What it does
The Taxation Administration (Remedial Power,Foreign Resident Capital Gains Withholding) Determination 2017 modifies the timing of a tax credit that arises when an amount is paid to the Commissioner under Subdivision 14‑D of Schedule 1 to the Taxation Administration Act 1953 (the TAA). Subdivision 14‑D is the foreign resident capital gains withholding regime. That regime requires a purchaser of certain Australian property interests from a foreign resident to withhold 12.5% of the proceeds and pay that amount to the Commissioner. The foreign resident vendor is then entitled to a credit for the amount withheld against their Australian income tax liability, under sections 18‑15, 18‑20 and 18‑25 of Schedule 1 to the TAA.
Before this determination, the statutory language could have been read to require the credit to arise in the income year in which the withholding amount was paid to the Commissioner. That timing could produce a mismatch if the transaction that gave rise to the withholding was recognised for income tax purposes in a different year. For example, a vendor might enter into a contract in one income year but receive the proceeds and have the withholding remitted in the next year. The credit would then fall into the later year even though the capital gain itself was assessable in the earlier year. That timing mismatch could increase compliance costs and lead to deferral of the benefit of the credit.
The determination remedies this mismatch by modifying the operation of sections 18‑15, 18‑20 and 18‑25, and any other provision of a taxation law affected by those sections. The modification provides that, to the extent an entity’s entitlement to a credit under one of those sections is in respect of an amount paid to the Commissioner under Subdivision 14‑D, the entitlement is treated as arising in the income year in which the transaction causing that application of Subdivision 14‑D is recognised for income tax purposes for the entity. So if the transaction is recognised in Year 1, the credit is treated as arising in Year 1, regardless of when the withholding amount was actually paid to the Commissioner. The modification applies to transactions entered into on or after 1 July 2016. It is a remedial determination made under section 370‑5 of Schedule 1 to the TAA, which empowers the Commissioner to modify the operation of a taxation law to correct an unintended or anomalous outcome that is not the result of a policy choice.
