1994 s. 17, assented 29 June 1994, commenced 1 October 1994. This amending Act updated multiple provisions to incorporate the PSMA 1994 and changed references consistent with the PSMA. The text of ss 2-6, 7, 9, 10 and 13 carry "Section X amended: No. 32 of 1994 s. 17(...)" annotations indicating points where the 1994 Act altered wording and cross‑references to the PSMA.
• Industrial Legislation Amendment Act 1995 No. 1 of 1995 s. 35; the compilation table notes s 11 of the Act was deleted by this 1995 amendment (11 deleted: No. 1 of 1995 s. 35), with commencement 1 January 1996 per the Gazette.
• Financial Legislation Amendment Act 1996 No. 49 of 1996 s. 64, assented 25 October 1996, commenced 25 October 1996. Annotations indicate s 12 and s 13 were amended by the 1996 Act (s 12 amended: No. 49 of 1996 s. 64; s 13 amended: No. 49 of 1996 s. 64).
• Financial Legislation Amendment and Repeal Act 2006 No. 77 of 2006 s. 4, assented 21 December 2006, commenced 1 February 2007. The compilation table lists this entry; annotations to ss 12 and 13 show s 12 and s 13 were amended by No. 77 of 2006 s. 4.
• Statutes (Repeals and Miscellaneous Amendments) Act 2009 No. 8 of 2009 s. 124, assented 22 May 2009, commenced 22 May 2009. The compilation table records this amendment as well and s 5 notes it: "Section 5 amended: ... No. 8 of 2009 s. 124".

Other notes included in the statutory compilation explain that several of the Commonwealth and State enactments referenced in the Act have been repealed by later legislation. Specifically:

• The Commonwealth Employees’ Furlough Act has been repealed by the Long Service Leave (Commonwealth Employees) Act 1976 (note 2).
• The Commonwealth Public Service Act provisions mentioned were repealed by the Public Employment (Consequential and Transitional) Amendment Act 1999 (note 3).
• The State Act originally referenced, the Superannuation and Family Benefits Act 1938, was repealed by the State Superannuation Act 2000 (note 4). The compilation table and uncommenced provisions table note transitional provisions in the State Superannuation (Transitional and Consequential Provisions) Act 2000 that remain to be proclaimed.

Effect of amendments on the text

• The 1994 amendments that incorporate and cross‑reference the PSMA are significant, because they substitute prior recruitment, appointment and probation processes with the PSMA framework, while retaining certain express displacements such as appointment without examination and probation under s 5(2).
• The insertion of s 13A (No. 20 of 1970 s. 3) added a specific elective pathway for Commonwealth Provident Account contributors to join the State Provident Account regime, with repayment and deeming rules mirroring those in s 12.
• Deletion of section 11 in 1995 shows the Act has been pruned on occasion, though the compilation table indicates no replacement provision of similar substantive scope.

Uncommenced provisions and transitional matters

• The compilation table records an uncommenced provision: State Superannuation (Transitional and Consequential Provisions) Act 2000 s. 75, which remains to be proclaimed. Administrators should be aware of any eventual proclamation that may affect transitional superannuation arrangements connected to this Act.

Practical takeaways from amendment history

• The Act has been updated over time to integrate with changed State public sector management and financial administration frameworks. The amendment history indicates that personnel and superannuation interfaces have been adjusted, but that the core architecture of a statutory election and conversion regime for Commonwealth Taxation Office staff in WA has been retained.
• The textual references to now‑repealed Commonwealth and State Acts create practical interpretive work for agencies implementing the Act, which must reconcile the Act’s provisions with successor Commonwealth and State superannuation and long service leave legislation.

The statutory text and the accompanying compilation and notes provided here contain no recorded cases, judgments, or litigation history. The document does not cite any judicial decisions interpreting the Taxation (Staff Arrangements) Act 1969, nor does it list appeals, reviews or administrative tribunal determinations arising under the Act. The Act text itself includes only statutory provisions, amendments and compilation notes.

Consequently, within the provided source there is no litigation history to summarise or to draw interpretive guidance from. Where questions of statutory construction, administrative discretion (for example under s 7(1) where the chief executive officer’s opinion determines remuneration entitlements), or the interaction with repealed Commonwealth and State Acts arise, one would normally look to case law for guidance. Because the source does not supply case law, practitioners should expect to rely on administrative law principles, the PSMA, State superannuation law and Treasury and Board administrative practice when advising on potential disputes.

Practical implication for advisers and tribunals

• The absence of reported litigation in the source means there is limited judicial guidance embedded in the Act’s compilation materials. Advisers should therefore treat the statutory text as the primary guide and be prepared to identify potential issues where judicial interpretation could be sought, for example in relation to the scope of the chief executive officer's discretion under s 7, the meaning and effect of elections and conditional repayments under s 12 and s 13A, and the operation of s 14's "notwithstanding" clause against the State Act.
• Where stakeholders need precedent, they will need to search external legal databases and administrative tribunal records for any decisions on exercise of the chief executive officer’s powers, Board determinations under ss 12-13A, and disputes over preservation or conversion of leave and superannuation entitlement. The provided Act text does not assist on that point.

