What it does
The Taxation Administration Regulations 2021 are subordinate legislation made under the Taxation Administration Act 1997 (Tas). Their primary mechanical effect is to set an administrative fee of 25 fee units for approved agents who lodge certain instruments for assessment under the Duties Act 2001. This fee is prescribed under section 118A of the Act. The instruments that attract the fee are those listed in Schedule 1: essentially transactions that involve non-market dealings, associated persons, business assets, multiple instruments, possible concessions or exemptions, partitions, severances, vesting orders, strata plan amendments, and other circumstances where the Commissioner would need to manually assess the return rather than process it through the standard electronic system. The regulations also empower the Commissioner to impose conditions on approved agents regarding how they endorse and submit returns or pay tax for specified instruments. Additionally, the regulations prescribe categories of persons to whom the Commissioner may disclose tax information under section 77(1)(e)(x) of the Act. That list includes Commonwealth tax officers, State valuation and grant administrators, workplace compensation officers, fire service investigators, the Director of Consumer Affairs and Fair Trading, and certain Commonwealth regulatory bodies. The regulations rescind the Taxation Administration Amendment Regulations 2012, which previously amended the earlier principal regulations. This rescission means that any changes introduced by that 2012 instrument are removed, though the regulations themselves are styled as a new principal instrument covering the same ground. The administrative fee of 25 fee units replaces any earlier fee arrangements for these lodgments. The fee applies per relevant lodging, meaning each instrument in Schedule 1 lodged by an approved agent attracts the fee separately, even if the lodgments relate to the same broader transaction. The regulations took effect on 15 December 2021 and are administered by the Department of Treasury and Finance.
