What it does
The Taxation Administration (Community Charity Trusts and Corporations) Declaration 2025 is a legislative instrument made under the Taxation Administration Act 1953. It does one mechanical thing: it specifies a closed list of trusts and corporations as “community charity trusts” and “community charity corporations” for the purposes of two provisions in Schedule 1 to the Act. Section 6 specifies 21 trusts under subsection 426‑117(3) for the purposes of paragraph 426‑117(1)(a). Section 7 specifies 18 corporations under subsection 426‑180(3) for the purposes of paragraph 426‑180(1)(b). The instrument itself does not create duties, impose penalties, or confer direct benefits; it is purely declaratory. Its legal effect flows entirely from the operation of the parent provisions in Schedule 1. Those provisions are not reproduced in the instrument, so a reader must cross‑refer to the Taxation Administration Act 1953 and, through the chain in section 3AA, to the Income Tax Assessment Act 1997. The declaration therefore functions as an administrative list that activates whatever tax treatment the enabling sections attach to entities with that status. The instrument is short - only seven substantive sections plus a preliminary part - and contains no transitional provisions, savings, or sunset clauses. It takes effect from registration on the Federal Register of Legislation (the instrument does not state a commencement date, but as a legislative instrument under the Legislation Act 2003 it commences on the day after registration unless otherwise provided). The absence of an explicit start date means the default rule in section 12 of the Legislation Act 2003 applies. Practitioners should verify the registration date to determine the exact operative day.