Short and strict time windows

• The various elections and repayment obligations in the Act have short statutory windows that can invalidate an employee’s election if not strictly complied with. A Commonwealth employee asked to elect has 28 days to do so under s 4(1); an electing Commonwealth contributor has one month from appointment to elect to join the Fund under s 12(3); long service leave elections must be made within three months per s 10(1)(a); and where a pre‑election refund is received, the employee must pay that refund to the Board at the time of election (s 12(4)) or else the election is invalid. If a refund arrives after election, the employee has only seven days to repay the refund to the Board or the election will be deemed of no effect (s 12(5)). Missing these windows can have substantial consequences for entitlements and financial position.

"Opinion" standard for remuneration

• Section 7(1) protects transferred employees against being paid less than they were previously entitled to, but crucially the protection is framed by the chief executive officer's opinion as to what the employee was entitled to immediately prior to transfer (s 7(1)-(2)). The subjective element can create uncertainty for employees and potential disputes where allowances, increments or other components of remuneration are contested. The Act does not prescribe an objective calculation method, and PSMA constraints and general laws reducing remuneration generally can still apply.

Interaction with repealed enactments

• The Act repeatedly references Commonwealth and State laws that the compilation notes indicate were later repealed or replaced. For example, the Commonwealth Employees’ Furlough Act is noted as repealed; the State Act referenced in s 12(1) was repealed by the State Superannuation Act 2000. Administrators and advisers should not assume that the textual cross‑references are to live statutes in their original form. Practical implementation will require mapping of historical entitlements and terms to the current statutory and administrative frameworks. This is a source of legal and administrative friction.

Long service leave catch: payments bar

• Section 10(1) states that nothing in the subsection entitles a transferred Commonwealth employee to be credited with long service leave in respect of any period of furlough for which the employee has received, or receives by reason of ceasing Commonwealth employment, any payment or other benefit under the Commonwealth Employees’ Furlough Act. In plain terms, if the employee has already been paid out at Commonwealth exit for a furlough period, the State will not credit that period as long service leave. This is a common‑sense anti‑double‑dipping provision, but it requires careful record‑keeping and reconciliation of any Commonwealth payments at cessation.

Appropriation does not specify limits

• Section 14(3) appropriates the Consolidated Account to the extent necessary for ss 12 and 13, and s 12(8) requires the Fund to be credited and the Consolidated Account charged where uncapped differences exist between State and Commonwealth contribution rates. Although this creates payment authority, it also creates a budget exposure for the State with no explicit statutory cap or prospective funding schedule. Agencies must therefore factor unknown budgetary consequences into financial planning.

Superannuation equivalence and actuarial work

• Section 12(7) places on the Board the duty to determine the Commonwealth pension applicable and the number of State units required to produce a full pension at the same age. Doing this requires actuarial equivalence work and clear policy on rounding and "approximately equal but not less than" language in s 12(7)(b). The Act allows the Board to set contribution rates as the State Act would for someone of the same age, or to allow contributions equal to the amount the person was paying under the Commonwealth Act where that is less, with the Consolidated Account making up the shortfall (s 12(8)). This multi‑factor determination can be administratively burdensome and politically sensitive.

Elective but not mandatory

• The chief executive officer "may request" an employee to elect under s 4(1), not must. The absence of a mandatory transfer power means the initiatives are voluntary for the employee, but the initial request and the particulars of the appointment frame choice. Employees may feel pressured to accept State appointment for continuity of employment or other operational reasons, and the Act’s tight time frames may limit considered decisions.

Lack of penalties but reliance on administrative reversal

• There is no express penalty scheme for non‑compliance; instead the Act uses invalidity, cessation of elections and Board repayments as the corrective mechanism (s 12(5)-(6)). That means an employee's election can be reversed administratively, potentially generating unsettled expectations and financial adjustments. The absence of a clear appeal path within the Act itself means disputes may end up in judicial review or administrative complaint processes under the PSMA or relevant public law channels.

Narrow subject matter scope

• The definition of Commonwealth employee in s 2 limits the Act to employees performing duties in the Commonwealth Taxation Office in positions located in Western Australia. This narrow subject scope limits the utility of the Act to other Commonwealth staff who might, on face value, seek similar arrangements. Practitioners should not attempt to apply the Act beyond its textual scope without legislative amendment.

