What it does
This instrument, titled the Taxation Administration (Country by Country Reporting Jurisdictions) Determination 2024, formally specifies a list of foreign jurisdictions for the purposes of subsection 3DA(4) of the Taxation Administration Act 1953 (the Act) (see s 1 and s 3). Section 5 sets out the jurisdictions that are to be treated as "jurisdictions for the purposes of subparagraph 3DA(1)(d)(ii) of the Act", and links each specified jurisdiction to the reporting periods to which the specification applies (s 5).
Mechanically, the determination performs two discrete functions:
-
It identifies which named jurisdictions are to be treated under the Act for the specific subparagraph cited (s 5). The list is presented in two groupings under the table headings "Jurisdictions that have a comprehensive international tax agreement with Australia" (items 5 and 10: Singapore and Switzerland) and "Other jurisdictions" (items 20-210, a list of 39 named jurisdictions). Every item in the table is annotated with the same reporting-period trigger: "All periods starting on or after 1 July 2024" (s 5 table entries).
-
It fixes the timing of the instrument. The whole instrument is to commence on the later of two events: (a) the day after the instrument is registered; and (b) the day Schedule 4 to the Treasury Laws Amendment (Responsible Buy Now Pay Later and Other Measures) Act 2024 commences. The instrument also expressly provides that, if the Schedule 4 event does not occur, the provisions do not commence at all (s 2(1)). The instrument further records that any information in column 3 of the table (the commencement table) is not part of the instrument and may be edited in published versions (s 2(2)).
The instrument does not itself set out the substantive reporting obligations, penalties, or procedures. Its legal effect is to declare that the listed jurisdictions are to be treated as specified jurisdictions for the purpose identified in s 5, thereby modifying how the Act applies where that subparagraph is engaged. The instrument states that the term the Act, when used in the instrument, means the Taxation Administration Act 1953 (s 4). The determination is dated 12 December 2024 and signed by the Assistant Minister for Competition, Charities and Treasury (header and s 1).
