What it does
This instrument, the Taxation Administration (Remedial Power - Small Business Restructure Roll‑over) Determination 2017, uses the remedial power in section 370‑5 of Schedule 1 to the Taxation Administration Act 1953 to modify how a specific part of the income tax law operates for certain transferred depreciating assets. Concretely, Schedule 1 item 1 modifies the operation of section 40‑340 of the Income Tax Assessment Act 1997 and "any other provision of a taxation law the operation of which is affected by the operation of that section" where the subject asset is one of the assets described in item 8 of the table in subsection 40‑340(1) of the ITAA 1997.
Mechanically, the determination directs that where section 40‑340 provides roll‑over relief in relation to a disposal of a depreciating asset because the condition in item 8 of the table in subsection 40‑340(1) is satisfied, section 40‑340 should operate "as if it also provided that the disposal of the asset has no direct consequences under the income tax law (other than Division 40 of that Act)" (Schedule 1(2)). In short, transfers covered by item 8 that qualify for the small business restructure roll‑over are to be treated as having no direct tax consequences across the income tax law except for matters falling within Division 40.
The modification applies only for transfers occurring on or after the day after this determination commences (Schedule 1(3)). The commencement clause in the instrument states that the whole determination commences on "the first day this determination is no longer liable to be disallowed, or to be taken to have been disallowed, under section 42 of the Legislation Act 2003" (Commencement table). The instrument is expressly made under s 370‑5 of Schedule 1 to the Taxation Administration Act 1953 (see clause 3).
Two explicit limits are spelled out. First, the modified operation is confined to depreciating assets that are the subject of item 8 of the table in s 40‑340(1) as modified (Schedule 1(1)). Second, the determination does not affect the income tax law in relation to anything that happens to the asset that does not directly relate to the transfer, nor does it affect ownership of the asset at any time (Schedule 1(4)(a)-(b)). The instrument contains no additional penalty or enforcement provisions.