For employing agencies (chief executive officers and HR/payroll teams)

• Prepare compliant written requests: Ensure any request under s 4(1) is in writing, specifies the particulars of the proposed appointment or engagement as required by s 4(2), and specifies the 28 day response window or an extended period if the chief executive officer allows. Maintain a contemporaneous record of the request and the particulars provided.
• Exercise appointment powers with PSMA compliance: Where an employee elects, effect appointments and temporary engagements using the statutory powers at ss 5(1) and 6(1). Use s 5(2) to appoint without examination and probation where applicable, and apply PSMA procedures to the extent the Act incorporates the PSMA (s 3; s 6(2)). Ensure HR files document the basis for waiver of examination and probation as permitted.
• Document remuneration comparisons: Under s 7(1) the chief executive officer determines what the employee was entitled to immediately before transfer. Prepare a written remuneration determination that records the chief executive officer’s opinion, identifies which allowances and increments are regarded as part of prior remuneration, and explains any variance from Commonwealth pay. Keep contemporaneous evidence of prior Commonwealth pay and allowances, and note any PSMA or State‑wide remuneration constraints reflected in the officer’s assessment.
• Credit leave correctly: Preserve recreation leave under s 8 and credit sick leave entitlement and PSMA prescribed sick leave on each anniversary date under s 9(1)-(2). For long service leave, compute the period of furlough for which the employee was eligible immediately prior to transfer and any pro rata furlough not yet eligible, and present the employee with the election described in s 10(1), including the three month timing option to elect continued accrual under the Commonwealth Employees’ Furlough Act or under the PSMA.
• Maintain records of Commonwealth payments: Verify whether the employee received any payment or benefit under the Commonwealth Employees’ Furlough Act or any refunds under Commonwealth superannuation. If so, check the repayment and invalidation consequences in ss 10(1), 12(4)-(5) and 13A(2)-(3).

For employees (Commonwealth employees receiving a request)

• Act within the statutory windows: Respond to a request under s 4 within 28 days or the extended period allowed. If you are a Commonwealth contributor and are considering election into the Fund, make your election in the Board’s approved form within one month of being appointed or engaged under this Act (s 12(3)). If considering the long service leave accrual choice, note the three month window in s 10(1)(a).
• Verify prior entitlements and refunds: Assemble documentary evidence of prior Commonwealth salary, allowances, sick leave and furlough eligibility. If you received any refund of contributions under the Commonwealth Superannuation Act, be aware that your election will be invalid unless you repay that refund to the Board at the time of election (s 12(4)), and that refunds received after you elect must be repaid within seven days to avoid revocation of your election (s 12(5)). Similar repayment rules apply for distributions under s 85 of the Commonwealth Superannuation Act where s 13A applies (s 13A(2)-(3)).
• Seek actuarial and financial advice for superannuation elections: Section 12 requires the Board to determine equivalence between Commonwealth pensions and State units. Employees should obtain advice or an actuarial estimate where possible to understand what State units will be required and whether contributions will be matched or supplemented by the Consolidated Account under s 12(8). Calculate the impact on future pension entitlements and taxation.

For the Board and Treasury

• Develop template determination processes: Establish clear internal procedures and templates to record the Board’s determinations under s 12(7) for the Commonwealth pension and the number of State units needed to match the pension. Include methodology for "approximately equal but not less than" equivalence and for handling rounding and age differences.
• Implement remittance procedures: When receiving amounts paid under ss 12(4)-(5) or s 13(1)(c), ensure prompt remittance to Treasury to be credited to the Consolidated Account as required by s 12(6)(a). Conversely, ensure the Fund is credited and the Consolidated Account charged where the State contribution required is less than the Commonwealth contribution as per s 12(8).
• Record keeping and interagency liaison: Maintain records of all elections, repayments, equivalence determinations and remittances. Liaise with Commonwealth superannuation administrators where legacy contribution or refund information is necessary to validate elections and repayments.

Operational controls and risk mitigation

• Cross‑check historical entitlements: Because the Act references statutory regimes that may have been repealed and replaced, agencies and the Board should map historical rules to present frameworks before making determinations. This mapping should be documented and include legal advice where necessary to bridge repealed Commonwealth or State laws.
• Training for staff: Provide training to payroll, HR and legal teams on the Act’s time limits, the chief executive officer’s remuneration opinion standard and the treatment of refunds. Special attention should be paid to the seven day repayment rule for refunds received after election under s 12(5), because that rule can invalidate elections.
• Budget forecasting: Given that s 14(3) appropriates the Consolidated Account and s 12(8) creates contingent charging obligations where State contribution rates are lower than Commonwealth contribution rates, Treasury and agency finance teams should forecast potential liabilities and incorporate contingency allowances.
• Communications and forms: Develop standardised forms approved by the Board for elections (s 12(3), s 13A(1)), and ensure these forms clearly explain repayment consequences and timeframes. When issuing requests under s 4, include precise particulars and advice on the employee’s rights and statutory deadlines.

When to get legal or actuarial advice

• Where the chief executive officer’s opinion on prior remuneration is likely to be contested, seek legal advice on the evidence base and any exposures.
• Where pension equivalence determinations are complex, engage actuaries to produce equivalence calculations for the Board, and consider tax advice for employees contemplating transfers.
• If the historical legal basis for an entitlement rests on a repealed Commonwealth or State statute, obtain legal advice to reconcile historical entitlements with current law and administrative practice.

By operationalising these steps and controls, agencies, the Board and employees can comply with the Act’s procedural deadlines, preserve lawful entitlements, and manage the financial and administrative consequences of transfers from Commonwealth to State employment.
