What it does
The Taxation Administration Order 2003 is a statutory instrument that performs a single, specific administrative mapping function for the purposes of section 79A of the Taxation Administration Act 1997. Mechanically the Order does three things:
- It gives the instrument a short title: "Taxation Administration Order 2003" (s 1).
- It fixes commencement: the Order takes effect on the day its making is notified in the Gazette (s 2). The instrument notes it was notified in the Gazette on 22 January 2003.
- It declares, for the purposes of s 79A of the Taxation Administration Act 1997, (a) a list of holders of particular offices as "corresponding Commissioners" (s 3(a) and Schedule 1) and (b) a list of State and Territory statutory enactments as "corresponding laws" (s 3(b) and Schedule 2).
The Order contains no operative provisions beyond that declaration: it does not itself set out powers, duties, penalties, or procedures. Its legal effect is confined to the function expressly defined in s 3 , i.e. the declaration of corresponding Commissioners and corresponding laws for the stated purpose. The Order also records who administers the instrument: the Department of Treasury and Finance (display note at end). Schedules 1 and 2 are the operative content listing the office-holders and laws that the Order declares to be corresponding Commissioners and corresponding laws respectively. The Schedules record amendments by S.R. 2005 No. 74, applied 29 June 2005, in bracketed editorial notes adjacent to the Schedules.
Because the Order specifies correspondences only "for the purposes of [section 79A of the] Taxation Administration Act 1997" (s 3), its concrete legal role is to supply the names of offices and statutes that another provision , s 79A , will treat as corresponding in order to achieve whatever cross-jurisdictional or reciprocal effect s 79A creates. The Order does not itself restate s 79A or explain how the correspondences will operate in practice; it must be read as a schedule-making instrument that feeds into the mechanics of s 79A.
